The exhibition is proposing a different reading of the legal text, reading against the grain of pre-conceived structures in order to re-chart the system of our relations with ourselves and with various communities; both territorial communities as well as those constructed ad hoc, based not on blood or territorial ties, but on shared values and beliefs. The exhibition raises the question of how the law literally produces us: both as individuals and as citizens, establishing a framework of our presence in (...) public space as well - its legality or illegality. It also questions the different meanings of a 'civil body', a 'legal thing', or a 'legal slave'. How do legal rituals and narratives influence and shape our existence? In this arresting book, Wai Chee Dimock takes on the philosophical tradition from Kant to Rawls, challenging its conception of justice as foundational, self-evident, and all-encompassing. The idea of justice is based on the premise that the world can be resolved into commensurate terms: punishment equal to the crime, redress equal to the injury, benefit equal to the desert. Dimock focuses, however, on what remains unexhausted, unrecovered, and noncorresponding in the exercise of justice. To honor these "residues," she turns to (...) literature, which, in its linguistic density, transposes the clean abstractions of law and philosophy into persistent shadows, the abiding presence of the incommensurate. Justice can only be a partial answer to the phenomenon of human conflict. In arguing for justice as an _incomplete_ virtue, Dimock draws upon legal history, political philosophy, linguistics, theology, and feminist theory; she discusses Aristotle and Augustine, Locke and Luther, Marx and Durkheim, Michael Sandel and Carol Gilligan, Noam Chomsky and Mary Ann Glendon. She also examines an unusual configuration of nineteenth-century American authors, pairing figures such as Herman Melville and Rebecca Harding Davis, Walt Whitman and Susan Warner. The result is a book both passionate and scholarly. The 2010 Nagoya Protocol is an international framework for access and benefit sharing (ABS) of the use of genetic and biological resources, with particular focus on indigenous communities. This is especially important in Africa, where local communities have a close reliance on environmental resources and ecosystems. However, national legislation and policies commonly lag behind international agreements, and this poses challenges for legal compliance as well as practical applications. This study reviews the academic literature on the Nagoya Protocol and ABS (...) applications, and then considers the implications of this analysis for research in Africa. Results show that there is uneven engagement with the principles of the Nagoya Protocol across different academic disciplines; local communities are sometimes sidelined in these studies; and only 8% of researchers in the literature analysed are located in Africa. Future developments should focus on ensuring national compliance with the Nagoya Protocol, and that researchers and industry work in partnership with local African communities on ABS issues. This paper asks whether geographically localised, or ‘hyperlocal’, uses of Twitter succeed in creating peer-to-peer neighbourhood networks or simply act as broadcast media at a reduced scale. Literature drawn from the smart cities discourse and from a UK research project into hyperlocal media, respectively, take on these two opposing interpretations. Evidence gathered in the case study presented here is consistent with the latter, and on this basis we criticise the notion that hyperlocal social media can be seen as a (...) community in itself. We demonstrate this by creating a network map of Twitter followers of a popular hyperlocal blog in Brockley, southeast London. We describe various attributes of this network including its average degree and clustering coefficient to suggest that a small and highly connected cluster of visible local entities such as businesses form a clique at the centre of this network, with individual residents following these but not one another. We then plot the locations of these entities and demonstrate that sub-communities in the network are formed due to close geographical proximity between smaller sets of businesses. These observations are illustrated with qualitative evidence from interviews with users who suggest instead that rather than being connected to one another they benefit from what has been described as ‘neighbourhood storytelling’. Despite the limitations of working with Twitter data, we propose that this multi-modal approach offers a valuable way to investigate the experience of using social media as a communication tool in urban neighbourhoods. The German word Festschrift has become the universally accepted term for a published collection of legal essays written by several authors to honour a distinguished jurist or mark a significant legal event. The genre dates back to the mid‐19th century on the Continent, but until recently it has made little impression on the literature of the common law. Less than a dozen legal Festschriften had been published in the United Kingdom up to 1968, but since then more than a (...) hundred legal Festschriften have appeared. This article traces the rise of the legal Festschrift in the United Kingdom, and attempts to account for its recent popularity. The nature of legal Festschriften, and the processes and problems of their production, are addressed. Emphasis is placed on the systemic failure to index contributions to legal Festschriften. This gap in the bibliographic resources of the common law consigns an enormous amount of scholarship to oblivion; hence the reference in the title to ‘graveyards of scholarship’. An indication of the magnitude of this problem is that the total number of contributions to legal Festschriften between 1969 and 2000 almost equals the total number of articles published in three leading British law reviews over the same period. The article concludes that the failure to index contributions to legal Festschriften by author and subject matter is lamentable, and undercuts the reasons for publishing legal Festschriften in the first place. Although philosophy cites less than most other academic subjects, many scholars still take a lack of reference to and engagement with the relevant literature as a reason to reject a paper in philosophy. Here I argue against that idea. Literature requests should only in rare circumstances be an absolute requirement, and a lack of (engagement with) references is not a good reason to reject a paper. Lastly, I briefly discuss whether an author has reasons to provide references, and (...) I argue that although there are special circumstances in which we ought to avoid referencing papers, there are strong reasons in favor of engaging with the literature. Hence there is an asymmetry between what the author has a reason to do in writing a paper and how reviewers and editors ought to evaluate it. (shrink)

Duty of care is the core ethical responsibility of healthcare workers. Getting the workforce vaccinated will provide safety to the public, protect the vulnerable population and provide a safe working environment. While most agree that healthcare workers should be prioritised in the vaccination programme, mandatory vaccination remains a complicated and contentious issue with political, legal and ethical dimensions. This study aims to determine the ethical considerations associated with mandatory vaccinations among healthcare workers. A total of 152 abstracts were identified of (...) which, 142 were excluded based on abstracts because they did not meet the inclusion criteria. The remaining ten articles were further evaluated with three articles that fit the inclusion criteria specifically discussing mandatory vaccination among healthcare workers and the ethical issues. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were used as a framework to discuss the ethical considerations which resonated both directly from the included papers, as well as more generally from the other literature associated with this search. There is limited literature on the topic of ethical considerations associated with COVID-19 mandatory vaccination of healthcare workers, as a systematic review identified only 3 papers. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were among the seven ethical considerations identified and discussed. (shrink)

BackgroundThe COVID-19 pandemic has presented extraordinary challenges to worldwide healthcare systems, however, prevalence remains low in some countries. While the challenges of conducting research in high-prevalence countries are well published, there is a paucity from low COVID-19 countries.MethodsA PRISMA guided systematic review was conducted using the databases Ovid-Medline, Embase, Scopus and Web of Science to identify relevant articles discussing ethical issues relating to research in low prevalence COVID-19 countries.ResultsThe search yielded 133 original articles of which only 2 fit the inclusion (...) criteria and aim, with neither specific to low prevalence. Most of the available literature focused on clinical management and resource allocation related to high prevalence countries. These results will be discussed under the ethical dimensions of equity, individual liberty, privacy and confidentiality, proportionality, public protection, provision of care, reciprocity, stewardship and trust..ConclusionsA systematic review failed to identify articles relating to COVID-19 research ethics, specific to low prevalence countries. It shows that there is a significant gap in the literature that warrants further investigation. Common ethical principles were used to present a distinct set of challenges experienced by a country with a low prevalence of COVID-19. This unique perspective of some of the common ethical problems surrounding research, may help guide further discussion and guide research in similar countries. (shrink)

ABSTRACTBuilding on Google's efforts to scan millions of books, this article introduces methodology using a database of annual word frequencies of the 40,000 most frequently occurring words in the American literature between 1800 and 2009. The current paper uses this methodology to replicate and identify terror management processes in historical context. Variation in frequencies of word usage of constructs relevant to terror management theory are investigated over a time period of 209 years. Study 1 corroborated previous TMT findings and (...) demonstrated that word use of constructs related to death and of constructs related to patriotism and romantic relationships significantly co-vary over time. Access to legal information and, in particular, to legal literature is examined for the creation of a search and retrieval system for Italian legal literature. The design and implementation of services such as integrated access to a wide range of resources are described, with a particular focus on the importance of exploiting metadata assigned to disparate legal material. The integration of structured repositories and Web documents is the main purpose of the system: it is constructed on the basis (...) of a federation system with service provider functions, aiming at creating a centralized index of legal resources. The index is based on a uniform metadata view created for structured data by means of the OAI approach and for Web documents by a machine learning approach, which, in this paper, has been assessed as regards document classification. Semantic searching is a major requirement for legal literature users and a solution based on the exploitation of Dublin Core metadata, as well as the use of legal ontologies and related terms prepared for accessing indexed articles have been implemented. What is the cultural value of illegal works that violate the copyrights of popular fiction? Why do they persist despite clear and stringent intellectual property laws? Drawing on the disciplines of new media, law, and literary studies, Illegal Literature suggests that extralegal works such as fan fiction are critical to a system that spurs the evolution of culture. Reconsidering voices relegated to the cultural periphery, David S. Roh shows how infrastructure--in the form of legal policy and network distribution--slows or (...) accelerates the rate of change. He analyzes the relationship between intellectual property rights and American literature in two recent copyright disputes. And, in comparing American fan fiction and Japanese dojinshi, he illustrates how infrastructure and legal climates detract from or encourage fledgling creativity. Dystopias, found mostly in the twentieth and twenty-first centuries, reflect, on the one hand, a fear that Christianity is under threat, and, on the other hand, the fear (...) that fundamentalist Christians will impose their beliefs on the country. There have also been a number of Jewish utopias and anti-Semitic dystopias as well as a few Islamic utopias and a growing number of anti-Islamic dystopias based on the belief that Muslims want to impose Shari`a law on everyone. Thanks to the particularly penetrating analysis of André Martinet, we now know that the complementary existence of two levels of different articulation is one of the most remarkable specific characteristics of language. To the first level belong all facts concerning significant units, the meaning and inflection of words, syntactic groupings and the composition of a discourse; the second articulation is that of non-significant elements that we call phonemes. In other words, it is at the second level that we pronounce articulate (...) sounds, while to the first we owe the possibility of formulating groups with meaning. The first articulation could be visualized as the molecular and cellular level in which the simplest elements, having a very limited autonomy, are organized according to affinities having the force of law; the second articulation would thus represent the atomic level, that of elementary particles identified by their role in groups. Transitional justice in Colombia has evolved, reflecting the political, social, and academic changes in the country. This study is a systematic review of the literature through articles indexed in Web of Science, applying the PRISMA protocol. Out of 3819 articles published in the last five years (2019-2024), 109 articles were selected following strict exclusion criteria. The methodology includes a quantitative analysis complemented with the visual analysis tool Posit PBC™ for bibliometric analysis in Biblioshyni. The study addresses the research question (...) on the evolution of the main research interests in the field of Transitional Justice in Colombia. The results show that initially, analyses on transitional justice focused on documenting the atrocities of the armed conflict, with a focus on truth and reparation, grounding legal mechanisms such as the Justice and Peace Law of 2005; with the 2016 Peace Agreement, research expanded into more complex issues, including the interaction between transitional justice and development, and the importance of civil society and victim engagement. The inclusion of the gender perspective, particularly after the 2016 Peace Agreement, led to studies on how women and LGBTI+ communities were differentially affected by the conflict. In addition, recent research has focused on the comparison between the peace processes with the AUC and the FARC-EP, analyzing the differences in their transitional justice frameworks and the challenges of implementing these agreements in a context of persistent violence. Since the #MeToo movement, many discussions arose on the role of consent in defining rape, among academics, legal practitioners, non-governmental organisations, and at the European Union level. This debate is particularly relevant in France, where rape is a sexual act committed by violence, coercion, threat, or surprise, with no mention of consent in the Criminal Code. By conducting a meta-analysis of the discourse of the French legal literature on this topic in four criminal law reviews and ten textbooks, this (...) study offers a new perspective to this debate. Based on this analysis, the definition of rape and the role of consent is barely discussed by the literature, partly due to an equivalence drawn between the constitutive elements of the offence and the absence of consent of the victim. Yet, the relevance of consent is highly criticised, mainly by a few male academics, using primarily arguments of authority instead of a critical approach to the topic. Background: Meaning in life of older persons is related to well-being, health, quality of life, and “good life.” However, the topic is scarcely covered in nursing literature. Objective: The aim of this integrative review for nurses is to synthesize knowledge from scholarly literature to provide insight into how older persons find meaning in life, what are influencing circumstances, and what are their sources of meaning. The review serves as a starting point for including meaning in life of older (...) persons as a major concern for nurses in their role as health promoters. Method: An integrative review was performed including empirical research literature and texts on theoretical perspectives. Ethical consideration: Researches agree with ethical codes for research of universities in the Netherlands. For literature reviews no additional procedures are necessary according to Dutch law. Findings: A total of 44 heterogeneous texts were included in this review. Finding meaning in life is challenging for older persons. Older persons find meaning through a developmental process, by creating and discovering. Meaning in life is found in connection with self and others. Health, living together, high socio-economic status, social relations, activities, and religion are associated with experiencing meaning in later life. The main source of meaning in life of older persons is human relationships. Other sources of meaning in life vary by age and culture. Discussion: The review provides insight into meaning in life of older persons. There are several gaps in knowledge: literature is culturally biased, research on discovery of meaning and daily meaning is limited, and research from a nursing perspective is lacking. In practice, nurses have many opportunities to attune to meaning in life of patients. Further development of competence and training are needed. Conclusion: Older persons find meaning in life through different processes. Meaning in life is associated with the circumstances old persons live in. Human relationship is the major source of meaning. The knowledge from this review is a necessary knowledge base for nurses to include meaning in life of older patients in care. Educators and students alike face an enormous number of new fields of study and new medical technologies. Health care professionals and institutions are also facing new challenges in the form of shrinking economic resources, and the AIDS epidemic. They must (...) also respond to increased patient participation in health care decisions, and public concern about abortion and euthanasia. These challenges to the health care professional have compelled educators to accommodate ethics within their already overcrowded curriculum. Those same dilemmas have influenced health care institutions to become active in health care ethics education.Medical ethics education gained a foothold in the United States during the late 1960s, when the medical schools of Pennsylvania State University, the University of Florida, and the State University of New York at Stonybrook established programs in the humanities (Pellegrino 1982). In 1978 Robert Veatch noted that formal teaching in medical ethics was rare; most institutions that taught medical ethics used "informal instruction in the apprenticeship mode" (Veatch 1978). However, by 1982 a survey by the American Medical Association (AMA) revealed that all but one of the 127 medical schools had courses that included medical ethics. Thirty eight of these had medical ethics as a required course (Pellegrino 1985). And by 1989, 43 of the 127 medical schools had separate courses in medical ethics, while 100 covered medical ethics within required courses. Medical ethics is now an accepted part of medical curriculum, though it is not fully mature, and its future remains somewhat unclear (Miles 1989).The evolution of ethics in the nursing curriculum has essentially mirrored that of the medical curriculum. A 1977 survey of baccalaureate nursing programs revealed that only 7 percent of nursing programs required courses in ethics [End Page 171] (Aroskar 1977). A decade later a second survey of undergraduate programs identified 85 percent of responding nursing schools as teaching nursing ethics either in separate ethics courses or within other required courses (Cassells and Redman 1989).Though the precise future of health care ethics may be unpredictable, there is little thought that the role of ethics will diminish in importance as the 21st century approaches. Other schools offer an array of elective courses in topics that relate to ethics in medicine and nursing (including medical humanities, medicine and the law, literature and medicine, history of medicine, patient advocacy, and human values in nursing.) "Brown bag" seminars and journal clubs are also common.There is much debate over how health care ethics should be taught. Some argue that medical professionals should be conversant with theories of ethics and principles of biomedical ethics. Others think that a theoretical approach will alienate already over-worked medical or nursing students, and that instruction in ethical theory should be kept to a minimum. Case studies are frequently cited as a way to involve students in medical decision making, forcing them to analyze problems that they can relate to their own experiences.Additional concerns center around who should teach health care ethics. Research using current literature on legal reasoning was conducted with the goals of (a) determining what skills are most important in good legal reasoning according to such literature, (b) determining the extent to which existing Law School Admission Test item types and subtypes are designed to assess those skills, and (c) suggesting test specifications or new or refined item types and formats that could be developed in the future to assess any important skills that appear [by (a) and (...) (b)] to be measured in a limited or minimal way by the current LSAT. So far as can be determined, such systematic research using legal reasoning literature has never been previously conducted. The goal of this essay is to illustrate how Ebrahim Moosa's method of “contrapuntal reading” can be applied fruitfully to the Sunni hadith literature. My case study is the set of penalties (hudud) for illicit sex, which include flogging, stoning, and banishment. I propose a fresh reading of these sacred texts that brings to the fore the ethical dimension of Prophet Muhammad's conduct, especially his strong reluctance to apply these measures. I conclude by identifying four ethical problems that the (...) stoning penalty raises and suggest how the hadith literature can be read to argue against the validity of this specific punishment. Retractions of COVID-19 literature in both preprints and the peer-reviewed literature serve as a reminder that there are still challenging issues underlying the integrity of the biomedical literature. The risks to academia become larger when such retractions take place in high-ranking biomedical journals. In some cases, retractions result from unreliable or nonexistent data, an issue that could easily be avoided by having open data policies, but there have also been retractions due to oversight in peer review and (...) editorial verification. As COVID-19 continues to affect academics and societies around the world, failures in peer review might also constitute a public health risk. The effectiveness by which COVID-19 literature is corrected, including through retractions, depends on the stringency of measures in place to detect errors and to correct erroneous literature. In any academic discipline, published articles in respective journals represent "production units" of scientific knowledge, and bibliometric distributions reflect the patterns in such outputs across authors or "producers." Closely following the analysis approach used for similar studies in the economics and finance literature, we present the first study to examine whether there exists an empirical regularity in the bibliometric patterns of research productivity in the business ethics literature. Our results present strong evidence that there indeed exists a distinct (...) empirical regularity. It is the so-called Generalized Lotka's Law of scientific productivity pattern: the number of authors publishing ç papers is about Í /n c of those publishing one paper. We discuss the likely processes that underlie the productivity pattern postulated by the Generalized Lotka's Law. We find that the value of the exponent is equal to about 2.6 for the comprehensive bibliometric data across the two leading business ethics journals. The observed research productivity pattern in the business ethics area, a relatively young discipline, is interestingly very consistent with those found in much older, related business disciplines like economics, accounting, and finance.
