This book fills a major gap in the ever-increasing secondary literature on Hannah Arendt's political thought by providing a dedicated and coherent treatment of the many, various and interesting things which Arendt had to say about law. Often obscured by more pressing or more controversial aspects of her work, Arendt nonetheless had interesting insights into Greek and Roman concepts of law, human rights, constitutional design, legislation, sovereignty, international tribunals, judicial review and much more. This book retrieves these aspects of her (...) legal philosophy for the attention of both Arendt scholars and lawyers alike. The book brings together lawyers as well as Arendt scholars drawn from a range of disciplines (philosophy, political science, international relations), who have engaged in an internal debate the dynamism of which is captured in print. Following the editors' introduction, the book is split into four Parts: Part I explores the concept of law in Arendt's thought; Part II explores legal aspects of Arendt's constitutional thought: first locating Arendt in the wider tradition of republican constitutionalism, before turning attention to the role of courts and the role of parliament in her constitutional design. In Part III Arendt's thought on international law is explored from a variety of perspectives, covering international institutions and international criminal law, as well as the theoretical foundations of international law. Criticising someone’s conduct is a disaffiliative action that can attract recipient objections, particularly in the form of defensive detailing by which the recipient volunteers extenuating circumstances that undermine the criticism. In Therapeutic Community meetings for clients with drug addiction, support staff regularly criticise clients’ behaviours that violate therapeutic principles or norms of conduct. This study examines cases where, rather than criticising a client’s behaviour directly, TC staff members do so indirectly through an anecdote: a case illustrating the inappropriateness of the (...) type of conduct of which the client’s behaviour is an instantiation. TC staff members design the anecdote to convey a principle or norm of conduct which the client has putatively violated, and they systematically pursue endorsement of that principle by the client. By constructing the anecdote as an exemplary case, distanced from the individual client’s personal experience, TC staff members make it an empirically unverifiable, self-evident, and therefore hard to challenge, illustration of a norm. Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

We investigate the major mathematical theories of space from a modal standpoint: topology, affine geometry, metric geometry, and vector algebra. This allows us to see new fine-structure in spatial patterns which suggests analogies across these mathematical theories in terms of modal, temporal, and conditional logics. Throughout the modal walk through space, expressive power is analyzed in terms of language design, bisimulations, and correspondence phenomena. The result is both unification across the areas visited, and the uncovering of interesting new questions.

This monograph offers a comprehensive study of contingent a priori truths. Building onto a theoretical framework developed by the philosopher and logician Saul Kripke, the author also presents a new approach to these truths. The first part of the book details the many theories on contingent a priori truths. The coverage examines the cases of Kripke and David Kaplan, Donnellan and the de re requirement, Evans and weak contingency, as well as Plantinga, Salmon, Soames, and the pseudo a priori. Overall, (...) it provides a systematic discussion and critical review of all these many positions. Next, the author develops an alternative approach. His working hypothesis is that performative verbs must play a central role in Kripke's examples, even if they do not show up at the surface structure of the corresponding sentences. This opens up an entirely new way of looking at Kripke's cases and of treating them by exploring some aspects of the theory of illocutionary acts. His discussion also examines brute facts and institutional facts, indexicals and performatives, as well as Frege's theory of definitions. The paper presents a historical account of the primacy of concepts in Frege's conception of logic. Moreover, it argues that Frege's priority-thesis (i.e., the assumption that judgeable contents are prior to concepts) does not imply that sentential logic is more basic than the logic of concepts in his thought.

Human adults incline toward moral objectivism but may approach things more relativistically if different cultures are involved. In this study, 4-, 6-, and 9-year-old children (N = 136) witnessed two parties who disagreed about moral matters: a normative judge (e.g., judging that it is wrong to do X) and an antinormative judge (e.g., judging that it is okay to do X). We assessed children’s metaethical judgment, that is, whether they judged that only one party (objectivism) or both parties (relativism) could (...) be right. We found that 9-year-olds, but not younger children, were more likely to judge that both parties could be right when a normative ingroup judge disagreed with an antinormative extraterrestrial judge (with different preferences and background) than when the antinormative judge was another ingroup individual. This effect was not found in a comparison case where parties disagreed about the possibility of different physical laws. These findings suggest that although young children often exhibit moral objectivism, by early school age they begin to temper their objectivism with culturally relative metaethical judgments. In considering what it means to lead organizations effectively and ethically, the literature comprising spirituality at work and spiritual leadership theory has become highly influential, especially in the USA. It has also attracted significant criticism. While in this paper, we endorse this critique, we argue that the strand of literature which purportedly takes a Christian standpoint within the wider SAW school of thought, largely misconstrues and misapplies the teaching of its founder, Jesus. As a result, in dismissing the claims and (...) application of SAW and SLT, there is a real risk that we lose the vital contribution of Christian thought, not least some of the timeless counter-cultural wisdom of Jesus which, we contend, offers a vital foundation to the practice of ethical leadership and business ethics in organizations. In proposing a way forward, two thorny issues which face all leaders are addressed: dealing with ego and closing the gap between what we say and what we do. The more we understand about the dynamics of human nature, the more we learn about the profundity of Jesus’ teachings. We then propose a number of ways in which Jesus-centred ethical leadership can be practised. Each is radical and each implies risk: both the personal risk of inner renewal arising from repentance as a doorway to personal integrity, as well as the risk of opposing unethical practices and promoting the excellence of core practices in the workplace. This paper provides an ethical intepretation of the Nash choice rule. In a setting in which (cardinal) utilities are interpersonally comparable, this procedure is characterised by an impartiality requirement and by the assumption that choices are not responsive to the agents' relative ability to convert resources into utility.

We present the foucaultian critique of the transcendental theme. We will try to show, sharpening the layout of the problem, that the specific target of such critique is not so much the transcendental instance as such, present in a sui generis way in Foucault himself, as rather a certain interpretation of this instance, mastered by the “knowledge” scheme and its postulates of natural affinity, constituent subjectivity and transcendental theology. So we will determine, in the first place, the framework and reach (...) of such critique. Secondly, we will set forth the interpretation of the transcendental which rules in the foucaultian critique of this theme. In the third place, we will take into account the assumptions which rule in this interpretation. Finally, we will sketch the foucaultian idea of “knowledge” (savoir). (shrink)

The question of whether the true character of reality is monistic or pluralistic spans almost the entire history of metaphysics. Though little discussed in recent decades, it presents problems that are nowadays considered of the utmost importance. Think, for instance, of the ultimate nature of elements such as matter, elemental particles or physical fields. Are they self-sufficient? Do they depend on a higher reality? A major discussion regarding the metaphysical grounds of such questions took place in Britain during the late (...) nineteenth century. It saw Francis Herbert Bradley and James Ward trying to understand the nature of experience. By recalling that specific discussion, this article seeks to show why the monistic character of reality prevails. (shrink)

Einstein’s “point-coincidence argument'” as a response to the “hole argument” is usually considered as an expression of “Leibniz equivalence,” a restatement of indiscernibility in the sense of Leibniz. Through a historical-critical analysis of Logical Empiricists' interpretation of General Relativity, the paper attempts to show that this labeling is misleading. Logical Empiricists tried explicitly to understand the point-coincidence argument as an indiscernibility argument of the Leibnizian kind, such as those formulated in the 19th century debate about geometry, by authors such as (...) Poincaré, Helmholtz or Hausdorff. However, they clearly failed to give a plausible account of General Relativity. Thus the point-coincidence/hole argument cannot be interpreted as Leibnizian indiscernibility argument, but must be considered as an indiscernibility argument of a new kind. Weyl's analysis of Leibniz's and Einstein's indiscernibility arguments is used to support this claim. (shrink)

The article attempts to reconsider the relationship between Leibniz’s and Kant’s philosophy of geometry on the one hand and the nineteenth century debate on the foundation of geometry on the other. The author argues that the examples used by Leibniz and Kant to explain the peculiarity of the geometrical way of thinking are actually special cases of what the Jewish-German mathematician Felix Hausdorff called “transformation principle”, the very same principle that thinkers such as Helmholtz or Poincaré applied in a more (...) general form in their celebrated philosophical writings about geometry. The first two parts of the article try to show that Leibniz’s and Kant’s philosophies of geometry, despite their differences, appear to be preoccupied with the common problem of the impossibility to grasp conceptually the intuitive difference between two figures (such as a figure and its scaled, displaced or mirrored copy). In the third part, it is argued that from the perspective of Hausdorff’s philosophical-geometrical reflections, this very same problem seems to find a more radical application in Helmholtz’s or Poincaré’s thought experiments on the impossibility of distinguishing distorted copies of our universe from the original one. I draw the conclusion that in Hausdorff’s philosophical work, which has received scholarly attention only recently, one can find not only an original attempt to frame these classical arguments from a set-theoretical point of view, but also the possibility of considering the history of philosophy of geometry from an uncommon perspective, where especially the significance of Kant’s infamous appeal to “intuition” can be judged by more appropriate standards. This article addresses Maurice Mandelbaum's criticism of anti-essentialism in Wittgensteinian-oriented art. Mandelbaum criticizes the common position of Paul Ziff, Morris Weitz and Willian Kennick according to which the definition of the concept of art cannot be established in essentialist terms. According to Mandelbaum, the anti-essentialist thesis fails because it is based on observable properties to claim that there is no necessary and sufficient property that runs through the set of all works of art. In this sense, the definition of the (...) concept of art could be established through relational properties. Mandelbaum's attack focuses on the notion of family resemblance developed by Ludwig Wittgenstein in Philosophical Investigations. In his interpretation of that notion, Mandelbaum assumes that Wittgenstein would be referring to directly displayed properties. However, the article argues that Mandelbaum's critique is not justified as it ignores the distinction between seeing and seeing as that Wittgenstein himself performs in passage XI of his mentioned work. Integrity is often conceived as a moral virtue that pertains to the coherence between one’s moral convictions and actions, as well as consistency in convictions over time. By contrast, I argue that integrity is primarily an epistemic virtue. To act with integrity, an individual or organisation must engage in responsible inquiry; that is, the collection, processing, sharing, and storage of information in ways that promote truth. Organisational structures such as division of labour and hierarchy present challenges to responsible inquiry, thereby (...) making epistemic integrity in organisations inherently vulnerable and increasing the risk of unintentional unethical behaviour. This epistemic perspective on organisational integrity emphasises the importance of developing virtuous epistemic infrastructure and an ethical epistemic culture. By aligning their beliefs with facts, organisations can also improve moral behaviour and reduce the risk of culpable ignorance. (shrink)

How to demarcate the political units within which democracy will be practiced? Although recent years have witnessed a steadily increasing academic interest in this question concerning the boundary problem in democratic theory, social contract theory’s potential for solving it has largely been ignored. In fact, contract views are premised on the assumption of a given people and so presuppose what requires legitimization: the existence of a demarcated group of individuals materializing, as it were, from nowhere and whose members agree among (...) themselves to establish a political order. In order to fill this gap in social contract theory, a distinction is made between three kinds of contract views: Lockean political voluntarism, contractarianism, and contractualism. Each of these views can be (re)interpreted in such a way that it offers a democratic solution to the boundary problem. Ultimately, however, a Rawlsian interpretation of the contractualist solution is defended. (shrink)
