How should we make choices when we know so little about our futures? L. A. Paul argues that we must view life decisions as choices to make discoveries about the nature of experience. Her account of transformative experience holds that part of the value of living authentically is to experience our lives and preferences in whatever ways they evolve.

The Free Choice effect—whereby \\) seems to entail both \ and \—has traditionally been characterized as a phenomenon affecting the deontic modal ‘may’. This paper presents an extension of the semantic account of free choice defended by Fusco to the agentive modal ‘can’, the ‘can’ which, intuitively, describes an agent’s powers. On this account, free choice is a nonspecific de re phenomenon that—unlike typical cases—affects disjunction. I begin by sketching a model of inexact ability, which grounds a modal approach (...) to agency in a Williamson -style margin of error. A classical propositional semantics combined with this framework can reflect the intuitions highlighted by Kenny ’s dartboard cases, as well as the counterexamples to simple conditional views recently discussed by Mandelkern et al.. In Section 3, I turn to an independently motivated actual-world-sensitive account of disjunction, and show how it extends free choice inferences into an object language for propositional modal logic. Recent literature on Stalnaker's Thesis, which seeks to vindicate it from Lewis (1976)'s triviality results, has featured linguistic data that is prima facie incompatible with Conditionalization in iterated cases (McGee 1989, 2000; Kaufmann 2015; Khoo & Santorio, 2018). In a recent paper (2021), Goldstein & Santorio make a bold claim: they hold that these departures light the way to a new, non‐conditionalizing theory of rational update.Here, I consider whether this new form of update is subject to a Dutch book. On (...) the official, invariantist version of the theory, I show that the answer is “yes”. On a competing, contextualist theory of indicative conditionals (Bacon, 2015), the answer is “no”, for reasons that have familiar connections to the limits of textbook Bayesianism. After presenting a concrete case, I explore the dialectical ramifications. The upshot is some hard choices for theories that seek to save the linguistic phenomena. (shrink)

I respond to a dilemma for Causal Decision Theory (CDT) under determinism, posed in Adam Elga's paper “Confessions of a Causal Decision Theorist”. The treatment I present highlights (i) the status of laws as predictors, and (ii) the consequences of decision dependence, which arises natively out of Jeffrey Conditioning and CDT's characteristic equation. My argument leverages decision dependence to work around a key assumption of Elga's proof: to wit, that in the two problems he presents, the CDTer must employ subjunctive‐suppositional (...) In ‘The logic of partial supposition’ (Analysis vol. 81), Benjamin Eva and Stephan Hartmann investigate partial imaging, a credence-revision method which combines the partiality familiar from Jeffrey Conditioning(The Logic of Decision, 1983) with the formal notion of imaging familiar from Lewis’s ‘Causal decision theory’ (1981). They argue that because partial imaging is non-monotonic, it ‘fail[s] to provide a plausible account of the norms of partial subjunctive suppositions’.In this note, I present a notion of partial imaging that does satisfy monotonicity, and (...) discuss some of the applications and ramifications. I propose a unified solution to two puzzles: Ross's puzzle and free choice permission. I begin with a pair of cases from the decision theory literature illustrating the phenomenon of act dependence, where what an agent ought to do depends on what she does. The notion of permissibility distilled from these cases forms the basis for my analysis of 'may' and 'ought'. This framework is then combined with a generalization of the classical semantics for disjunction — equivalent to Boolean disjunction (...) on the diagonal, but with a different two-dimensional character — that explains the puzzling facts in terms of semantic consequence. El propósito del análisis es doble. Por un lado, mostraremos como el constituirse de la autonomia como área refleja una ‘revolución’ en el panorama de la izquierda italiana de aquellos años y, por otro, reconstruiremos la comprensión de la noción de revolución elabora el (...) filósofo Antonio Negri en el marco de la revista Rosso, una de las referencias más importante para los militantes de la organización. Por último, indicaremos cómo las reelaboraciones de las nociones de vanguardia de clase y obrero social gestadas en el seno de Autonomia siguen siendo útiles para (re)pensar nuestro horizonte de acción contemporáneo y su posible trasformación radical. A century after the publication of Evgeny Pashukanis's pivotal book General Theory of Law and Marxism, this collection presents a comprehensive account and analysis of his key concept of legal form. Evgeny Pashukanis's General Theory, born amidst the fervour of the first socialist revolution, remains still a crucial reference point in Marxist theories of the law and critical legal theory. Its theoretical depth paved the way for new understandings of the relationship between Marxism and the law. Its crucial virtue continues (...) to be, even after a century, the ability to articulate epochal concerns in the context of a socialist revolution that turned hitherto theoretical problems into dilemmas of practice. This book returns to Pashukanis's main concept: 'legal form'. Through this jurisprudential category Pashukanis aimed to grasp the dependence of the law on the economy, and at the same time, to enquire into the degree to which the law preserves its autonomy from economic relations. In other words, the legal form as a concept conveys both the law's dependence on the economic sphere of exchange and its greatest inherent specificity: the way it translates economic relations into its proper language and set of legal/ideological constructs. The contributions to this volume provide a range of perspectives on how the concept of legal form has been developed and reinterpreted. Including the first English translation of Pashukanis's essay, 'Hegel, State and Law', this collection will be of considerable interest to scholars and students of legal and political theory. This paper presents experimental data relevant to understanding the modal free choice effect (Kamp, 1973) when there are more than two disjuncts under the relevant modal operator. The results suggest that speakers' willingness to draw free choice inferences is correlated with whether the embedded disjuncts are *modally separable*, in a sense brought into focus by considering cases within which the relevant propositions fail to be pairwise redundant but are redundant as a set.

Across three studies, the authors examine the interactive effects of moral identity and the negative reciprocity norm in predicting revenge. The general argument is that moral identity provides the motivational impetus for individuals’ responses, whereas the normative framework that people adopt as a basis for guiding moral action influences the direction of the response. Results indicated that moral identity and the negative reciprocity norm significantly interacted to predict revenge. More specifically, the symbolization dimension of moral identity interacted with the negative (...) reciprocity norm to predict revenge when individuals were the targets of mistreatment, whereas the internalization dimension of moral identity interacted with the negative reciprocity norm to predict revenge when individuals were the observers of mistreatment. Theoretical implications related to the differences between the symbolization and internalization dimensions of moral identity, the importance of examining normative frameworks, and the functionality of revenge are discussed. It is an appealing idea that deontic modality is a modality of the open future, and that the indeterminacy of the open future is the key, within natural language, to understanding the deontic modal puzzles that form the traditional subject-matter of deontic logic. In this paper, I pull together three well-studied strands of indeterminism—Thomason (1980)’s settledness operator, the modal base of Kratzer (1981, 1991)’s analysis of modals, and Stalnaker (1978)’s notion of diagonal acceptance—to argue for two theses governing a deontic (...) logic for natural language. -/- The first thesis makes a claim about postsemantic truth, and is couched in terms of Stalnaker’s dagger operator. The second concerns what it is for an act to be permissible, when agents exercise partial control over their obligations as well as their bodily movements. (shrink)

We examine the processes involved in the escalation of a plant closure from a local concern to a perceived organizational moral failure that commands national attention. Our empirical case covers the controversy over the decision of telecommunications giant Nokia to close a plant in Germany, despite having received significant state subsidies, and the relocation of production to Hungary and Romania. We conducted an inductive study that utilizes a semiotic analysis to identify how various actors framed the controversial plant closure and (...) sought to cast it as moral failure. Our analysis uncovered two distinctive moral framings of the plant closure and revealed how key actors used evocative labels to frame these events in moral terms. These moral framings drew in additional stakeholders, generated more widespread media coverage, and turned the case into an organizational moral failure in the eyes of the national public. We contribute to the literature on organizational moral failure by theorizing its escalating process and elaborating why and how local events may become moral issues of interest to broader stakeholder groups. Academic incivility can create divisiveness and affect learners’ sustainability towards degree attainment. Therefore, there is a need to empirically assess learner views on what constitutes academic incivility in higher education. To fill this gap, we developed the Incivility Indicators Instrument (i3), a multifaceted scale that measures the extent to which students view cumulative behaviors and dynamics as instances of academic incivility. To examine the reliability and factor structure of the i3, we conducted a two-part study with two samples of adults (...) in the United States who were enrolled in higher education programs. In study 1 (N = 342), we conducted an exploratory factor analysis (EFA) and found the initial three-factor structure. In study 2, we administered the instrument to a validating sample (N = 510) and examined the stability of the three-factor model and scores through confirmatory factor analysis (CFA). In this study, we describe the results of the study, provide implications, and discuss future directions. (shrink)

Phenomenal character is the what-it's-likeness of subjective experience. I develop an ontology of phenomenal feel as process. My being in some phenomenal state R is the process of my instantiating R’s neurological correlate. The ontology explains why we have asymmetric epistemic access to phenomenal characters: the ontological ground for the subjective or first-personal stance is different from the ontological ground for the objective or third-personal stance. I end by situating my account in debates about physicalism.

Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the (...) concept of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. This paper addresses a little puzzle with a surprisingly long pedigree and a surprisingly large wake: the puzzle of Free Choice Permission. I begin by presenting a popular sketch of a pragmatic solution to the puzzle, due to Kratzer and Shimoyama, which has received a good deal of discussion, endorsement and elaboration in recent work :535–590, 2006; Fox, in: Sauerland and Stateva Presupposition and implicature in compositional semantics, 2007; Geurts, Mind Lang 24:51–79, 2009; von Fintel, Central APA session on Deontic (...) Modals, 2012). I then explain why the general form of the Kratzer and Shimoyama explanation is not extensionally adequate. This leaves us with two possibilities with regard to the original solution-sketch; either the suggested pragmatic route fails, or it succeeds in a particularly strange way: Free Choice permission is rendered a kind pragmatic illusion on the part of both speakers and hearers. This article represents an attempt to organize, critique, and extend research findings on gender differences in business ethics. The focus is on two dependent variables—ethical judgment and behavioral intent. Differences in findings between student and professional groups are noted and theoretical implications are discussed. The new research provided for this article contains two benchmark studies undertaken with identical stimuli and identical measures. These studies were followed by two additional studies, using the same measures but different stimuli, as a partial replication (...) and extension of the first two. Findings suggest that little difference exists between the genders on behavioral intent for professional groups and only minimal differences for the ethical judgment measures. Student results, however, produced more substantial differences for behavioral intention. (shrink)

The notion of form-of-life refers to a living dimension that has overthrown the structures of power in which humans are supposedly destined to live, disclosing the possibility of a new understanding of political and legal life. By placing the 'form-of-life' in the context of contemporary philosophy, this book re-imagines anew some of the basic categories of human socialities - such as work, rights, obligation, property, and use. Recent feminist debates reveal a concern about the notion that equality is no longer a valuable ideal for feminist thinkers. Suspicious that equality represents sameness, feminists have leaned toward rejecting the ideal of equality and moved toward the recognition of differences among women as the guide of political judgement. In this article, equality is approached from a feminist perspective that does not conclude that identical sameness is the only reading of equality. Borrowing Rawls' notion of the moral person, I argue (...) that gender reflection should be considered part of an expanded view of equality. (shrink)

Two-dimensional semantics, which can represent the distinction between a priority and necessity, has wielded considerable influence in the philosophy of language. In this paper, I axiomatize the dagger operator of Stalnaker’s “Assertion” in the formal context of two-dimensional modal logic. The language contains modalities of actuality, necessity, and a priority, but is also able to represent diagonalization, a conceptually important operation in a variety of contexts, including models of the relative a priori and a posteriori often appealed to Bayesian and (...) Gricean contexts. Finally, I sketch the prospects for extending this two-dimensional upgrade to other kinds of modal logics for natural language. (shrink)

The paper examines Johann Georg Hamann’s influence on Ludwig Wittgenstein’s late philosophy. Wittgenstein’s letters, diaries and Drury’s memoirs show that Wittgenstein read Hamann’s writings in the early 1930s and 1950s. Wittgenstein’s diary notes and the Cambridge lectures show that Wittgenstein’s discussion of Hamann’s views in 1931 corresponds to adopting a Hamannian view of symbols and rule-following. The view of language as an intertwining of signs, objects and meanings in use forms a common core in the philosophies of Hamann and Wittgenstein. (...) The harmony of language and reality takes place in communicative use, so non-communicative private languages and pre-linguistic ideal forms of representation are not possible. Serial homology, i.e., homology between repetitive structures in the same individual organism, is a debated concept in evolutionary developmental biology. The central question is the evolutionary interpretation of “sameness” in the context of the same body. This essay provides a synthetic analysis of the main issues involved in the debate, connecting conceptual problems with current experimental research. It is argued that a concept of serial homology that is not of the all-or-nothing kind can smooth several theoretical inconsistencies, while being more (...) in line with what we know about evolutionary change and the way we investigate it. This article explores and compares cross-gender interactions of first and third graders in one child care center. Three prevalent forms of interaction are discussed: teasing, disputing, and playing. The author argues that these three forms of interaction are related to the use of space: Teasing often occurs when space is constricted, disputing is often the result of invaded space, and playing requires shared space and varying levels of cooperation. By focusing on the relationship between space and interaction, important power asymmetries (...) appear. Since boys are more likely to initiate invasions and more likely to determine the rules and terms of the play, they maintain a greater amount of power and control. (shrink)
