Ontologies represent the standard way to model the knowledge about specific domains. This holds also for the legal domain where several ontologies have been put forward to model specific kinds of legal knowledge. Both for standard users and for law scholars, it is often difficult to have an overall view on the existing alternatives, their main features and their interlinking with the other ontologies. To answer this need, in this paper, we address an analysis of the state-of-the-art in legal ontologies (...) and we characterise them along with some distinctive features. This paper aims to guide generic users and law experts in selecting the legal ontology that better fits their needs and in understanding its specificity so that proper extensions to the selected model could be investigated. Siamo ormai lontani dalla stagione in cui la forza propulsiva della “svolta linguistica” si impose come tendenza dominante nel dibattito filosofico. Da varie angolazioni si è potuto parlare negli ultimi anni di pictorial turn come antidoto all’egemonia del paradigma linguistico in filosofia. Il volume Verità, Immagine, Normatività. Truth, Image, and Normativity non si inserisce direttamente in questa nuova tendenza, ma ruota comunque intorno a questioni che derivano dal medesimo sfondo. I 24 saggi qui raccolti tengono conto dei diversi ruoli che (...) le immagini possono svolgere, a seconda che si focalizzi la loro dimensione descrittiva o normativa, e indagano alcuni aspetti del rapporto tra immagine e linguaggio. Questi problemi di filosofia dell’immagine, intesa sia come immagine cognitiva sia come immagine grafica, costituiscono il fil rouge di questo volume. Una tale riflessione sui linguaggi figurati e sulla comunicazione visiva non-linguistica costringe a riformulare in termini nuovi le grandi domande concernenti le tradizionali nozioni di verità, oggettività, normatività, consenso e persuasione. This chapter serves as an introduction to a carefully planned research and mutually curated volume on the relationship between Pop art initiator Eduardo Paolozzi and celebrity philosopher Ludwig Wittgenstein. Mantoan and Perissinotto argue that this peculiar encounter between an artist and a philosopher—both as a man and as far as his philosophy is concerned—was a “kind of happening”, which took place years before the generation of future conceptual artists had even entered art school. Not only was Paolozzi the first and (...) perhaps still is the only artist who devoted a substantial part of his oeuvre to the Austrian philosopher, but his works also impress even a philosophically qualified audience for the level of expertise and intuitiveness with which the writings of Wittgenstein are handled. Hence, Mantoan and Perissinotto pursue a twofold aim: on the one side, to present the artist Paolozzi as a precursor in reading Wittgenstein in the field of contemporary art, influencing or forestalling the then upcoming generation of conceptual artists; on the other side, to demonstrate how the reader Paolozzi may even be seen as a precursor as regards the interpretation of Wittgenstein’s philosophy. In questo contributo tenterò di rispondere ad una domanda fondamentale e assai complessa: la concezione di Dio come Esse Ipsum Subsistens rischia una deriva verso il monismo parmenideo? L’indagine verterà dapprima sul superamento di Aristotele della visione parmenidea e poi si concentrerà sulla metafisica dell’essere di Tommaso d’Aquino che, se correttamente intesa, non rischia affatto una deriva verso il monismo ontologico. Saranno infatti presentati alcuni passi che comprovano come il concetto centrale della concezione di Tommaso, quello di partecipazione, garantisca proprio (...) dal rischio del monismo, a patto che si intenda la presenza di Dio negli enti non in un senso quantitativo. This special volume 6 of "Symphilosophie: International Journal of Philosophical Romanticism" celebrates and engages with Immanuel Kant’s legacy and indelible influence on the romantics in the eighteenth and nineteenth centuries. In recognition of Kant’s enduring importance, we have invited authors to mark his 300th birth year with articles, translations, and reviews that take up Kantian themes present in romantic thinkers. Despite the contrast in styles between Kant and the romantics, the importance of Kant’s critical system for the core ideas of (...) romanticism is undeniable and inex- tricable. In questo contributo vengono indagati alcuni concetti della teologia aristotelica (il concetto di divino e quello di trascendenza) a partire da un’espressione emblematica utilizzata dallo storico francese Étienne Gilson per descrivere il Primo Motore Immobile aristotelico: “centrale elettrica della natura”. L’espressione del noto studioso non è soltanto particolarmente accattivante, ma risulta essere filosoficamente assai significativa poiché veicola perfettamente il significato che assume il Dio di Aristotele nell’economia complessiva del cosmo, più in particolare nel ciclo eterno delle corruzioni e delle generazioni. La ricostruzione storica è finalizzata a mostrare la novità del messaggio cristiano contenuto nella Rivelazione e che trova nelle pagine di Tommaso d’Aquino una chiarezza concettuale, filosofico-metafisica, di eccezionale valore. In esse è possibile osservare la piena maturazione della nuova visione di tipo creazionista (basata sulla Metafisica dell’Esodo 3,14) che, pur in continuità con la visione aristotelica, ne approfondisce smisuratamente i presupposti metafisici. The standard interpretation of quantum physics (QP) and some recent generalizations of this theory rest on the adoption of a rerificationist theory of truth and meaning, while most proposals for modifying and interpreting QP in a “realistic” way attribute an ontological status to theoretical physical entities (ontological realism). Both terms of this dichotomy are criticizable, and many quantum paradoxes can be attributed to it. We discuss a new viewpoint in this paper (semantic realism, or briefly SR), which applies both to (...) classical physics (CP) and to QP. and is characterized by the attempt of giving up verificationism without adopting ontological realism. As a first step, we construct a formalized observative language L endowed with a correspondence truth theory. Then, we state a set of axioms by means of L which hold both in CP and in QP. and construct a further language Lv which can express bothtestable andtheoretical properties of a given physical system. The concepts ofmeaning andtestability do not collapse in L and Le hence we can distinguish between semantic and pragmatic compatibility of physical properties and define the concepts of testability and conjoint testability of statements of L and Le. In this context a new metatheoretical principle (MGP) is stated, which limits the validity of empirical physical laws. By applying SR (in particular. MGP) to QP, one can interpret quantum logic as a theory of testability in QP, show that QP is semantically incomplete, and invalidate the widespread claim that contextuality is unavoidable in QP. Furthermore. SR introduces some changes in the conventional interpretation of ideal measurements and Heisenberg’s uncertainty principle. (shrink)

According to the doctrine of the guise of the good, all that is desired is seen by the subject as good to some extent. As a claim about action, the idea is that intentional action, or acting for a reason, is action that is seen as good by the agent. I explore the thesis' main attractions: it provides an account of intentional behavior as something that makes sense to the agent, it paves the way for various views in meta-ethics and (...) normative ethics, and it offers a unified account of practical and theoretical reason. In response to common objections, I examine points of current debate: what is it for something to appear as good? Is value or normative reasons the basic concept at work? How to explain akrasia, perversity in action, and expressive action? I conclude with an overview of alternatives to the guise of the good. (shrink)

Although Volk may be considered as a central concept in the work of Carl Schmitt, and one to which the German jurist dedicated a sizable amount of writing, a remarkably limited number of publications have so far provided an analytical study of how Schmitt conceptualised Volk, particularly in English-language secondary literature. This article intends to address this gap by systematically reviewing how the concept of Volk appears in the Schmitt’s theoretical effort, with a particular focus on his publications from the (...) late 1920s to 1945, and how it relates to his main legal-theoretical and political claims, both in his constitutional doctrine (Staatsrechtslehre) as well as in international law. It sketches some interpretive pathways to locate Volk in a broader historical and theoretical context, and it offers a conceptualisation of the relation between Schmitt and existentialist nationalism. The fitting attitude analysis of value states that for objects to have value is for them to be the fitting targets of attitudes. Good objects are the fitting targets of positive attitudes, while bad objects are the fitting targets of negative attitudes. The following paper presents an argument to the effect that value and the fittingness of attitudes differ in terms of their explanations. Whereas the fittingness of attitudes is explained, inter alia, by both the properties of attitudes and those (...) of their fitting targets, the explanation of value tends to have a different content. In particular, objects have value in virtue of the features that make them valuable, and these need not involve any attitudinal properties. If this is right, then there are reasons to doubt the claim that for objects to have value is just for them to be the fitting targets of attitudes. Insofar as value is a property, it appears to be distinct from the property of objects being the fitting targets of attitudes. (shrink)

Frances Kamm argues that physical distance is per se relevant to our duty to give aid to strangers.
Her methods, however, fail to bring into light the relevance per se of distance. To understand the claim that
distance is per se morally relevant, it is helpful to use distinctions devised by Jonathan Dancy among
different roles a feature may play in the explanation of moral reasons, yielding thus different senses of
relevance. A feature can directly count in favor of an action, enable another feature (...) to count in favor of an
action, or strengthen the favoring already done by another feature. For the relevance of nearness that is at
issue in Kamm's thesis, if nearness is relevant at all to our duty to aid strangers, it cannot be relevant in the
way Kamm takes it to be. It cannot directly count in favor of aiding or be a special reason to aid, someone
that non-near agents lack. Nor can physical distance be seen as a consideration that strengthens our
independently existing pro tanto duty to aid strangers, whenever we are near them. (shrink)

This book argues that Michael Oakeshott's political philosophy contributes to current debates in normative international theory and international political theory on the historical, social, and moral dimension of international society. Davide Orsi contends that the theory of civil association may be the ground for an understanding of international society as a rule-based form of moral association constituted by customary international law. The book also considers the role of evolving practices of morality in debates on international justice. The intuition of neutrality, as discussed by John Broome, says that the addition of people does not, by itself, produce or subtract value from the world. Such intuition allows us to disregard the effects of climate change policy onto the size of populations, effectively allowing us to make policy recommendations. Broome has argued that the intuition has to go. Orsi responds by urging a normative (rather than Broome's axiological) interpretation of neutrality in terms of an exclusionary permission to disregard (...) the value of adding lives. He explores justifications and limits of such permission by referring to the prospect of human extinction. (shrink)

The paper presents a positive argument for a version of metaphysically light ethical non-naturalism from the nature of mental states such as desires. It uses as its premise the time-honoured, and recently rediscovered, doctrine of the guise of the good, whereby it is essential to desire that the object of desire be conceived as good or as normatively favoured under some description. The argument is that if the guise of the good is a correct theory of desire, then a certain (...) version of non-naturalism is better placed than other meta-ethical views to make sense of it. First I define ethical non-naturalism and the guise of the good, providing also an initial defence of the latter. Then I briefly survey some historical precedents and proceed to the argument. For each major meta-ethical view I consider I offer reasons why combining them with the guise of the good leads to consequences that are or should be unwelcome by the guise of the good. At the end of this elimination process a form of relatively metaphysically light non-naturalism will emerge as the view that best fits with the guise of the good. (shrink)

The aim of this work is to bring analytically to light Sidgwick’s complex views on sexual morality. Sidgwick saw nothing intrinsically, self-evidently, and even derivatively wrong in getting sexual pleasure for its own sake. However, the overall consequences of attempting to modify common sense in matters of sexual ethics seemed to him to be worse, at his time, than retaining the moral category of purity. Sidgwick’s view is then contrasted with John Stuart Mill’s, whom he directly mentions in this connection. (...)
