The two purposes of this essay. The general philosophical problem with most versions of social libertarianism and how this essay will proceed. The specific problem with liberty explained by a thought-experiment. The positive and abstract theory of interpersonal liberty-in-itself as ‘the absence of interpersonal initiated constraints on want-satisfaction’, for short ‘no initiated impositions’. The individualistic liberty-maximisation theory solves the problems of clashes, defences, and rectifications without entailing interpersonal utility comparisons or libertarian consequentialism. The practical implications of instantiating liberty: three rules (...) of liberty-in-practice, 1) initial ultimate control of one’s body, 2) initial ultimate control of one’s used resources, 3) consensual interpersonal interactions and resource transfers. These rules are economically efficient and maximise general want-satisfaction. Private property and legal remedies are additional practical institutional aspects, but to which ‘initiated impositions’ then apply prima facie. Libertarian law is often mistaken for complete libertarianism. Moral explanations are a separate issue. The three main moral theories imply libertarianism, but it can be morally posited independently of them. Critical rationalism and its application. No empirical or argumentative support for theories. An important ambiguity with ‘justification’. How the epistemology applies to the theory of liberty and its application but remains separable in principle. Sacrifice haunts the Phaedo. In this article, I argue that the mise-en-scène of the death scene of the Phaedo, as well as other sacrificial elements in the background of the dialogue, creates a nexus that positively integrates the birth, philosophical practice, and death of Socrates into the ritualized rhythm of the life of the city of Athens. A close reading of the death scene presented as a synopsis with Walter Burkert’s well-known analysis of Greek sacrifice reveals convergences and divergences between (...) the Phaedo and Greek sacrificial practice. Socrates appears as a willing victim who accepts the city’s sacrificial practice while remaining on his own terms. (shrink)

Epistemology is often a problem for libertarianism. Many libertarian texts assume that they need to do more than explain and defend the libertarian conjecture. Instead, they try to offer epistemological support for it (whether empirically or morally); which falsificationism and, more broadly, critical rationalism explains is not possible. Moreover, they often mistake this attempt at support for an explanation of libertarianism (which ought to include an abstract theory of liberty and how it relates to liberty in practice). Therefore, when a (...) criticism of falsificationism appears on a libertarian website it seems useful to reply to it (even though no discussion of libertarianism itself is involved). (shrink)

This volume presents political phenomenology as a new specialty in western philosophical and political thought that is post-classical, post-Machiavellian, and post-behavioral. It draws on history and sets the agenda for future explorations of political issues. It discloses crossroads between ethics and politics and explores border-crossing issues. All the essays in this volume challenge existing ideas of politics significantly. As such they open new ways for further explorations BY future generations of phenomenologists and non-phenomenologists alike. “Critical-Rationalist Libertarianism” (CRL) was replied to in “Libertarianism Without Argument” (the reply). Various points in that text are here given responses. Both critical rationalism and how it applies to libertarianism are elucidated and elaborated. This response will proceed by quoting the reply where relevant (virtually all of it) and then responding immediately after the quotations, following the order of the reply’s very brief “critique” (605 words).

Peter Singer’s famous and influential article is criticised in three main ways that can be considered libertarian, although many non-libertarians could also accept them: 1) the relevant moral principle is more plausibly about upholding an implicit contract rather than globalising a moral intuition that had local evolutionary origins; 2) its principle of the immorality of not stopping bad things is paradoxical, as it overlooks the converse aspect that would be the positive morality of not starting bad things and also thereby (...) conceptually eliminates innocence; and 3) free markets—especially international free trade—have been cogently explained to be the real solution to the global “major evils” of “poverty” and “pollution”, while “overpopulation” does not exist in free-market frameworks; hence charity is a relatively minor alleviant to the problem of insufficiently free markets. On the assumption of personhood, it is explained how there need be no overall inflicted harm and no proactive killing with abortion and infanticide. This starts with an attached-adult analogy and transitions to dealing directly with the issues. Various well-known criticisms are answered throughout. 3. There is then a more-abstract explanation of how it is paradoxical to assume a duty to do more than avoid inflicting overall harm (...) and, instead, positively benefit. A putative counterexample is explained away. 4. A positive theory of intellectual personhood is defended in principle, but not made precise, which is sufficient to be practical. The greater moral value of intellectual-personhood is defended. An important putative reductio of the potential-personhood argument is refuted. 5. To explain the correct libertarian approach to immigration, a thought-experiment posits a minimal-state libertarian UK and then the introduction of several relevant anti-libertarian policies with their increasingly disastrous effects. It is argued that the reverse of these imagined policies, as far as is politically possible, must be the correct way forward. This framing is intended to counter the tendency for many articles to misapply libertarian principles to the current messy situation on the mistaken assumption that a state need only stop (...) interfering without rectifying or adjusting for its previous interferences. The relevant parts of various open-border texts are then criticised in light of this and for other errors, in particular for overlooking the likely huge scale of immigration as indicated by Gallup surveys. Additional criticisms are addressed in footnotes throughout. The conclusion outlines three broad options on immigration and suggests that directionally-libertarian policies are both more libertarian and practical than having states open their borders. This paper argues that a key lesson of the GFC of 2008-9 is that our “silo” approach to the disciplines of accounting, finance, and economics (AFE) has not equipped students to deal with complex real world problems such as global financial crises. Such real world problems are interdisciplinary in their causes, effects, and solutions. The paper discusses elements of each of the AFE disciplines that are essential for understanding the GFC, and why courses in economics and finance that seek to (...) address the GFC as a topic need to integrate ideas from these three disciplines. A problem-based learning (PBL) approach is offered as a way forward, through at least one capstone course in a business/commerce degree that brings together the strands from a range of commerce/business disciplines in a case study approach. The strong Scottish Enlightenment interest in science created a market in Edinburgh for information about this subject, and Smith responded by providing a course that included the history of astronomy. A key part was a theory of theorizing or system building, with a system identified as an ‘imaginary machine’ invented to provide a coherent pattern of cause and effect in phenomena. His major works presented systems on this model in ethics and economics. WN's free‐enterprise system was foreshadowed in a third (...) course given at Edinburgh on jurisprudence, in which Smith traced the development of law, and argued that humanity could evolve from barbarism to opulence, through enjoying peace, moderate taxes, also minimal justice, and reliance on the natural course of things. A new translation of Aristotle's classic work on the natural sciences.

The “free world” was the political rhetoric used during the Cold War in contrast to the “communist” countries. However, the “free world” was manifestly never free: the state considerably interfered with people in their persons and their property. And the “communist” countries were manifestly never communist in the Marxist sense: there was no common ownership of the means of production with the absence of social classes, money, and the state. It would have been more accurate to call them the “authoritarian (...) world” and the “totalitarian world”. Today the “free world” is sometimes still used, but Western countries remain authoritarian in terms of taxation and restrictive legislation. The, by implication, “unfree world” is largely only somewhat more authoritarian. Why does this continuing authoritarianism exist in the West? (shrink)

Two distinct problems of objectivity in moral theory are that of reference and truth and that of justification. These questions are often run together. However, it is possible to discuss the two questions separately. A defense is offered of moral ascriptions and moral properties, in opposition to the proposals of Mackie and Harman. But the thin or minimal defense of moral ascriptions leaves the second problem of objectivity unaddressed. Further argumentation leads to a proposal that claims limited moral objectivity.
