Rather than as a giving of permission to someone to transgress one’s bodily boundaries, I argue for defining sexual consent as feeling-with one’s sexual partner. Dominant approaches to consent within feminist philosophy have failed to capture the intercorporeal character of erotic consciousness by treating it as a form of giving permission, as is evident in the debate between attitudinal and performative theories of consent. Building on the phenomenology of Maurice Merleau-Ponty, Ann Cahill, Linda Martín Alcoff, and others, I argue (...) that taking consent to be an intercorporeal and dynamic coexistence of desiring bodies opens up new ways of thinking about the role of consent in sexual ethics. I suggest that phenomenology’s theories of embodied consciousness, operative intentionality, and the direct perception of others provide a better groundwork for conceptualizing the role of ambiguity and subtle power dynamics in sexual encounters than attitudinal or performative accounts of consent. I also defend my view against Jonathan Jenkins Ichikawa’s argument for doing away with the concept of consent in sexual ethics due to consent's stubborn and infelicitous presupposition of permission-giving. Scientific Essentialism defends the view that the fundamental laws of nature depend on the essential properties of the things on which they are said to operate, and are therefore not independent of them. These laws are not imposed upon the world by God, the forces of nature or anything else, but rather are immanent in the world. Ellis argues that ours is a dynamic world consisting of more or less transient objects which are constantly interacting with each other, and (...) whose identities depend on their roles in these processes. Natural objects must behave as they do, because to do otherwise would be contrary to their natures. The laws of nature are, therefore, metaphysically necessary, and consequently, there are necessary connections between events. Although the theory that the laws of nature are immanent in things, rather than imposed on them from without, is an ancient one, much recent work has been done to revive interest in essentialism and "The Philosophy of Nature" is a distinctive contribution to this lively current debate. Brian Ellis exposes the philosophical and scientific credentials of (...) the prevailing Humean metaphysic as less than compelling and makes the case for new essentialism as an alternative metaphysical perspective in lucid and unambiguous terms. This book develops this alternative metaphysic and considers the consequences for philosophy, and for some other areas of investigation, of working with such a metaphysic. The nature of measurement is a topic of central concern in the philosophy of science and, indeed, measurement is the essential link between science and mathematics. Professor Ellis's book, originally published in 1966, is the first general exposition of the philosophical and logical principles involved in measurement since N. R. Campbell's Principles of Measurement and Calculation, and P. W. Bridgman's Dimensional Analysis. Professor Ellis writes from an empiricist standpoint. His object is to distinguish and define the basic concepts (...) in measurement, for example: scale, quantity, unit. dimension, number and probability. He discusses the problem of classifying scales of measurement and the special logical problems associated with each kind of scale. Many philosophers believe that God has been put to rest. Naturalism is the default position, and the naturalist can explain what needs to be explained without recourse to God. As is often the case in clinical ethics, the discourse in COVID-19 has focused primarily on difficult and controversial decision-making junctures such as how to decide who gets access to intensive care resources if demand outstrips supply. However, the lived experience of COVID-19 raises less controversial but arguably more profound moral questions around what it means to look after each other through the course of the pandemic and how this translates in care for the dying. This piece explores the interface (...) between the pandemic, ethics, and the role of palliative care. We argue that the ethical discourse should be broader, and that the principles that underly the discipline of palliative care provide a solid ethical foundation for the care of all patients through the coronavirus pandemic. The politics of ethnic names, such as ‘Latino’ and ‘Hispanic’, raises legitimate issues for three reasons: because non-political considerations of descriptive adequacy are insufficient to determine absolutely the question of names; political considerations may be germane to an ethnic name’s descriptive adequacy; and naming opens up the political question of a chosen furture, to which we are accountable. The history of colonial and neo-colonial conditions structuring the relations of the North, Central and South Americas is both critical in understanding the (...) political condition of Latinos in the USA and relevant in current colonial relations. Philosophers and bioethicists are typically sceptical about invocations of dignity in ethical debates. Many believe that dignity is essentially devoid of meaning: either a mere rhetorical gesture used in the absence of good argument or a faddish term for existing values like autonomy and respect. On the other hand, the patient experience of dignity is a substantial area of research in healthcare fields like nursing and palliative care. In this paper, it is argued that philosophers have much to learn from (...) the concrete patient experiences described in healthcare literature. Dignity is conferred on people when they are treated as having equal status, something the sick and frail are often denied in healthcare settings. The importance of equal status as a unique value has been forcefully argued and widely recognised in political philosophy in the last 15 years. This paper brings medical ethics up to date with philosophical discussion about the value of equal status by developing an equal status conception of dignity. (shrink)

The method of reflective equilibrium starts with a set of initial judgments about some subject matter and refines that set to arrive at an improved philosophical worldview. However, the method faces two, trenchant objections. The Garbage-In, Garbage-Out Objection argues that reflective equilibrium fails because it has no principled reason to rely on some inputs to the method rather than others and putting garbage-in assures you of getting garbage-out. The Circularity Objection argues that reflective equilibrium fails because it has no principled, (...) non-circular way of sorting whatever is put into the method. The moves required to avoid both objections are instructive. Reflective equilibrium requires a meta-justification, and we offer one that appeals to the epistemic goods that underwrite a view known as phenomenal conservatism. Reflective equilibrium calls on us to start with what seems most likely to be true and to alter that collection of judgments in the ways that seem most likely to get us to the truth. Proceeding in this way is epistemically defensible and unavoidable. Hence, reflective equilibrium is not just good, it’s phenomenal. (shrink)

In this paper I set out the problem of feminist social science as the need to explain and justify its method of theory choice in relation to both its own theories and those of androcentric social science. In doing this, it needs to avoid both a positivism which denies the impact of values on scientific theory-choice and a radical relativism which undercuts the emancipatory potential of feminist research. From the relevant literature I offer two possible solutions: the Holistic and the (...) Constructivist models of theory-choice. I then rate these models according to what extent they solve the problem of feminist social science. I argue that the principal distinction between these models is in their contrasting conceptions of truth. Solving the problem of feminist social science will require understanding that what is at stake in the debate is our conception of truth. This understanding will serve to clarify, though not resolve, the various approaches to and disagreements over methodologies and explanations in feminist social science. (shrink)

How are we to view the nature of desire and its relation to value, humanity, and God? Sartre, Nietzsche, and Levinas have interesting things to say in this context, and they can be understood to be responding in their different ways to two seemingly opposed ways of conceiving of desire, namely, as lack or deficiency or as plenitude or creativity. I clarify, link, and distinguish the relevant conceptions of desire, and give a sense of what it could mean to comprehend (...) desire in either or both of these ways. I question Sartre's insistence that man is a ‘useless passion’, trace it back to his commitment to a ‘lack’ model of desire, and argue that this model, as he understands it, stands in the way of the more creative conception which is lurking in the background of his account. There will be a question of whether the atheist is entitled to this creative conception, and I shall challenge his assumption that it becomes available only when theism is overthrown. I shall suggest also that there is something important to be salvaged from the lack model. (shrink)

Initial responses to questionnaires used to assess participants' understanding of informed consent for malaria vaccine trials conducted in the United States and Mali were tallied. Total scores were analyzed by age, sex, literacy (if known), and location. Ninety-two percent (92%) of answers by United States participants and 85% of answers by Malian participants were correct. Questions more likely to be answered incorrectly in Mali related to risk, and to the type of vaccine. For adult participants, independent predictors of higher scores (...) were younger age and female sex in the United States, and male sex in Mali. Scores in the United States were higher than in Mali (P = 0.005). Despite this difference participants at both sites were well informed overall. Although interpretation must be qualified because questionnaires were not intended as research tools and were not standardized among sites, these results do not support concerns about systematic low understanding among research participants in developing versus developed countries. Our experience of music in a concert hall depends on whether we sit in the front row or under the balcony. The unique acoustics of religious spaces acquire symbolic meaning. Usage-based approaches to language hold that we learn multiword expressions as patterns of language from language usage, and that knowledge of these patterns underlies fluent language processing. This paper explores these claims by focusing upon verb–argument constructions such as “V about n.” These are productive constructions that bind syntax, lexis, and semantics. It presents analyses of usage patterns of English VACs in terms of their grammatical form, semantics, lexical constituency, and distribution patterns in large corpora; patterns of VAC usage in (...) child-directed speech and child language acquisition; and investigations of VAC free-association and psycholinguistic studies of online processing. We conclude that VACs are highly patterned in usage, that this patterning drives language acquisition, and that language processing is sensitive to the forms of the syntagmatic construction and their distributional statistics, the contingency of their association with meaning, and spreading activation and prototypicality effects in semantic reference. Language users have rich implicit knowledge of the statistics of multiword sequences. (shrink)

For many decades, race and racism have been common areas of study in departments of sociology, history, political science, English, and anthropology. Much more recently, as the historical concept of race and racial categories have faced significant scientific and political challenges, philosophers have become more interested in these areas. In this book, Ellis argues that moral and political objectives are not independent of one other, and so must be pursued in tandem. _Social humanism_ is a moral and political philosophy that does just this. As a political philosophy, it justifies the implementation and maintenance of many of the characteristic social policies of welfare states. As a moral philosophy, it provides the foundation required for most human rights legislation. To this end, Ellis elaborates on the theory of social (...) humanism and the need to reconsider the metaphysical foundations of morals. According to Cushman, rationalization occurs when a person has performed an action and then concocts beliefs and desires that would have made it rational. We argue that this isn't the paradigmatic form of rationalization. Consequently, Cushman's explanation of the function and usefulness of rationalization is less broad-reaching than he intends. Cushman's account also obscures some of rationalization's pernicious consequences.

I defend a form of naturalism which has much in common with Iris Murdoch's ‘true naturalism’, but I argue that it can accommodate God. I consider what it could mean for naturalism to be theistic in this sense, and respond to the charge that it leaves no room for the transcendent.

Kant holds that the whole “higher faculty of knowledge” (‘reason’ or ‘understanding’ in a broad sense), is a spontaneous faculty. But what could this mean? It seems that it could either be a perfectly innocent claim or a very dangerous one. The innocent thought is that reason is spontaneous because it is not wholly passive, not just a slave to what bombards the senses. If so, then the rejection of Hume’s radical empiricism would suffice for Kant’s claim. But the dangerous (...) thought is that reason, and the ‘I think’ which expresses it, is free, having the power to produce something entirely from itself. While this freedom is characteristic of practical reason, could it be characteristic of reason in general, even in its theoretical employment? Some contemporary interpreters have admirably defended the ‘dangerous’ conception by stripping it of the implication that it makes reason in general entirely self-sufficient. I attempt to add to this effort. However, what I contend is that this weightier conception of spontaneity (‘absolute’ or ‘non-relative’ spontaneity) requires abandoning a certain approach to the question that has been assumed by virtually everyone in the debate—namely, that the question can be answered by siding with either the so-called ‘metaphysical’ or the ‘epistemic’ interpreters of Kant. My goal is to suggest that the proper perspective on reason’s spontaneity resists such characterizations all together, and thereby resists any of the conditions under which it could be understood as ‘relative’ to anything. The important and no longer novel insight from ecology that ecosystems are dynamic and ever-changing along immensely complex causal pathways prompts the further insight that environmental protection regimes should promote not a particular ecosystemic end state, but rather ecosystem resilience, or the capacity to absorb and adapt to stress without compromising essential function. For law to embrace resilience as an objective, it is argued, it must itself be dynamic and flexible, capable of learning and adaptation. This poses potentially serious challenges (...) to law’s resilience: to what extent are flexibility and adaptability at odds with what Niklas Luhmann argues is an essential feature of normative systems, namely, resistance to learning in the face of disappointment? The potentially rapid rate of change expected of a law oriented to ecosystem resilience could overwhelm law’s capacity to provide the measure of order, stability, and predictability that are core to its contribution, or prestation, to society. This paper takes this challenge seriously, but also explores another possible implication of law in the pursuit of ecosystem resilience: if environmental law is no longer conceived of in primarily instrumental terms, as a means to bring about a specific set of ecosystem objectives, there may be some possibility for its own resilience to be enhanced. Combines phenomenology with the "enactivist" approach to consciousness theory and recent emotion research to explore the way self-motivated action plans shape selective attention, exploration, and ultimately the mind's interpretation of reality - in philosophy, psychology, cultural awareness, and our personal lives.

I argue that, for Kant, there is a point at which the notions of self-consciousness and self-limitation become one. I proceed by spelling out a logical progression of forms of self-consciousness in Kant’s philosophy, where at each stage we locate the limits of the capacity in question and ask what it takes to know those limits. After briefly sketching a notion of self-consciousness available even to the animal, we look at whether there could be a notion of self-consciousness available to (...) the capacity of human sensibility. At this stage I argue that Kant and Heidegger (or Heidegger’s Kant) share a conception of what it is to be self-limiting through self-consciousness. I then critically examine this conception, and, specifically, the way in which it fails to account for the most essential form of self-limitation in Kant’s critical philosophy—namely, the form of self-limitation which rejects spatial and temporal articulation. The conclusion we reach is that Kant’s theory of transcendental self-consciousness is a theory of the activity of thinking as determining itself (including its limits) non-spatially and non-temporally. A celebrated problem for representationalist theories of phenomenal character is that, given externalism about content, these theories lead to externalism about phenomenal character. While externalism about content is widely accepted, externalism about phenomenal character strikes many philosophers as wildly implausible. Even if internally identical individuals could have different thoughts, it is said, if one of them has a headache, or a tingly sensation, so must the other. In this paper, I argue that recent work on phenomenal concepts reveals that, contrary (...) to appearances, this standard conjunction of externalism about content and internalism about phenomenal character is ultimately untenable on other models of phenomenal character as well, including even “qualia realism.” This would be significant for a number of reasons. The first is patent: it would undermine a primary objection to representationalism. The fact that representationalism is incompatible with the conjunction would be no serious problem for representationalism if no other plausible model of phenomenal character is compatible with it. The second is that the many philosophers who embrace the conjunction would be forced to abandon one of the two views; externalism would be true either of both content and phenomenal character, or of neither. Likewise, those philosophers who have taken a stance on only one of the two internalism/externalism debates would have to be seen as thereby committed to a particular stance on the other. The third reason stems from the fact that qualia realism typically goes hand in hand with internalism about phenomenal character. To the extent that it does, my argument would reveal that qualia realism is itself in tension with externalism about content. This would perhaps be the most surprising result of all. (shrink)

Empirical, logical, historical and mathematical inquiries may be able to tell us what it is ultimately right for us to believe in these various fields, and, in this pragmatic sense, they may be able to tell us what is true. But such inquiries cannot tell us what must exist in reality for them to be true, since they cannot tell us what their truthmakers are. To do this, we have to step back from the particular disciplines of science, mathematics, history, (...) and so on, and seek to offer a general account of the nature of reality – one that is adequate to accommodate most of our empirical and theoretical knowledge of it. This is the task of ontology. It is not one that can be left to scientists, or other specialist inquirers, for at least two important reasons. The methodology of ontology is necessarily very different from that of any specialist field, and the account that it seeks to offer must be general. It cannot be limited to any one field of inquiry. In this paper, I shall describe and defend a strategy for arriving at an ontology that depends on keeping ontological and epistemological questions apart. The strategy is required, I shall argue, because these two sorts of questions are easily confused with one another. (shrink)
