It is widely held in translation studies that translation proper is not merely a process of linguistic transfer but also of cultural transfer. But how cultural transfer is effected or whether it can be effected is not at all clear. The study begins with a critical analysis of the problems relating to law translation in general and translating the common law into Chinese in particular. It then examines the nature of cultural transfer in law translation with special reference to the (...) translation of common law terminology. The study purports to set out the framework for legal translation as cultural transfer, in particular, for translating the common law into Chinese in Hong Kong. It argues that successful transfer of the legal culture of foreign laws always requires the adjustment of translating language and the employment of metalanguage. (shrink)

Threshold- and signal-detection-based models have dominated theorizing about recognition memory. Building upon these theoretical frameworks, we have argued for a dual-process model in which conscious recollection and familiarity contribute to memory performance. In the current paper we assessed several memory models by examining the effects of levels of processing and the number of presentations on recognition memory receiver operating characteristics . In general, when the ROCs were plotted in probability space they exhibited an inverted U shape; however, when they were (...) plotted inzspace they exhibited a U shape. An examination of the ROCs showed that the dual-process model could account for the observed ROCs, but that models based solely on either threshold or signal-detection processes failed to provide a sufficient account of the data. Furthermore, an examination of subjects' introspective reports using the remember/know procedure showed that subjects were aware of recollection and familiarity and were able to consistently report on their occurrence. The remember/know data were used to accurately predict the shapes of the ROCs, and estimates of recollection and familiarity derived from the ROC data mirrored the subjective reports of these processes. With the gradual deepening of environmental problems and the increase in consumer awareness of environmental protection, many enterprises have already begun to pay attention to green supply chain management. However, the price of green products is higher than that of nongreen products, which is an enormous challenge for many small- or medium-sized enterprises. To study the pricing and coordination of green supply chains under capital constraints, a model consisting of a manufacturer and a capital-constrained retailer is established; the manufacturer invests (...) in green products and provides a deferred payment contract. Setting the situation without capital constraints as a benchmark, this study explores the impact of the retailer’s capital constraints on the manufacturer’s product greenness design; an interesting result shows that deferred payment can help encourage the retailer to order more products and improve the profit of the manufacturer and the efficiency of the entire supply chain as well as the product’s greenness level simultaneously. However, the profit of the retailer will be hurt by the deferred payment contract. Therefore, to guarantee the profit of the entire channel and to make the two agents obtain a win-win outcome, a new two-way revenue-sharing contract is designed to coordinate the green supply chain. This is a paper about the nature of snobbery and the undermining import of a charge of snobbery. On my account, snobs sincerely attempt to identify and correctly evaluate the aesthetically relevant features of an object, but they get things wrong, and their getting things wrong is explained by the fact that they under-value that which they associate with being lower-class. We can see the need for this account by reflecting on examples, and can distinguish it from existing accounts of (...) snobbery by thinking about when and why evidence of snobbery constitutes higher-order evidence against one’s aesthetic judgements. Existing accounts either are consistent with snobs’ aesthetic judgements being flawless, and thus not undermined by evidence of snobbery, or they imply that the canonical reasoning-process for arriving at aesthetic judgements has been bypassed altogether. On my account, by contrast, snobbery does not bypass the canonical aesthetic reasoning-process but distorts it in systematic and predictable ways. (shrink)

We evaluate people all the time for a wide variety of activities. We blame them for miscalculations, uninspired art, and committing crimes. We praise them for detailed brushwork, a superb pass, and their acts of kindness. We accomplish things, from solving crosswords to mastering guitar solos. We bungle our endeavors, whether this is letting a friend down or burning dinner. Sometimes these deeds are morally significant, but many times they are not. Simply Responsible defends the radical proposal that the blameworthy (...) artist is responsible in just the same way that the blameworthy thief is. We can be responsible for all kinds of different activities, from lip-synching to long division, from murders to meringues, but the relation involved, what author Matt King calls the basic responsibility relation, is the same in every case. We are responsible for the things we do first, then blameworthy or praiseworthy for having done them in light of whether they're good or bad, according to a variety of standards. Why is this a radical proposal? Firstly, because so much of the contemporary literature on moral responsibility has moralized its nature. According to most accounts, moral responsibility is either a special species of responsibility or else depends on moralized capacities. In contrast, King argues that we get a more complete and unifying picture of responsible agency from a more general theory of responsibility. Secondly, the proposal is radical due to its drastic simplicity. King foregoes many of the complications that feature in other accounts of responsibility, arguing that we can make do with less demanding theoretical elements. (shrink)

In her paper “Radical Externalism”, Amia Srinivasan argues that externalism about epistemic justification should be preferred to internalism by those who hold a “radical” worldview (according to which pernicious ideology distorts our evidence and belief‐forming processes). I share Srinivasan's radical worldview, but do not agree that externalism is the preferable approach in light of the worldview we share. Here I argue that cases informed by this worldview can intuitively support precisely the internalist view that Srinivasan challenges, offer two such cases, (...) and explain away the externalist‐friendly intuitions that Srinivasan's cases solicit. I then articulate and defend a “radical” internalism, arguing that internalists’ aversion to epistemic hubris and emphasis on subjecting one's beliefs to critical scrutiny are especially attractive in realistic cases involving multiple intersecting axes of oppression—that is, precisely the sort of case that permeates our social world. I also argue that externalism's lack of interest in action‐guiding principles leaves it with little to offer us in the fight against epistemic oppression. (shrink)

This essay considers the potential role of bioethics in disaster response planning and preparedness. Bioethicists can make substantial contributions, by ensuring that decision-making and distribution of resources during crises is carried out in a fair and just manner, as well as by examining the assumptions upon which disaster planning are based. Bioethicists should also be aware of potential pitfalls of overly-hasty engagement with this new field.

My research focuses on the moral evaluation of people’s motivations. A popular recent view in Philosophy is that good people are motivated by the considerations that make actions morally right (the “right-making features”). For example, this view entails that a Black Lives Matter protester can be a good person if she is motivated to engage in protest by the thought that it will bring about equality, or justice, since this is what makes engaging in protest morally right. But this view (...) entails that the protester cannot be a good person if she engages in protest because it is morally right. I think that this is a serious mistake. My view is that it is good to be explicitly committed to acting rightly and motivated by the moral rightness of one’s actions. More specifically, I explore the nature and defend the value of a complex state that I call "trying to act rightly". This comprises (a) wanting to act rightly, (b) thinking about which actions are right, and (c) doing the things that you think are right, because they are right. The three papers of my Dissertation each make part of the case for trying to act rightly. My first paper, “Praiseworthy Motivations”, addresses the view that it is good to be motivated by the right-making features but not good to be motivated to act rightly. I argue that this view rests on poorly-drawn comparison cases that are not genuine minimal pairs, and that well-constructed cases show these two types of motivation to be equally good. I address the worry that trying to act rightly leads people with false moral beliefs to act wrongly, by noting that this also applies to motivation by right-making features, since people can be motivated by a right-making feature while being mistaken about which acts have this feature. I then argue that we should distinguish carefully between motivations, actions, and beliefs when evaluating these well-meaning but morally mistaken agents. The second paper, “We Can Have Our Buck and Pass It, Too”, addresses the view that the fact that an act is morally right is not a genuine reason to perform it, and that our reasons for action are instead provided by the right-making features. I argue that this view rests on a confused picture of moral metaphysics, which would rule out any case in which one reason to perform an act is partially metaphysically constituted by another fact that is also a reason to perform the same act – as, for example, when a salad both is healthy and contains vegetables. I then sketch an alternative picture of moral metaphysics, on which genuine reasons for action can be metaphysically related to one another. My third paper, “Accidentally Doing the Right Thing”, uses general reflections on the nature of deliberate action and its relationship to praiseworthiness to argue that someone is only praiseworthy for acting rightly if she was trying to act rightly. I apply this idea to the philosophical debate on moral worth, defending the Kantian view that actions have moral worth just in case they are instances of someone’s trying to act rightly and succeeding. This is a radical departure from the most popular contemporary view on moral worth, and requires a re-evaluation of the main case discussed in this literature: that of Huckleberry Finn. (shrink)

Though these expressions are often called “names of months”, there is good reason to hold that they are not names at all. Syntactically, these words behave as count nouns. They combine with determiners such as ‘every’, ‘many’, ‘exactly three’ etc. to form restricted quantifiers:3 (1) Every January I go skiing. (2) I spent many Januarys at Squaw Valley. (3) I wasted exactly three Januarys in Bakersfield. Like other count nouns, they can take relative clauses in constructions such as (1)-(3): (1a) (...) Every January that you visited we went skiing. (2a) I spent many Januarys that I will never forget at Squaw Valley. (3a) I wasted three Januarys that seemed interminable in Bakersfield. They also combine with the copula, indefinite article and adjectival modifiers to form predicates in the way that other count nouns do: (4) The first full month I lived in Northern California was a pleasant July. Further, it is generally held that only constituents of the same syntactic category can be conjoined. And as the following example shows, ‘January’ can be conjoined with other count nouns:4 (5) All Januarys and funerals last too long. Thus distributional evidence strongly suggests that ‘January’, ‘February’, etc. are count nouns. Since in general we take count nouns to express properties, we ought to take ‘January’, ‘February’ etc. to express properties as well.5 We shall return to the question of what properties such words express below. This paper concerns recent attempts to use the epistemological notions of sensitivity and safety to shed light on legal debates about so-called “bare” statistical evidence. These notions might be thought to explain either the outright inadmissibility of such evidence or its inadequacy for a finding of fact—two different phenomena that are often discussed in tandem, but that, I insist, we do better to keep separate. I argue that neither sensitivity nor safety can hope to explain statistical evidence’s inadmissibility, since neither (...) offers a plausible criterion of admissibility that would exclude such evidence; both are subject to copious counterexamples, especially given their factivity, and it is difficult even to state a coherent criterion of admissibility in terms of either sensitivity or safety. The possibility remains, though, that either notion might explain statistical evidence’s inadequacy for a finding of fact; I express some doubts about this possibility but do not rule it out. Therefore, gene activation at a particular time and its maintenance during cell division are significant for cellular differentiation and individual development. Although many studies have sought to explain the molecular mechanisms of gene expression regulation, the mechanism through which gene expression states are inherited during cell division has not been fully elucidated yet. This review (...) illustrates the general principles and the complexities involved in the establishment and maintenance of active transcription through cell cycles. It focuses on the most‐recent findings about the ways in which molecular memory marks for active transcription are coordinated with cell cycle events, such as replication, mitosis and nuclear organization, to mediate transcription memory across cell division events, which may establish a unifying memory process of active transcription. Rolfe King argues that exploring these significantly refines ideas of evidence for God, including the claim that God must operate within a logically necessary structure of revelation. Examining obstacles to divine revelation clarifies this structure and paves the way to evaluating its significance.

Despite great advances in understanding genetic mechanisms, there still exists a bias toward equating genes with innate modules that determine important developmental events. But genes are equally relevant to understanding developmental plasticity shaped by ecological events. In other words, the term 'genetic inheritance' does not specify ontogenetic mechanisms. Here we present a case history of a species assumed to be under the control of prespecified genetic wiring to direct critical behavioral events such as communication and mating. We show, however, that (...) exogenetic processes stemming from the species's ontogenetic niche provide an alternative view of the flexibility of development especially with respect to behavioral performance. This contribution examines the relatively unresearched doctoral thesis of Hans Urs von Balthasar as a Germanist, particularly in relation to the role that the reading of the Russian religious philosopher Nikolai Berdyaev played in the development of Balthasar's earliest theological thought. The authors argue that Berdyaev provided the young Germanist with a markedly eschatological point of departure for his nascent theological reflections. Although Balthasar had to renounce certain aspects of Berdyaev's thought, this eschatological orientation received from Berdyaev nevertheless remained recognizable (...) through Balthasar's mature theological works. This article synthesizes insights from deterrence theory and social psychology literature on retributive justice to develop and test a theoretical model which predicts how and why observers’ tax compliance intentions are influenced by knowledge of the punitive outcomes faced by individuals found guilty of tax fraud. We test our model experimentally on a sample of Canadian taxpayers and manipulate perceived responsibility for a fraud and whether a fraud perpetrator is punished. We show that observers’ tax compliance increases when a fraud (...) perpetrator is punished only when the perpetrator is perceived as blameworthy. The psychological process through which this positive influence operates is relatively complex, as it includes perceptions of punishment deservingness and affect. We also find that tax compliance decreases when a tax fraud perpetrator is unpunished, regardless of perceived blameworthiness. Our results are robust when we control for economic determinants known to influence fraud. The article concludes by discussing our findings’ implications for fraud research and policy. (shrink)

It is increasingly fashionable to attack McTaggart's arguments about the Unreality of Time with a minimum of attention to what he was trying to establish. Those who have only read his one still famous paper ‘The Unreality of Time’ [III] are too likely to assume from professional philosophers' current counter-arguments that the man was a sceptic with only a single idea in his head, rather than an ingenious, constructive metaphysician. Since so much formal and informal analysis has been directed against (...) so few of McTaggart's comments on Time, and mainly against his destructive claim that the vulgar concept of Time requires as explicans an incoherent ‘A-series’ of becomings with ever-shifted pasts, presents and futures, perhaps it is time to encourage some redirection of analytical assessment to what he was arguing for. I say this not only for historical reasons, though I shall draw historical comparisons, but because rationally assessing what McTaggart really denies about Time may require some serious interest in what he so interestingly asserts about our experience of what we call ‘Time’. Trousers, pace Austin, normally have one wearer but two legs. If McTaggart's negative points deserve such a plethora of analysis, then the positive view needs attention or the analysis is ill-aimed. The idea that conventionalized general knowledge – sometimes referred to as a frame – guides the perception and interpretation of the world around us has long permeated various branches of cognitive science, including psychology, linguistics, and artificial intelligence. In this paper we provide experimental evidence suggesting that frames also play a role in explaining certain long-distance dependency phenomena, as originally proposed by Deane (1991). We focus on a constraint that restricts the extraction of an NP from another NP, called subextraction, (...) which Deane (1991) claims is ultimately a framing effect. In Experiment 1 we provide evidence showing that referents are extractable to the degree that they are deemed important for the proposition expressed by the utterance. This suggests that the world knowledge that the main verb evokes plays a key role in establishing which referents are extractable. In Experiment 2 we offer evidence suggesting that the acceptability of deep subextractions is correlated with the overall plausibility of the proposition, suggesting that complex structures can evoke complex frames as well, if sufficiently frequent and semantically coherent, and therefore more easily license deeper subextractions. This article presents evidence regarding aspects of the gendered nature of care women with gynaecological cancer receive from their (usually) male surgeons and oncologists in Australia. We argue that despite women’s general preference for female gynaecologists, those with a gynaecological cancer develop a strong therapeutic relationship with their male medical specialist, not extended to their (usually) female nurses and other allied health professionals. Given the highly sensitive and sexualized nature of gynaecological cancer, this requires explanation. These findings can be partly (...) explained by examining the division of labour between nurses and doctors, specifically issues of control over this process and the development of specializations. The findings also bring into stark relief the way in which power and status differences can be used by medicine to create a positive therapeutic relationship with patients while simultaneously de-eroticizing the intimate procedures necessary in assisting women throughout their cancer treatment. Importantly, this relationship also has relevance for policy makers, particularly those concerned with the highly gendered division of labour of the medical specialty workforce in Australia. Advance directives (ADs) are assumed to reflect the patients’ preferences, even if these are not clearly expressed. Research into whether this assumption is correct has been lacking. This study explores to what extent ADs reflect the true wishes of the signatories.

Limitations on reproductive decision making, including forced sterilization and involuntary birth control, raise significant ethical challenges. In the United States, these issues are further complicated by a disturbing history of the abuse and victimization of vulnerable populations. One particularly fraught challenge is the risk of teratogenicity posed by moodstabilizing psychiatric medications in patients who are incapable of appreciating such dangers. Long-acting reversible contraception (LARC) offers an intervention to prevent pregnancy among individuals who receive such treatments, but at a cost to (...) their reproductive autonomy. This article examines the ethical issues involved in the use of involuntary LARC for patients on teratogenic psychiatric medications (TPMs) and argues that such an approach can only be justified as a last resort after a careful consideration of the alternatives and an assessment of potential risks and benefits. The aim of this study was to analyze nurses' experiences of role strain when taking care of patients with severe acute respiratory syndrome (SARS). We adopted an interpretive/constructivist paradigm. Twenty-one nurses who had taken care of SARS patients were interviewed in focus groups. The data were analyzed using thematic analysis. The self-state of nurses during the SARS outbreak evolved into that of professional self as: (1) self-preservation; (2) self-mirroring; and (3) self-transcendence. The relationship between self-state and reflective practice is discussed.

She argues that it is flawed because we are obligated to perform some actions that we cannot perform, and goes on to present a suggested theory for anyone who would deny the principle. She examines the traditional motivations for Ought Implies Can, and (...) finds that they to a large degree do not support it. Using examples like gay rights, addiction, and disability, she argues that we can preserve many of the motivations that led us to the principle by thinking more about what we, as individuals or institutions, can fairly demand of ourselves and each other. This article examines the main lines of contemporary thinking about analysis in philosophy. It first considers G. E. Moore’s statement of the paradox of analysis. It then reviews a number of accounts of analysis that address the paradox of analysis, including the account offered by Ernest Sosa 1983 and others by Felicia Ackerman ; the latter gives an account of analysis on which properties are the objects of analysis. It also discusses Jeffrey C. King’s accounts of philosophical analysis, before (...) turning to views of analysis that are not aimed at addressing the paradox of analysis, including those associated with David Lewis, Frank Jackson, and David Chalmers. In particular, it comments on Lewis’s argument that conceptual analysis is simply a means for picking out the physical state that occupies a certain role, where formulating what that role is constitutes a conceptual analysis of the relevant notion. In the last decade, advances in technology have significantly disrupted the way firms provide goods and services. At the forefront of this technological disruption is the sharing economy, where individuals earn income by providing services or sharing assets through peer-to-peer platforms. With global revenues in the sharing economy projected to increase substantially in the next decade, income from this economy will continue to be an important source of tax revenues for governments around the world. However, sceptics argue that the sharing (...) economy inherently lends itself to dishonest reporting of taxable income. We employ an online experiment, using 746 taxpayers, to observe whether the prosocial benefits often promoted by P2P platforms reduce honest reporting of taxable sharing economy income. Consistent with moral licensing theory, we find that earning income from a prosocial-oriented P2P platform liberates taxpayers to dishonestly report their sharing economy income, and this result is fully driven by taxpayers whose personal values are incongruent with values promoted by the P2P platform. Our paper contributes to the limited but growing research on the sharing economy and its implications for ethical decisions. It also adds to the moral licensing literature by identifying value congruency as an important moderator for moral licensing effect. (shrink)

This article explores the significance of sustainability and several ways in which education for sustainable development can be considered. It presents several issues related to the theories of sustainability and ESD, which are generated based on a firm concept of anthropocentrism. ESD has been used for developing a scientific understanding of the world and is expected to effectively address the environmental damage facing humans. However, this is a narrow view of sustainability, through which learners do not gain an authentic understanding (...) of nature. If the phenomenon of ecological interdependence is true, a non-anthropocentric stance of sustainability is the actual representation required for ESD teaching. Ecological wisdom in Buddhist philosophy indicates that natural sustainability corresponds to human living in harmony with the natural environment, an insight derived particularly from the Buddhist concept of the no-self. Instead of denying the existence of ‘I’, the no-self is the loss of self-preoccupation. This notion highlights the non-dual relation between the self and this world. If I am I and nature is nature, then human sustainability differs from natural sustainability. Only when I am nature and nature is I can natural sustainability translate into human sustainability. This state presents actual sustainability for humans. Regarding ESD, it can be achieved by coming to nature, and learning to see nature in ourselves. As nature does, it comes to all beings, manifesting itself in all beings. (shrink)

Elinor Mason's Ways to be Blameworthy offers an interesting and potentially-fruitful distinction between varieties of blame and, correspondingly, between varieties of blameworthiness. The notion of "Grasping" Morality is central to her picture, distinguishing those who act subjectively wrongly and can be blamed in the ordinary way from those who only act objectively wrongly and can only be blamed in a detached way. Here I request more information about this central notion and pose a puzzle for Mason's account; I argue that (...) the various things Mason says about agents who grasp Morality appear inconsistent once we recognize that people can count as grasping Morality overall despite significant gaps in their understanding of it. In this article we provide a case history of the development of a communicative system in songbirds. In particular, we explore how brown-headed cowbirds, male and female, cooperate in the development and use of species-typical song. The goal is to show how social interactions between and within sexes create a platform for the production and perception of song. We consider six perspectives. First, we discuss the nature of the acoustic signal. Second, we look at the process of song learning. Third, (...) we describe a specific song mechanism, social shaping. Fourth, we look at the more general developmental process of neophenogenesis. Fifth, we consider the developmental ecology for social learning. Finally, we describe how social networks measures can be used to capture the nature of social interactions as the engines of song learning. Taken as a whole, we argue that culturally transmitted behaviors structure social interactions that predict the acquisition of species' typical behaviors necessary for successful reproduction.
