Emotional AI is an emerging technology used to make probabilistic predictions about the emotional states of people using data sources, such as facial (micro)-movements, body language, vocal tone or the choice of words. The performance of such systems is heavily debated and so are the underlying scientific methods that serve as the basis for many such technologies. In this article I will engage with this new technology, and with the debates and literature that surround it. Working at the intersection of (...) criminology, policing, surveillance and the study of emotional AI this paper explores and offers a framework of understanding the various issues that these technologies present particularly to liberal democracies. I argue that these technologies should not be deployed within public spaces because there is only a very weak evidence-base as to their effectiveness in a policing and security context, and even more importantly represent a major intrusion to people’s private lives and also represent a worrying extension of policing power because of the possibility that intentions and attitudes may be inferred. Further to this, the danger in the use of such invasive surveillance for the purpose of policing and crime prevention in urban spaces is that it potentially leads to a highly regulated and control-oriented society. I argue that emotion recognition has severe impacts on the right to the city by not only undertaking surveillance of existing situations but also making inferences and probabilistic predictions about future events as well as emotions and intentions. In the 1980s, philosophical, historical and social studies of science underwent a change which later evolved into a turn to practice. Analysts of science were asked to pay attention to scientific practices in meticulous detail and along multiple dimensions, including the material, social and psychological. Following this turn, the interest in scientific practices continued to increase and had an indelible influence in the various fields of science studies. No doubt, the practice turn changed our conceptions and approaches of science, but (...) what did it really teach us? What does it mean to study scientific practices? What are the general lessons, implications, and new challenges? This volume explores questions about the practice turn using both case studies and theoretical analysis. The case studies examine empirical and mathematical sciences, including the engineering sciences. The volume promotes interactions between acknowledged experts from different, often thought of as conflicting, orientations. It presents contributions in conjunction with critical commentaries that put the theses and assumptions of the former in perspective. Overall, the book offers a unique and diverse range of perspectives on the meanings, methods, lessons, and challenges associated with the practice turn. (shrink)

A large number of legal rules create an obligation to prevent, repair or otherwise mitigate damage to human health or the environment. Many of these rules require that a legally relevant causal relation between human behaviour and the damage at issue is established, and in the establishment of causal relations of this kind scientific information is often pressed into service. This thesis examines this specifically legal use of scientific information. It shows that many legally relevant causal relations cannot be established (...) in this way. It also shows that the legal strategy for dealing with epistemic difficulties by relaxing the standard of proof is of limited value in tackling this problem. Consequently, the legal rules focused upon are less efficient tools for combating damage to human health and the environment than their appearances suggest. Other legal means to achieve this aim should therefore be considered. The thesis begins by presenting a framework which can be used to solve some important problems with communication and the division of labour that arise when scientific information is used to answer legal questions. This framework recognizes both epistemological and ontological differences between law and science. The latter are differences between the kinds of entity which are relevant in distinct theoretical contexts; the former, by contrast, are differences between applicable standards of proof. In subsequent parts of the thesis this framework shapes the discussion of the question: To what extent can legally relevant causal relations, involving legally significant entities, be established through the application of scientific information about other, scientifically relevant entities and legal standards of proof. The thesis concludes with a discussion of some of the ways in which the legal regulation could, potentially, be adapted, so as to counteract damage to human health and the environment more efficiently. Disputes about how to understand intersectional relations often pivot around the tension between separateness and inseparability, where some scholars emphasize the need to separate between different intersectional categories while others claim they are inseparable. In this article the author takes issue with the either/or thinking that underpins an unnecessary and unproductive polarization in the debate over the in/separability of intersectional categories. Drawing on Roy Bhaskar’s dialectical critical realist philosophy, the author argues that we can think of intersectional categories as well (...) as different ontological levels as both distinct and unified and elaborates on the issue of how significance of the dialectical notion of unity-in-difference for intersectional studies. As part of the argument the author addresses the issue of what it actually means for something to be distinct or separate as opposed to inseparable or unified with something else, demonstrating that lack of clarity about this is at the heart of polarized arguments about separateness versus inseparability in intersectionality theory. In this final response, the author reflects on the recent European elections that favored Euro-skeptic right-wing parties all over Europe. Their Far-Right views blame ‘immigrants’ for the current problems in Europe and challenge institutionalized solidarity. The response, firstly, attacks the dominating discourses in the media which obscure that 75 % of the voters embrace the status quo of free movement and regional citizenship within the EU. Secondly, this final reply connects the move to Far-Right views to general feelings of insecurity (...) that increased in the aftermath of the 2008 financial crisis. Current scape-goat policies regarding immigrants can be traced to strategies of neighborliness, which in turn reflect deeper social and economic anxieties caused by the withdrawal of state services and the logic of neo-liberal capitalism. This article examines the recent transformations of the Italian welfare state from a familist welfare model to what I term transnational market familism. In this model, families buy in care labour, commonly provided by migrant workers. There is now a growing literature exploring both the transformations of the Italian welfare model and the experiences of migrant workers providing care in Italy. However, what has been overlooked in the current literature is the ethical aspect of this model of welfare provision, which (...) is part of the transnational political economy of care. The article analyses the ethical implications of the migrant-in-the-family model, which transforms the care relationship between the caregiver and care receiver into a complex relationship between the family member organising care, the migrant caregiver and the dependent care receiver. The context of such welfare provision is transnational. Examining this care triangle, I draw on care ethics and individualization perspective for an analysis of how social policies safeguard, or overlook, human interaction and care relationships in the context of global hierarchies. The article draws on ethnographic data gathered in Naples, Italy, during 2004–2005, including interviews with Neapolitan employers and elderly care-receivers, interviews with migrant workers, as well as participant observations. The aim of this article is to present the voyages made in the second half of the 14th century by Queen Jadwiga of Poland, the wife of the first Jagiellonian ruler on the Polish throne. Ladislaus Jagiełło ruled over a vast area of the Polish and Lithuanian states, like other European monarchs, through an itinerary system around his realm. Jadwiga accompanied her husband in the performance of his monarchical duties, and sometimes replaced him, but her trips were not only political (...) or representative. The queen also traveled, perhaps even primarily, for family and private functions. During her travels, she most often visited the royal lands of Lesser Poland, and less often went to other regions of the country or beyond its borders. The sources used in this research are narrative and, it should be noted, do not come directly from the period of Jadwiga’s life. These are the Annals of Jan Długosz, written several decades later, which provide information about the time and place of the journeys made by the queen. However, they make it possible to learn – to a far greater extent than other sources – about the circumstances which induced the Queen consort Jagiełło to leave the walls of the Wawel Castle. The study of the subject is also possible thanks to the itinerary of Queen Jadwiga, compiled by Grażyna Rutkowska, which enables analysis beyond the findings concerning the timetable of these trips and corrects the coverage by the Polish chronicler. The literary division of royal travels into “small” and “great” allows us to see the difference not only in territorial range, but above all in the nature and purpose of travels made by the Queen. Jadwiga liked staying in the royal estates of Małopolska using the time for recreation, but when necessary, she also made the effort to travel to more distant towns to join in the implementation of state policy. W niepodległej Polsce kontynuowano dyskusje o kierunkach rozwoju narodowej kultury, zarówno w kontekście niezależnego, autonomicznego życia żydowskiego, jak i relacji między kulturą polską, kulturą dominująca a peryferyjną w kontekście państwa kulturą żydowską. Na przykładzie otwartego (...) 20 maja 1928 roku Salonu Wiosennego Żydowskiego Towarzystwa Krzewienia Sztuk Pięknych widzimy, że polska krytyka artystyczna nie tylko dopiero w połowie lat dwudziestych XX wielu. dostrzegła istnienie sztuki żydowskiej, ale i nie zdawała sobie sprawy ze znaczenia ideowego konstruktu sztuki żydowskiej dla żydowskiej społeczności. Równie niewielu krytyków zdawało sobie sprawę z doniosłości istnienia odrębnej, żydowskiej instytucji artystycznej, jaką było ŻTKSP i roli Towarzystwa w rozwoju żydowskiego życia artystycznego. Background: Nurses and physicians in nephrology settings provide care for patients with end-stage kidney disease receiving hemodialysis treatment along a complex illness trajectory. Aim: The aim was to explore physicians’ and nurses’ perspectives on the trajectories toward the end of life involving decisions regarding hemodialysis withdrawal for patients with end-stage kidney disease. Research design and participants: A qualitative research approach was used. Four mixed focus group interviews were conducted with renal physicians (5) and nurses (17) in Sweden. Qualitative content analysis (...) was used to analyse data. Ethical considerations: Ethical approval was obtained (Dnr 2014/304-31). Findings and discussion: Findings illuminated multi-faceted, intertwined processes encompassing healthcare professionals, patients, and family members. The analysis resulted in four themes: Complexities of initiating end-of-life conversations, Genuine attentiveness to the patient’s decision-making process, The challenge awaiting the family members’ processes, and Negotiating different professional responsibilities. Findings showed complexities and challenges when striving to provide good, ethical care which are related to beneficence, nonmaleficence, and self-determination, and which can give rise to moral distress. Conclusion: There are ethical challenges and strains in the dialysis context that healthcare professionals may not always be prepared for. Supporting healthcare professionals in not allowing complexities to hinder the patient’s possibilities for shared decision-making seems important. An open and continual communication, including family meetings, from dialysis initiation could serve to make conversations involving decisions about hemodialysis withdrawal a more natural routine, as well as build up a relationship of trust necessary for the advance care planning about the end of life. Healthcare professionals should also receive support in ethical reasoning to meet these challenges and handle potential moral distress in the dialysis context. (shrink)

It has long been taboo for feminist theorists to draw on notions of nature in their conceptualizations of gender relations. Objecting to this nature-phobia, I argue that we need to anchor our social theories in explicit notions of the natural necessities on which any social structure draws and must ultimately accommodate. Such a reference to a ‘natural ontological order’ is needed not only for explaining how power structures can get a hold over people, but also for specifying the ways in (...) which the natural necessities impose absolute constraints on the forms that oppressive structures can take, ultimately creating a conatus to getting rid of the oppressive structure. In the human-social realm a crucial aspect of nature is those basic human needs that any society must meet in order to reproduce itself. One such human need that has been theoretically overlooked, although often implicitly assumed, is the need for love. Drawing on Anna G. Jónasdóttir's theory of ‘love power’, I elaborate on the contradictions inherent in the power that men acquire by exploiting women's love, arguing that these contradictions can be understood only with reference to natural necessities. The present study examined the effects of mindfulness training on attention regulation in university students and whether the potential benefits of implementation are influenced by the yoga component of mindfulness-based interventions (MBIs) and/or by MBI homework practice. In a non-randomized trial with pre- and post-assessments, n = 180 university students were allocated to either mindfulness training (experimental groups), awareness activities (active control group), or no training (passive control group). Mindfulness was taught through two MBIs, one including yoga and the other (...) excluding yoga. Attention regulation was operationalized via behavioral indicators, namely sustained attention, cognitive flexibility, cognitive inhibition, and data-driven information processing. With the exception of speed in a cognitive flexibility task, the results indicated no systematic or differential advantage arising from mindfulness training, with or without yoga, regarding the aspects of attention regulation. There was no consistent influence of homework quantity or quality. The implications for mindfulness training in academic contexts are discussed. (shrink)

In this chapter it is argued that Mary Wollstonecraft’s political is best characterized as ‘feminist republicanism’. Wollstonecraft’s feminism challenges republicanism from within. The republican movement used the language of rights and liberty in arguments for popular sovereignty and against despotic and aristocratic privilege. Wollstonecraft articulated her feminism within and against this movement, which argued for the rights of all while taking for granted that ‘all’ is properly represented by white men with property. Her feminism requires the dismantling of all hierarchies, (...) for the sake of freedom and virtue. Many have read Wollstonecraft as a liberal. If by liberal one simply means a philosophy based on natural rights and a principle of individual liberty, then Wollstonecraft was a liberal, but we do not gain any understanding of the particulars of her thinking in that way. The republican conception of personal freedom – independence or freedom from arbitrary rule – is an organising principle in Wollstonecraft’s thought. This conception of freedom feeds her feminist critique of republicanism: the sexism of republicanism is found in the definitional association of liberty and virtue with maleness. Of equal importance is her critical take on the civic humanist discourse of virtue as a way of living freely in society. Virtue is not a set of rules; it is the learnt habit of a resolute and independent personal character. This in turn requires that a person receives rational education and is treated with equal respect. Women are deliberately kept out of this sphere of moral progress. When Wollstonecraft ironically notes that ‘truth, fortitude and humanity’ are seen to be ‘manly morals’ she attacks, from within, the republican language that makes virtue into a male domain. This paper deals with calibration in scientific practices which investigate relatively well-understood natural phenomena by means of already standardized instrumental devices. Calibration is a crucial topic, since it conditions the reliability of instrumental procedures in science. Yet although important, calibration is a relatively neglected topic. We think more attention should be devoted to calibration. The paper attempts to take a step in this direction. The aims are two-fold: (1) to characterize calibration in a relatively simple kind of scientific practices; (2) (...) to provide conceptual and taxonomic tools of broader scope that help to get a better understanding of calibration in more complex cases and other kinds of scientific practices. For this purpose, we first provide indications for why a conceptual framework is needed. Second, a bibliographic survey of works dealing with calibration is attempted. Third, we introduce different tools to enable a better understanding of calibration. Fourth, we turn to the elaboration of what we call a “simple exemplar” of calibration, illustrated through the case of the calibration of an equal-arm balance. Fifth, the tools previously introduced, and the framework of the simple exemplar, are applied to a more complex case of calibration: calibration procedures in X-ray experiments. This serves to show the work accomplished by the simple exemplar and to emphasize features of more complex cases of calibration. Eventually, we revisit and specify the nature, status, scope and value of the proposed framework. (shrink)

The biofuel boom is placing enormous demands on existing cropping systems, with the most crucial consequences in the agri-food sector. The biofuel industry is responding by initiating private governance and certification. The Roundtable on Sustainable Palm Oil (RSPO) and the Cramer Commission, among others, have formulated criteria on “sustainable” biofuel production and processing. This article explores the legitimacy of private governance and certification by the biofuel industry, highlighting opportunities and challenges. It argues that the concept of output based legitimacy is (...) problematic in the case of biofuel as long as no consensus or commonly agreed “best” solution has been established on what sustainable biofuel production is. Furthermore, it shows that the private governance initiatives analyzed fail to adequately include actors from developing countries. Finally, the article argues that we need mechanisms for control and accountability in order to guarantee that the political output of biofuel certification serves the common welfare. (shrink)

L'article propose une analyse comparative des positions de Popper et de Kuhn sur quatre points liés : la comparaison des « cadres théoriques » ou des « paradigmes scientifiques » ; le pouvoir contraignant que sont susceptibles d'avoir les arguments invoqués dans les discussions critiques ; les éléments qui, en fin de compte, pèsent ou doivent peser sur les praticiens lorsqu'il s'agit d'élire un cadre théorique au détriment d'un autre ; et enfin, la conception qu'ont chacun des deux auteurs de (...) ce que Kuhn a nommé la « science normale ». On commence par discuter en détails les comptes-rendus dans lesquels Popper explique pourquoi les choix scientifiques de Galilée et de Kepler sont conformes à la méthodologie falsificationniste. On montre de là, premièrement, qu'à suivre à la lettre ces comptes-rendus, il faut conclure que les données expérimentales non problématiques – les énoncés de base unanimement acceptés – ne suffisent pas à elles seules à imposer en droit la falsification empirique (puisque sur la base des mêmes mesures de Tycho Brahé, Kepler a eu raison d'admettre que l'hypothèse des orbites circulaires était empiriquement réfutée, tandis que Galilée a eu raison d'admettre le contraire). On montre alors, deuxièmement, qu'au-delà des différences importantes entre Popper et Kuhn au niveau des lexiques et de l'idéal de scientificité, la méthodologie poppérienne, bien qu'elle se revendique « logique », ne donne concrètement pas plus que la conception kuhnienne pourtant si souvent stigmatisée comme « sociologique », lorsqu'il s'agit d'indiquer ce qu'un bon scientifique devrait faire, que ce soit en période « révolutionnaire » ou en période de « science normale ». Our article examines how journalistic reports and online comments have made sense of computational politics. It treats the discourse around data-driven campaigns as its object of analysis and codifies four main perspectives that have structured the debates about the use of large data sets and data analytics in elections. We study American, British, and German sources on the 2016 United States presidential election, the 2017 United Kingdom general election, and the 2017 German federal election. There, groups of speakers maneuvered between (...) enthusiastic, skeptical, agnostic, or admonitory stances and so cannot be clearly mapped onto these four discursive positions. Coming along with the inconsistent accounts, public sensemaking was marked by an atmosphere of speculation about the substance and effects of computational politics. We conclude that this equivocality helped journalists and commentators to sideline prior reporting on the issue in order to repeatedly rediscover the practices they had already covered. (shrink)

Запропоновані комплексні заходи для формування регіональної концепції якості юридичних послуг; упровадження в програму підготовки сучасного юриста спеціальних навчальних курсів у сфері маркетингу, менеджменту, зв'язків із громадськістю; розвитку клієнтоорієнтованих технологій сервісного обслуговування, розробки регіональної програми збереження молодих юридичних кадрів.

In this article the philosophy of Merleau-Ponty is considered in the methodological aspect as an approach to the study of the problem of meaning in the visual arts. The author's hypothesis is that the ideas of Merleau-Ponty can serve as a philosophical justification for the aesthetic theory of tropos in the visual arts. The author of the article comes to the conclusion that the meta-aesthetic function of painting, grounded by the philosopher, was not a consequence of her representative nature, but (...) a form of actualization of unrepresentative aspects of art in the artistic space of the twentieth century. A careful reading of the late works of Merleau-Ponty convinces us that his phenomenology of the artistic language allows us not to confine ourselves to semiotic models in the study of the problem of language in art, transforming it into a problem of the author's style, which is considered by philosopher on the basis of the diacritical concept of meaning as difference, formed in the phenomenology of Merleau-Ponty under the influence of Saussure's theory. Unlike the semiotic approach to the communicative function of the work, which is secondary in art, the diacritical concept of meaning by Merleau-Ponty is oriented toward explication of the creative function of the work, which leads to semantic changes. The article focuses on the Merlot-Ponty's concept of perceptual meaning. Art as a privileged way of manifesting of perceptual meaning is based on the mechanism of the dual vision of "fact" and "essence", revealed by Merleau-Ponty, in which "fact" stands in the status of norm, and "essence" is deviation from the norm, which leads to the formation of meaning. The author of the article traces the correlation of the positions of rhetorical theory, according to which the ratio of the norm and the deviation from it forms the structure of the rhetorical figure and the mechanism of the generation of the indirect meaning, and the diacritical concept of meaning as the difference proposed by Merleau-Ponty, which indicates the relevance of it as a theoretical tool for studying the phenomenon of tropos in art. We conducted two eye-tracking experiments investigating the processing of the Mandarin reflexive ziji in order to tease apart structurally constrained accounts from standard cue-based accounts of memory retrieval. In both experiments, we tested whether structurally inaccessible distractors that fulfill the animacy requirement of ziji influence processing times at the reflexive. In Experiment 1, we manipulated animacy of the antecedent and a structurally inaccessible distractor intervening between the antecedent and the reflexive. In conditions where the accessible antecedent mismatched the animacy cue, (...) we found inhibitory interference whereas in antecedent-match conditions, no effect of the distractor was observed. In Experiment 2, we tested only antecedent-match configurations and manipulated locality of the reflexive-antecedent binding (Mandarin allows non-local binding). Participants were asked to hold three distractors (animate vs. inanimate nouns) in memory while reading the target sentence. We found slower reading times when animate distractors were held in memory (inhibitory interference). Moreover, we replicated the locality effect reported in previous studies. These results are incompatible with structure-based accounts. However, the cue-based ACT-R model of Lewis and Vasishth ( 2005 ) cannot explain the observed pattern either. We therefore extend the original ACT-R model and show how this model not only explains the data presented in this article, but is also able to account for previously unexplained patterns in the literature on reflexive processing. I argue along the following lines: For Wollstonecraft, liberty is independence in two different spheres, one presupposing the other. On the one hand, liberty is independence in relation to others, in the sense of not being vulnerable to their whim or arbitrary will. Call this social, or political, liberty. For liberty understood in this way, infringements do not require individual instances of interfering. Liberty is lost in unequal relationships, through dependence on the goodwill of a master. In addition, liberty is (...) independence of mind, a state I am in when I trust my own reasoned judgement above any other authority. Call this moral liberty. Moral liberty needs social liberty. In other words, to the extent I am subject to the whim of others, I am not in a position to be guided by my own judgement. Moral liberty is one of two aspects of virtue: a disposition to independent deliberation according to reason. As such, virtue is a habit of mind. The second aspect of virtue is universal benevolence as its action guiding principle. This is how liberty, equality, and virtue fit together. Social liberty, understood as independence in relation to others, necessarily coexist with equality, and is necessary for moral liberty, the habit of mind that makes up one aspect of virtue, as well as for universal benevolence as virtue’s action guiding principle. This triad explains her views on property, on sex equality, and also on legitimate government. My second line of argument is that according to Wollstonecraft, we have a duty to be virtuous. Virtue is the main object of human life. But since virtue, in both its aspects, needs social liberty and since liberty is the birthright of man, the duty is conditioned on the right. The foundation for the triad of liberty, equality, and virtue is a theory of rights. The basis for the discussion of virtue is the right to the conditions necessary for its realization. The duty is conditioned on the right to liberty. (shrink)

Against influential strands of feminist theory, I argue that there is nothing essentialist or homogenising about the category ‘women’. I show that both intersectional claims that it is impossible to separate out the ‘woman part’ of women, and deconstructionist contentions that the category ‘women’ is a fiction, rest on untenable meta-theoretical assumptions. I posit that a more fruitful way of approaching this disputed category is to treat it as an abstraction. Drawing on the philosophical framework of critical realism I elucidate (...) the nature of the vital and inevitable process of abstraction, as a means of finding a way out of the theoretical and methodological impasse that the ‘ban’ on the category ‘women’ has caused. Contrary to many contemporary feminist theorists, I contend that, although the category ‘women’ does not reflect the whole reality of concrete and particular women, it nevertheless refers to something real, namely the structural position as woman.
