The interpretability of AI is just as important as its performance. In the LegalAI field, there have been efforts to enhance the interpretability of models, but a trade-off between interpretability and prediction accuracy remains inevitable. In this paper, we introduce a novel framework called LK-IB for compulsory measure prediction (CMP), one of the critical tasks in LegalAI. LK-IB leverages Legal Knowledge and combines an Interpretable model and a Black-box model to balance interpretability and prediction performance. Specifically, LK-IB involves three steps: (...) (1) inputting cases into the first module, where first-order logic (FOL) rules are used to make predictions and output them directly if possible; (2) sending cases to the second module if FOL rules are not applicable, where a case distributor categorizes them as either “simple” or “complex“; and (3) sending simple cases to an interpretable model with strong interpretability and complex cases to a black-box model with outstanding performance. Experimental results demonstrate that the LK-IB framework provides more interpretable and accurate predictions than other state-of-the-art models. Given that the majority of cases in LegalAI are simple, the idea of model combination has significant potential for practical applications. (shrink)

Emotional creativity refers to a set of cognitive abilities and personality traits related to the originality of emotional experience and expression. Previous studies have found that emotional creativity can positively predict posttraumatic growth and mental health. The outbreak of coronavirus disease 2019 (COVID-19) has posed great challenges to people’s daily lives and their mental health status. Therefore, this study aims to address the following two questions: whether emotional creativity can improve posttraumatic growth and mental health during the COVID-19 pandemic and (...) how it works. To do this, a multiple mediation model has been proposed, which supposes that emotional creativity is associated with posttraumatic growth and mental health through perceived social support and regulatory emotional self-efficacy. The study involved 423 participants from multiple regions with different COVID-19 involvement levels. Participants were asked to complete a questionnaire with six parts, which included Emotional Creativity Inventory (ECI), Regulatory Emotional Self-Efficacy Scale (RES), Stress-Related Growth Scale-Short Form (SRGS-SF), Multidimensional Scale of Perceived Social Support scale (MSPSS), Brief Symptom Inventory-18 scale (BSI-18), and COVID-19-related life events questionnaire. Path analysis used to examine the mediation model indicated that under the control of COVID-19-related life events and age, perceived social support mediated a positive association between emotional creativity and posttraumatic growth as well as a negative association between emotional creativity and all mental health problems, including somatization, depression, and anxiety. Regulatory emotional self-efficacy mediates the association between emotional creativity and posttraumatic growth, emotional creativity and anxiety, and emotional creativity and depression. The results suggest that emotional creativity plays an important role in coping with stressful events related to COVID-19. Furthermore, these results might provide a better understanding of the possible paths through which emotional creativity is related to psychological outcomes, such as mental health and posttraumatic growth. With the outbreak of the COVID-19 crisis, the public keeps getting epidemic-related information on the media. News reports on the increasing number of fatalities have exposed individuals to death, which causes negative emotional experiences such as tension, anxiety, and fear. This study aimed to investigate whether creativity could serve as an anxiety-buffer when mortality is salient. Based on previous findings, the present study utilized type of creative task and personal search for meaning as moderators. In Study 1, a 2 × (...) 2 between-subject design was utilized, and 168 subjects were randomly assigned to four experimental conditions. In Study 2, 221 subjects were recruited. The experimental procedure was similar to Study 1, except that the priming paradigm of mortality was changed and search for meaning was included as an additional moderating variable. State anxiety was measured as the dependent variable in both studies. Results of Study 1 showed that, while the benevolent creative task could buffer anxiety in the mortality salience condition, the malevolent creative task did not have the same effect. Furthermore, there was a significant interaction between mortality salience, type of creative task, and search for meaning in life on anxiety. In Study 2, the buffering function of benevolent creativity was more intense for participants with a higher level of search for meaning. Together, these findings reveal the influence of different types of creative tasks on individual anxiety levels under death priming conditions and the moderating effect of search for meaning in this relationship. Further, they suggest the need to focus on the role of creativity in terror management. (shrink)

The output feedback controller is designed for a class of stochastic nonlinear systems that satisfy uncertain function growth conditions for the first time. The multivariate function growth condition has greatly relaxed the restrictions on the drift and diffusion terms in the original stochastic nonlinear system. Here, we cleverly handle the problem of uncertain functions in the scaling process through the function maxima theory so that the Ito differential system can achieve output stabilization through Lyapunov function design and the solution of (...) stochastic nonlinear system objects satisfies the existence of uniqueness, ensuring that the system is globally asymptotically stable in the sense of probability. Furthermore, it is concluded that the system is inversely optimally stable in the sense of probability. Finally, we apply the theoretical results to the practical subsea intelligent electroexecution robot control system and obtain good results. (shrink)

This paper reports the results of a survey of 842 undergraduate business students in four nations - the United States of America, the Peoples' Republic of China, Japan, and the Republic of Korea. This survey asked students to respond to four scenarios with potentially unethical business behavior and a string of questions related to the importance of ethics in business strategy and in personal behaviors. Based on arguments related to differences in recent historical experiences, the authors suggest that student responses (...) may be as different within the East Asian environment as they are between this environment as a whole and the USA. Survey results indicate a greater perception of ethical problems and more importance placed on ethics per se in business practices, as well as less of an emphasis on social harmony on the part of USA students. At the same time, substantial national differences in response are also witnessed within the set of East Asian students. A priori expectations as to the manner in which these East Asian responses should vary based on differences in recent historical experiences are partially, but not fully, supported. The authors argue that the key value of the reported research rests on a demonstration that national differences within a common cultural area can be as great as differences across cultural areas and that practitioners of global business must fine-tune their expectations as to acceptable business and personal actions to accommodate specific national historical experiences to be effective. We examine whether investors value the disclosure of first-time standalone corporate social responsibility reports, and whether market valuations differ between government-controlled and privately controlled firms. Using a matched sample of Chinese publicly listed firms, we find that CSR initiators have higher market valuations than matched CSR non-initiators, and CSR initiators controlled by the central and local governments have lower market valuations than CSR non-initiators and CSR initiators controlled by private shareholders. Additional analyses demonstrate that CSR initiators with high CSR reporting (...) quality and perceived credibility have higher market valuations than CSR initiators with low CSR reporting quality and medium or low perceived credibility of CSR reporting. We do not find convincing evidence that CSR mandate, litigation risk, and prior stock returns affect market reactions to CSR reporting. Overall, we find that the market values standalone CSR reports, and that CSR reporting quality and perceived credibility are important factors in market valuation. (shrink)

Compared to constraint-based causal discovery, causal discovery based on functional causal models is able to identify the whole causal model under appropriate assumptions [Shimizu et al. 2006; Hoyer et al. 2009; Zhang and Hyvärinen 2009b]. Functional causal models represent the effect as a function of the direct causes together with an independent noise term. Examples include the linear non-Gaussian acyclic model, nonlinear additive noise model, and post-nonlinear model. Currently, there are two ways to estimate the parameters in the models: dependence (...) minimization and maximum likelihood. In this article, we show that for any acyclic functional causal model, minimizing the mutual information between the hypothetical cause and the noise term is equivalent to maximizing the data likelihood with a flexible model for the distribution of the noise term. We then focus on estimation of the PNL causal model and propose to estimate it with the warped Gaussian process with the noise modeled by the mixture of Gaussians. As a Bayesian nonparametric approach, it outperforms the previous one based on mutual information minimization with nonlinear functions represented by multilayer perceptrons; we also show that unlike the ordinary regression, estimation results of the PNL causal model are sensitive to the assumption on the noise distribution. Experimental results on both synthetic and real data support our theoretical claims. (shrink)

Long before Wittgenstein drew attention to its complexities, the concept of play had captured the interest of theorists for millennia. How do games contribute to our knowledge of the world? Wherein lies their universal appeal? Play is usually associated with a certain blitheness and buoyancy - could it nevertheless be argued that playfulness is not quite as innocent as it might seem? Bence Kun draws on Adorno's writings to explore the relation between philosophical play (understood here as imaginative thought as (...) well as experimental expression) and an experience of dread Adorno links to children's first encounter with death. By investigating his less familiar works, some of which have not yet been translated, Kun challenges the received view on Adorno's approach to metaphysics, the role of systematic inquiry and the modern condition. As he has Adorno say, the originary impression of shock at the heart of philosophical reflection can only be fully apprehended through an open-ended and defiantly creative intellectual practice. To better understand what information is and to explain information-related issues has become an essential philosophical task. General concepts from science, ethics and sociology are insufficient. As noted by Floridi, a new philosophy, a Philosophy of Information (PI), is needed. In the 80’s, Wu Kun proposed a “The Basic Theory of the Philosophy of Information”, which became available in English only in 2010. Wu and Joseph Brenner then found that the latter’s non-standard “Logic in Reality” provided critical logical support for (...) Wu’s theory. In Part I of our paper, we outline the two basic theories as a metaphilosophy and metalogic for information. We offer our two theories as a further contribution to an informational paradigm. In longitudinal cohort studies involving large populations over extended periods, informed consent entails numerous urgent challenges. This paper explores challenges regarding informed consent in long‐term, large‐scale longitudinal cohort studies based on the longitudinal and dynamic nature of such research. It analyzes and evaluates widely recognized broad consent and dynamic consent methods, highlighting limitations concerning their ability to adapt to evolving research objectives and participant perspectives. This paper discusses trust‐based informed consent and emphasizes the needs to establish and maintain trust with (...) research participants and to balance information disclosure with respect for participants' autonomy. Informed consent in long‐term studies is an evolving process that must adapt to changing research environments. Based on participant trust, researchers should observe and assess potential research risks. Finally, the paper recommends enhancing institutional credibility, implementing reconsent procedures, and ensuring robust ethical oversight to safeguard participants' rights despite the complexity of modern biomedical research. This study examines how the social climate of comparison in which a founder grew up impacts family business (FB) philanthropy, emphasizing the founder's role in FB decisions. With a dataset of 758 Chinese FBs, we find that the stronger the social climate of comparison in the founder's region of upbringing, the more charitable donations the FB tends to make. This effect is more pronounced in areas with a high concentration of FBs. The unspoken rules of Chinese society, related to ‘face (...) We explored the care experiences and needs of the home caregivers of patients with amyotrophic lateral sclerosis (ALS) to improve their quality of life. We interviewed home caregivers in-depth and analyzed the data using Colaizzi's descriptive phenomenological method. We interviewed 11 home caregivers of patients with ALS with a disease duration between 1.5 and 4 years. Primary caregivers were predominantly female and were the patients' spouses. Daily caregiving time averaged 4–14 h for 0.5–3.5 years. Interview themes included helplessness and adaptation (...) to life changes, hopelessness, compassion for the patient’s prognosis, and expectation for diverse support. The study sample size was limited, as all participants were from a single tertiary hospital, and all patients had severe functional impairment. Caregivers of patients with ALS experience a considerable burden. Patients and their caregivers can benefit from diversified support channels, and assistive communication systems can be applied to home care. Future research will focus on in-home public long-term care services in China. (shrink)

It is commonplace to encounter nonstationary or heterogeneous data, of which the underlying generating process changes over time or across data sets. Such a distribution shift feature presents both challenges and opportunities for causal discovery. In this paper we develop a principled framework for causal discovery from such data, called Constraint-based causal Discovery from Nonstationary/heterogeneous Data, which addresses two important questions. First, we propose an enhanced constraint-based procedure to detect variables whose local mechanisms change and recover the skeleton of the (...) causal structure over observed variables. Second, we present a way to determine causal orientations by making use of independence changes in the data distribution implied by the underlying causal model, benefiting from information carried by changing distributions. Experimental results on various synthetic and real-world data sets are presented to demonstrate the efficacy of our methods. (shrink)

The present study explored the correlation between music preference and mental health of college students to make an empirical contribution to research in this field. The self-reported music preference scale and positive mental health scale of college students were adopted to conduct a questionnaire survey in college students. Common method variance was conducted to test any serious common method bias problem. No serious common method bias problem was observed. The results showed that college students’ preference for pop music, Western classical (...) music, and Chinese traditional music has a significant and positive correlation with their mental health. Furthermore, college students’ preference for heavy music has a significant and inverse correlation with their mental health. This research presents a correlational study; therefore, no causality can be inferred. (shrink)

The whistleblower system assumes that an element necessary for proper functioning about an organization is to see irregularities occurring in it. For this reason, whistleblowing and follow-up internal investigations occupy a central place in the organization’s compliance management system and an important role in the organization’s culture. These two areas constantly complement each other. However, compliance systems seem to be a broader concept, where the organization’s culture is part of it. The culture of an organization represents the habits, traditions, and (...) customs of organizations, which are not always written down. It is often referred to as the “company atmosphere.” Compliance is a system of procedures and rules, most often written down, which define procedures for dealing with specific situations, rights and obligations of employees, co-workers, or contractors. The regulations that emerge from the compliance system derive from laws, industry regulations, ethical norms, including the culture of a particular organization. Well-developed and implemented whistleblowing procedures that become part of the organization’s culture for good influence the existence of a highly developed compliance system that guarantees the multifaceted success of the organization. Despite recent major advances in the neuroscience underlying cognition, the processes of its emergence and evolution are far from being understood. In our view, current interrelated concepts of mind; knowledge; epistemology; perception; cognition and information fail to reflect the real dynamics of mental processes, their ontology and their logic. It has become routine to talk about information in relation to these processes, but there is no consensus about its most relevant qualitative and functional properties. We present a theory of human (...) cognition based on an ontology and epistemology of information and information processes originally proposed by Wu including an ontological doctrine of the different grades of information; and an informational epistemology based on a noegenesis of the doctrine of informational intermediaries that mediate between the cognitive subject and object. This theory is supported by the new, non-propositional logic proposed recently by Brenner. We demonstrate the utility of our approach for the reconceptualization of the virtual properties of reality and cognition. It is strongly anti-representationalist and can provide the basis for the integration of inputs from outside the brain into cognitive structures. For us, the philosophy of information is a metaphilosophy, implying major changes in both the content and methodology of standard philosophical disciplines. We suggest that this philosophy of information and our informational approach may help guide research in a number of current areas of cognitive science. (shrink)

Prior studies have found that emojis can contribute to rebuilding customers’ trust when after-sale staff apologize to them, but studies on the different types of emojis and their different levels of effectiveness in rebuilding trust are still needed. In this paper, we explore the different types and frequencies of emojis and their effectiveness in rebuilding trust based on commercial discourses. Our data are collected from conversations between after-sale staff and customers during Ali Trademanager after-sale service. We find three types of (...) emojis frequently used when after-sale staff apologizing to customers: face-related emojis, gesture-related emojis, and object-related emojis. Moreover, face-related emojis are the most frequently used, as their nature is to express emotion and attitude. The most effective emojis are the whimper emoji and kiss emoji, which are used by after-sale staff for sajiao (literally, ‘playing cute’). On the other hand, we show that the least effective emojis are the sorry emoji and happy emoji, which are deemed insincere because they violate the quality maxim and quantity maxim in the Cooperative Principle. This paper thus contributes to understanding the nature and function of emojis in commercial communication. (shrink)

A central theme in western philosophy was to find formal methods that can reliably discover empirical relationships and their explanations from data assembled from experience. As a philosophical project, that ambition was abandoned in the 20th century and generally dismissed as impossible. It was replaced in philosophy by neo-Kantian efforts at reconstruction and justification, and in professional statistics by the more limited ambition to estimate a small number of parameters in pre-specified hypotheses. The influx of “big data” from climate science, (...) neuropsychology, biology, astronomy and elsewhere implicitly called for a revival of the grander philosophical ambition. Search algorithms are meeting that call, but they pose a problem: how are their accuracies to be assessed in domains where experimentation is limited or impossible? Increasingly, the answer is through simulation of data from models of the kind of process in the domain. In some cases, these innovations require rethinking how the accuracy and informativeness of inference methods can be assessed. Focusing on causal inference, we give an example from neuroscience, but to show that the model/simulation strategy is not confined to causal inference, we also consider two classification problems from astrophysics: identifying exoplanets and identifying dark matter concentrations.
