We evaluate here the performance of four models of cross-situational word learning: two global models, which extract and retain multiple referential alternatives from each word occurrence; and two local models, which extract just a single referent from each occurrence. One of these local models, dubbed Pursuit, uses an associative learning mechanism to estimate word-referent probability but pursues and tests the best referent-meaning at any given time. Pursuit is found to perform as well as global models under many conditions extracted from (...) naturalistic corpora of parent-child interactions, even though the model maintains far less information than global models. Moreover, Pursuit is found to best capture human experimental findings from several relevant cross-situational word-learning experiments, including those of Yu and Smith (), the paradigm example of a finding believed to support fully global cross-situational models. Implications and limitations of these results are discussed, most notably that the model characterizes only the earliest stages of word learning, when reliance on the co-occurring referent world is at its greatest. Ten years after the Human Genome Project’s completion the life sciences stand in a moment of uncertainty, transition, and contestation. The postgenomic era has seen rapid shifts in research methodology, funding, scientific labor, and disciplinary structures. Postgenomics is transforming our understanding of disease and health, our environment, and the categories of race, class, and gender. At the same time, the gene retains its centrality and power in biological and popular discourse. THE TITLE OF THIS PAPER calls for clarification. Not only are there several senses in which something may be said to "be," there are also many nuances to the terms "categorial" and "intuition." Taking Aristotle as a guide, let us focus upon the primary sense of "being," that is, substance considered both as first substance and second substance. We may then take "categorial" as referring to what Aristotle calls the "figures of predication," the ways in which predicates characterize subjects, indicating (...) "what" the subject is, its quality, quantity, relation, its "where," its "when," and so forth. The term "intuition" expresses something too primitive to be defined, but Edmund Husserl's metaphorical contrast between the "emptiness" of thought and speech and the "fullness" of intuition successfully highlights its essential characteristic. A couple of examples should suffice to grasp the import of Husserl's distinction. Consider the difference, for instance, between first entertaining vague plans of visiting a foreign city and then experiencing the fulfillment of actually strolling through its streets, or the difference between first reading a manual of instructions for performing some task and then actually executing the task skillfully. Taking Husserl as a guide, let us therefore characterize intuition broadly as the presentation of something in its fullness, as opposed to thinking or talking about it in an empty way. Finally, combining Husserlian and Aristotelian terminologies, we may describe categorial intuition as the presentation of figures of predication. Rather than presenting some particular thing, say a red chair, categorial intuition presents the chair's being red, the red quality's belonging to the chair. Patient consent has been formulated in terms of radical individualism rather than shared benefits. Medical education relies on the provision of patient consent to provide medical students with the training and experience to become competent doctors. Pelvic examination represents an extreme case in which patients may legitimately seek to avoid contact with inexperienced medical students particularly where these are male. However, using this extreme case, this paper will examine practices of framing and obtaining consent as perceived by medical students. This (...) paper reports findings of an exploratory qualitative study of medical students and junior doctors. Participants described a number of barriers to obtaining informed consent. These related to misunderstandings concerning student roles and experiences and insufficient information on the nature of the examination. Participants reported perceptions of the negative framing of decisions on consent by nursing staff where the student was male. Potentially coercive practices of framing of the decision by senior doctors were also reported. Participants outlined strategies they adopted to circumvent patients’ reasons for refusal. Practices of framing the information used by students, nurses and senior doctors to enable patients to decide about consent are discussed in the context of good ethical practice. In the absence of a clear ethical model, coercion appears likely. We argue for an expanded model of autonomy in which the potential tension between respecting patients’ autonomy and ensuring the societal benefit of well-trained doctors is recognised. Practical recommendations are made concerning information provision and clear delineations of student and patient roles and expectations. (shrink)

This article proposes a retheorisation of Rawlsian civil disobedience through examining the burdens we expect people to bear when they practice civil disobedience, focussing specifically on marginalised groups. First, I consider public concerns over civil disobedience, to elicit the idea of an ‘authentic civil disobedience’. I then assess the claim that civil disobedience occurs within a ‘nearly just’ society in order to recognise the more complex position of marginalised civil disobedients. This allows me to frame any criteria we theorise for (...) civil disobedience as a wicked problem. Next, I examine one particular criterion dominant within the literature: that to be interpreted as civil disobedience, disobedients must show a willingness to suffer the legal consequences – and so, must not act anonymously. I claim that this asks too much of civil disobedients in a marginalised context and conclude civil disobedience theory needs retheorising to consider when and why anonymity is acceptable. (shrink)

Partant du constat qu’il existe à la fois une très grande similitude entre les philosophies de la perception d’Aristote et de Merleau-Ponty, et une revendication de ce dernier de s’affranchir du cadre ontologique hérité, cet article cherche à définir où se situe exactement la différence entre les deux conceptions. Il écarte d’abord l’hypothèse d’une assimilation ontologique totale entre sentant et sensible dans l’indistinction de la chair, dans la mesure où ce tissu n’est pas un uniforme mais peut toujours présenter la (...) dualité adhérente de l’envers et de l’endroit. Ensuite se pose la question de savoir si la Visibilité en général, comme puissance indéterminée, était impensable pour Aristote en raison de sa théorie de la substance – et il est montré que celle-ci, bien comprise, admet la pure puissance, tout en favorisant la détermination. Dès lors, la différence entre les deux auteurs se manifeste plutôt dans la conception de l’être, qui pour Merleau-Ponty demeure en retrait, tandis que pour Aristote il est toujours a priori déterminable, quoique selon des modalités irréductiblement multiples.Starting from the observation that there is at once a great similarity between the perception philosophy of Aristotle and Merleau-Ponty, and a claiming from the latter to emancipate oneself from the inherited ontological frame, this article tries to define where exactly stands the difference between the two conceptions. It first dismisses the hypothesis of a complete ontological assimilation between perceptive and perceptible in the indistinction of the « flesh », as far as this « web » is not a uniform but can always produce the adhering duality of inside and outside. Then comes the question whether the general Visibility, as indeterminable potency, was unthinkable by Aristotle because of his substance theory – and it is showed that this theory, if well understood, admits the pure potency even favouring the determination. Finally, the difference between the two thinkers appears rather in the conception of Being, that, according to Merleau-Ponty, stands in the background, while, according to Aristotle, it is always a priori determinable although in irreducibly multiple modes. Humility holds a modest but important place among the judicial virtues. But in spite of its growing popularity, it does not yet have a place on the ‘central judicial virtues’ lists. This paper provides an argument that judicial humility, especially institutional judicial humility, should be considered a necessary judicial virtue at least in common-law jurisdictions. This is because it is a necessary ingredient in precedent-based decisions that are fully justified from the point of view of the law and of political (...) morality. Further, while it is sufficient that individual judges make decisions that a humble judge would have made, the judicial community must in fact be humble in order to produce fully justified common-law decisions – humility is therefore necessary as a community-virtue. Bertrand Russell's work on the foundations of mathematics apparently played a decisive role in persuading Wittgenstein to abandon his aeronautical engineering studies in favor of philosophy. Wittgenstein's influence on Russell turned out to be profound as well: two years after they first met, Wittgenstein had delivered an objection to Russell's theory of judgment that was so devastating that it led to the abandonment of a major philosophical project of Russell's, leaving him reportedly “paralysed”. Two fundamental elements are pivotal to the (...) logicism of Russell's Principles of Mathematics: his conception of a proposition, and his commitment to the doctrine of the unrestricted variable. In addition to the ontological problems facing his theory of propositions, Russell also became convinced that his ontology of propositions contained fundamental logical problems, as he encountered recurring contradictions in his attempts to formalize a propositional logic that would comport with his philosophical theory. This article questions whether it is legitimate to propagate national sentiment and foster ties of nationality through school curricula. Against certain arguments for the ethical significance of nationality I question whether those who share a national identity have special moral obligations to members of their national group that they do not have to other persons. I argue that such ties of sentiment are unnecessary for achieving principled liberal goals, and that education within a liberal democracy should focus directly upon certain (...) general moral principles, such as fairness, justice, and toleration. The recent Advisory Group on Citizenship's Education for Citizenship and the Teaching of Democracy in Schools (1998) similarly endorses, I argue, education focused upon general moral principles. With this significant work from 1932, The Self-Conscious Determination of Nothingness, we have the third important book of Nishida’s period of philosophical maturity. Here, Nishida has moved beyond the unconvincing essays of the previous periods, such as the ingenuous psychologism of A Study of Good or the epistemological theorization of the hesitant neo-Kantian period. Nishida is now developing the consequences of his major philosophical notion, the “logic of place”. Feminist argumentation theorists have criticized the Dominant Adversarial Model in argumentation, according to which arguers should take proponent and opponent roles and argue against one another. The model is deficient because it creates disadvantages for feminine gendered persons in a way that causes significant epistemic and practical harms. In this paper, I argue that the problem that these critics have pointed out can be generalized: whenever an arguer is given a role in the argument the associated tasks and norms of (...) which she cannot fulfill, she is liable to suffer morally significant harms. One way to react to this problem is by requiring arguers to set up argument structures and allocate roles so that the argument will be reasons-reflective in as balanced a way as possible. However, I argue that this would create to heavy a burden. Arguers would then habitually have to take on roles that require them to divert time and energy away from the goals that they started arguing for and instead serve the goal of ideal reasons-reflectiveness. At least prima facie arguers should be able to legitimately devote their time and energy towards their own goals. This creates a problem: On the one hand, structures that create morally significant harms for some arguers should be avoided—on the other hand, arguers should be able to take argument-roles that allow them to devote themselves to their own argumentative goals. Fulfilling the second requirement for some arguers will often create the morally significant harms for their interlocutors. There are two possible solutions for this problem: first, arguers might be required to reach free, consensual agreements on the structure they will adopt for their argument and the way they will distribute argumentative roles. I reject this option as both fundamentally unfeasible and practically unrealistic, based on arguments developed by theorists like Krabbe and Jacobs. I argue that instead, we should take a liberal view on argument ethics. Arguers should abide by moral side constraints to their role taking. They should feel free to take roles that will allow them to concentrate on their argumentative goals, but only if this does not create a situation in which their interlocutors are pushed into a role that that they cannot effectively play. When evaluating the arguer instead of the argument, we soon find ourselves confronted with a puzzling situation: what seems to be a virtue in one argumentative situation could very well be called a vice in another. This paper will present the idea that there are in fact two sets of virtues an arguer has to master—and with them four sometimes very different roles.
