In the preface to his commentary on the Song of Songs, Theodoret of Cyrrhus states that the book has without doubt a spiritual meaning and that a literal interpretation is worthy only of wicked heretics, ridiculous in their own blindness, amongst whom it is difficult to include Theodore of Mopsuestia. The spiritual nature of the Song of Songs is supported by the reference to Esdra and by the many early Fathers who have commented upon it (amongst whom Eusebius has pride (...) of place, followed by Origen, then Cyprian for the struggle against heretics) or who have acknowledged it as sacred (amongst whom are Basil, Gregory of Nazianzo and, contrary to common belief, Amphilochius of Iconium). The sacredness of the work voids its immoral content and compels one to interpret it in an allegorical way. (shrink)

How psychopaths and their capacity for moral action are viewed is not only philosophically interesting but is also important and relevant for policy. The philosophical discussion of psychopathy has focussed upon the psychological faculties that are prerequisites for moral responsibility and empirical findings regarding psychopathy that are relevant to philosophical accounts of moral understanding and motivation. However, there are legitimate worries about whether psychopathy is a robust scientific construct, and there are risks attached to reifying psychopathy or other psychiatric constructs. (...) We defend the concept of psychopathy by pointing out the relevance of empirical studies about it for our ordinary practices of ascribing moral responsibility and folk psychological accounts of moral understanding and motivation. Some bilateralists have suggested that some of our negative answers to yes-or-no questions are cases of rejection. Mark Textor (2011. Is ‘no’ a force-indicator? No! Analysis 71: 448–56) has recently argued that this suggestion falls prey to a version of the Frege-Geach problem. This note reviews Textor's objection and shows why it fails. We conclude with some brief remarks concerning where we think that future attacks on bilateralism should be directed.

Explanations are conceived to ensure the trustworthiness of AI systems. Yet, relying solemnly on algorithmic solutions, as provided by explainable artificial intelligence (XAI), might fall short to account for sociotechnical risks jeopardizing their factuality and informativeness. To mitigate these risks, we delve into the complex landscape of ethical risks surrounding XAI systems and their generated explanations. By employing a literature review combined with rigorous thematic analysis, we uncover a diverse array of technical risks tied to the robustness, fairness, and evaluation (...) of XAI systems. Furthermore, we address a broader range of contextual risks jeopardizing their security, accountability, reception alongside other cognitive, social, and ethical concerns of explanations. We advance a multi-layered risk assessment framework, where each layer advances strategies for practical intervention, management, and documentation of XAI systems within organizations. Recognizing the theoretical nature of the framework advanced, we discuss it in a conceptual case study. For the XAI community, our multifaceted investigation represents a path to practically address XAI risks while enriching our understanding of the ethical ramifications of incorporating XAI in decision-making processes. In this chapter, we investigate whether psychopathy is a mental disorder. We argue that addressing this question requires engaging, at least, with three principal issues that have conceptual, empirical, and normative dimensions. First, it must be established whether current measures of psychopathy individuate a unitary class of individuals. By this we mean that persons classifed as psychopaths should share some relevant similarities that support explanation, prediction, and treatment. Second, it must be proven that psychopathy harms the person who has it. (...) Third, it must be established that the harm associated with psychopathy is relevant for the ascription of disorder status. Regarding this latter issue, we argue that psychopathy should be considered a disorder if its harmfulness derives from certain incapacities or limited capacities. These incapacities should affect basic competences that are justifably required for conducting a preferable type of life. Within this framework, we tentatively advance the hypothesis that some normatively justifed conclusions and empirical evidence about psychopathy, that needs nonetheless to be further investigated, might support the claim that people with psychopathy have a mental disorder. In this paper we aim to offer a balanced argument to motivate (re)thinking about the mental illness clause within the insanity defence. This is the clause that states that mental illness should have a relevant causal or explanatory role for the presence of the incapacities or limited capacities that are covered by this defence. We offer three main considerations showing the important legal and epistemological roles that the mental illness clause plays in the evaluation of legal responsibility. Although we acknowledge (...) that these advantages could be preserved without having this clause explicitly stated in the law, we resist proposals that deny the importance of mental illness in exculpation. We argue, thus, that any attempt at removing the mental illness clause from legal formulations of the insanity defence should offer alternative ways of keeping in place these advantages. (shrink)

Constitutivism argues that the source of the categorical force of the norms of rationality and morality lies in the constitutive features of agency. A systematic failure to be guided by these norms would amount to a loss or lack of agency. Since we cannot but be agents, we cannot but be unconditionally guided by these norms. The constitutivist strategy has been challenged by David Enoch. He argues that our participation in agency is optional and thus cannot be a source of (...) categorical demands. In this paper, I defend the viability of constitutivism by showing that agency is indeed a special ‘inescapable’ enterprise. Agency has the largest jurisdiction, and it is closed under rational assessment. This inescapability does not exempt constitutivism from raising the question whether agents have reason to be agents, but this question has to be taken up within agency. If this question is answered affirmatively, then—I argue—the criteria of practical correctness are self-ratifying in a non-circular way. This is sufficient to show the viability of the constitutivist strategy. Whether agents have conclusive reasons to be agents, however, is a matter to be addressed in the terms of particular versions of constitutivism. (shrink)

This book examines phenomenal conservatism, one of the most influential and promising internalist conceptions of non-inferential justification debated in current epistemology and philosophy of mind. It also explores the significance of the findings of this examination for the general debate on epistemic justification. According to phenomenal conservatism, non-inferential justification rests on seemings or appearances, conceived of as experiences provided with propositional content. Phenomenal conservatism states that if it appears to S that P, in the absence of defeaters, S thereby has (...) some justification for believing that P. This view provides the basis for foundationalism and many ordinary epistemic practices. This book sheds new light on phenomenal conservatism by assessing objections to it and examining epistemological merits and advantages attributed to it. In a nutshell, phenomenal conservatism is actually compatible with Bayesian reasoning, and it is unaffected by bootstrapping problems and challenges that appeal to the cognitive penetrability of perception. Nevertheless, appearance-based justification proves unstable or elusive and its antisceptical bite is more limited than expected. These difficulties could be surmounted if phenomenal conservatism were integrated with a theory of inferential justification. The book appeals to scholars and postgraduates in the field of epistemology and philosophy of mind who are interested in the rational roles of appearances. (shrink)

The paper introduces what is deemed as the general epistemological problem of measurement: what characterizes measurement with respect to generic evaluation? It also analyzes the fundamental positions that have been maintained about this issue, thus presenting some sketches for a conceptual history of measurement. This characterization, in which three distinct standpoints are recognized, corresponding to a metaphysical, an anti-metaphysical, and relativistic period, allows us to introduce and briefly discuss some general issues on the current epistemological status of measurement science.

In this paper, I will discuss the various ways in which intentions can be said to be conditional, with particular attention to the internal conditions on the intentions’ content. I will first consider what it takes to carry out a conditional intention. I will then discuss how the distinctive norms of intention apply to conditional intentions and whether conditional intentions are a weaker sort of commitments than the unconditional ones. This discussion will lead to the idea of what I call (...) the ‘deep structure’ of intentions. Roughly, this is the idea that the conditional nature of our intentions is only partially made explicit in the expressions we use to communicate our intentions and in the explicit form of our thinking about and reasoning with them. Most conditions that qualify our intentions are part of a deep functional structure that can be evinced by observing the actual psychological functioning of intentions and by considering the rational requirements that they engage. I will argue that the deep structure of intentions is characteristically conditional. Genuinely unconditional intentions are only limiting instances of conditional intentions and their contribution to agency can only be understood in light of this fact. I will conclude by showing that the characteristic conditional structure of intentions is intimately related to distinctive features of human agency, especially to its unity over time. (shrink)

In this paper we show how Dummett-Prawitz-style proof-theoretic semantics has to be modified in order to cope with paradoxical phenomena. It will turn out that one of its basic tenets has to be given up, namely the definition of the correctness of an inference as validity preservation. As a result, the notions of an argument being valid and of an argument being constituted by correct inference rules will no more coincide. The gap between the two notions is accounted for by (...) introducing the distinction between sense and denotation in the proof-theoretic-semantic setting. (shrink)

Many classically valid meta-inferences fail in a standard supervaluationist framework. This allegedly prevents supervaluationism from offering an account of good deductive reasoning. We provide a proof system for supervaluationist logic which includes supervaluationistically acceptable versions of the classical meta-inferences. The proof system emerges naturally by thinking of truth as licensing assertion, falsity as licensing negative assertion and lack of truth-value as licensing rejection and weak assertion. Moreover, the proof system respects well-known criteria for the admissibility of inference rules. Thus, supervaluationists (...) can provide an account of good deductive reasoning. Our proof system moreover brings to light how one can revise the standard supervaluationist framework to make room for higher-order vagueness. We prove that the resulting logic is sound and complete with respect to the consequence relation that preserves truth in a model of the non-normal modal logic _NT_. Finally, we extend our approach to a first-order setting and show that supervaluationism can treat vagueness in the same way at every order. The failure of conditional proof and other meta-inferences is a crucial ingredient in this treatment and hence should be embraced, not lamented. (shrink)

This paper investigates, in a simple risk-sharing framework, the extent to which the incompleteness of contracts could be attributed to the complexity costs associated with the writing and the implementation of contracts. We show that, given any measure of complexity in a very general class, it is possible to find simple contracting problems such that, when complexity costs are explicitly taken into account, the contracting parties optimally choose an incomplete contract which coincides with the ‘default’ division of surplus. Optimal contracts (...) with complexity costs are constrained efficient in our model. We therefore interpret our results as saying that, in the absence of a strategic role for complexity costs, their effect is entirely determined by their size relative to the size of payoffs. Crispin Wright has given an explanation of how a first time warrant can fall short of transmitting across a known entailment. Formal epistemologists have struggled to turn Wright’s informal explanation into cogent Bayesian reasoning. In this paper, I analyse two Bayesian models of Wright’s account respectively proposed by Samir Okasha and Jake Chandler. I argue that both formalizations are unsatisfactory for different reasons, and I lay down a third Bayesian model that appears to me to capture the valid kernel of (...) Wright’s explanation. After this, I consider a recent development in Wright’s account of transmission failure. Wright suggests that his condition sufficient for transmission failure of first time warrant also suffices for transmission failure of supplementary warrant. I propose an interpretation of Wright’s suggestion that shield it from objections. I then lay down a fourth Bayesian framework that provides a simplified model of the unified explanation of transmission failure envisaged by Wright. (shrink)

In set theory, a maximality principle is a principle that asserts some maximality property of the universe of sets or some part thereof. Set theorists have formulated a variety of maximality principles in order to settle statements left undecided by current standard set theory. In addition, philosophers of mathematics have explored maximality principles whilst attempting to prove categoricity theorems for set theory or providing criteria for selecting foundational theories. In Aristophanes' Male and Female Revolutions author Kenneth M. De Luca offers a detailed study of two of Aristophanes' plays and reveals how each illuminates the other and the question of the rule of law through the lens of democracy. De Luca uses classical thought to clarify contemporary and foundational issues in political theory.

There are some distinct methodological challenges, and possible pitfalls, for neuroethics when it evaluates neuroscientific results and links them to issues such as moral or legal responsibility. Some problems emerge in determining the requirements for responsibility. We will show how philosophical proposals in this area need to interact with legal doctrine and practice. Problems can occur when inferring normative implications from neuroscientific results. Other problems arise when it is not recognized that data about brain anatomy or physiology are relevant to (...) the ascription of responsibility only when they are significantly correlated with the psychological capacities contemplated by the legal formulations of responsibility. We will demonstrate this by considering two significant cases concerning psychopathy. Some paradigms that aim at measuring higher-order capacities, such as moral understanding, have limited validity. More robust paradigms for the study of learning in restricted controlled conditions, on the other hand, have limited ecological validity across individuals and context to be of any use for the law. There is widespread debate in contemporary philosophy of mind over the place of conscious experiences in the natural world – where the latter is taken to be broadly as described and explained by such sciences as physics, chemistry and biology; while conscious experiences encompass pains, bodily sensations, perceptions, feelings and moods. Many philosophers and scientists, who endorse physicalism or materialism, maintain that these mental states can be completely described and explained in natural terms. Frank Jackson’s knowledge argument is a very (...) influential objection to physicalism and, thus, to such an optimistic view about the scientific treatability of conscious experiences. According to the knowledge argument, we can know facts about our colour experiences that are not physical facts. -/- At the heart of this book lies a response to the knowledge argument that aims to defend a version of physicalism, that the author calls modest reductionism. This reply is based on the endorsement of the phenomenal concept strategy. According to this response, the knowledge argument cannot prove that there are non-physical facts. Instead, it can only show that there are ways of thinking about colour experiences that are based on phenomenal concepts that differ from scientific concepts. The author argues for the superiority of the phenomenal concept strategy over other influential physicalist replies to the knowledge argument. However, he criticises some recent physicalist accounts of phenomenal concepts and develops his own distinctive theory of these concepts. -/- . (shrink)

Coherentism in epistemology has long suffered from lack of formal and quantitative explication of the notion of coherence. One might hope that probabilistic accounts of coherence such as those proposed by Lewis, Shogenji, Olsson, Fitelson, and Bovens and Hartmann will finally help solve this problem. This paper shows, however, that those accounts have a serious common problem: the problem of belief individuation. The coherence degree that each of the accounts assigns to an information set (or the verdict it gives as (...) to whether the set is coherent tout court) depends on how beliefs (or propositions) that represent the set are individuated. Indeed, logically equivalent belief sets that represent the same information set can be given drastically different degrees of coherence. This feature clashes with our natural and reasonable expectation that the coherence degree of a belief set does not change unless the believer adds essentially new information to the set or drops old information from it; or, to put it simply, that the believer cannot raise or lower the degree of coherence by purely logical reasoning. None of the accounts in question can adequately deal with coherence once logical inferences get into the picture. Toward the end of the paper, another notion of coherence that takes into account not only the contents but also the origins (or sources) of the relevant beliefs is considered. It is argued that this notion of coherence is of dubious significance, and that it does not help solve the problem of belief individuation. (shrink)

This paper questions different conceptions of Medical Humanities in order to provide a clearer understanding of what they are and why they matter. Building upon former attempts, we defend a conception of Medical Humanities as a humanistic problem-based approach to medicine aiming at influencing its nature and practice. In particular, we discuss three main conceptual issues regarding the overall nature of this discipline: (i) a problem-driven approach to Medical Humanities; (ii) the need for an integration of Medical Humanities into medicine; (...) According to constitutivism, we can justify the authority of aims and norms on the ground that they are inescapable. Constitutivist views divide between ambitious and modest ones. According to ambitious constitutivism, the inescapability of aims grounds their unconditional authority, whereas according to modest constitutivism, the inescapability of aims only grounds their conditional authority. Either way, both forms of constitutivism share the assumption that inescapability grounds authority, which in turn presupposes that at the foundation of normativity we find aims and norms (...) that can be evaluated as having or lacking authority. In this paper I shall defend a form of constitutivism that rejects this assumption. According to this view, which I shall call Hinge Constitutivism, at the foundation of epistemic normativity we find an aim, the truth-aim, that is altogether beyond the evaluation in terms of the ordinary notion of authority. Moreover, I shall argue that to aim at truth is a condition of possibility for justifying the authority of any other aims or norms. In this sense, to aim at truth is a hinge of deliberation. This book offers the first comprehensive exploration of the relevance of naturalism and theories of nature in Classical German Philosophy. It presents new readings from internationally renowned scholars on Kant, Jacobi, Goethe, the Romantic tradition, Fichte, Schelling, Hegel, and Marx that highlight the significance of conceptions of nature and naturalism in Classical German Philosophy for contemporary concerns. The collection presents an inclusive view: it goes beyond the usual restricted focus on single thinkers to encompass the tradition as a whole, prompting (...) dialogue among scholars interested in different authors and areas. It thus illuminates the post-Kantian tradition in a new, wider sense. The chapters also mobilize a productive perspective at the intersection of philosophy and history by combining careful textual and historical analysis with argument-based philosophizing. This book develops an original theoretical framework for understanding human-technology relations. The author's approach, which he calls technoanalysis, analyzes artificial intelligence based on Freudian psychoanalysis, biosemiotics, and Latour's actor-network theory. How can we communicate with AI to determine shared values and objectives? And what, ultimately, do we want from machines? These are crucial questions in our world, where the influence of AI-based technologies is rapidly growing. Unconscious dynamics influence AI and digital technology and understanding them is essential to better controlling (...) AI systems. Standard metasemantic frameworks render word meanings resistant to the control of ordinary speakers, and hinder our ability to exercise sovereignty over the denotations of words. The literature suggests three main responses to the problem: views on which ordinary denotational interventions cannot cause changes to semantic reality, views on which we should drop the metasemantic premises that generate the difficulty, and views on which denotational interventions boil down to operations on a non-recalcitrant region of the semantic spectrum. I review these responses (...) and argue that they face difficulties. Then, I draw on linguistic work on variation to make an alternative proposal. I suggest that part of the problem hinges on a tendency to think about standing meanings under heavily idealized assumptions of intra-linguistic homogeneity. To amend this, we should consider endorsing a localist ontology for semantic properties that allows individual vocabulary items to bear variable standing meanings at different communities of speakers of a public language. The result, I argue, is a middle-ground framework which accepts the difficulties of wide-scope meaning change while granting speakers semantic self-determination, and strikes an attractive balance between a few central desiderata. Contemporary views of truth-directedness endorse what I shall call the Common-Element Argument. According to this argument, there is something in common between judgment and other attitudes like assumption and imagination: they all regard their contents as true. Since this regarding-as-true feature is not distinctive of judgment - the argument goes - it can’t explain its truth-directedness. On this ground, theorists have been motivated to endorse an inflationary view that tries to capture truth-directedness by appealing to some further feature: intentions, second-order (...) representations, sub-personal mechanisms, or subjugation to norms are the most discussed candidates for fulfilling this role. In this paper I will argue that the Common-Element Argument is unsound. It rests on a false premise, namely that there is some common element such as a regarding-as-true component between judgment and other cognitive attitudes. I shall reject Velleman’s and Railton’s defenses of the Common-Element-Argument. Then I will discuss three influential inflationary accounts of truth-directedness: Railton’s account, Velleman’s teleological account, and Shah and Velleman’s conceptualist account. I shall argue that they all face a phenomenological and an explanatory challenge. Finally, I shall sketch a deflationary view of truth-directedness that evades these challenges. (shrink)

Prominent theories in moral psychology maintain that a core aspect of moral competence is the ability to distinguish moral norms, which derive from universal principles of justice and fairness, from conventional norms, which are contingent on a specific group consensus. The present study investigated the psychological bases of the moral-conventional distinction by manipulating the framing of the test question, the authority’s license, and the historical context. Participants evaluated moral and conventional transgressions by answering an ‘okay for you’ test question (i.e., (...) judging according to their opinion) or an ‘okay in context’ test question (i.e., judging by imagining being a contemporary of the story protagonist). In evaluating moral transgressions that happened in a distant context or with the authority’s license, most of the participants condemned the violations when responding to the ‘okay for you’ test question, but did not do so when responding to the ‘okay in context’ test question. A similar effect of the question framing was found also on scenarios presenting conventional violations suggesting that subtle changes in the framing of the test question can influence people’s evaluations of both moral and conventional prototypical transgressions. We propose that these effects indicate the presence of moral and conventional construals of social actions that are highly flexible and context-sensitive. (shrink)

Recently it has been argued that certain neuropsychological findings on the decision-making, instrumental learning, and moral understanding in psychopathic offenders offer reasons to consider them not criminally responsible, due to certain epistemic and volitional impairments. We reply to this family of arguments, that collectively we call the irresponsibility of the psychopath argument. This type of argument has a premise that describes or prescribes the deficiencies that grant or should grant partial or complete criminal exculpation. The other premise contends that neuropsychological (...) evidence shows that psychopaths have incapacitates that are sufficient to ascribe complete or partially exculpatory deficiencies. The focus of our criticism is this latter premise. We argue that it requires that psychopathy should correlate significantly with certain rational incapacities that manifest across contexts. We show that the available neuropsychological data do not support the claim that psychopaths have such general exculpatory incapacities. (shrink)

We introduce the rejection game, designed to formalize the interaction between interlocutors in a Stalnakerian conversation: a speaker who asserts something and a listener who may accept or reject. The rejection game is similar to other signalling games known to the literature in economics and biology. We point out similarities and differences, and propose an application in linguistics. We uncover basic conditions under which the Gricean maxim of quality emerges from incentives among the players, providing evidence for a functionalist understanding (...) of the Gricean program. In the last decades Robert Fludd’s philosophy has received increasing attention. On the other hand, his life, network, and acquaintances have been investigated in much less detail. As William Huffman rightly put it, “[o]ne of the main problems confronting someone interested in Robert Fludd is the lack of information about his formative years, as well as about his later associations”. Ron Heisler already observed that regrettably Huffman’s own account is not always accurate or complete. Scholars such as Johannes Rösche have (...) recently added more details. The aim of this article is to give scope for further research; it collects contributions by previous scholars and adds details, corrects inaccuracies, identifies hitherto nameless people with whom Fludd came into contact, and places he visited. Both sustainability and identity are said to be paradoxical issues in organizations. In this study we look at the paradoxes of corporate sustainability at the individual level by studying the identity work of those managers who hold sustainability-dedicated roles in organizations. Analysing 26 interviews with sustainability managers, we identify three main tensions affecting their identity construction process: the business versus values oriented, the organizational insider versus outsider and the short-term versus long-term focused identity work tensions. When dealing with these tensions, (...) some interviewees express a paradoxical perspective in attempting to accept and maintain the two poles of each of them simultaneously. It emerges in particular that metaphorical reasoning can be used by sustainability managers in varied ways to cope with the tensions of identity work. Background Italy was the first European country to be involved with the COVID-19 pandemic. As a result, many healthcare professionals were deployed and suddenly faced end-of-life care management and its challenges. Aims To understand the experiences of palliative care professionals deployed in supporting emergency and critical care staff during the COVID-19 first and second pandemic waves. Research design A qualitative descriptive design was adopted, and in-depth interviews were used to investigate and analyse participants’ perceptions and points of view. Participants and (...) research context Twenty-four healthcare professionals (physicians, nurses, psychologists, physiotherapists, and spiritual support) from the most affected areas of Italy were recruited via the Italian society of palliative care and researchers’ network. Ethical considerations The University Institutional Board granted ethical approval. Participants gave written informed consent and agreed to be video-recorded. Findings The overarching theme highlighted participants’ experience supporting health professionals to negotiate ethical complexity in end-of-life care. Crucial topics that emerged within themes were: training emergency department professionals on ethical dimensions of palliative and end-of-life care, preserving dying patients’ dignity and developing ethical competence in managing end-of-life care. Conclusions Our study showed palliative care teams’ challenges in supporting health professionals’ ethical awareness in emergencies. However, while they highlighted their concerns in dealing with the emergency staff’s lack of ethical perspectives, they also reported the positive impact of an ethically-informed palliative care approach. Lastly, this study illuminates how palliative care professionals’ clinical and ethical competence might have assisted a cultural change in caring for dying patients during COVID-19 and future emergencies.
