Knowledge of the heterosexual spread of HIV is needed to plan future health-care needs. In December 1989 we gained approval and finance for unlinked anonymous testing of neonatal Guthrie card samples in Scotland. Local ethics committee approval was required before testing could start. Twenty ethics committees were approached in the 15 Scottish health board areas. Nineteen of the committees have agreed, representing 99.6 per cent of births in Scotland. Cloth, $75.00.Professor Sell’s goal is to discern the impact of Locke’s thought upon the later divines; Sell’s scope is the seventeenth century through the nineteenth century. Most of the text is a detailed descriptive account of various scholars’ reactions (...) to Locke’s epistemology, metaphysics, and views concerning religion. Sell focuses on the question of the relative authority of scripture, reason and revelation. He contends that Locke’s epistemological and political positions are intimately bound up with his Christian faith, that as a conservative empiricist, Locke is “much more the rationalist than he has sometimes been painted” (48). The important question bequeathed by Locke to Christian apologetics is: “can the epistemological starting point be redeemed for Christian apologetic use or is it not viable at all?” (12). Sell addresses this question throughout the following chapters: “Ideas, Knowledge and Truth”; “Reason, Revelation, Faith and Scripture”; “Morality and Liberty”; “Toleration and Government”; and “Christian Doctrine”.Sell notes Locke’s roots in Calvinism, his appreciation of Arminian doctrine and his friendship with a number of prominent Latitudinarians. He argues that most criticisms of Locke’s Reasonableness of Christianity are misguided. During the seventeenth and eighteenth centuries Locke was charged with scepticism, deism, Socinianism and materialism. Sell presents the objections of numerous scholars, notably Bishop Stillingfleet, William Carroll, John Norris, Richard Bentley, Henry Lee, Richard Price, Bishop Berkeley, and Samuel Johnson. He also covers the views of Locke’s defenders, including Anthony Collins, Catharine Cockburn and Samuel Bold.The reader might be disappointed with Sell’s short presentation of an inordinate number of Lockean critics; there is little analysis or discussion of the merits of the particular objections cited. He does offer an analysis of the general charges against Locke, but rarely quotes Locke sufficiently to justify his conclusion that Locke was not a deist, sceptic, or materialist. Sell simply takes Locke’s word for it. This book is best taken as an excellent reference guide.Sell contends that in spite of Locke’s friendship with deists such as Collins, Locke’s Reasonableness of the Christian Religion was written to dissolve the deist prejudice against Christianity. He dismisses the charge of deism because: (1) Locke argues for revelation and against natural religion, (2) Locke’s God possesses the traditional attributes assigned to him (power, omniscience, providence), (3) Locke grounds morality not exclusively in natural law, as did deists, but in the gospel, (4) the anti-materialist thrust of Book IV, Chapter X of the Essay, and (5) Locke’s argument that there can be truths of revelation which are above reason. Sell concludes that the “main problem posed to Locke by the deists was that of guilt by association” (209), in other words Locke’s work was misused for political reasons.Sell considers the charge of Socinianism more serious than that of deism. Socinianism is defined by its denial of the Trinity, and by the claims that there cannot be an innate idea of God, that there is no original corruption deriving from Adam, that the wicked will not suffer eternal torments, and that some bodies are not raised at general resurrection. Despite Locke’s agreement with most Socinian claims, Sell claims that [End Page 631] Locke cannot be pinned down on the issue of the Trinity. There is no question, he says, that “the Locke of 1662 affirmed both the doctrine of the Trinity and the human divine nature of Christ, whilst recognizing that the human mind could not explain how these things could be so; there is no question that especially from the 1690’s onwards he was actively reviewing the matter; there is no hard evidence that he ever repudiated the doctrine.” (214)According to Stillingfleet, Locke’s sensationalism and his proposal that matter might be capable of thought undermine Christian faith. Berkeley's Theory of Vision, or Visual Language Showing The Immediate Presence and Providence of A Deity, Vindicated And Explained was published in 1733, occasioned by an anonymous letter of the previous year to the London Daily Post Boy . The letter criticized Berkeley's New Theory of Vision , which had been published in 1709, but which had been appended to Berekely's Alciphron , published in 1732. No one has ever identified the author whose criticisms led Berkeley to his Theory of (...) Vision Vindicated . Circumstantial evidence presented here suggests that the author was Catherine Trotter Cockburn. Part of the evidence is the brilliance of her interpretation of Locke, whose position is defended in the letter against Berkeley. (shrink)

The McNaughton rules for determining whether a person can be successfully defended on the grounds of mental incompetence were determined by a committee of the House of Lords in 1843. They arose as a consequence of the trial of Daniel McNaughton for the killing of Prime Minister Sir Robert Peel’s secretary. In retrospect it is clear that McNaughton suffered from schizophrenia. The successful defence of McNaughton on the grounds of mental incompetence by his advocate Sir Alexander Cockburn involved a (...) profound shift in the criteria for such a defence, and was largely based on the then recently published scientific thesis of the great US psychiatrist Isaac Ray, entitled A Treatise on the Medical Jurisprudence of Insanity. Subsequent discussion of this defence in the House of Lords led to the McNaughton rules, still the basis of the defence of mental incompetence in the courts of much of the English-speaking world. This essay considers one of these rules in the light of the discoveries of cognitive neuroscience made during the 160 years since Ray’s treatise. A major consideration is the relationship between the power of self-control and irresistible impulse as conceived by Cockburn on the one hand, and by cognitive neuroscience on the other. The essay concludes with an analysis of the notion of free will and of the extent to which a subject can exert restraint in the absence of particular synaptic connections in the brain. (shrink)

In this impressive study of early Modern Philosophy, Jacqueline Broad analyzes the influence that Cartesianism has had in the development of feminist thought. Her work covers the early modern philosophy of Elisabeth of Bohemia, Margaret Cavendish, (...) Ann Conway, Mary Astell, Damaris Cudworth Masham and Catherine Trotter Cockburn. She points out the paradoxical relationship between current feminist philosophy and the writings of early Modern women. Broad concentrates on the metaphysical issues of mind-body dualism, thinking matter, and the role of reason in knowledge.Recent feminists have argued that even though Cartesianism appears to emphasize an egalitarian concept of reason, it entails a male bias which excludes women from philosophy. Broad covers the work of Genevieve Lloyd, Hilda Smith, Margaret Atherton and other feminists. Her goal is to show that the common Cartesian interpretation of early women's writings obscures the anti-Cartesian and anti-dualist aspects of their thought. Like Lloyd, she argues that historically women were associated with a lesser form of reason following the rise of Cartesianism.The conflict between reason and femininity is noted in the complexity of early Modern thought. Broad argues that even though Elisabeth is remembered as a critic of Descartes, many of her suggestions are not as anti-dualist as some scholars believe. Broad highlights the critical content of Elisabeth's letters to Descartes and discusses her criticisms of dualism and her Cartesian method of discovering truth and certainty. On the basis of her letters she contends that Elisabeth can be regarded as a precursor to feminist philosophers who give an equal role to the body and emotions in their metaphysical and ethical writings.Like Elisabeth, Margaret Cavendish rejects Cartesian dualism. The common thread that runs through early Modern feminist philosophy is the argument that interaction between two unlike substances is inconceivable. Broad argues that like Cavendish, Anne Conway ascribes spiritual characteristics to the body and material properties to the soul. According to Broad, their ontological views amount to a rejection of the stereotypes of femininity.Broad argues that Mary Astell's metaphysical views diverge from the modern Cartesians of her time. Although she is indebted to Descartes, Broad contends that she supports a metaphysical system which avoids some of the gender biases identifiable in Cartesianism. Astell, for example, does not find a life based on reason as a rival to a life concerned with the body; her emphasis on rationality is simply a reaction to the stereotype of women as irrational material beings.Damaris Masham is generally considered a philosophical rival of Astell, but Broad argues that Masham's arguments are focused on the same presuppositions as Astell's. She argues that both philosophers champion women's education, criticize the occasionalism of Norris and believe in interaction between the corporeal and incorporeal worlds. Broad emphasizes the common theological outlook inspired by Cambridge Platonism. Contrary to the interpretation of Ruth Perry, she finds that there is sufficient evidence that Masham was positively inspired by the second part of Astell's Serious Proposal.Broad concludes with an analysis of Catherine Cockburns' metaphysics and moral philosophy. According to Cockburn, women's ignorance is simply the result of being discouraged from rational pursuits. Objective: To evaluate one ethics rounds model by describing nurses’ and doctors’ experiences of the rounds. Methods: Philosopher-ethicist-led interprofessional team ethics rounds concerning dialysis patient care problems were applied at three Swedish hospitals. The philosophers were instructed to promote mutual understanding and stimulate ethical reflection, without giving any recommendations or solutions. Interviews with seven doctors and 11 nurses were conducted regarding their experiences from the rounds, which were then analysed using content analysis. Findings: The goal of the rounds was partly (...) fulfilled. Participants described both positive and negative experiences. Good rounds included stimulation to broadened thinking, a sense of connecting, strengthened confidence to act, insight into moral responsibility and emotional relief. Negative experiences were associated with a sense of unconcern and alienation, as well as frustration with the lack of solutions and a sense of resignation that change is not possible. The findings suggest that the ethics rounds above all met the need of a forum for crossing over professional boundaries. The philosophers seemed to play an important role in structuring and stimulating reasoned arguments. The nurses’ expectation that solutions to the ethical problems would be sought despite explicit instructions to the contrary was conspicuous. Conclusion: When assisting healthcare professionals to learn a way through ethical problems in patient care, a balance should be found between ethical analyses, conflict resolution and problem solving. The hopes and fears expressed in the debate on human enhancement are not always based on a realistic assessment of the expected possibilities. Discussions about extreme scenarios may at times obscure the ethical and policy issues that are relevant today. This paper aims to contribute to an adequate and ethically sound societal response to actual current developments. After a brief outline of the ethical debate concerning neuro-enhancement, it describes the current state of the art in psychopharmacological science and current uses (...) of psychopharmacological enhancement, as well as the prospects for the near future. It then identifies ethical issues regarding psychopharmacological enhancements that require attention from policymakers, both on the professional and on the governmental level. These concern enhancement research, the gradual expansion of medical categories, off-label prescription and responsibility of doctors, and accessibility of enhancers on the Internet. It is concluded that further discussion on the advantages and drawbacks of enhancers on a collective social level is still needed. (shrink)

'Thought insertion' in schizophrenia involves somehow experiencing one's own thoughts as someone else's. Some philosophers try to make sense of this by distinguishing between ownership and agency: one still experiences oneself as the owner of an inserted thought but attributes it to another agency. In this paper, we propose that thought insertion involves experiencing thought contents as alien, rather than episodes of thinking. To make our case, we compare thought insertion to certain experiences of 'verbal hallucination' and show that they (...) amount to different descriptions of the same phenomenon: a quasi-perceptual experience of thought content. We add that the agency/ownership distinction is unhelpful here. What requires explanation is not why a person experiences a type of intentional state without the usual sense of agency, but why she experiences herself as the agent of one type of intentional state rather than another. Objective: To evaluate whether ethics rounds stimulated ethical reflection. Methods: Philosopher-ethicist-led interprofessional team ethics rounds concerning dialysis patient care problems were applied at three Swedish hospitals. The philosophers were instructed to stimulate ethical reflection and promote mutual understanding between professions but not to offer solutions. Questionnaires directly before and after rounds were answered by 194 respondents. The analyses were primarily content analysis with Boyd’s framework but were also statistical in nature. Findings: Seventy-six per cent of the respondents reported a moderate (...) to high rating regarding new insights on ethical problem identification, but the ethics rounds did not seem to stimulate the ethical reflection that the respondents had expected (p<0.001). Dominant new insights did not seem to fit into traditional normative ethics but were instead interpreted as hermeneutic ethics. This was illustrated in the extended perspective on the patient and increased awareness of relations to other professions. Regarding insights into how to solve ethical problems, the request for further interprofessional dialogue dominated both before and after rounds. Conclusion: The findings show the need for interprofessional reflective ethical practice but a balance between ethical reflection and problem solving is suggested if known patients are discussed. Further research is needed to explore the most effective leadership for reflective ethical practice. (shrink)

Today's modern car is an assemblage of mechanical and digital components, of metal panels that comprise its structure and silicon chips that run its functions. Communication and information studies scholars have interrogated the problematic aspects of the programs that run those functions, revealing serious issues surrounding privacy and security, worker surveillance, and racial, gendered, and class-based bias. This article contributes to that work by taking a step back and asking about the issues inherent not in the software running on these (...) chips, but on the microchips themselves. Using the lens of “chipification”—the process by which a device is rendered capable of reading and processing data through the embedding of microchips—this article explores how the integration of microchips also involves processes that are often borne from, replicate, or create troubling power dynamics of their own. It takes light-duty passenger vehicles as a case study into how chipification is radically reshaping such processes as resource allocation, labor flows, and cultural practices around car manufacture, use, repair, and modification. By naming the process of chipification, this article allows researchers to identify and analyze the ways that integrating data processing capabilities into everyday devices is not a frictionless practice, but rather one that implicates a variety of power dynamics within these massive industries. Clinical ethics support, including ethics consultation, has become established in the field of medical practice throughout the world. This practice has been regarded as useful, most notably in the UK and the USA, in solving ethical problems encountered by both medical practitioners and those who receive medical treatment. In Japan, however, few services are available to respond to everyday clinical ethical issues, although a variety of difficult ethical problems arise daily in the medical field: termination of life support, euthanasia and (...) questions about patient autonomy. In light of these conditions, a group of 17 volunteer educators and researchers from the area of biomedical ethics, including the authors, have formed the Clinical Ethics Support and Education Project, and began providing Japan’s first small team clinical ethics consultation service in October, 2006. Members include scholars of biomedical ethics, scholars of philosophy and ethics, legal professionals and legal scholars, nurses and doctors, consisting of five women and 12 men. Consultation teams, made up of a small number of members, were organised each time a request for consultation was received. Over approximately 15 months (October 2006–December 2007), the programme received 22 consultation requests from medical practitioners and medical institutions, and three from the families of patients. In this paper, we will discuss the status of our consultation service and examples of consultation cases we have handled. In addition, we will examine the process of evaluating small team clinical ethics consultation services, as well as the strengths and weakness of such programmes. (shrink)

The “standard position” on organ donation is that the donor must be dead in order for vital organs to be removed, a position with which we agree. Recently, Robert Truog and Walter Robinson have argued that brain death is not death, and even though “brain dead” patients are not dead, it is morally acceptable to remove vital organs from those patients. We accept and defend their claim that brain death is not death, and we argue against both the US “whole (...) brain” criterion and the UK “brain stem” criterion. Then we answer their arguments in favour of removing vital organs from “brain dead” and other classes of comatose patients. We dispute their claim that the removal of vital organs is morally equivalent to “letting nature take its course”, arguing that, unlike “allowing to die”, it is the removal of vital organs that kills the patient, not his or her disease or injury. Then, we argue that removing vital organs from living patients is immoral and contrary to the nature of medical practice. Finally, we offer practical suggestions for changing public policy on organ transplantation. (shrink)

It is sometimes suggested that expressivism in meta-ethics is to be criticized on grounds which do not themselves concern meta-ethics in particular, but which rather concern philosophy of language more generally. Frank Jackson and Philip Pettit (1998; see also Jackson and Pettit 1999, and Jackson 2001) have recently advanced a novel version of such an argument. They begin by noting that expressivism in its central form makes two claims—that ethical sentences are not truth evaluable, and that to assert an ethical (...) sentence is to express one’s desires or feelings rather than to report a fact. They then argue that, given some plausible premises in the philosophy of language emanating mainly from Locke, the two central claims of expressivism are contradictory: when combined with the plausible premises, they say, the second claim refutes the first. The purpose of this paper is to formulate Jackson and Pettit’s Lockean argument, and to suggest that it fails. (shrink)

This article explores yet another paradox – aside from the privacy paradox – related to the datafication of media: citizens trust least the media they use most It investigates the role that daily life plays in shaping the trust that citizens place in datafied media. The study reveals five sets of heuristics guiding the trust assessments of citizens: characteristics of media organisations, old media standards, context of use and purpose, experiences of datafication and understandings of datafication. The article discusses the (...) use of these heuristics and the value that everyday life holds in assessing trust in datafied media. It concludes that, guided by a partial ‘structure of perception’ and enticed into trusting datafied media in the context of their daily lives, citizens may be highly concerned by the datafication of media but use them nevertheless. In the past decades, an enormous amount of precious information has been collected about molecular and genetic characteristics of cancer. This knowledge is mainly based on a reductionistic approach, meanwhile cancer is widely recognized to be a ‘system biology disease’. The behavior of complex physiological processes cannot be understood simply by knowing how the parts work in isolation. There is not solely a matter how to integrate all available knowledge in such a way that we can still deal with complexity, (...) but we must be aware that a deeply transformation of the currently accepted oncologic paradigm is urgently needed. We have to think in terms of biological networks: understanding of complex functions may in fact be impossible without taking into consideration influences outside of the genome. Systems Biology involves connecting experimental unsupervised multivariate data to mathematical and computational approach than can simulate biologic systems for hypothesis testing or that can account for what it is not known from high-throughput data sets. Metabolomics could establish the requested link between genotype and phenotype, providing informations that ensure an integrated understanding of pathogenic mechanisms and metabolic phenotypes and provide a screening tool for new targeted drug. We give an example of a countable theory $T$ such that for every cardinal $\lambda \geq \aleph_2$ there is a fully indiscernible set $A$ of power $\lambda$ such that the principal types are dense over $A$, yet there is no atomic model of $T$ over $A$. In particular, $T$ is a theory of size $\lambda$ where the principal types are dense, yet $T$ has no atomic model.

Is it really necessary to add something like the Health Impact Fund to the existing global patent system? We can divide this question into two parts. First, is there something seriously wrong with the status quo and, if so, what exactly is it? Second, how do we best go about solving the problem; that is, how does the design of the reform proposal address the flaws in the status quo? Jorn Sonderholm, in his critique of the Health Impact Fund, or (...) HIF, raises both of these issues. These criticisms afford us the opportunity to reaffirm our commitment to ameliorating glaring problems with the current system for incentivizing R&D for essential medicines, and to clarify why we believe the HIF is exactly what the world needs.
