Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the (...) concept of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. Figuring prominently in their decisions regarding which theories to pursue are scientists' appeals to the promise or lack of promise of those theories. Yet philosophy of science has had little to say about how one is to assess theory promise. This essay identifies several indices that might be consulted to determine whether or not a theory is promising and worthy of pursuit. Various historical examples of appeals to such indices are introduced.

This article explores and compares cross-gender interactions of first and third graders in one child care center. Three prevalent forms of interaction are discussed: teasing, disputing, and playing. The author argues that these three forms of interaction are related to the use of space: Teasing often occurs when space is constricted, disputing is often the result of invaded space, and playing requires shared space and varying levels of cooperation. By focusing on the relationship between space and interaction, important power asymmetries (...) appear. Since boys are more likely to initiate invasions and more likely to determine the rules and terms of the play, they maintain a greater amount of power and control. (shrink)

To practice medicine and ethics, physicians need wisdom and integrity to integrate scientific knowledge, patient preferences, their own moral commitments, and society's expectations. This work of integration requires a physician to pursue certain goals of care, determine moral priorities, and understand that conscience or integrity require harmony among a person's beliefs, values, reasoning, actions, and identity. But the moral and religious pluralism of contemporary society makes this integration challenging and uncertain. How physicians treat patients will depend on the particular beliefs (...) and values they and other health professionals bring to each instance of shared decision making. This book offers a framework for practical wisdom in medicine that addresses the need for integrity in the life of each health professional. In doing so, it acknowledges the challenge of moral pluralism and the need for moral dialogue and humility as professionals fulfil their obligations to patients, themselves, and society. (shrink)

How should we make choices when we know so little about our futures? L. A. Paul argues that we must view life decisions as choices to make discoveries about the nature of experience. Her account of transformative experience holds that part of the value of living authentically is to experience our lives and preferences in whatever ways they evolve.

Across three studies, the authors examine the interactive effects of moral identity and the negative reciprocity norm in predicting revenge. The general argument is that moral identity provides the motivational impetus for individuals’ responses, whereas the normative framework that people adopt as a basis for guiding moral action influences the direction of the response. Results indicated that moral identity and the negative reciprocity norm significantly interacted to predict revenge. More specifically, the symbolization dimension of moral identity interacted with the negative (...) reciprocity norm to predict revenge when individuals were the targets of mistreatment, whereas the internalization dimension of moral identity interacted with the negative reciprocity norm to predict revenge when individuals were the observers of mistreatment. Theoretical implications related to the differences between the symbolization and internalization dimensions of moral identity, the importance of examining normative frameworks, and the functionality of revenge are discussed. This descriptive qualitative study examined how the Storypath (also known as Storyline) approach to teaching social studies involves elementary school students in action civics (authentic civic activities, self-chosen issues, ongoing reflection, decisions valued). Storypath, a project-based approach, utilizes the story structure to frame learning through an inquiry process whereby students consider an overarching question about a topic, create a relevant setting, become characters in the setting, and engage in the plot of the story (critical incidents). This Storypath engaged a class (...) of ethnically and culturally diverse fifth graders in creating a music company (setting) dedicated to producing songs for social change. As company employees (characters), students researched issues they chose (affirming their agency in the learning process), then created songs and music videos for social impact. The arts (songs and videos) and technology (digital media) became integral to students’ efforts as they created and recorded music to share with the world. Students responded to Padlet and worksheet prompts, wrote song lyrics, and recorded music videos which all were analyzed to address this research question: What did authentic civic advocacy through creating music within the Storypath approach reveal about elementary students’ civic disciplinary knowledge, thinking, and skills? Findings revealed two overarching types of thinking: civic and political. Evidence indicates that civic thinking was justice-oriented for social well-being while political thinking was influence-oriented for strategic impact. This suggests that the Storypath implemented in this study can engage elementary school students in authentic civic advocacy within the classroom to cultivate civic and political thinking for meaningful participation in democratic life beyond the classroom. The particular lifts we considerare Ramseyfication, branching and resumption.In each case we get exact criteria fordefinability of the lift in terms of simpler quantifiers.

In the real world, there can be constraints on rational decision-making: there can be limitations on what I can know and on what you can know. There can also be constraints on my ability to deliberate or on your ability to deliberate. It is useful to know what the norms of rational deliberation should be in ideal contexts, for fully informed agents, in an ideal world. But it is also useful to know what the norms of rational deliberation should be (...) in the actual world, in non-ideal contexts, for imperfectly informed agents, especially for big, life-changing decisions. That is, we want to know how to deliberate as best we can, given the real-world limitations on what we can know, and given real-world limitations on how we are able to deliberate. In this paper, our concern is with the norms of rational deliberation in certain, important, non-ideal contexts, where the reasoning occurs from the agent’s first person, subjective point of view. The norms governing the process of deliberation for real people in the sorts of non-ideal contexts we’ll consider need to reflect the way that real agents, with an incomplete grasp on the facts and an imperfect ability to deliberate, can be expected to proceed. Our central contention is that framing and exploring the deliberative process from the first person perspective allows us to uncover and explore important, real-world constraints on boundedly rational agents deliberating from the subjective perspective. Phenomenal character is the what-it's-likeness of subjective experience. I develop an ontology of phenomenal feel as process. My being in some phenomenal state R is the process of my instantiating R’s neurological correlate. The ontology explains why we have asymmetric epistemic access to phenomenal characters: the ontological ground for the subjective or first-personal stance is different from the ontological ground for the objective or third-personal stance. I end by situating my account in debates about physicalism.

This paper contains a formal treatment of the system of quantified epistemic logic sketched in Appendix II of Carlson (1983). Section 1 defines the syntax and recapitulates the model set rules and principles of the Appendix system. Section 2 defines a possible worlds semantics for this system, and shows that the Appendix system is complete with respect to this semantics. Many models of word recognition assume that processing proceeds sequentially from analysis of form to analysis of meaning. In the context of morphological processing, this implies that morphemes are processed as units of form prior to any influence of their meanings. Some interpret the apparent absence of differences in recognition latencies to targets (SNEAK) in form and semantically similar (sneaky-SNEAK) and in form similar and semantically dissimilar (sneaker-SNEAK) prime contexts at an SOA of 48 ms as consistent with this claim. (...) To determine the time course over which degree of semantic similarity between morphologically structured primes and their targets influences recognition in the forward masked priming variant of the lexical decision paradigm, we compared facilitation for the same targets after semantically similar and dissimilar primes across a range of SOAs. The effect of shared semantics on recognition latency increased linearly with SOA when long SOAs were intermixed (Exp. 1) and latencies were significantly faster after semantically similar than dissimilar primes at homogeneous SOAs of 48 ms (Exp. 2) and 34 ms (Exp. 3). Results limit the scope of form-then-semantics models of recognition and demonstrate that semantics influences even the very early stages of recognition. Finally, once general behavior across trials has been accounted for, we fail to provide evidence for individual differences in morphological processing that can be linked to measures of reading proficiency. In its excitement over the quandries posed by biotechnology, bioethics is in danger of neglecting basic health care needs. What is needed is an understanding of ethics that emphasizes responsibility to others rather than rights.

Humans all around the world are drawn to creating and consuming art due to its capability to evoke emotions, but the mechanisms underlying art-evoked feelings remain poorly characterised. Here we show how embodiement contributes to emotions evoked by a large database of visual art pieces (n = 336). In four experiments, we mapped the subjective feeling space of art-evoked emotions (n = 244), quantified “bodily fingerprints” of these emotions (n = 615), and recorded the subjects’ interest annotations (n = 306) (...) and eye movements (n = 21) while viewing the art. We show that art evokes a wide spectrum of feelings, and that the bodily fingerprints triggered by art are central to these feelings, especially in artworks where human figures are salient. Altogether these results support the model that bodily sensations are central to the aesthetic experience. (shrink)

Recent feminist debates reveal a concern about the notion that equality is no longer a valuable ideal for feminist thinkers. Suspicious that equality represents sameness, feminists have leaned toward rejecting the ideal of equality and moved toward the recognition of differences among women as the guide of political judgement. In this article, equality is approached from a feminist perspective that does not conclude that identical sameness is the only reading of equality. Borrowing Rawls' notion of the moral person, I argue (...) that gender reflection should be considered part of an expanded view of equality. (shrink)

The study discusses the philosophy of Finnish philosopher J.V. Snellman (1806–81). The focus is on Snellman's so-called philosophy of personality, which he presented in his work "Essay on the speculative Development of the Idea of Personality" (Tübingen, 1841). Besides this work he addressed his philosophy of personality in his other works and in his public lectures. -/- In his philosophy of personality Snellman develops the concept of personality within the framework of G.W.F. Hegel's (1770–1831) philosophy. The concept of personality serves (...) as a basis for Hegel's philosophy of right, and it plays an important role also in other parts of Hegel's system. However, he never provided a comprehensive definition of this concept. The essence of personality was debated among Hegelians after Hegel's death in 1831. In the course of the debate the Hegelian school split into two groups. At the time of publication of "The Idea of Personality" there was a serious rift between the Right- and the Left-Hegelians. -/- The study analyzes Snellman's philosophy of personality in respect of Hegel's philosophy and in respect of the views of other Hegelians – mainly D.F. Strauss (1808–74), L. Feuerbach (1804–72) and C.F. Göschel (1781–1861). I also attend to some contemporaries outside the Hegelian School like F.W.J. Schelling (1775–1854) and I.H. Fichte (1796–1879). -/- The study is divided into six sections (A–F). The first comprises an introduction and an outline of the structure of the study. The second section (B) discusses the historical context of Snellman's philosophy. The first subsection focuses on the Central European debate on Hegel's legacy. The second subsection deals with Snellman's life and his work on philosophy. The systematic part of the study comprises three sections (C–E), which consider the dialectic of Snellman's work of 1841. This dialectic follows the outline of Hegel's philosophy of subjective spirit and culminates in the definition of personality. Snellman, however, exceeds the realm of the philosophy of subjective spirit, as he discusses e.g. the philosophy of religion. He also comments on the debate among Hegelians. According to Snellman, neither Right- nor Left-Hegelians are true to Hegel's philosophy. In effect, his own standpoint in the debate, as I will argue, comes close to that of the Left-Hegelians. Recent research in philosophy of science suggests that the relationship which scientists have towards the artifacts of science, i.e. their theories, is considerably richer than many traditional accounts of scientific appraisal would lead us to believe. Problem-solving methodologists, in particular, advocating a pragmatic account of scientific theories, argue that traditional methodologies have tended to focus exclusively on one modality of appraisal--that of theory acceptance, and have advanced normative proposals which provide only for assessments of the empirical well-foundedness of scientific theories. (...) As a result, it is held, these traditional accounts are unable to accommodate certain historical cases in which conceptual considerations have played a vital role in scientific appraisal, and in which the behavior of scientists clearly indicates something less or other than theory acceptance on their part. ;In this essay, a problem-solving methodology is adopted in the interests of contributing to this recent research in philosophy of science by critically assessing and further developing selected features of it. Two historical case-studies are presented. The first examines the theories of space and of motion advanced by Descartes and Newton, while the second explores atomism and affinitism in nineteenth-century chemical theory. These cases are used to establish: that conceptual considerations have figured significantly in the assessments which scientists make of their theories; that scientists do something more than accept or reject theories, they pursue them; and that in defending their decisions to pursue or not to pursue a theory, scientists typically do make reference to the promise, or lack of promise, of the theory. Specific normative proposals are developed which are intended to enrich our appreciation of scientific appraisal by providing an account of what it is to pursue a theory, of what it is for a theory to be promising, and of the role of conceptual considerations in supporting judgements of theory promise. Sitä, mikä tekee Snellmanista nimenomaan vasemman keskustan eikä esimerkiksi oikean keskustan edustajaa ei kuitenkaan juuri ole pohdittu. I argue for a property mereology and for mereological bundle theory. I then apply this theory to the one over many problem (universals) and puzzles concerning persistence and material constitution.

This article argues for separating the institutions of marriage and parenting, conceptually and legally. Marriage is neither necessary nor adequate for fostering cooperative and stable co-parenting. Because promoting marriage fails to protect all children, the state should develop a more suitable formal mechanism whereby co-parents can commit to cooperate in good faith in order to best serve the interests of their children. Like civil marriage, many of the terms of these contracts are aspirational and not enforceable, though they can guide (...) arrangements for custody and financial support. Co-parenting agreements need not be limited to two parents, nor need they be limited to legal parents, but can include de facto parents, such as stepparents, foster parents, and other support parents. One important aim of these agreements is to recognise and support the valuable work that married or unmarried co-parents perform, and to protect the parental rights of caregivers in different kinds of situations. Laurie Johnson Bagby examines the loss of the appreciation for honor in modern Western society through an examination of the political philosophy of English political philosopher Thomas Hobbes. She finds in Hobbes's thought a 'turning point for honor,' in which honor is rejected as too dangerous, and fear and self-interest are put in its place as the chief means of peace and good order.

Drawing on diverse historical cases, this paper describes and examines various aspects of a modality of scientific appraisal which has remained largely unexplored, theory pursuit. Specifically, it addresses the following issues: the epistemic and pragmatic commitments involved in theory pursuit, including how these differ from those characteristic of theory acceptance; how the research interests of scientists enter into their pursuit decisions; some of the strategies for the refinement and extension of a theory's empirical abilities which typify theory pursuit; and the (...) need to distinguish between individual and community rationality in contexts of pursuit. The term ‘phenomenology’ has become almost as over-used and emptied of meaning as that other word from Continental Philosophy, namely ‘existentialism’. Yet Husserl, who first put forward the phenomenological method, considered it a rigorous alternative to positivism, and in the hands of Merleau-Ponty, a disciple of Husserl in France, phenomenology became a way of gaining a disciplined and coherent perspective on the world in which we live. When this study originally published in 1977 there were only a few books in (...) English on Merleau-Ponty’s philosophy. It introduced the reader and suggested how his thought might throw light on some of the assumptions and presuppositions of certain contemporary forms of Anglo-Saxon philosophy and social science. It also demonstrates how phenomenology seeks to unite philosophy and social science, rather than define them as mutually exclusive domains of knowledge. (shrink)

The right not to know is a contested matter. This can be because the inversion of the normal framing of entitlement to information about one's own health is thought to be illogical and inconsistent with self-authorship and/or because the very idea of claiming a right not to know information is an inappropriate appeal to the discourse of rights that places impossible responsibilities on others. Notwithstanding, there has been a sustained increase in this kind of appeal in recent years fueled in (...) large part by the rise and rise of the importance of personal autonomy in health care ethics, and by domestic and international health law. The right not to know has been acknowledged in at least two important international legal instruments. For example, the UNESCO Universal Declaration on the Human Genome and Human Rights, Article 5c provides: “The right of every individual to decide whether or not to be informed of the results of genetic examination and the resulting consequences should be respected.”. The phenomenon of the New Genetics raises complex social problems, particularly those of privacy. This book offers ethical and legal perspectives on the questions of a right to know and not to know genetic information from the standpoint of individuals, their relatives, employers, insurers and the state. Graeme Laurie provides a unique definition of privacy, including a concept of property rights in the person, and argues for stronger legal protection of privacy in the shadow of developments in human genetics. Laurie Shrage attributes much of the long-standing controversy about abortion to Roe v. Wade and to the Supreme Court's controversial regulatory scheme in that 1973 decision. Shrage explores the origins of that scheme but argues for an alternate scheme - therapeutic abortions shorter than six months can protect women's interests and advance important public interests, but that reproductive rights campaigns should also focus on the social and economic conditions that prevent women having access to the abortion services they need. Despite the numerous benefits associated with forgiveness, many individuals find it difficult to forgive. This is especially true in organizations, where forgiveness is rare and can be under-valued. Across two studies, we explore how to facilitate forgiveness within organizational contexts and in the aftermath of workplace unfairness. We examine whether individuals can reduce the “injustice gap” that can be created by violations and enhance forgiveness through expressive writing interventions—guided writing techniques that can be self-administered. Participants wrote about their reactions to (...) a fictional scenario or an actual workplace experience. Results indicate that expressive writing was associated with higher reported perceived resolution. Whereas negative emotions mediated this relationship in Study 1, positive emotions and perceived injustice mediated this relationship in Study 2. Perceived resolution also mediated the relationship between expressive writing and forgiveness. Theoretical, methodological, and practical implications are discussed. (shrink)
