This study focuses on influence that older adults, living in nursing homes, have over everyday activities. Everyday activities are key to sustain a sense of stability, predictability, and enjoyment in the local world of people's everyday and therefore a critical dimension of the person‐centeredness framework applied within gerontology. This narrative ethnographic study aimed to shed light on how influence can be situated contextually, and how it can emerge through activities as well as how it is negotiated in everyday by frail (...) older adults living in a nursing home. Residents, staff members, and significant others from one nursing home in an urban area of Sweden participated in this study. Data were gathered through fieldwork, including participant observation and formal and informal conversations during a period of 6 months. Data were analyzed through a narrative interpretative approach. The findings are presented in narrative form as exemplars. The exemplars—Craquelures as justification, Seeking a place for other life worlds and An almost perfect trip—reveal a gap between the client‐centeredness framework and lived experiences regarding older adults’ influence in everyday activities. The role of everyday activities in the context of frailty is discussed in terms of ethical and responsive engagement, and implications for health‐care practices are considered. (shrink)

Recent contributions in moral philosophy have raised questions concerning the prevalent assumption that moral judgments are typologically discrete, and thereby distinct from ordinary and/or other types of judgments. This paper adds to this discourse, surveying how attempts at defining what makes moral judgments distinct have serious shortcomings, and it is argued that any typological definition is likely to fail due to certain questionable assumptions about the nature of judgment itself. Machine learning algorithms are increasingly used to support decision-making in the exercise of public authority. Here, we argue that an important consideration has been overlooked in previous discussions: whether the use of ML undermines the democratic legitimacy of public institutions. From the perspective of democratic legitimacy, it is not enough that ML contributes to efficiency and accuracy in the exercise of public authority, which has so far been the focus in the scholarly literature engaging with these developments. According to one (...) influential theory, exercises of administrative and judicial authority are democratically legitimate if and only if administrative and judicial decisions serve the ends of the democratic law maker, are based on reasons that align with these ends and are accessible to the public. These requirements are not satisfied by decisions determined through ML since such decisions are determined by statistical operations that are opaque in several respects. However, not all ML-based decision support systems pose the same risk, and we argue that a considered judgment on the democratic legitimacy of ML in exercises of public authority need take the complexity of the issue into account. This paper outlines considerations that help guide the assessment of whether a ML undermines democratic legitimacy when used to support public decisions. We argue that two main considerations are pertinent to such normative assessment. The first is the extent to which ML is practiced as intended and the extent to which it replaces decisions that were previously accessible and based on reasons. The second is that uses of ML in exercises of public authority should be embedded in an institutional infrastructure that secures reason giving and accessibility. (shrink)

The extension of quantum mechanics to a general functional space (“rigged Hilbert space”), which incorporates time-symmetry breaking, is applied to construct extract dynamical models of entropy production and entropy flow. They are illustrated by using a simple conservative Hamiltonian system for multilevel atoms coupled to a time-dependent external force. The external force destroys the monotonicity of the ℋ-function evolution. In the 1920s and 1930s, an attempt was made to resurrect the aurochs (Bos primigenius primigenius), the extinct wild ancestor of contemporary domestic cattle. The back-bred species that was produced are called ‘Heck cattle’. I argue that the attempt to create the Heck cattle as a form of resurrected aurochs, and their subsequent use in rewilding projects (as in the Oostvaardersplassen in the Netherlands) is a prime example of the continuous human project of the domination of nature. The consideration of (...) domination as an extreme form of management serves as a critical lens on the policy of rewilding, similar to long-standing critiques of the policy of ecological restoration by this author. Rewilding projects do not re-create a ‘wild’ nature free from human intervention and activity. Rewilding is another form of the human management of natural processes to achieve anthropocentric goals. My examination of the Heck cattle in the rewilding process is intentionally provocative because there is a connection to Nazism. I will argue that policies of rewilding have historical antecedents (and parallels in philosophical meaning) to the Nazi plans for re-creating an authentic Aryan landscape in the lands of Eastern Europe. The case history of the Heck cattle projects illustrates the danger of pursuing radical forms of management of the natural world. (shrink)

For every legal concept X, there are clear instances exemplifying an X and clear instances exemplifying a non-X. The cases that come before courts are those that seem to lie in between, being neither clearly an X nor clearly a non-X. It is tempting to think that, being in-between, they should receive an in-between treatment, that is, to the extent that they are an X they should be treated as an X. If they are sixty percent toward being an X, (...) they should get sixty percent of the treatment due an X. But this presupposes that in-between cases can be rank-ordered at least roughly according to the degree of their X-ness. This Article explains why that generally cannot be done and why courts therefore go for an either/or approach: something gets treated either as an X or as a non-X. The explanation is rooted in the kind of phenomena explored in the theory of social choice and multi-criterial decision-making. (shrink)

Should artificial intelligences ever be included as co-authors of democratic decisions? According to the conventional view in democratic theory, the answer depends on the relationship between the political unit and the entity that is either affected or subjected to its decisions. The relational conditions for inclusion as stipulated by the all-affected and all-subjected principles determine the spatial extension of democratic inclusion. Thus, AI qualifies for democratic inclusion if and only if AI is either affected or subjected to decisions by the (...) political unit in relevant ways. This paper argues that the conventional view is too simple; that it neglects democratic reasons to recognize only agents and/or moral patients as participants in decision-making. The claim defended is that AAP and ASP implicitly affirm requirements for agency and patiency. In ASP, the entity included must be an agent understood either in terms of legal status, capacity to comply with the law or ability to recognize legitimate authority. In AAP, the entity included must be a patient, understood either in terms of capacity for sentience or consciousness. Thus, the idea here is to explore the potential democratic inclusion of artificial intelligences by an updated account of the relevant conditions of agency and patiency that are implicit in democratic theory. Although conceivable that AI is or will be either affected or subjected in relevant ways to decisions made by political units, it is far less clear that AI will ever be agents or patients in the sense required for democratic inclusion. A recent online article in the Journal of Medical Ethics, which received wide media coverage, raised the possibility that children are being ‘subjected to torture’ due to the ‘fervent or fundamentalist views’ of their parents. However, the quality of argument in that article was inadequate to sustain such a radical thesis. There was no engagement with the perspectives of different religious traditions about end-of-life care. Instead the authors invoked practices such as male infant circumcision which are wholly irrelevant to the (...) end-of-life theme. There were serious failings in relation to core principles of social and epidemiological research practice: the study based its conclusion on a sample of only six cases and failed to consider even the more obvious confounding features. Rather than demonizing the religious beliefs of parents there should be recognition of the need for mutual respect, dialogue based on an ‘expert–expert relationship’ and collaboration based on ‘shared understanding’. ¿Cómo entender la contradicción de una filosofía que, a la vez que se autoproclama heredera legítima de la fenomenología, pretende liberarse de sus límites y abrir paso a la manifestación incondicionada? ¿Debemos sin más leer la obra de Jean-Luc Marion como una verdadera renovación de la fenomenología, tal como él y sus seguidores pretenden o, por el contrario, debemos leerla como pura teología independizada del movimiento fenomenológico? ¿Por qué sería la vía teológica la única salida posible de la crisis de (...) la metafísica contemporánea denunciada por Marion y, más aún, una vía necesaria? Para responder a estas y otras preguntas, el presente trabajo desarrolla algunas de las paradojas que surgen del giro teológico marioniano, distinguiendo dos maneras posibles de entender su _Kehre_: o bien como una _desviación_ que permite extender la fenomenología a nuevos campos, o bien como un regreso o vuelta atrás y abandono del proyecto fenomenológico. Por último, nos preguntamos si la ontología donadora gradual, propuesta por Marion, no permite pensar en una posible tercera vía, según la cual el pensamiento de Marion no sería ya una _fenomenología_, sino una _fansiología teológico gradualista_. Music exists not to be parsed, categorized, or otherwise processed, but because it provides enjoyment. Thus methodologies that concentrate on the cognitive aspects of music alone omit what is essential about this aesthetic form. This paper provides an alternative approach by proposing a measure of musical preference. Specifically, it is argued that a musical passage will be preferred to the extent that it induces synchrony in those brain structures that are responsible for processing the passage. It is first shown that (...) this conception is consistent with time-honored principle of unity in diversity. It is then argued that the synchrony measure follows from more recent results regarding a possible solution to the binding problem. The bulk of the paper, however, is concerned with verifying the measure via simulation. It is shown, in particular, that the measure applied to a network of interacting integrate and fire neurons responsible for the processing of musical stimuli produces results consistent with human musical preference. This was carried out in three areas in the context of Western classical and popular musical forms. First, the model was applied to the laws of voice leading and other principles developed in the period of common harmonic practice. Next, it was shown that the three most salient aspects of melody, the preponderance of stepwise transitions, the theme and variation nature of phrase development, and increased positive affect with exposure all follow directly from the model. Finally, it was demonstrated how a steady rhythm can increase neural synchrony and presumably positive affect. Additional simulations run on Turkish art songs show that the synchrony measure may have some applicability to non-Western musical forms. The paper concludes by arguing that the synchrony measure may, in certain cases, apply to non-musical aesthetic stimuli. (shrink)

Most patterns of an organism develop reproducibly and predictably. Thus, most biological patterns are largely predetermined by the nature of the zygote and by the nature of the surrounding world. Some ontogenetic patterns can also be considered to be preformed. Eighteenth and nineteenth century definitions of 'preformation' suggested that all aspects of a precursor pattern--its elements and its configuration--are preserved during development. Today, the idea of preformed configurations has been lost. To revive this lost idea, we offer the following biologically (...) contemporary definition for preformed ontogenetic patterns: preformed patterns are those patterns with topologies that have been conserved during their ontogenies. This definition is presented in precise mathematical language, and its application is demonstrated in a system of developing, abstract patterns. (shrink)
