This article examines the role of social media and journalistic media in presidential electoral processes. A systematic review of scientific articles published from 2012 to 2022 was conducted. The results indicate that the media has a significant influence on public perception and the political agenda during election campaigns. Furthermore, the importance of evaluating political leaders in the voters' decision-making process is emphasized. O livro oferece o primeiro estudo sobre o espólio de Edmundo Curvelo (1913-1954), professor da Faculdade de Letras da Universidade de Lisboa e um dos introdutores dos laboratórios psicotécnicos e psicológicos em Portugal. This book presents the first study into the collection of Edmundo Curvelo (1913-1954), professor in the Faculty of Letters of the University of Lisbon and co-responsible for the introduction of psychotechnic and psychological laboratories into Portugal. Some of his philosophical manuscripts are published here for the first time, along with his correspondence with great names of 20th century Philosophy (W. V. Quine, Alonzo Church, Stephen Kiss, Joaquim de Carvalho and Delfim Santos). La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. Many prominent theories of moral responsibility rely on the notion of “tracing,” the idea that responsibility for an outcome can be located in (i.e., “traced back to”) some prior moment of control, perhaps significantly antecedent to the proximate sources of a considered action. In this article, I show how there is a problem for theories that rely on tracing. The problem is connected to the knowledge condition on moral responsibility. Many prima facie good candidate cases for tracing analyses appear to (...) violate the knowledge condition on moral responsibility. So, either we need to dispense with tracing approaches or we must refine our understanding of the knowledge condition or we are responsible less frequently than we suppose. (shrink)

The artificial intelligence models with machine learning that exhibit the best predictive accuracy, and therefore, the most powerful ones, are, paradoxically, those with the most opaque black-box architectures. At the same time, the unstoppable computerization of advanced industrial societies demands the use of these machines in a growing number of domains. The conjunction of both phenomena gives rise to a control problem on AI that in this paper we analyze by dividing the issue into two. First, we carry out an (...) epistemological examination of the AI’s opacity in light of the latest techniques to remedy it. Many prominent accounts of free will and moral responsibility make use of the idea that agents can be responsive to reasons. Call such theories Reasons accounts. In what follows, I consider the tenability of Reasons accounts in light of situationist social psychology and, to a lesser extent, the automaticity literature. In the first half of this chapter, I argue that Reasons accounts are genuinely threatened by contemporary psychology. In the second half of the paper I consider whether such threats can (...) be met, and at what cost. Ultimately, I argue that Reasons accounts can abandon some familiar assumptions, and that doing so permits us to build a more empirically plausible picture of our agency. (shrink)

The online space has become a digital public square, where individuals interact and share ideas on the most trivial to the most serious of matters, including discussions of controversial ethical issues in science, technology and medicine. In the last decade, new disciplines like computational social science and social data science have created methods to collect and analyse such data that have considerably expanded the scope of social science research. Empirical bioethics can benefit from the integration of such digital methods to (...) investigate novel digital phenomena and trace how bioethical issues take shape online.Here, using concrete examples, we demonstrate how novel methods based on digital approaches in the social sciences can be used effectively in the domain of bioethics. We show that a digital turn in bioethics research aligns with the established aims of empirical bioethics, integrating with normative analysis and expanding the scope of the discipline, thus offering ways to reinforce the capacity of bioethics to tackle the increasing complexity of present-day ethical issues in science and technology. Through modern driver assistant systems, algorithmic decisions already have a significant impact on the behavior of vehicles in everyday traffic. This will become even more prominent in the near future considering the development of autonomous driving functionality. The need to consider ethical principles in the design of such systems is generally acknowledged. However, scope, principles and strategies for their implementations are not yet clear. Most of the current discussions concentrate on situations of unavoidable crashes in which the life of human (...) beings is existentially affected. In this paper, we argue that ethical considerations should be mandatory for any algorithmic decision of autonomous vehicles, instead of a limitation to hazard situations. Such an ethically aligned behavior is relevant because autonomous vehicles, like any other traffic participants, operate in a shared public space, where every behavioral decision impacts the operational possibilities of others. These possibilities concern the fulfillment of a road-user’s safety, utility and comfort needs. We propose that, to operate ethically in such space, an autonomous vehicle will have to take its behavior decisions according to a just distribution of operational possibilities among all traffic participants. Using an application on a partially-autonomous prototype vehicle, we describe how to apply and implement concepts of distributive justice to the driving environment and demonstrate the impact on its behavior in comparison to an advanced but egoistic decision maker. When public opinion gets polarized, the population’s beliefs can experience two different changes: they can become more extreme in their contents or they can be held with greater confidence. These two possibilities point to two different understandings of the rupture that characterizes political polarization: extremism and radicalism. In this article, I show that from the close examination of the best available evidence regarding how we get polarized, it follows that the pernicious type of political polarization has more to do with (...) radicalism than with extremism. Reinforcing the confidence in the core beliefs of the group we identify with makes our beliefs immune to the reasons coming from the other political side. Finally, I also suggest that the rise of political polarization is not necessarily the result of an irrational process. (shrink)

This book gives an overview of paraconsistent logics - that is logics which allow for inconsistency. Although allowing for inconsistency, paraconsistent logics are worth considering: Logical systems are worth considering in their own right since we can learn about very abstract structural properties of logics and the concepts employed within them such as negation, necessity and consistency. Some non-classical logics are especially of interest from a philosophical perspective since they alone offer the possibility of solving or even stating some philosophical (...) problems. These introductory lectures argue from a philosophical perspective that some paraconsistent logics are of interest or even the best candidates for dealing with specific philosophical problems. In On the Difficulty of Living Together, Manuel Cruz launches a nuanced study of memory and forgetting, defining their forms and uses, political meanings, and social and historical implications. Memory is not an intrinsically positive phenomenon, he argues, but an impressionable and malleable one, used to advance a variety of agendas. Cruz focuses on five memory models: that which is inherently valuable, that which legitimizes the present, that which supports retributive justice, that which is essential to mourning, and that (...) which elicits renunciation or revelation. His methodical approach makes sense of memory's positive and negative effects, its contradictions, and its tensions. Cruz shows us that remembering is not necessarily an end in itself, nor is it a supreme value, immune to external influence. The exercise of memory guarantees nothing, though many insist it is a progressive act preventing the repetition of past mistakes. Globalization has created numerous ethical problems for the manager of the multinational corporation. What does justice demand, for example, in the relations between a multinational and its host country, particularly when that country is less developed? Should human rights principles govern the relations between a multinational and the workers of a host country, and if so, which (...) principles are the correct ones? How should a multinational deal with a government in which corruption is rife? What are the ethical considerations involved in determining whether and how to transfer a risky technology to a country whose people may not be able to safely absorb that technology? What kind of labor and environmental standards should a multinational adopt when operating in a country whose government legislates only very low standards? (shrink)

Focusing on the recent work of Michael Bratman as emblematic of several important developments in the philosophy of action, I raise four questions that engage with a set of interlocking concerns about systemic functionalism in the philosophy of action. These questions are: (i) Are individual and institutional intentions the same kind of thing? (ii) Can the risk of proliferation of systemic functional explanations be managed? (iii) Is there an appealing basis for the apparent methodological individualism in our theories of action (...) and agency? and (iv) Why not, instead, pursue a methodologically anti-individualist and ecological approach to action and agency? The latter alternative, I suggest, offers a promising way to retain many of the core insights of the Bratmanian project while avoiding the difficulties inherent to some of the methodological presumptions of some strands of contemporary philosophy of action. Recent years have seen recurring episodes of tension between proponents of freedom of speech and advocates of the disenfranchised. Recent survey research attests to the ideological division in attitudes toward free speech, whereby conservatives report greater support for free speech than progressives do. Intrigued by the question of whether “canceling” is indeed a uniquely progressive tendency, we conducted a vignette-based experiment examining judgments of offensiveness among progressives and conservatives. Contrary to the dominant portrayal of progressives and conservatives, our study documented (...) ideological symmetry in their evaluations of offensive speech. When faced with utterances whose content matters to them, both conservatives and progressives viewed outgroup speakers as more offensive than ingroup speakers. A second contribution of this chapter is to provide a deeper understanding of the cognitive mechanism implicated in evaluating outgroup speech as more offensive than ingroup speech. Our results suggest that perception of offensiveness is mediated by ascriptions of intent: we tend to attribute negative intent to the speaker whenever we deem their utterances to be offensive, even against the explicitly stated speaker’s background attitudes. We show the following: the o-minimal fundamental group of G is isomorphic to ℤn; for each k>0, the k-torsion subgroup of G is isomorphic to n, and the o-minimal cohomology algebra over ℚ of G is isomorphic to the exterior algebra over ℚ with n generators of degree one.

I evaluate the adequacy of the three models of international business ethics that have been recently proposed by Thomas Donald son, Gerard Elfstrom and Richard De George. Using the example of the conduct of the aluminum companies in Jamaica, I argue that these three models fail to address the most important of the ethical issues encountered by multinationals because they focus too narrowly on human rights issues and on utilitarian considerations. In addition I argue that these models also evidence an (...) inadequate understanding of microeconomic theory. I end by proposing that these defects can be remedied by a model of ethics that incorporates a theory of moral rights, a utilitarian-based theory of the market, and a theory of justice. (shrink)

Environmentalists have long claimed it is unjust for the state to prioritize economic interests over environmental ones by sacrificing ecosystem integrity and functioning to unsustainably expand the economy. Recently, mainstream environmentalists have moved to a more conciliatory approach highlighting the common ground between environmental and economic goals. They today claim processes of economic growth and development can be made just if they become green. This paper explores the question: should states pursue “green growth”? Although some critics claim green growth is (...) impossible, I maintain it is. I theorize three conditions that must be met for an instance of growth to be truly considered green. That a development project is green, however, does not automatically ensure it is just. Justice considerations remain in adjudicating the competing interests of different groups of stakeholders. I then examine four reasonable approaches to resolving controversies over the pursuit of green growth: cost-benefit analysis, sufficientarianism, democracy, and pluralism. I conclude a liberal pluralist form of decision-making is best for ensuring fairness. (shrink)

Commercial genetic testing offered over the internet, known as direct-to-consumer genetic testing (DTC GT), currently is under ethical attack. A common critique aims at the limited validation of the tests as well as the risk of psycho-social stress or adaption of incorrect behavior by users triggered by misleading health information. Here, we examine in detail the specific role of advertising communication of DTC GT companies from a medical ethical perspective. Our argumentative analysis departs from the starting point that DTC GT (...) operates at the intersection of two different contexts: medicine on the one hand and the market on the other. Both fields differ strongly with regard to their standards of communication practices and the underlying normative assumptions regarding autonomy and responsibility. Following a short review of the ethical contexts of medical and commercial communication, we provide case examples for persuasive messages of DTC GT websites and briefly analyze their design with a multi-modal approach to illustrate some of their problematic implications. We observe three main aspects in DTC GT advertising communication: (1) the use of material suggesting medical professional legitimacy as a trust-establishing tool, (2) the suggestion of empowerment as a benefit of using DTC GT services and (3) the narrative of responsibility as a persuasive appeal to a moral self-conception. While strengthening and respecting the autonomy of a patient is the focus in medical communication, specifically genetic counselling, persuasive communication is the normal mode in marketing of consumer goods, presuming an autonomous, rational, independent consumer. This creates tension in the context of DTC GT regarding the expectation and normative assessment of communication strategies. Our analysis can even the ground for a better understanding of ethical problems associated with intersections of medical and commercial communication and point to perspectives of analysis of DTC GT advertising. Within these necessary properties and the difference between natural and semantic laws can be accounted for. The proper background theory for this is an updated version of Logical Empiricism, which is congenial to recent trends in Structural Realism. The anti-metaphysical attitude of Logical Empiricism deserves revitalization. (...) El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Una de las estrategias legislativas más extendidas en el ámbito penal es la de establecer límites mínimos y límites máximos para cada delito. De esta manera, al momento de determinar la pena para el caso en concreto, los jueces utilizan estos límites como guías de menor o mayor reproche por la conducta cometida. Entre los elementos en los que se apoyan los jueces para esta determinación se encuentran la culpabilidad del agente al momento de cometer el hecho y la lesividad (...) de su conducta delictiva. Sin embargo, existen ciertos casos en los cuales la pena mínima se muestra desproporcionada con el reproche que merece el agente. En particular, en este trabajo abordaré estas situaciones a fin de reconstruir algunas discusiones existentes en la filosofía jurídica y política. (shrink)

According to the partisan cheerleading view, numerous political disagreements that appear to be genuine are not authentic disputes, because partisans _deliberately_ misreport their beliefs to show support for their parties. Recently, three arguments have been put forth to support this view. First, contemporary democracies are characterized by affective rather than ideological polarization. Second, financial incentives indicate that partisans often deliberately misreport their beliefs to express their attitudes. Third, partisans have inconsistent and unstable political beliefs, so we should not take these (...) attitudes seriously. In this paper, I examine these arguments and present an alternative view, which I call the partisan conviction view. According to it, partisans are not necessarily insincere in their political judgments, and they are in genuine disagreement. (shrink)

There has been a growing interest within analytic philosophy in addressing political and social issues, which has been referred to as the “political turn” in the discipline. The aim of this paper is twofold. First, it discusses the very characterization of the political turn. In particular, it introduces the definition proposed by Bordonaba-Plou, Fernández-Castro, and Torices, suggests that we should not consider the turn a form of activism, and explores an additional benefit of the ideal/nonideal distinction for characterizing the turn. (...) Second, it addresses the concern of what attitude we should take in the face of the different sensitivities we might have with respect to what constitutes an injustice. Which philosophical works should count as part of the political turn? The paper explores three different attitudes toward this dilemma, and favors what it calls the revisionist attitude, which emphasizes the fact that our perception of injustice is subject to error. En la literatura jurídica existe un acuerdo generalizado en que los topes máximos de la pena establecidos la legislación son un límite infranqueable por los jueces. Sin embargo, al abordar el límite mínimo los desacuerdos comienzan a surgir. El objetivo del presente trabajo será el de defender que los mínimos penales, si bien son vinculantes para los jueces, pueden ser dejados de lado cuando las circunstancias particulares del caso lo ameriten. El método empleado será análisis conceptual, más precisamente, al contructivismo (...) interpretativista propuesto por Ronald Dworkin, aplicado al estudio de la jurisprudencia y la doctrina argentina. El resultado final será una justificación – apoyada en la concepción comunicativa del castigo – según la cual los límites mínimos pueden ser dejados de lado en casos concretos y excepcionales, como cuando la culpabilidad del acusado o la lesividad de su conducta se muestran desproporcionadas con el límite mínimo. De esta manera se busca dar respuesta a un problema que se encuentra presente en la práctica jurídica y, sobre todo, brindar herramientas argumentativas para que los operadores judiciales puedan resolver aquellos casos donde este límite se encuentre en discusión. Composition as Identity is the view that an object is identical to its parts taken collectively. I elaborate and defend a theory based on this idea: composition is a kind of identity. Since this claim is best presented within a plural logic, I develop a formal system of plural logic. The principles of this system differ from the standard views on plural logic because one of my central claims is that identity is a relation which comes in a variety of (...) forms and only one of them obeys substitution unrestrictedly. I justify this departure from orthodoxy by showing some problems which result from attempts to avoid inconsistencies within plural logic by means of postulating other non-singular terms besides plural terms. Thereby, some of the main criticisms raised against Composition as Identity can be addressed. Further, I argue that the way objects are arranged is relevant with respect to the question which object they compose, i.e. to which object they are identical to. This helps to meet a second group of arguments against Composition as Identity. These arguments aim to show that identifying composite objects on the basis of the identity of their parts entails, contrary to our common sense view, that rearranging the parts of a composite object does not leave us with a different object. Moreover, it allows us to carve out the intensional aspects of Composition as Identity and to defend mereological universalism, the claim that any objects compose some object. Much of the pressure put on the latter view can be avoided by distinguishing the question whether some objects compose an object from the question what object they compose. Eventually, I conclude that Composition as Identity is a coherent and plausible position, as long as we take identity to be a more complex relation than commonly assumed. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

Necessitism about individuals claims that necessarily every individual necessarily exists. An analogous necessitist thesis attributes necessary existence to properties and relations. Both theses have been defended by Williamson. Furthermore, Williamson specifically argues against the hybrid conjunction of first-order contingentism and higher-order necessitism; a combination that would bring about additional drawbacks. I work out a defence of the hybrid combination, including some replies to Williamson’s additional objections. Considerations of ontological parsimony and pre-theoretical intuitions favour the hybrid view over necessitism at all (...) orders. (shrink)

The present chapter is concerned with revisionism about free will. It begins by offering a new characterization of revisionist accounts and the way such accounts fit (or do not) in the familiar framework of compatibilism and incompatibilism. It then traces some of the recent history of the development of revisionist accounts, and concludes by remarking on some challenges for them.
