The argument between retributivists and consequentialists about what morally justifies the punishment of offenders is incoherent. If we were to discover that all of the contending justifications were mistaken, there is no realistic prospect that this would lead us to abandon legal punishment. Justification of words, beliefs and deeds, can only be intelligible on the assumption that if one's justification were found to be invalid and there were no alternative justification, one would be prepared to stop saying, believing or doing (...) what one has attempted to justify. Therefore, the moral standing or basis of our practices of punishing offenders can not rest on a justification of it. (shrink)

Critical pedagogy is an optimistic approach for achieving transformative agency, which remains an elusive and vital aspect of civic education. Therefore, the purpose of this study was to examine the pedagogical approach of three critically identifying teachers. Specifically, this study was interested in understanding participant teacher critically civic ontological postures. The posture implies an understanding of the power inherent to civic relation and pedagogy. Participant teachers uniquely demonstrated postures that allowed them to address conceptual, personal, and material aspects of civics (...) education. Participants achieved this first by making clear temporal connections between citizenship and disciplines; second, by incorporating student experiences; and lastly by utilizing a range of instructional approaches to negate traditional civic archetypes. Findings suggest that critical civic ontological postures are dynamic, contextual, and disciplinarily situated. Authentically critically civic ontological postures include developing intellectual solidarity with students and those in educational communities. (shrink)

In Davidson's example of causal deviancy, a climber knows that he can save himself from plummeting to his death by letting go of a rope connecting him to a companion who has lost his footing, but the thought of the contemplated act so upsets him that he lets go unintentionally. Causation of behavior by intentional states that rationalize it is not enough for it to count as acting. Therefore, the behavior must be caused in 'the right way' or by the (...) Right Kind of Cause. The immediate cause in Davidson's and other examples of causal immediacy is the agent's awareness or contemplation of what he or she is intending or thinking of doing, which is either caused by, or implicit in the agent's awareness of, his or her intentions or beliefs and desires. I argue that RKC can only be a mechanism-the Will-whose operation we are not directly aware of, but only indirectly once the action is underway. (shrink)

The article criticises various interpretations of Epicurus's claim that belief in determinism is self-invalidating: -/- - 'The man who says that all things come to pass by necessity cannot criticise one who denies that all things come to pass by necessity, for he admits that this too happens of necessity.' - -/- especially Ted Honderich's argument that the real force of the Epicurean claim is that if belief acquisition is causally necessitated, we will be excluded from possible facts and inquiries (...) that might have produced new knowledge and might have shown some of what we take to be knowledge to be false. Honderich's argument fails to consider that undetermined inquirers might fail to make discoveries that determined inquirers could not fail to make. Determinism would not, therefore, put us in a worse position as seekers of knowledge than indeterminism. (shrink)

In this piece, the author examined the impact of ideology, experience, and privilege on pre-service Social Studies teacher disposition. Findings suggest that participants conceptually understood injustice and began to critique social antagonisms like whiteness and class. However, they continued reinforcing raced and classed ideologies in their interactions with those outside their group. When faced with the cognitive dissonance between stated ideology and their privileged position, the more liberal participants re-narrativize their political stances to adopt more critical ideological worldviews while maintaining (...) their privileged identities. More conservative participants disassociated themselves from more extreme aspects of U.S. conservative political ideology. Both groups maintained the ideologies that provided justification for social hierarchy. Upbringing/identity, understandings of power/hierarchy, emic cultural understandings, and a desire to live one’s ideology, or not, beyond the classroom, informed participant decition making. Civic engagement requires individuals to have both knowledge of democratic principles and the skills for enacting change. Acquiring the knowledge and skills necessary for a productive civic life can be difficult for students if they are not provided conceptual scaffolds and opportunities to practice citizenship. We implemented and studied an activity using Westheimer and Kahne's (2004) citizenship typology during a summer civics institute to help students grapple with their understandings of “good” citizenship. We found (1) students appropriated the language of (...) Westheimer and Kahne's citizenship typology by using it to describe their expanding understandings of citizenship; and (2) students used the citizenship typology to name and make sense of their civic identity. We discuss these findings and reflect on our use of Westheimer and Kahne's citizenship typology as a cognitive scaffold. (shrink)

This paper presents the relationship between pedagogical content knowledge and political/ideological clarity as a framework for understanding the nuanced interpretations and applications of critical social studies pedagogy and practice. Using a qualitative case study research design, this study explores the decision-making process of two novice social studies teachers as they decide if and how to utilize critical historical inquiry within their classrooms. Findings indicate that teachers’ use of critical historical inquiry is informed by their subject area consciousness and political and (...) ideological clarity which is cultivated through personal, schooling, and communal experiences. However, we also find that a teacher's pedagogy is significantly strengthened when political and ideological clarity are coupled with pedagogical content knowledge to ensure a more developed enactment of critical historical inquiry is reached within the social studies classroom. The wealth of scholarship on Christian mysticism attests an enduring interest in this subject matter. Amidst the immense collection of commentaries on Christian mysticism lies this valuable book by Nelstrop, Magill, and Onishi. Their book, far from merely offering a survey of current theories on Christian mysticism, does make significant inroads in teasing out logical connections amongst interpretive theories and interpreted themes.Four different theories on mysticism, namely, perennialist, contextualist, performative language, and feminist, are set to work on examining themes (...) within the Christian tradition such as Neoplatonic influences, apophatic language, erotic imagery, scriptural symbolism and exegesis, self-introspection, church hierarchy, female mysticism, and imaginative meditations. The first two parts of the book range over the readings of these themes through the lenses of the four mentioned theoretical approaches. The last chapter of part two presents viewpoints of the four. Issues of institutional identity and integrity in Roman Catholic health care institutions have been addressed at the level of individual institutions as well as by organizations of Catholic health care providers and at various levels in the Church hierarchy. The papers by Carol Taylor, C.S.F.N, Thomas Shannon, Kevin O’Rourke, O.P., Gerard Magill in this volume provide a significant contribution to concerns of Roman Catholic health care institutions as they face the challenges of providing health care in a secular, (...) pluralistic, market-driven economy. One way to understand institutional integrity is as a measure of the coherence between what an institution identifies as its commitments (its stated moral character), what an institution does (its manifest moral character) and an institution’s fundamental moral commitments (its deep moral character). The essays in this volume support this model of integrity. Although it is not their explicit focus, the four essays together provide a vision of institutional integrity for Catholic health care institutions. Each author focuses on one of the three central aspects of integrity: what one identifies as one’s commitments (Taylor), how one's actions reflect one’s values (Shannon and Magill), and what one is or what one values at a deep level (O’Rourke). I will offer a brief overview of the ways in which the integrity of Catholic health care institutions has been addressed. Then I will consider the four essays and show how each offers an analysis of one of the three critical elements of integrity. (shrink)

Husserl seems to have devoted roughly equal amounts of energy and pages to the description of perception, judgement, and imagination. By “description,” he meant the analysis of the traits and components of mental states or acts and their objects. As his views changed over the years about the nature of intentionality and philosophy, the descriptive psychology of the Logical Investigations (1900/01) gave way to descriptive programmes in which the objects of perception and of judgement were conceived of in terms of (...) a new, analytic framework; in particular Husserl lost interest in describing the things and processes in the real world that are the objects of perception and judgement and so too in describing their relations to these acts. His new analytic framework, particularly as it applies to perception, has been thoroughly expounded and discussed in the literature. My aim here is to expound Husserl's first descriptions of perception within the framework of the Investigations and to incorporate as far as possible his later descriptive results to the extent that these are separable from his later turn to idealism. Contemporary political philosophers disagree about whether theories of justice should be utopian or realistic. Contributors to this volume largely deny that the choice between realism and idealism is binary. Their contributions represent a continuum between realism and idealism that best represents the contemporary state of the debate.

Phenomenology was in large part the discovery of Edmund Husserl, whose Logical Investigations of 1900/01 are normally regarded as the work that launched the phenomenological movement. Yet Husserl's phenomenology, in particular in the form in which it is set out in this his most important contribution to philosophy, is itself part of an Austrian philosophical tradi tion inspired by Brentano and continued, in very different ways, by Meinong, Stumpf, Twardowski, Ehrenfels, Husserl - and Marty. Like Brentano and all his heirs (...) Marty's philosophical interests were in the philosophy of mind, where this is taken to include or at least ground the philosophy of language, and analytic metaphysics. It is Marty's discussions of topics in these two areas that provide the contributions to this volume with their subject-matter. The papers by Roderick Chisholm, S. -Y. This chapter presents what people think about God and how one should act in this world. It discusses how people should pray, and that, if possible, one could pray through poetry. It also discusses why poetry is considered as sacrament, on how its writings reflect one's belief. It focuses on “Lachrimae”, a poem that exemplifies sacramental manner.

This essay develops a novel account of the distinction between a publicly justified polity and modus vivendi regimes by appealing to the ideal of congruence in public reason liberalism. A fully publicly justified polity is one whose laws are supported by congruent “first-personal” and “second-personal” moral reasons to internalize laws as personally binding on those subject to them. Regimes approach modus vivendi status to the extent that their laws fail to be justified by either type of reason, or where firstpersonal (...) and second-personal reasons fail to justify internalization. This is a working paper that presents the first phase of what will eventually be a huge project, namely a critical appropriation of Aristotle’s Nicomachean Ethics. Early on it provides a sketch of the main strands of Aristotle’s theoretical web in his N. Ethics. Following that, the paper offers some critical commentary concerning some of Aristotle’s main positions: especially his views on moral virtue, the soul, intellectual virtue, and human well-being. The paper then turns to the development of some significantly (...) different ways of construing both intellectual virtue as well as moral virtue. With respect to intellectual virtue, I present my own perspective in interconnection with a process-oriented way of understanding reality, as opposed to Aristotle’s substance-oriented way. With respect to moral virtue, I present my interpretation in relation to a thisworldly understanding of the human spirit/soul, as well as a humanistic-Marxist interpretation of human well-being. Toward the paper’s end, I offer some suggestions concerning a modified “doctrine of the mean” that would be a sort of critical synthesis of the views of Aristotle and Confucius. (shrink)

Although music is commonly conceived of as a humanities, in a wider sense, music is a spiritually infused business – a profession redolent of priceless eternal illumination and beauty. Hence the stories of the life and work of great composers and performers are, in a profound sense, stories about businesspeople of a peculiarly enlightened and noble ilk, dedicated to the creation and perpetuation of an enduring form of incorporeal wealth that I shall designate as sapiential capital. It is notable that (...) whereas some renowned composers are not necessarily deemed to be financial successes as measured within the span of their own mortal lifetimes, the (financial and nonfinancial) heritage of their work for posterity can be colossal. Thus, seen from augmented temporal, spiritual, non-egoistic, and non-materialistic vantage points, many great musicians were (and still are) monumental successes – both qua their humanities legacies and qua their business endeavors. The thrust of the paper is to draw spiritually significant insights that are pertinent for businesspeople aspiring to venture beyond the secular confines of conventional business life attached to materialistic norms and values. The study seeks to examine – from a faith and spirituality standpoint – interdisciplinary linkages between music-qua-humanities and music-qua-business that point to higher purposes and meanings for business life and beyond. Christian Ethics and Commonsense Morality goes against the grain of various postmodern approaches to morality in contemporary religious ethics. In this book, Jung seeks to provide a new framework in which the nature of common Christian moral beliefs and practices can be given a new meaning. He suggests that, once major philosophical assumptions behind postmodern theories of morality are called into question, we may look at Christian morality in quite a different light. On his account, Christian morality is a historical (...) morality insofar as it is rooted in the rich historical traditions of the Christian church. Yet this kind of historical dependence does not entail the evidential dependence of all moral beliefs on historical traditions. It is possible to argue for the epistemic autonomy of moral beliefs, according to which Christian and other moral beliefs can be justified independently of their historical sources. The particularity of Christian morality lies not in its particular historical sources that also function as the grounds of justification, but rather in its explanatory and motivational capacity to further articulate the kind of moral knowledge that is readily available to most human beings and to enable people to act upon their moral knowledge.
