So much philosophical theory is irrelevant for the practice of ethics! How many wasted volumes of tortuous arguments and counterarguments have been written in search of an elusive theory of ethics that could be applied deductively, without modification, to produce “correct” answers under all circumstances to any ethical problem? The practice of ethics is much closer to the common sense casuistry approach outlined by Jonsen and Toulmin, in which we work from. intuitively grasped, paradigm, cases by way of analogy to (...) provide presumptive answers to more complex problems. Alasdair Maclntyre argued however that we cannot trust such individualistic intuitive judgements. Thus we should start by looking at his critique of modern ethics. (shrink)

The national ethical guidelines relevant to assisted reproductive technology have recently been reviewed by the National Health and Medical Research Council. The review process paid particular attention to the issue of non-medical sex selection, although ultimately, the updated ethical guidelines maintain the pre-consultation position of a prohibition on non-medical sex selection. Whilst this recent review process provided a public forum for debate and discussion of this ethically contentious issue, the Victorian case of JS and LS v Patient Review Panel [2011] (...) VCAT 856 provides a rare instance where the prohibition on non-medical sex selection has been explored by a court or tribunal in Australia. This paper analyses the reasoning in that decision, focusing specifically on how the Victorian Civil and Administrative Tribunal applied the statutory framework relevant to ART and its comparison to other uses of embryo selection technologies. The Tribunal relied heavily upon the welfare-of-the-child principle under the Assisted Reproductive Treatment Act 2008. The Tribunal also compared non-medical sex selection with saviour sibling selection. Our analysis leads us to conclude that the Tribunal’s reasoning fails to adequately justify the denial of the applicants’ request to utilize ART services to select the sex of their prospective child. The UK Supreme Court in Montgomery v Lanarkshire Health Board adopts an approach to information disclosure in connection with clinical treatment that moves away from medical paternalism towards a more patient-centred approach. In doing so, it reinforces the protection afforded to informed consent and autonomous patient decision making under the law of negligence. However, some commentators have expressed a concern that the widening of the healthcare providers’ duty of disclosure may provide impetus, in future cases, for courts to adopt a (...) more rigorous approach to the application of causation principles. The aim would be to limit liability but, in turn, it would also limit autonomy protection. Such a restrictive approach has recently been adopted in Australia as a result of the High Court decision in Wallace v Kam. This paper considers whether such an approach is likely under English negligence law and discusses case law from both jurisdictions in order to provide a point of comparison from which to scope the post- Montgomery future. Consciousness and Cognition, 17, 1281–1291.] conducted a rigorous study that sampled two populations differentially exposed to threat in real life, and found that critical predictions from the Threat Simulation Theory of dreams [Revonsuo, A. . The reinterpretation of dreams: An evolutionary hypothesis of the function of dreaming. Behavioral and Brain Sciences, 23, 877-901.; Revonsuo, A. . Did (...) ancestral humans dream for their lives? Behavioral and Brain Sciences, 23, 1063–1082.] were not supported. Specifically, we found no evidence of increased realistic threats to physical survival or enhanced threat avoidance in the dreams of those from the exposed population. Revonsuo and Valli’s [Revonsuo, A., & Valli, K. . How to test the threat simulation theory. Consciousness and Cognition, 17, 1292-1296.] commentary on our study argues that the methods we used are so flawed as to render the results meaningless. Revonsuo’s influential Threat Simulation Theory predicts that people exposed to survival threats will have more threat dreams, and evince enhanced responses to dream threats, compared to those living in relatively safe conditions. Participants in a high crime area differed significantly from participants in a low crime area in having greater recent exposure to a life-threatening event . Contrary to TST’s predictions, the SA participants reported significantly fewer threat dreams , and did not differ from the Welsh participants in responses to (...) dream threats . Overall, the incidence of threat in dreams was extremely low—less than 20% of dreams featured realistic survival threats. Escape from dream threats occurred in less than 2% of dreams. We conclude that this evidence contradicts key aspects of TST. (shrink)

The influential threat simulation theory asserts that dreaming yields adaptive advantage by providing a virtual environment in which threat-avoidance may be safely rehearsed. We have previously found the incidence of biologically threatening dreams to be around 20%, with successful threat avoidance occurring in approximately one-fifth of such dreams. TST asserts that threat avoidance is over-represented relative to other possible dream contents. To begin assessing this issue, we contrasted the incidence of ‘avoidance’ dreams with that of their opposite: ‘approach’ dreams. Because (...) TST states that the threat-avoidance function is only fully activated in ecologically valid contexts, we also performed this contrast for populations living in both high- and low-threat environments. We find that ‘approach’ dreams are significantly more prevalent across both contexts. We suggest these results are more consistent with the view that dreaming is generated by reward-seeking systems than by fear-conditioning systems, although reward-seeking is clearly not the only factor determining the content of dreams. This article uses Jeremy Bentham's notion of disambiguation, which links language to power and ‘sinister interest’, to analyse criticisms of the Royal Academy of Arts by Benthamites and Philosophic Radicals at the Select Committee on Arts and Manufactures of 1835/6. This practice of disambiguation aimed to produce a distinction between the Royal Academy of Arts and the publicly funded art school. I situate this activity within the linguistic turn taken by Bentham's ethics, and its relevance to a dilemma of pedagogy (...) in commercial society framed by Adam Smith. Smith's dilemma turns on the conflict between the requirement for a pedagogy that conforms to the principle of free trade, and an equally binding requirement for a virtue ethical model of pedagogy that offers a remedy for the corrupting effects of commerce on character. Adam Smith's support for private academies of art asserted a hierarchy of virtue ethics over utility, thus safeguarding autonomous ethical reasoning within capitalist forms of social life. Bentham's thought, in contrast, eschews the link between ethics and character, and places ethics itself within normative rules of language and cognition. (shrink)

This study examines Australian tax agents' perceptions of the ethical environment in which they practice, within the context of an income tax system based on self-assessment principles. The research identifies and ranks an inventory of ethical issues in terms of perceived frequency of occurrence and importance to Western Australian tax agents. In addition, the extent and influence of ethical concerns in the profession are evaluated.The study has determined that the most frequently cited ethical issue is the failure to make reasonable (...) enquiries where information or documentation provided by a client appears to be inaccurate or incomplete. The most important ethical problem is a failure to ensure confidentiality with regard to privileged client information. When the frequency of occurrence and importance means are compared, inadequate technical competence, failure to make reasonable enquiries/conduct research, continuing to act for a client where there is incorrect information, and conflicts in distinguishing between tax planning and tax avoidance emerge as the high frequency/high importance issues. Although acknowledging the potential for unethical actions in tax practice, Western Australian tax agents consider that they carry out their professional activities within an ethical environment. What is the relationship between detailed critical analysis and the background assumptions made by a given theory of film spectatorship? In this article, I approach this question by looking at Vittorio Gallese and Michele Guerra's The Empathic Screen in the light of the method of triangulation—the coordination and integration of phenomenological, psychological, and neuroscientific evidence, as set out in my Film, Art, and the Third Culture. In particular, I examine Gallese and Guerra's arguments concerning the role of camera movement in (...) prompting immersive, embodied simulation, as well as critiques of these arguments from David Bordwell and Malcolm Turvey. I focus on the special, irreducible role of critical analysis in these arguments. Detailed analysis of film form and style plays an essential role, I argue, in demonstrating the plausibility (or otherwise) of the thesis advanced by Gallese and Guerra. Such analysis is where the rubber of theoretical assumptions meets the road of the material work. (shrink)

This essay begins with the impossibility of thinking back, or at least of conscious memory, and the need to fix on a fragment, before unconscious memory may emerge as inscription. I then follow the intuition of a link, contained in the cover image of Malcolm Bowie's book Freud, Proust, Lacan: Theory as Fiction, between fictions which theorize and the apparition of the feminine as a haunting incompleteness. It is suggested that such apparitions may be read — like the image (...) in Plato's chora, as read by Pierre Fédida — as a surviving trace, hovering phantom-like between reminiscence and existence. As such, the image might be seen not only as the impensé of theory, producing in texts auratic moments which condense signifiers of present encounter and lost memory trace, but furthermore as the unthinkable feminine negative of masculine pursuit, returning us quite simply to a nodal point of silent gazing. He interprets the leadership styles and compelling (...) voices of some of the most towering figures: Martin Luther King, Jr., Malcolm X, and Ella Baker, to show us how we have the power to be the heroes that our democracy so urgently requires. Through these three leaders, Glaude displays how ordinary people have the capacity to be the heroes that our democracy requires, instead of outsourcing their needs to leaders who represent them. Glaude also integrates his own evolving views of Black politics with the assistance of Ralph Waldo Emerson, John Dewey, Sheldon Wolin, Toni Morrison, James Baldwin, and Ralph Elison. Glaude’s book is a powerful reminder that if our US-American democracy is to survive, it requires a particular kind of person for this to work, and the engagement of ordinary people. _. (shrink)

Malcolm Acock attempts to show that three widely accepted “solutions” to the philosophical problem of theory choice between the ordinary account of the age of the universe, and “Russell's hypothesis” that the world sprang into existence five minutes ago, are unsatisfactory. In the following paper we shall attempt to show why “Russell's hypothesis” is defective as a cosmological explanation of the age of the universe.

Malcolm-Smith, Solms, Turnbull and Tredoux [Malcolm-Smith, S., Solms, M.,Turnbull, O., & Tredoux, C. . Threat in dreams: An adaptation? Consciousness and Cognition, 17, 1281–1291.] have made an attempt to test the Threat-Simulation Theory , a theory offering an evolutionary psychological explanation for the function of dreaming [Revonsuo, A. . The reinterpretation of dreams: An evolutionary hypothesis of the function of dreaming. Behavioral and Brain Sciences, 23, 877–901]. Malcolm-Smith et al. argue that empirical evidence from (...) their own study as well as from some other studies in the literature does not support the main predictions of the TST: that threatening events are frequent and overrepresented in dreams, that exposure to real threats activates the threat-simulation system, and that dream threats contain realistic rehearsals of threat avoidance responses. Other studies, including our own, have come up with results and conclusions that are in conflict with those of Malcolm-Smith et al. In this commentary, we provide an analysis of the sources of these disagreements, and their implications to the TST. Much of the disagreement seems to stem from differing interpretations of the theory and, consequently, of differing methods to test it. (shrink)

What should we do if we cannot figure what morality requires of us? Holly M. Smith argues that the best moral codes solve this problem by offering two tiers, one of which tells us what makes acts right and wrong, and the other of which provides user-friendly decision guides. She opens a path towards resolving a deep problem of moral life.

Given their large number of adherents, and the land and property they own, religious communities have been identified as groups that could have an influence on achieving carbon net-zero. The theological views held by religious communities relating to ecological matters – their “ecotheological values” – play an important role in motivating their environmental concern and action. But which ecotheological ideas are most, and which are least, efficacious in this respect? This paper presents findings salient to this question from a recent (...) survey (n = 319) conducted amongst Christian activists and advocates concerned with climate change. It reports on which ecotheological ideas are most widely and firmly held amongst samples from six Christian environmental activist and advocacy groups in the UK, and discusses the extent to which these ideas are either continuous with mainstream Christian theology, or indicate innovative theological thinking. We find examples of both: some mainstream views are popular, and some are unpopular, amongst our sample, whilst some innovative and newer ideas are becoming more popular, whilst others are resisted. These results will be useful in seeking to promote a greater pro-environmental stance within Christian communities more widely. (shrink)

It is sometimes claimed that faith is a virtue. To what extent faith is a virtue depends on what faith is. One construal of faith, which has been popular in both recent and historical work on faith, is that faith is a matter of taking oneself to have been spoken to by God and of trusting this purported divine testimony. In this paper, I argue that when faith is understood in this way, for faith to be virtuous then it must (...) be accompanied by intellectual humility. I defend this view by showing how someone ought to respond to purported divine testimony if her faith is to be intellectually humble, and how, if it fails in this respect, it will instead be accompanied by the vices of either servility or arrogance. Semantic dialetheists astutely dodge Explosion, the logical contagion of everything being true if a single contradiction is true. A dialetheia is contained in their semantics, and sustained by a paraconsistent logic. Graham Priest has shown that this is a solution to the Liar paradox. I use the Pinocchio paradox, devised by Veronique Eldridge-Smith, as a counter-example. The Pinocchio paradox turns on the truth of Pinocchio, whose nose grows if and only if what he is saying is not true, saying (...) ‘My nose is growing’. It is not just a matter of interpretation whether Pinocchio’s nose is and is not growing. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Ossian and the Invention of Textual HistoryKristine Louise HaugenIt is now controversial to call James Macpherson a forger or the poems of Ossian a hoax. 1 Encouraged by Derick Thomson’s 1952 demonstration that Macpherson’s Ossian indeed echoes authentic Gaelic verse, 2 a group of critics has undertaken to “rehabilitate” Macpherson, not least through a new critical edition of Ossian’s poems and related texts. 3 The edition (...) makes it easier than before to encounter Ossian directly:Morna, thou fairest of women, daughter of Cormac-Carbre? [sic] why in the circle of stones, in the cave of the rock, alone? The stream murmureth hoarsely. The blast groaneth in the aged tree. The lake is troubled before thee.... But thou art like snow on the heath. Thy hair like a thin cloud of gold on the top of Cromleach.... Thy arms, as two white pillars in the hall of Fingal. 4The authentic source of this passage seems to be the eighteenth-century commonplace that the savage and uneducated delight in figurative language, especially similes and metaphors—a commonplace enunciated often in the writings [End Page 309] of Hugh Blair, a literary critic deeply interested in Macpherson’s Ossianic productions. 5 As Harold Weinbrot and others suggest, the Ossian poems were celebrated largely because they confirmed readers’ most picturesque preconceptions about the “infancy of mankind.” 6There was room for disagreement. Many influential litterati were convinced of the poems’ antiquity, among them Goethe, Herder, Cesarotti, and a host of Scottish intellectuals. 7 But there were also detractors, mainly English—for example, Dr. Johnson and Edward Gibbon—although David Hume soon joined the skeptics, and the Scotsman Malcolm Laing issued the most crushing attack in the exchange several decades after Ossian’s first appearance in 1760. 8 The Ossian poems served a potent mixture of scholarly and political concerns, of which some were new but some were venerable. With a subtle but important shift in balance, the same mixture underlay the willingness of the most prominent eighteenth-century critics to discredit problematic texts and textual myths, even at the cost of an apparent reduction in historical knowledge. 9 For all parties Macpherson’s Ossian invited not only aesthetic delectation, but sustained thought about the relationship between early poetry and history and the value of early texts for reconstructing the past. [End Page 310]The question of British origins had preoccupied seventeenth-century antiquaries for a number of reasons, including Polydore Vergil’s unflattering Anglica Historia (first published 1546). 10 In the campaign to establish respectable national roots the Celtic druids had quickly become a kind of favorite example; they were presented early and often as heroes of British culture. The druids and their associates the bards had been described in their French setting by classical authors; William Camden, John Selden, and others transferred them easily to Celtic Britain. It was then straightforward to suggest further that the British Celts were the first discoverers of writing and philosophy, or at least discoverers concurrent with the ancient Hebrews, or both, this theory having been elaborated for the French Celts through Annius of Viterbo’s historical forgeries of 1498 and Annius’s French partisans. 11In fact this theory placed England at a disadvantage as Scotland, Ireland, and Wales had the more convincing joint claim to Celtic ancestry. Individual claims for Scotland and Ireland were frequently heard as well. The text most relevant to Ossian was the deist John Toland’s 1726 history of the druids, in which Toland both satirized the eighteenth-century clergy and argued that the ancient Celts of France and Scotland were colonists from Ireland—the original home of druidism, learning, and Toland. 12 In Toland’s version the theory made much of certain unpublished Irish manuscripts, supposedly dating from Cicero’s day and written in the “native” Irish alphabet. St. Patrick had burned hundreds of druidical religious books when he arrived in Ireland—proof that the Celts had a written language—but the bardic histories, couched in rugged verse, had escaped the evangelist’s flames. 13 Clearly, any respectable reply would need to draw on ancient manuscripts too.Even for readers unfamiliar with Toland, Macpherson’s texts... The aim of this article is to examine some of the consequences of the recent advances in neurobiology in terms of the ability of drugs to manipulate the mind. Most laymen are totally ignorant of the general mechanism underlying the brain-mind relationship and therefore of the action of mind-altering drugs. Professor Grahame-Smith considers that one of the intrinsic evils of man's neurobiological make up is that a prime motive of the brain seems to be to bring comfort, security and (...) pleasure for itself. Therefore it is not surprising that drugs - notably the barbiturates and more recently the benzodiazepines (tranquilizers) - have been prescribed to give to the brain that peace of mind that it seeks. However, it can be argued that such drugs cannot replace anxiety with peace of mind or unhappiness or depression with happiness. The action of such drugs upon the molecules of the brain is negative - a placebo effect. (shrink)
