The classical Athenian 'state' had almost no formal coercive apparatus to ensure order or compliance with law: there was no professional police force or public prosecutor, and nearly every step in the legal process depended on private initiative. And yet Athens was a remarkably peaceful and well-ordered society by both ancient and contemporary standards. Why? Law and Order in Ancient Athens draws on contemporary legal scholarship to explore how order was maintained in Athens. Lanni argues that law and formal legal (...) institutions played a greater role in maintaining order than is generally acknowledged. The legal system did encourage compliance with law, but not through the familiar deterrence mechanism of imposing sanctions for violating statutes. Lanni shows how formal institutions facilitated the operation of informal social control in a society that was too large and diverse to be characterized as a 'face-to-face community' or 'close-knit group'. In his tractA Rationale of Judicial Evidence, Jeremy Bentham repeatedly refers to the courtroom as the ‘theatre of justice’. Bentham's description has been borne out by recent scholarship on Athenian law. As a form of civic space, the Athenian lawcourts were similar to the Theatre of Dionysos in many respects: litigants faced each other in a competitiveagon, delivering lines written for them by logographers to a mass audience which would range, ordinarily, from 200 to 1500 jurors. It goes on to discuss the utilitarian theories of Jeremy Bentham and John Stuart Mill in detail, commenting on the latter's view of the Christianity of his day and his optimal socialist society. The book argues that the key theory of utility is fundamentally concerned with happiness, stating that happiness has largely been left (...) out of discussions of utility. This article argues that attention to the expressive function of law suggests that the Athenian laws prohibiting former prostitutes from active political participation may have had a much broader practical impact than previously thought. By changing the social meaning of homosexual pederasty, these laws influenced norms regarding purely private conduct and reached beyond the limited number of politically active citizens likely to be prosecuted under the law. Some appear to have become more careful about courting in public while others adopted (...) a conception of chaste pederasty that would not run afoul of the law. Design, composition, and the play of light and shadow are central elements in these photographs, but the images are much more than formal experiments; they confront disability in a way that affirms life. The paper outlines a view of normativity that combines elements of relativism and expressivism, and applies it to normative concepts in epistemology. The result is a kind of epistemological anti-realism, which denies that epistemic norms can be (in any straightforward sense) correct or incorrect; it does allow some to be better than others, but takes this to be goal-relative and is skeptical of the existence of best norms. It discusses the circularity that arises from the fact that we need to (...) use epistemic norms to gather the facts with which to evaluate epistemic norms; relatedly, it discusses how epistemic norms can rationally evolve. There are quite a few theses about logic that are in one way or another pluralist: they hold (i) that there is no uniquely correct logic, and (ii) that because of this, some or all debates about logic are illusory, or need to be somehow reconceived as not straightforwardly factual. Pluralist theses differ markedly over the reasons offered for there being no uniquely correct logic. Some such theses are more interesting than others, because they more radically affect how we are (...) initially inclined to understand debates about logic. A series of discussions that invites philosophers from or based in Australasia to share their student and academic experiences. The segment looks into what inspires people to study philosophy, how they pursue their philosophical interests, and gives our audiences a better idea of philosophy as an undergraduate.

It is “the received wisdom” that any intuitively natural and consistent resolution of a class of semantic paradoxes immediately leads to other paradoxes just as bad as the first. This is often called the “revenge problem”. Some proponents of the received wisdom draw the conclusion that there is no hope of any natural treatment that puts all the paradoxes to rest: we must either live with the existence of paradoxes that we are unable to treat, or adopt artificial and ad (...) hoc means to avoid them. Others (“dialetheists”) argue that we can put the paradoxes to rest, but only by licensing the acceptance of some contradictions (presumably in a paraconsistent logic that prevents the contradictions from spreading everywhere). The paper offers a solution to the semantic paradoxes, one in which (1) we keep the unrestricted truth schema “True(A)↔A”, and (2) the object language can include its own metalanguage. Because of the first feature, classical logic must be restricted, but full classical reasoning applies in “ordinary” contexts, including standard set theory. The more general logic that replaces classical logic includes a principle of substitutivity of equivalents, which with the truth schema leads to the general intersubstitutivity of True(A) with A (...) within the language.The logic is also shown to have the resources required to represent the way in which sentences (like the Liar sentence and the Curry sentence) that lead to paradox in classical logic are “defective”. We can in fact define a hierarchy of “defectiveness” predicates within the language. Contrary to claims that any solution to the paradoxes just breeds further paradoxes (“revenge problems”) involving defectiveness predicates, there is a general consistency/conservativeness proof that shows that talk of truth and the various “levels of defectiveness” can all be made coherent together within a single object language. The paper presents a kind of normative anti-realist view of epistemology, in the same ballpark as recent versions of expressivism. But the primary focus of the paper is less on this meta-epistemological view itself than on how it should affect ground-level issues in epistemology: for instance, how it should deal with certain forms of skepticism, and how it allows for fundamental revision in epistemic practices. It is hoped that these methodological consequences will seem attractive independent of the normative anti-realism. Indeed, (...) some normative realists seem to embrace the view on skepticism, but it is argued that their position is unstable: the realism undermines the methodology. The general theme of the paper is that the issue of normative realism is deeply entwined with issues of methodology, in strong contrast to the common claim that meta-epistemological views in the tradition of expressivism have no first order impact. Both in dealing with the semantic paradoxes and in dealing with vagueness and indeterminacy, there is some temptation to weaken classical logic: in particular, to restrict the law of excluded middle. The reasons for doing this are somewhat different in the two cases. In the case of the semantic paradoxes, a weakening of classical logic (presumably involving a restriction of excluded middle) is required if we are to preserve the naive theory of truth without inconsistency. In the case of vagueness (...) and indeterminacy, there is no worry about inconsistency; but a central intuition is that we must reject the factual status of certain sentences, and it hard to see how we can do that while claiming that the law of excluded middle applies to those sentences. So despite the different routes, we have a similar conclusion in the two cases. (shrink)

Various attempts to characterize psychopaths are considered and rejected, in particular the widely held (...) view that psychopaths are, in general, incapable of understanding moral concepts. The particular disability proposed here, the incapacity to form other-regarding moral beliefs, is then derived from an analysis of what is required for someone to be a responsible agent. This is illustrated with a detailed case history. A defect of this kind is shown to vitiate moral responsibility, because it renders the psychopath irresponsive to the social pressures which normally ensure respect for moral norms. It is also shown that the psychopath is not a suitable subject for the assessment of legal responsibility, because he lacks the capacity to act from common prudence to avoid sanctions. In her commentary of Field (1999), Hammerl (1999) has drawn attention to several interesting points concerning the issue of contingency awareness in evaluative conditioning. First, she comments on several contentious issues arising from Field's review of the evaluative conditioning literature, second she critiques the data from his pilot study and finally she argues the case that EC is a distinct form of conditioning that can occur in the absence of contingency awareness. With reference to these criticisms, this reply attempts to (...) address Hammerl's comments by exploring the issues of how awareness is defined, how it is best measured, and whether it is reasonable to believe that EC uniformly occurs in the absence of contingency awareness. Keeping these things requires a weakening of classical logic; I suggest a logic based on the strong Kleene truth tables, but with → (...) as an additional connective, and where the effect of classical logic is preserved in the arithmetic or formal syntax itself. What are the ethical, political and cultural consequences of forgetting how to trust our senses? How can artworks help us see, sense, think, and interact in ways that are outside of the systems of convention and order that frame so much of our lives? In Cultivating Perception through Artworks, Helen Fielding challenges us to think alongside and according to artworks, cultivating a perception of what is really there and being expressed by them. 1. Of what use is the concept of causation? Bertrand Russell [1912-13] argued that it is not useful: it is “a relic of a bygone age, surviving, like the monarchy, only because it is erroneously supposed to do no harm.” His argument for this was that the kind of physical theories that we have come to regard as fundamental leave no place for the notion of causation: not only does the word ‘cause’ not appear in the advanced sciences, but the (...) laws that these sciences state are incompatible with causation as we normally understand it. But Nancy Cartwright has argued [1979] that abandoning the concept of causation would cripple science; her conclusion was based not on fundamental physics, but on more ordinary science such as the search for the causes of cancer. She argues that Russell was right that the fundamental theories of modern physics say nothing, even implicitly, about causation, and concludes on this basis that such theories are incomplete. Most of us think so, but there are serious difficulties in maintaining the view, and in explaining the idea of determinateness in a satisfactory manner. The paper argues that to overcome the difficulties, we need to reject the law of excluded middle; and it investigates the sense of 'rejection' that is involved. This paper is concerned with the debate between substantival and relational theories of space-time, and discusses two difficulties that beset the relationalist: a difficulty posed by field theories, and another difficulty called the problem of quantities. A main purpose of the paper is to argue that possibility can not always be used as a surrogate of ontology, and that in particular that there is no hope of using possibility to solve the problem of quantities.
