COVID-19 continues to dominate 2020 and is likely to be a feature of our lives for some time to come. Given this, how should health systems respond ethically to the persistent challenges of responding to the ongoing impact of the pandemic? Relatedly, what ethical values should underpin the resetting of health services after the initial wave, knowing that local spikes and further waves now seem inevitable? In this editorial, we outline some of the ethical challenges confronting those running health services (...) as they try to resume non-COVID-related services, and the downstream ethical implications these have for healthcare professionals’ day-to-day decision making. This is a phase of recovery, resumption and renewal; a form of reset for health services.1 This reset phase will define the ‘new normal' for healthcare delivery, and it offers an opportunity to reimagine and change services for the better. There are difficulties, however, healthcare systems are already weakened by austerity and the first wave of COVID-19 and remain under stress as the pandemic continues. The reset period is operating alongside, rather than at the end, of the pandemic and this creates difficult ethical choices. ### Balancing the greater good with individual care Pandemics—and public health emergencies more generally—reinforce approaches to ethics that emphasise or derive from the interests of communities, rather than those grounded in the claims of the autonomous individual. The response has been to draw on more public health focused ethics, ‘if demand outstrips the ability to deliver to existing standards, more strictly utilitarian considerations will have to be applied, and decisions about how to meet the individual's need will give way to decisions about how to maximise overall benefit’.2 Alongside this, effective …. Medical decisions for children are usually justified by the claim that they are in a child's best interests. More recently, following criticisms of the best interests standard, some advocate that the family's interests should influence medical decisions for children, although what is meant by family interests is often not made clear. I argue that at least two senses of family interests may be discerned. There is a ‘weak’ sense of family interests and a ‘strong’ sense. I contend that there are (...) problems with both approaches in making medical decisions for children but that the weak sense is more plausible. In response to scholarship which has shown that seventeenth-century Scottish scholasticism was influenced by John Duns Scotus (1265/66–1308), Jean-Pascal Anfray has argued that Scottish scholasticism was only indirectly influenced by Scotism, especially by Jesuit thinkers like Francisco Suárez (1548–1618), using the Aberdeen Doctor James Sibbald (1595–1647) and his theory of the body-soul composite as a litmus test. In reply to Anfray’s claims, this article undertakes three interconnected tasks. First, it renews calls for philosophical Scotism to be defined according to a (...) principles-based approach focusing on Scotus’s metaphysics of essence in contrast to a quasi-falsificationist approach. Second, it shows how Sibbald adopts the Scotist metaphysics of essence over the very different Suárezian metaphysics of essence. Third, it demonstrates how Sibbald endorses Scotus’s qualified pluralism in accounting for the body-soul composite. Sibbald thus turns out to be more directly Scotist (and less Suárezian) than first thought. (shrink)

In his response to an earlier paper of ours Anton Killin takes issue with a certain aspect of our definition of an antique. He agrees with our view that the concept of an antique is an adjectival one and is at least happy to grant that those elements of the definition that relate to age are correct. But he takes issue with the idea that technical excellence is a necessary condition for being an antique. In addition to this, he also (...) criticizes us for largely excluding art objects from our discussion. In this rejoinder we focus mainly on defending the technical excellence criterion. To explain how constitutions shape and are shaped by women's lives, the contributors to this volume examine constitutional cases pertaining to women in twelve countries. Analyzing jurisprudence about reproductive, sexual, familial, socio-economic, and democratic rights, they focus constructively on women's claims to equality, asking who makes these claims, what constitutional rights inform them, how they have evolved, what arguments work in defending them, and how they relate to other national issues. Their findings reveal significant similarities in outcomes and in reasoning (...) about women's constitutional rights in these twelve countries, challenging the tradition of distinguishing constitutional jurisprudence depending on whether the country has a written or unwritten constitution, subscribes to civil or common law, is a federal or unitary state, limits constitutional adjudication to the public domain, accords international norms binding or subject to incorporation force, or relies on a specialized or general court to adjudicate constitutional matters. The unpleasantness of pain motivates action. Hence many philosophers have doubted that it can be accounted for purely in terms of pain’s possession of indicative representational content. Instead, they have explained it in terms of subjects’ inclinations to stop their pains, or in terms of pain’s imperative content. I claim that such “noncognitivist” accounts fail to accommodate unpleasant pain’s reason-giving force. What is needed, I argue, is a view on which pains are unpleasant, motivate, and provide reasons in virtue of (...) possessing content that is indeed indicative, but also, crucially, evaluative. In this essay I examine a recent argument by Steven Weinberg that seeks to establish local quantum field theory as the only type of quantum theory in accord with the relevent evidence and satisfying two basic physical principles. I reconstruct the argument as a demonstrative induction and indicate it's role as a foil to the underdetermination argument in the debate over scientific realism.

Recent national and international debates on truth and reconciliation in Uganda have emphasized the importance of incorporating local-level mechanisms into a national transitional justice strategy. The Juba Peace Talks represented an opportunity to develop and articulate sufficient and just alternatives and complementary mechanisms to the international criminal model. The most commonly debated mechanism is the Acholi process known as mato oput (drinking the bitter root), a restorative justice approach to murder. Drawing on 2 months of research in nine internally displaced (...) persons’ camps in 2007, we examine local justice practices in the region of northern Uganda to consider their potential, promise and pitfalls to realizing a successful truth-telling process. We find that although local mechanisms could help facilitate reconciliation in the region, truth-telling is but one part of a conciliatory process complicated by a national context of fear and the complexity of the victim–perpetrator identity at the community level. These locally informed insights help move forward the debate on such mechanisms in Uganda and add useful insights into community processes in the field of transitional justice more generally. This essay considers the extent to which a concept of emergence can be associated with Effective Field Theories (EFTs). I suggest that such a concept can be characterized by microphysicalism and novelty underwritten by the elimination of degrees of freedom from a high-energy theory, and argue that this makes emergence in EFTs distinct from other concepts of emergence in physics that have appeared in the recent philosophical literature.

I defend externalism about color experiences and color thoughts, which I argue color objectivism requires. Externalists face the following question: would a subject's wearing inverting lenses eventually change the color content of, for instance, those visual experiences the subject reports with “red”? From the work of Ned Block, David Velleman, Paul Boghossian, Michael Tye, and Fiona Macpherson, I extract problems facing those who answer “Yes” and problems facing those who answer “No.” I show how these problems can be overcome, leaving (...) externalism available to the color objectivist. How do things come to stand for something other than themselves? An understanding of the ontology of relations allows for a compelling account of the action of signs. The Primacy of Semiosis is concerned with the ontology of relations and semiosis, the action of signs. Drawing upon the work of Gilles Deleuze, John Deely, and John Poinsot, Paul Bains focuses on the claim that relations are 'external' to their terms, and seeks to give an ontological account of this purported externality (...) of relations. Bains develops the proposition, first made in 1632 by John Poinsot (John of St. Thomas), that, ontologically, signs are relations whose whole being is in esse ad ('being-toward'). Furthermore, relations are found to be univocal in their being as relations. This univocity of being is antecedent to the division between 'ens rationis' and 'ens reale'. The ontology of relations Bains presents is thus neither mind-dependent nor mind-independent insofar as the rationale of the relation is concerned. The book includes chapters on Deleuze and Deely on relations, Jacob von Uexkull and Heidegger on Umwelten (self-worlds), Maturana and Varela on Autopoiesis. It provides a form of vicarious causality, by way of the scholastic doctrine of the 'species', that complements the emerging school of 'object oriented ontology'. The Primacy of Semiosis provides a semiotic that subverts the opposition between realism and idealism; one in which what have been called 'nature' and 'culture' interpenetrate in an expanding collective of human and non-human. Bains' work promises to be a touchstone for semiotic discussion for years to come. (shrink)

Radical Ontic Structural Realism (ROSR) claims that structure exists independently of objects that may instantiate it. Critics of ROSR contend that this claim is conceptually incoherent, insofar as, (i) it entails there can be relations without relata, and (ii) there is a conceptual dependence between relations and relata. In this essay I suggest that (ii) is motivated by a set-theoretic formulation of structure, and that adopting a category-theoretic formulation may provide ROSR with more support. In particular, I consider how a (...) category-theoretic formulation of structure can be developed that denies (ii), and can be made to do work in the context of formulating theories in physics. Pain, crucially, is unpleasant and motivational. It can be awful; and it drives us to action, e.g. to take our weight off a sprained ankle. But what is the relationship between pain and those two features? And in virtue of what does pain have them? Addressing these questions, Colin Klein and Richard J. Hall have recently developed the idea that pains are, at least partly, experiential commands—to stop placing your weight on your ankle, for example. In this paper, I reject (...) their accounts. Against Klein, I use dissociation cases to argue that possession of ‘imperative content’ cannot wholly constitute pain. Against them both, I further claim that possession of such content cannot even constitute pain’s unpleasant, motivational aspect. For, even if it were possible to specify the relevant imperative content—which is far from clear—the idea of a command cannot bear the explanatory weight Klein and Hall place on it. (shrink)

Lawrence Kohlberg's Approach to Moral Education presents what the late Lawrence Kohlberg regarded as the definitive statement of his educational theory. Addressing the sociology and social psychology of schooling, the authors propose that school culture become the center of moral education and research. They discuss how schools can develop as just and cohesive communities by involving students in democracy, and they focus on the moral decisions teachers and students face as they democratically resolve problems. As the authors put (...) it: "...we propose an educational renewal of our democratic society.... We have attempted to establish schools that do more than just teach about democratic citizenship, that are themselves democratic societies.". (shrink)

An effective field theory is a theory of the dynamics of a physical system at energies small compared to a given cut-off. Low-energy states with respect to this cut-off are effectively independent of states at high energies; hence one may study the low-energy dynamics without the need for a detailed description of the high-energy dynamics. Many authors have suggested that, because of the essential role the cut-off plays in the standard method of constructing an EFT, an appropriate interpretation of an (...) EFT requires a realistic interpretation of the cut-off. For some, this suggests an ontology of "quasi-autonomous domains" ; for others, it suggests an ontology in which space is discrete and finite ; and for yet others, it suggests that EFTs engage in idealizations and are inherently approximate. I argue that these interpretations are not forced upon us, in so far as there is an alternative to the Wilsonian method for constructing an EFT that does not explicitly employ a cut-off. (shrink)

I will argue that there are difficulties with the application of the four principles approach to incompetent children. The most important principle – respect for autonomy – is not directly applicable to incompetent children and the most appropriate modification of the principle for them is not clear. The principle of beneficence – that one should act in the child’s interests – is complicated by difficulties in assessing what a child’s interests are and to which standard of interests those choosing for (...) children should be held. Motivated by examples from general relativity and Newtonian gravitation, this essay attempts to distinguish between the dynamical structure associated with a theory in physics, and its kinematical structure. This enables a distinction to be made between a structural realist interpretation of a theory based on its dynamical structure, and a structural realist interpretation of spacetime, as described by a theory, based on its kinematical structure. I offer category-theoretic formulations of dynamical and kinematical structure and indicate the extent to which such (...) formulations deflect recent criticism of the radical ontic structural realist's conception of structure as "relations devoid of relata". A philosophical essay under this title faces severe rhetorical challenges. New accounts of the good life regularly and rapidly turn out to be variations of old ones, subject to a predictable range of decisive objections. Attempts to meet those objections with improved accounts regularly and rapidly lead to a familiar impasse — that while a life of contemplation, or epicurean contentment, or stoic indifference, or religious ecstasy, or creative rebellion, or self-actualization, or many another thing might count as a good (...) life, none of them can plausibly be identified with the good life, or the best life. Given the long history of that impasse, it seems futile to offer yet another candidate for the genus “good life” as if that candidate might be new, or philosophically defensible. And given the weariness, irony, and self-deprecation expected of a philosopher in such an impasse, it is difficult for any substantive proposal on this topic to avoid seeming pretentious. (shrink)

This essay touches on a number of topics in philosophy of quantum field theory from the point of view of the LSZ asymptotic approach to scattering theory. First, particle/field duality is seen to be a property of free field theory and not of interacting QFT. Second, it is demonstrated how LSZ side-steps the implications of Haag's theorem. Finally, a recent argument due to Redhead, Malament and Arageorgis against the concept of localized particle states is addressed. Briefly, the argument observes that (...) the Reeh-Schlieder theorem entails that correlations between spacelike separated vacuum expectation values of local field operators are always present, and this, according to the above authors, dictates against the notion of a localized particle state. I claim that this moral is excessive and that a coherent notion of localized particles is given by the LSZ approach. The underlying moral to be drawn from this analysis is that questions concerning the ontology of interacting QFT cannot be appropriately addressed if one restricts oneself to the free theory. Patients who are dying of cancer usually give up eating and then stop drinking. This raises ethical dilemmas about providing nutritional support and fluid replacement. The decision-making process should be based on a knowledge of the risks and benefits of giving or withholding treatments. There is no clear evidence that increased nutritional support or fluid therapy alters comfort, mental status or survival of patients who are dying. Rarely, subcutaneous fluid administration in the dying patient may be justified if the family (...) remain distressed despite due consideration of the lack of medical benefit versus the risks. Some cancer patients who are not imminently dying become dehydrated from reversible conditions such as hypercalcaemia. This may mimic the effects of advanced cancer. These conditions should be sought and fluid replacement therapy should be given along with the specific treatments for the condition. (shrink)

Perceptualists say that having a pain in a body part consists in perceiving the part as instantiating some property. I argue that perceptualism makes better sense of the connections between pain location and the experiences undergone by people in pain than three alternative accounts that dispense with perception. Turning to fellow perceptualists, I also reject ways in which David Armstrong and Michael Tye understand and motivate perceptualism, and I propose an alternative interpretation, one that vitiates a pair of objections—due to (...) John Hyman—concerning the meaning of ‘Amy has a pain in her foot’ and the idea of bodily sensitivity. Perceptualism, I conclude, remains our best account of the location of pains. (shrink)

In this outstanding introduction, Lawrence Shapiro sets out the central themes and debates surrounding embodied cognition, explaining and assessing the work of many of the key figures in the field, including George Lakoff, Alva Noë, Andy Clark, and Arthur Glenberg. We report specific heat and μSR measurements on Th and/or B substituted UBe13. The specific heat data show that either Th or B substitution reduces the Kondo temperature TK and increases the entropy at the superconducting transition by almost 20%, indicating an enhanced density of states. However, whereas μSR shows clear evidence for magnetic correlations for Th substitutions, no magnetism is observed for B substitutions. The enhanced specific heat jump in the B-substituted material is associated with a change in the (...) superconducting properties as TK is reduced. (shrink)

There is much more said in the Critique of Pure Reason about the relationship between God and purposiveness than what is found in Kant's analysis of the physico-theological argument. The ‘Wise Author of Nature’ is central to his analysis of regulative principles in the ‘Appendix to the Transcendental Dialectic’ and also appears in the ‘Canon’, first with regards to the Highest Good and then again in relation to our theoretical use of purposiveness. This paper will begin with a brief discussion (...) of the physico-theological argument before moving on to the Appendix and the Canon.
