Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

In combating the ongoing global health threat of the COVID-19 pandemic, decision-makers have to take actions based on a multitude of relevant health data with severe potential consequences for the affected patients. Because of their presumed advantages in handling and analyzing vast amounts of data, computer systems of algorithmic decision-making are implemented and substitute humans in decision-making processes. In this study, we focus on a specific application of ADM in contrast to human decision-making, namely the allocation of COVID-19 vaccines to (...) the public. In particular, we elaborate on the role of trust and social group preference on the legitimacy of vaccine allocation. We conducted a survey with a 2 × 2 randomized factorial design among n = 1602 German respondents, in which we utilized distinct decision-making agents and prioritization of a specific social group as design factors. Our findings show that general trust in ADM systems and preference for vaccination of a specific social group influence the legitimacy of vaccine allocation. However, contrary to our expectations, trust in the agent making the decision did not moderate the link between social group preference and legitimacy. Moreover, the effect was also not moderated by the type of decision-maker. We conclude that trustworthy ADM systems must not necessarily lead to the legitimacy of ADM systems. (shrink)

Social norms have played a key role in the evolution of human cooperation, serving to stabilize prosocial and egalitarian behavior despite the self-serving motives of individuals. Young children’s behavior mostly conforms to social norms, as they follow adult behavioral directives and instructions. But it turns out that even preschool children also actively enforce social norms on others, often using generic normative language to do so. This behavior is not easily explained by individualistic motives; it is more likely a result of (...) children’s growing identification with their cultural group, which leads to prosocial motives for preserving its ways of doing things. Debates on the moral status of human embryos have been highly and continuously controversial. For many, these controversies have turned into a fruitless scholastical endeavor. However, recent developments and insights in cellular biology have cast further doubt on one of the core points of dissent: the argument from potentiality. In this article we want to show in a nonscholastical way why this argument cannot possibly survive. Getting once more into the intricacies of status debates is a must in our eyes. (...) The present paper attempts to show that a 1915 article by Erich Kretschmann must be credited not only for being the source of Einstein’s point-coincidence remark, but also for having anticipated the main lines of the logical-empiricist interpretation of general relativity. Whereas Kretschmann was inspired by the work of Mach and Poincaré, Einstein inserted Kretschmann’s point-coincidence parlance into the context of Ricci and Levi-Civita’s absolute differential calculus. Kretschmann himself realized this and turned the point-coincidence argument against Einstein in his second (...) and more famous 1918 paper. While Einstein had taken nothing from Kretschmann but the expression “point-coincidences”, the logical empiricists, however, instinctively dragged along with it the entire apparatus of Kretschmann’s conventionalism. Disappointingly, in their interpretation of general relativity, the logical empiricists unwittingly replicated some epistemological remarks Kretschmann had written before General Relativity even existed. I discuss three arguments that have been advanced in support of the epistemic mentalist view, i.e., the view that infants' social cognitive abilities manifest a capacity to attribute beliefs. The argument from implicitness holds that SCAs already reflect the possession of an “implicit” and “rudimentary” capacity to attribute representational states. Against it, I note that SCAs are significantly limited, and have likely evolved to respond to contextual information in situated interaction with others. I challenge the argument from parsimony by claiming (...) that parsimony per se favors neither a mentalist nor a behavior-reading account. Finally, I argue that early SCAs do not develop continuously into four-year-olds' belief attribution abilities. Accordingly, the argument from developmental continuity is empirically inadequate. Careful analysis of both the empirical data and the theoretical assumptions leading to the epistemic mentalist view is needed in order to improve our understanding of SCAs in earl.. (shrink)

Two-thirds of global industrial greenhouse gas emissions over the past two centuries can be traced to the activities of a handful of companies (‘carbon majors'). Based on their direct contribution to climate change in terms of carbon emissions and on a number of morally relevant facts, this article proposes a normative framework to establish the responsibilities that carbon majors have in relation to climate change. Then, the analysis articulates these responsibilities in the form of two duties: a duty of decarbonisation (...) and a duty of reparation. The duty of decarbonisation entails a large-scale transformation that carbon majors ought to undergo in order to reduce and eventually eliminate carbon emissions from their entire business model. The duty of reparation implies rectification through disgorgement of funds for the wrongful actions of carbon majors, which resulted in negative climate impacts, starting from the most socially vulnerable groups affected by climate change. Finally, the article indicates possible practical implications of these duties. (shrink)

In this paper, I delineate the first pages of a philosophical genealogy which outlines the cornerstones of a philosophy of bio-technical forms. In so doing, the essay contributes to the philosophical understanding of some key scientific concepts. In particular, it analyses the philosophical and historical preconditions, the epistemic assumptions, as well as the ontological commitments of the concept of form as used in digital design and in bionics. In the first section, I investigate Ernst Kapp’s philosophy of technical forms. In (...) the second section, I analyse the emergence of biotechnology, today’s bionics, as an independent technical discipline. At the beginning of the 20th century, the Austro-Hungarian botanist Raoul Heinrich Francé (1874–1943) founded this discipline with the aim of imitating the technical solutions chosen by nature. In the conclusion, I draw broader conclusions about the philosophy of bio-technical forms. Particularly, I argue, first, that the role of materiality and form-intrinsic propriety is of central importance in processes of form design. Second, I define morphology as a theory of possible constructions of forms in space and not, as in evolutionary biology, a science of the changes of forms in time. This characterises what I have called the ontological turn in form-design disciplines: nature operates technically to conceive new forms. (shrink)

Meditation comprises a series of practices mainly developed in eastern cultures aiming at controlling emotions and enhancing attentional processes. Several authors proposed to divide meditation techniques in focused attention and open monitoring techniques. Previous studies have reported differences in brain networks underlying FA and OM. On the other hand common activations across different meditative practices have been reported. Despite differences between forms of meditation and their underlying cognitive processes, we propose that all meditative techniques could share a central process that (...) would be supported by a core network for meditation since their general common goal is to induce relaxation, regulating attention and developing an attitude of detachment from one’s own thoughts. To test this hypothesis, we conducted a quantitative meta-analysis based on activation likelihood estimation of 10 neuroimaging studies on different meditative techniques to evidence the core cortical network subserving meditation. We showed activation of basal ganglia , limbic system and medial prefrontal cortex . We discuss the functional role of these structures in meditation and we tentatively propose a neurocognitive model of meditation that could guide future research. (shrink)

Human adults incline toward moral objectivism but may approach things more relativistically if different cultures are involved. In this study, 4-, 6-, and 9-year-old children (N = 136) witnessed two parties who disagreed about moral matters: a normative judge (e.g., judging that it is wrong to do X) and an antinormative judge (e.g., judging that it is okay to do X). We assessed children’s metaethical judgment, that is, whether they judged that only one party (objectivism) or both parties (relativism) could (...) be right. We found that 9-year-olds, but not younger children, were more likely to judge that both parties could be right when a normative ingroup judge disagreed with an antinormative extraterrestrial judge (with different preferences and background) than when the antinormative judge was another ingroup individual. This effect was not found in a comparison case where parties disagreed about the possibility of different physical laws. These findings suggest that although young children often exhibit moral objectivism, by early school age they begin to temper their objectivism with culturally relative metaethical judgments. A standard approach to examining Deleuze's concept of difference in Difference and Repetition is to follow his critique of representation through an overturning of Platonism, which Deleuze finds to be the definitive task of philosophy after Nietzsche. While engaging this largely critical project, however, there is a tendency to overlook the dimensions of Platonism that Deleuze rehabilitates in a differential and immanent register. This paper aims to recover the essential dimensions of Platonism at the very heart of Deleuze's philosophy of (...) difference. This recovery is accomplished by distinguishing Nietzsche's overturning of Platonism through his evaluation of the reactive politics of the Idea from Deleuze's own reversal of Platonism through his evaluation of the active politics of simulacra. The standard view of classical cognitive science stated that cognition consists in the manipulation of language-like structures according to formal rules. Since cognition is ‘linguistic’ in itself, according to this view language is just a complex communication system and does not influence cognitive processes in any substantial way. This view has been criticized from several perspectives and a new framework (Embodied Cognition) has emerged that considers cognitive processes as non-symbolic and heavily dependent on the dynamical interactions between the cognitive system (...) and its environment. But notwithstanding the successes of the embodied cognitive science in explaining low-level cognitive behaviors, it is still not clear whether and how it can scale up for explaining high-level cognition. In this paper we argue that this can be done by considering the role of language as a cognitive tool: i.e. how language transforms basic cognitive functions in the high-level functions that are characteristic of human cognition. In order to do that, we review some computational models that substantiate this view with respect to categorization and memory. Since these models are based on a very rudimentary form of non-syntactic ‘language’ we argue that the use of language as a cognitive tool might have been an early discovery in hominid evolution, and might have played a substantial role in the evolution of language itself. In this paper, I explore how bio-hybrid forms can be created and combined starting from organic forms. The thesis put forward is epistemological: the combinatorial practice of bionics, biomimetics, biorobotics, and all design strategies inspired by nature is not based on a kind of biomimetic inspiration, i. e., on a kind of imitation of nature, but on a practice of translation. To develop this thesis, I focus on the practices of contemporary biorobotics, first examining the practice of translating natural forms (...) into technical artefacts as developed by Raoul Heinrich Francé at the beginning of the 20th century, secondly, analysing the production of robots capable of replicating complex locomotion systems and, finally, investigating the interaction between robots and living organisms (fish). In the last part of the paper, I reflect on the philosophical payoff and broader conditions of possibility for this translational practice. I discuss when and to what extent a translation of biological forms into biotechnical ones is acceptable and point out the notion of form that underlies this practice. Moreover, I draw attention to the need to philosophically investigate what happens between different domains of knowledge – and especially between science and technology. This article is thus an invitation to philosophers to develop a philosophy in the interstices of knowledge production. (shrink)

In this paper, I try to show that Kripke’s proposed solution to the problem of negative existentials fails. I try to show that Kripke’s proposal fails because it entails that anybody who has good reasons to believe that there are no propositions has also good reasons to believe that he or she does not exist. However, there were philosophers who had good reasons to believe that there are no propositions even though they didn’t have good reasons to believe that they (...) do not exist. I conclude that Kripke’s proposed solution to the problem of negative existentials fails. (shrink)

The coronavirus disease imposes an unusual risk to the physical and mental health of healthcare workers and thereby to the functioning of healthcare systems during the crisis. This study investigates the clinical knowledge of healthcare workers about COVID-19, their ways of acquiring information, their emotional distress and risk perception, their adherence to preventive guidelines, their changed work situation due to the pandemic, and their perception of how the healthcare system has coped with the pandemic. It is based on a quantitative (...) cross-sectional survey of 185 Swiss healthcare workers directly attending to patients during the pandemic, with 22% of them being assigned to COVID-19-infected patients. The participants answered between 16th June and 15th July 2020, shortly after the first wave of COVID-19 had been overcome and the national government had relaxed its preventive regulations to a great extent. The questionnaire incorporated parts of the “Standard questionnaire on risk perception of an infectious disease outbreak”, which were adapted to the case of COVID-19. Clinical knowledge was lowest regarding the effectiveness of standard hygiene. Knowledge of infectiousness, incubation time, and life-threatening disease progression was higher, however still significantly lower than regarding asymptomatic cases and transmission without physical contact. 70% of the healthcare workers reported considerable emotional distress on at least one of the measured dimensions. They worried significantly more strongly about patients, elderly people, and family members, than about their own health. Adherence to preventive guidelines by the government displayed patterns such that not all guidelines were followed equally. Most of the participants were faced with a lack of protective materials, personnel, structures, processes, and contingency plans. An increase in stress level was the most prevalent among the diverse effects the pandemic had on their work situation. Better medical equipment, better protection for their own mental and physical health, more personnel, more comprehensive information about the symptoms of the disease, and a system of earlier warning were the primary lessons to be learned in view of upcoming waves of the pandemic. In the present article, I review some evidence that shows how body odor disgust sensitivity plays a central role in the so-called behavioral immune system, a set of processes aimed at detecting, emotionally reacting, and behaviorally avoiding pathogen threats. I also report empirical evidence on how the BODS relates to social attitudes such as authoritarianism, xenophobia, and condemnation of “impure” moral violations. This research is interpreted from an Evolutionary psychology framework.

In an unpublished text from the early postwar period, Georges Canguilhem deals with Nietzsche’s maxim “Become who you are!” Is this “apparently contradictory formula of a philosopher full of contradictions” really only seemingly inconsistent? Canguilhem regards it as a norm whose supposed metaphysical or objective content dissolves upon further analysis. So he here discerns a new instance of the same potential confusion he had already addressed in his classical essay on The Normal and the Pathological (1943). According to him, the (...) formula “become who you are!” must not be misunderstood in a naturalistic sense, a tendency from which not even Nietzsche himself, Canguilhem thinks, was entirely free. Besides the French philosophy of his time, his philosophical inquiry into “Become who you are!” critically engages two classic German Nietzsche scholars, Ernst Bertram and Karl Jaspers, as well as the French interpreters of the latter’s philosophy of Existenz, Mikel Dufrenne and Paul Ricœur. Finally, the paper highlights Nietzsche’s specific importance for Canguilhem and the ambivalence in his privileged relationship to the German thinker. (shrink)

In the traditional debate on the dichotomy between dogmatism and criticism in scientific practice (the Popper-Kuhn debate), dogmatism is considered a psychological or ethical attitude of the individual scientist. In this paper, I propose a new interpretation of scientific dogmatism by means of a reconstruction of the pragmatist and Wittgensteinian heritage of Kuhn’s concept of dogmatism. My thesis is that such a revised concept accounts for both the stability of scientific knowledge (against scepticism and ceaseless scientific revolutions), and the importance (...) of doubt and criticism for scientific progress. This is possible only if we consider dogmatism from a social perspective that focuses on scientific communities as the main actors in the history of science. From this point of view, dogmatism is not the unjustified acceptance of particular beliefs, but the blind adherence to the “formal” normative structure of the paradigm. I argue that we have grounded this normative structure in the training process that physics students experience in their formative years, and that Kuhn describes in a similar way to Wittgenstein’s analysis of general linguistic training. Finally, dogmatism does not refer to a system of beliefs, but to a system of norms; not to the specific content of knowledge but to the way that scientific knowledge is authenticated, organised, and transmitted by scientific communities. The institutional structure of science, that is to say its social organisation trough training, textbooks, scientific communities and so on, is a precondition for the organisation of meaningful scientific discourse (i.e. for the production and organisation of empirically verifiable or falsifiable statements). That is the nature of the paradigm: it creates and constrains the possibilities of scientific practice. In normal circumstances, dogmatism and certainty are concerned with such pragmatic a priori, while criticism and doubt are concerned with the empirical statements articulated through it. (shrink)

Partiendo de la genealogía del neoliberalismo que Michel Foucault traza en _Nacimiento de la biopolítica_ hasta los ordoliberales alemanes, se sostendrá que, si en lugar de haberla basado en sus textos posteriores a la Segunda Guerra Mundial, Foucault hubiera acudido a los textos fundacionales de la época de Weimar: a) no hubiera incurrido en el equívoco de pensar que el papel del Estado fue secundario para estos, y b) habría advertido el carácter autoritario de su propuesta. Así, analizaremos en detalle (...) la inverosímil confluencia en torno a una misma tesis de Carl Schmitt y de los ordoliberales en la década de 1930: Estado fuerte, economía sana. Belief Revision addresses the problem of rationally incorporating pieces of new information into an agent’s belief state. In the AGM paradigm, the most used framework in Belief Revision, primacy is given to the new information, which is fully incorporated into the agent’s belief state. However, in real situations, one may want to reject the new information or only accept a part of it. A constructive model called Selective Revision was proposed to meet this need but, as in the AGM framework, (...) focused on belief sets. In this paper we adapt the selective revision operators, that were proposed for belief sets, to the belief base context, obtaining a model in which an agent’s epistemic state is represented by a belief base and that allows the acceptance of only part of the new information. We present several representation theorems for selective base revision operators based on different base revision operators. (shrink)

The present contribute aims to reconstruct, using the methodology of intellectual history, the broad spectrum of metaphysical doctrines that Kant could know during the years of the formation of his philosophy. The first part deals with the teaching of metaphysics in Königsberg from 1703 to 1770. The second part examines the main characteristics of the metaphysics in the various handbooks, which were taught at the Albertina, in order to have an exhaustive overview of all metaphysical positions.O presente trabalho, valendo-se da (...) metodologia da história das idéias, visa reconstruir o amplo espectro de doutrinas metafísicas às quais Kant poderia ter acesso durante os anos de formação de sua filosofia. A segunda parte examina as principais características da metafísica com base nos diversos manuais em uso na Albertina, a fim de que se tenha um panorama exaustivo de todas as posições então objeto de ensino. We investigated motor resonance in children using a priming paradigm. Participants were asked to judge the weight of an object shortly primed by a hand in an action-related posture or a non action-related one . The hand prime could belong to a child or to an adult. We found faster response times when the object was preceded by a grasp hand posture . More crucially, participants were faster when the prime was a child’s hand, suggesting that it could belong to (...) their body schema, particularly when the child’s hand was followed by a light object . A control experiment helped us to clarify the role of the hand prime. To our knowledge this is the first behavioral evidence of motor simulation and motor resonance in children. Implications of the results for the development of the sense of body ownership and for conceptual development are discussed. (shrink)

The central hyperexcitability observed in animal models supports a pathophysiological explanation for chronic human pain. Novel information on cholecystokinin (CCK) upregulation offers a rationale for reduced opioid response in neuropathic pain. However, the basic information provided by scientists should not lead clinicians to equate experimental models to chronic human conditions. Clinicians should provide careful reports and attempt to classify pathophysiologically clinical conditions that have so far been grouped generically.
