This study dealt with one of the most important legal subjects in private international law that relates to the topic of law applicable to electronic signature and is problematic by the lack of clear and explicit texts to determine the law required on the topic The main objective of the study was to reflect the legal regulation in private international law of such a problem, as well as to address some practical and applicable problems relating to the topic of the (...) study, including the legal nature of an electronic signature, When preparing this study, the researcher relied on the inductive approach by extracting legal texts on the subject of the letter in accordance with Jordanian legislation. in addition to the analytical approach where the researcher analysed and described the legislative and doctrinal positions and international conventions associated with the subject matter of the letter, The prescriptive approach, through a statement of the legal nature of the electronic signature. The researcher produced a series of results, the most important of which was the absence of clear and explicit texts specifying the law applicable to the electronic signature. This result was reflected in the recommendations of this letter, which were the most important recommendation to the Jordanian legislature that legal rules should be drawn up to determine the law applicable to the subject matter of the study. Lex Mercatoria play a crucial role in resolving disputes arising from international trade contracts before arbitration bodies, thus establishing them as an independent legal system capable of regulating international commercial relations. This legal characteristic imposes a certain obligation on various arbitration bodies to apply them to the disputes brought before them, either based on the parties' intentions or based on the legal force inherent in those customs. Consequently, this research examines the extent of recognition of the binding force of commercial (...) customs before arbitration bodies, and based on that, it elucidates the authority of these bodies in applying them to international trade disputes. It is evident that these customs, due to their flexibility derived from the nature of commercial transactions and the customary practices of traders resorting to them, have become today an independent legal system that imposes itself on arbitration bodies even if the parties did not choose to apply those customs. This paper recommends the Jordanian legislator to explicitly adopt the application of these commercial customs in the Jordanian Arbitration Law texts, following the example of national and international comparative legislation. Given the evolution of the public health (PH) and the changes from the phenomenon of globalization, this area has encountered new ethical challenges. In order to find a coherent approach to address ethical issues in PH policy, this study aimed to identify the evolution of public health ethics (PHE) frameworks and the main moral values and norms in PH practice and policy. According to the research questions, a systematic search of the literature, in English, with no time limit was performed (...) using the main keywords in databases Web of Science (ISI) and PubMed. Finally, the full text of 56 papers was analyzed. Most of the frameworks have common underpinning assumptions and beliefs, and the need to balance PH moral obligation to prevent harm and health promotion with respect for individual autonomy has been specified. As such, a clear shift from liberal values in biomedical ethics is seen toward the community’s collective values in PHE. The main moral norms in PH practice and policy included protecting the population against harm and improving PH benefits, utility and evidenced-based effectiveness, distributive justice and fairness, respect for all, privacy and confidentiality, solidarity, social responsibility, community empowerment and participation, transparency, accountability and trust. Systematic review of PHE frameworks indicates utilization of the aforementioned moral norms through an practical framework as an ethical guide for action in the PH policy. Agostinho discute a violência sexual contra as mulheres no primeiro livro de A Cidade de Deus (De ciuitate Dei). Tendo vivido nos séculos IV e V, o autor se reflete sobre o estupro de três perspectivas: moral, legal e social. Quanto à moral, defende que o estupro não macula a dignidade das vítimas. Quanto à legal, considera o estupro um crime contra a vítima e que esta, além de não merecer culpabilização nem pena, deve ter uma consolatio. No âmbito social, (...) denuncia a mentalidade da época como baseada numa concepção deturpada da pudicitia (oriunda da narrativa de Tito Lívio sobre o estupro de Lucrécia e seu subsequente suicídio). Segundo Agostinho, a pudicícia romana agrava a punição injusta das vítimas com violências ulteriores. Nesses termos, reivindica uma política imperial de proteção e amparo às mulheres violentadas. O estudo desse texto de Agostinho é desenvolvido em quatro fases: breve contexto histórico, o exemplo imperial de pudor feminino (Lucrécia), as consequências desastrosas desse exemplo e, enfim, o posicionamento de Agostinho. Ibadiyya is one of the earliest Islamic sects and one of the few to have survived to the present day. The Ibadiyya sect is still active in many places, including Tanzania, the Sultanate of Oman, and North Africa. Despite all of this information, fewer studies on Ibadis exist than on other extant and non-member sects. An Islamic group known as the Ibadiyya first appeared following the so-called “great acts of sedition” (büyük fitne) in the first century AH. This group initially (...) supported the Kharijites, but over time, it gradually shifted away from them in terms of politics and mindset. Even though the Kharijites were exterminated from the historical scene at an early age, the Ibadis have survived until the present. However, according to many researchers, the Ibadis still exist as a branch of the Kharijites. In this study, the theological thoughts of North African Ibadis are discussed. Since the Ibadis and Kharijites generally held different ideological and political perspectives. And the North African Ibadis in particular are distinguished from the Kharijites as well as from the general Ibadis by their differences. And it is essential to understand the underlying and guiding thinking behind these differences in order to understand their essence. (shrink)

In many areas, technology has facilitated many things, diagnosing diseases, regulating traffic and teaching students in schools rely on Intelligent systems to name a few. At present, traditional classroom-based education is no longer the most appropriate in schools. From here, the idea of intelligent e-learning for students to increase their culture and keep them updated in life began. E-learning has become an ideal solution, relying on artificial intelligence, which has a footprint in this through the development of systems based on (...) education without a teacher taking into account the individual differences of students. This study describes intelligent tutoring system for teaching the Data Manipulation Language (DML) Commands Using SQLite to non IT students to overcome the difficulties they face. The System was built as education system by using the researcher own authoring tool that based on mobile and web App. The basic idea of this system is a systematic introduction into the concept of Database and its DML query. The system presents the topic of DML Commands, help student to execute what they are learn from the system content using the practical part of the system and administers automatically adapted at run time to the student’s individual growth. The system was assessed by a group of teachers and students and the outcome showed as 91% from the database specialists, 94% from Diploma students group and 89% from the secondary school students group. Sur la base d'une définition qui inscrit les questions économiques nouvelles dans le champ de la réflexion sociale et politique classique, le Dictionnaire présente une conception globalisante de l'économique relativement innovante. Dans le cadre du présent volume III (Économie politique) des Anthologies de l'encyclopédie méthodique, nous avons privilégié l'ensemble des articles consacrés aux États-Unis et à la (...) Virginie, ce nouveau Monde où « la réflexion politique moderne est mise à l'épreuve, et transformée par l'économie politique ». Le modèle américain est tendu par Démeunier à « la partie la plus saine de l'Europe » comme « le miroir de son avenir », en particulier quand il célèbre la dimension exemplaire du nouveau code civil et criminel préparé pour la Virginie, ou encore les dispositions sur la tolérance religieuse. Enfin, nous avons fait suivre le choix d'articles tirés du Dictionnaire de Démeunier d'extraits de la traduction française de l'abbé Morellet des Observations sur la Virginie, ouvrage rédigé par Jefferson et auquel Démeunier a abondamment emprunté. Le lecteur appréciera derechef la hauteur et la nouveauté de vues de ce grand homme, héritier exemplaire des Lumières, préoccupé tout entier de réformes et de changements pour cette nouvelle société en train de se constituer. Cette anthologie paraît de façon posthume. C'est en effet le dernier ouvrage que préparait Paule-Monique VERNES, professeure émérite de philosophie moderne et politique à l'Université de Provence, quand elle est décédée soudainement le 15 janvier 2013. When faced with adverse circumstances, there may be a tendency for individuals, agencies, and governments to search for a target to assign blame. Our focus will be on the novel coronavirus outbreak, where racial groups, political parties, countries, and minorities have been blamed for spreading, producing or creating the virus. Blame—here defined as attributing causality, responsibility, intent, or foresight to someone/something for a fault or wrong—has already begun to damage modern society and medical practice in the context of the COVID-19 (...) outbreak. Evidence from past and current pandemics suggest that this tendency to seek blame affects international relations, promotes unwarranted devaluation of health professionals, and prompts a spike of racism and discrimination. By drawing on social and cognitive psychology theories, we provide a framework that helps to understand the effect of blame in pandemics, when people blame, whom they blame, and how blame detrimentally affects the COVID-19 response. Ultimately, we provide a path to inform health messaging to reduce blaming tendencies, based on social psychological principles for health communication. (shrink)

This article explores how legal treatises (rasāʾil) were essential sites for the development and expansion of Islamic legal schools’ (madhāhib) positions. The rasāʾil, along with legal dicta (fatāwā)—besides legal commentaries (shurūḥ) and manuals (mutūn)—were among the prime loci where jurists contended with rapid social, political, and economic changes. Although these legal treatises were written to address specific sociolegal issues, I argue that the treatise—as a separate genre—provided a creative space for jurists to reaffirm, restate, or advance a new opinion in (...) the school. These legal treatises were carefully considered and extensively referenced in the authoritative works of the school for their updated legal positions, practical utility for judges in courts, and relevance for official policy purposes. To demonstrate this dynamic, I present a close reading of two legal treatises by Maḥmūd Efendī al-Ḥamzāwī (d. 1887), a key Ḥanafī authority and judge, and the muftī of Damascus (1867–1887). The first covers the issue of criminal law procedures in Islamic/Ottoman courts and the second addresses the topic of hunting with rifles. Both treatises expanded the legal positions of the Ḥanafī school by incorporating new justifications, qualifications, and information. They offer an essential perspective on the status of this genre of legal writing through an exposition of a range of emerging issues in the late nineteenth century. (shrink)

Um marco sobre a questão do tempo na História da Filosofia, o livro XI das Confissões de Agostinho de Hipona (354–430) ainda hoje recebe interpretações. O presente artigo menciona pontos que já apresentei noutro texto sobre o tempo como espelho da alma, no entanto ele recebe o acréscimo de dois pontos que mudam a ênfase de minha interpretação prévia: (1) a citação a Josué e (2) a escolha de Deus creator ominum para exemplificar a relação, via tempo, entre ser humano, (...) Deus e o mundo. Mediante a análise textual do livro XI, a seguinte conclusão será encaminhada: embora Agostinho não recuse a existência do tempo como uma realidade independente das vivências humanas, ele privilegia outro aspecto do tempo, medular nas Confissões, a saber, a relação humana com o tempo em correspondência com a intenção da vontade pela qual a vida humana é governada. Em Agostinho, o tempo da vida se compromete com a ética, e reflete o modo como a vontade habita a vida. Tempo e alma, nas Confissões, são interdependentes a ponto de a experiência humana do tempo ser um espelhamento da vontade. (shrink)

Agostinho de Hipona recebeu uma formação intelectual nos moldes da cultura clássica, tendo sido educado segundo o ciclo disciplinar varroniano. Provém dessa educação sua apreciação da dialética como arte que instrui argumentar corretamente e que permite discernir, nos discursos, os elementos que geram a falsidade da conclusão. É a dialética que permite conectar proposições verdadeiras para alcançar conclusões também verdadeiras e é elaa ciência que deflagra a falsidade e a dissimulação nos argumentos. Ora, na obra Contra Crescônio, gramático e donatista, (...) Agostinho defende-se da acusação descabida de ser ele um homo dialecticus que, por sua habilidade de argumentar, falsearia o verdadeiro e tornaria o verdadeiro falso. Crescônio, para acusar Agostinho, acusa a dialética. Em sua réplica, Agostinho defenderá a eminência e importância dessa ciência para, a partir desse fundamento, atacar o donatismo e, finalmente, liquidar Crescônio. É precisamente essa apreciação positiva da dialética que este artigo pretende destacar, ressaltando assim a importância do estudo de Contra Crescônio para o estudo da dialética agostiniana. Abstract:Augustine of Hippo received an intellectual formation in the molds of the classical culture, having been educated according to Varro’s disciplinary cycle. This educational background provided him an appreciation of Dialectics as the liberal art which instructs to reason correctly, and allows discerning, in discourses, the elements that generate false conclusions. It is Dialectics that allows connecting true propositions to reach true conclusions, and it is the science that deflagrates falsehood and dissimulation in arguments. In his work, Against Cresconius, grammarian and Donatist, Augustine defends himself against the unreasonable charge of being a homo dialecticus, who, by his ability to argue, would falsify the truth and turn it false. Cresconius, to accuse Augustine, charges dialectics. In his reply, Augustine will defend the eminence and importance of this science to, from this foundation, attack Donatism and, finally, liquidate Cresconius. It is precisely this positive appreciation of Dialectics that this article intends to highlight, thus highlighting the importance of studying Contra Cresconius for the study Augustinian Dialectics. One of the main arguments intended to show that content externalism undermines the privileged access thesis is the ‘slow switching argument’, originally proposed by Boghossian. In this argument, it is supposed that a subject is unknowingly switched back and forth between Earth and Twin Earth: then it is claimed that, given externalism, when the subject is on Earth thinking that water is wet, he cannot know the content of his thought a priori, for he cannot, by mere reflection, rule out (...) the relevant alternative hypothesis that he is on Twin Earth thinking that twater is wet. One of the controversies surrounding this argument stems from the fact that it is not clear which epistemological principle underlies it. Here, I examine two suggestions made in the literature as to what that underlying principle might be. I argue that neither of these suggested principles is plausible, and thus that the slow switching argument never gets off the ground. (shrink)

I provide an account of the physical appropriate to the task of the physicalist while remaining faithful to the usage of “physical” natural to physicists. Physicalism is the thesis that everything in the world is physical, or reducible to the physical. I presuppose that some version of this position is a live epistemic possibility. The physicalist is confronted with Hempel’s dilemma: that physicalism is either false or contentless. The proposed account of the physical avoids both horns and generalizes a recent (...) proposal by Vicente (2011). My account defines physicalism as the thesis that there are no objects that cannot be described by physical quantities. Tatiana Ehrenfest-Afanassjewa was an important physicist, mathematician, and educator in 20th century Europe. While some of her work has recently undergone reevaluation, little has been said regarding her groundbreaking work on dimensional analysis. This, in part, reflects an unfortunate dismissal of her interventions in such foundational debates by her contemporaries. In spite of this, her work on the generalized theory of homogeneous equations provides a mathematically sound foundation for dimensional analysis and has found some appreciation and development. It remains to (...) provide a historical account of Ehrenfest-Afanassjewa's use of the theory of homogeneous functions to ground (and limit) dimensional analysis. We take as a central focus Ehrenfest-Afanassjewa's contributions to a debate on the foundations of dimensional analysis started by physicist Richard Tolman in 1914. I go on to suggest an interpretation of the more thoroughgoing intervention Ehrenfest-Afanassjewa makes in 1926 based on this earlier context, especially her limited rehabilitation of a "theory of similitude" in contradistinction to dimensional analysis. It is shown that Ehrenfest-Afanassjewa has made foundational contributions to the mathematical foundations and methodology of dimensional analysis, our conception of the relation between constants and laws, and our understanding of the quantitative nature of physics, which remain of value. Ubuntu has been defined as a moral quality of human beings, as a philosophy or an ethic, as African humanism, and as a worldview. This paper explores these definitions as conceptual tools for understanding the cultural, educational, and philosophical landscape of post-apartheid South Africa. Key to this understanding is the Althusserian concept of state apparatus. Louis Althusser divides the state apparatus into two forces: the repressive state apparatus (RSA); and the ideological state apparatus (ISA). RSAs curtail the working classes, predominately (...) through direct violence or the threat of violence, whereas ISAs function primarily by ideology, including forms of organised religion, the education system, family units, legal systems, trade unions, political parties, and media. This paper discusses the link between increasing inequality in post-apartheid South Africa and education, with specific reference to Althusser’s ISAs and the abuse of Ubuntu as a subterfuge for socio-economic inequality. Imagination has always been a mysterious issue for modern philosophy and psychology. In this paper, however, I will not deal with modern theories of imagination; instead, I will suggest an alternative notion of imaginal power by stepping back toward Persian illuminative thought within which we may glimpse a hint of a transcendent concept of imagination as the source of human subjectivity and its power to create the object and the world. My objective here is to extend some noetic aspects of (...) this concept and extract further conclusions theoretically. To this end, I will first introduce a brief account of the noetic characteristic of the Illuminationist perspective of the imagination, then I outline aspects of its efficiency which may shed some light on the modern debate on the subject and its relation to the object. Several lines of reasoning have been proposed to show the incompatibility of content externalism with justification internalism. In this paper I examine two such lines of reasoning, which both rely on the general idea that since content externalism is incompatible with certain aspects of the alleged privileged character of self-knowledge, it would tend to undermine justification internalism as well. I shall argue that both lines of reasoning, as they stand, lack plausibility, though the core idea of the second line can (...) be reconstructed into a new argument which shows considerable promise. In particular, relying upon the reliability constraint on knowledge, I shall argue that the so-called ‘two-concept’ version of content externalism is incompatible with ‘the transparency of sameness of content’, and thereby would also undermine justification internalism.
