The Ontological and Epistemological Assumptions of Montaigne’s ScepticismMontaigne is widely regarded as one of the most significant sceptics of the 16th century. His most important work, Essays, had a great impact on the thinkers of the 16th and 17th centuries, in particular on the philosophy of Descartes. The article presents Montaigne’s critique of senses and reason as sources of human knowledge. The elements of his scepticism that went beyond the sceptic arguments of ancient thinkers has been emphasized. The negative role (...) of his ontological variabilism in knowing things has been underlined. As a result of the total criticism of the possibilities of human cognition made by the author of the Essays, attention has been paid to the non-sceptical type of the question posed by him: “What do I know?” “Que sais-je?”. The answer to this question led him to fideism in cognition. At the end of the article, an attempt has been made to indicate Montaigne’s main epistemological and metaphysical assumptions that contributed to the problem of cognition. It has also been highlighted in what way the understanding of reason, method, and, above all, self became for Descartes, unlike Montaigne, the foundation of certain knowledge. (shrink)

Can we see the expressiveness of other people's gestures, hear the intentions in their voice, see the emotions in their posture? Traditional theories of social cognition still say we cannot because intentions and emotions for them are hidden away inside and we do not have direct access to them. Enactive theories still have no idea because they have so far mainly focused on perception of our physical world. We surmise, however, that the latter hold promise since, in trying to understand (...) cognition, enactive theory focuses on the embodied engagements of a cognizer with his world. In this paper, we attempt an answer for the question What is social perception in an enactive account? In enaction, perception is conceived as a skill, crucially involving action, an ability to work successfully within the set of regularities, or contingencies that characterize a given domain. If this is the case, then social perception should be a social skill. Having thus transformed the question of what social perception is into that of what social skill is, we examine the concept of social contingencies and the manner in which social skills structure—both constrain and empower— social interaction. Some of the implications of our account for how social and physical perception differ, the role of embodiment in social interaction and the distinction between our approach and other social contingency theories are also addressed. Perceptual modalities have been traditionally considered the product of dedicated biological systems producing information for higher cognitive processing. Psychological and neuropsychological evidence is offered which undermines this point of view and an alternative account of modality from the enactive approach to understanding cognition is suggested. Under this view, a perceptual modality is a stable form of perception which is structured not just by the biological sensitivities of the agent, but by their goals and the set of skills or expertise which (...) they are deploying at a given time. Such a view suggests that there is no such thing as an experience that is purely visual, auditory, or otherwise modal and that our attempts to understand consciousness and the mind must be conducted within a framework that provides an account of embodied, goal-directed adaptive coping with the world. In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban development (...) in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

In this paper we show that this equivalence holds also for all modal logics which are closed under replacement of tautological equivalents (rte-logics).We give a general method which, for any class of modal logics determined by a set of joint axioms and rules, generates in the given class the weakest logic having the property (†). Thus, for the class of all modal logics we obtain the weakest modal logic which owns this property. On the other hand, applying the method to various classes of modal logics: rte-logics, congruential, monotonic, regular and normal, we obtain the weakest in a given class logic defining D2. (shrink)

In this paper we present a comparison of certain inconsistencyadaptive logics and Jaśkowski’s logic.

We generalize the notion of analytic/Borel equivalence relations, orbit equivalence relations, and Borel reductions between them to their continuous and quantitative counterparts: analytic/Borel pseudometrics, orbit pseudometrics, and Borel reductions between them. We motivate these concepts on examples and we set some basic general theory. We illustrate the new notion of reduction by showing that the Gromov–Hausdorff distance maintains the same complexity if it is defined on the class of all Polish metric spaces, spaces bounded from below, from above, and from (...) both below and above. Then we show that [Formula: see text] is not reducible to equivalences induced by orbit pseudometrics, generalizing the seminal result of Kechris and Louveau. We answer in negative a question of Ben Yaacov, Doucha, Nies, and Tsankov on whether balls in the Gromov–Hausdorff and Kadets distances are Borel. In appendix, we provide new methods using games showing that the distance-zero classes in certain pseudometrics are Borel, extending the results of Ben Yaacov, Doucha, Nies, and Tsankov. There is a complementary paper of the authors where reductions between the most common pseudometrics from functional analysis and metric geometry are provided. (shrink)

The author examines the arguments for applicability of the limitation clause which specifies the requirements for limitation of constitutional freedoms and rights (Article 31 para. 3 of the Constitution) to the right to protection of life (Article 38). Even if there is almost a general acceptance of such applicability, this approach does not hold up to criticism based on the rule existing in the Polish legal order that treaty commitments concerning human rights have supremacy over national statutory regulations. Due to (...) an international pattern which does not provide application of the limitation clause to the right to life protection, despite the recognition — at the level of a constitutional standard — of applicability of the clause of Article 31 para. 3 to Article 38, and to protection of life in general, this will be made impossible at any attempt to formulate a statutory standard. He also points out the defectiveness of the reasoning leading to acceptance of certain limitations of a particular value (e.g. life) on the basis of the ex definitione exemptions existing in the international standard to the assumption of applicability of the limitation clause when shaping statutory standards in the Polish legal system. The discussed issues are related to the question of interpretation of the inviolability of human rights. This term takes different meaning in the context of: 1) inviolability of all human rights understood in abstracto as normative structures of a general and abstract nature; 2) right protecting certain values with no exception; 3) rights to which an application of the limitation clause is forbidden; 4) rights not subject to derogation; 5) inviolability of understood in concreto, as that is (here and now) due to the subject of dignity; 6) inviolable essence of freedoms and rights. One should also clearly distinguish between (7) the descriptive and (8) the normative meaning of inviolability. -/- Punktem wyjścia jest analiza argumentacji na rzecz tezy o stosowalności do prawa do ochrony życia (art. 38 Konstytucji RP), klauzuli limitacyjnej określającej warunki ograniczania konstytucyjnych wolności i praw (art. 31 ust. 3). Mimo niemal powszechnej akceptacji tej tezy, nie wytrzymuje ona krytyki opartej na pierwszeństwie, które w polskim porządku prawnym mają zobowiązania traktowe dotyczące praw człowieka, wobec regulacji ustawowych. Ze względu na wzorzec międzynarodowy, który nie przewiduje stosowania klasycznej klauzuli limitacyjnej do prawa do życia, mimo uznania - na poziomie standardu konstytucyjnego - stosowalności klauzuli z art. 31 ust. 3 do art. 38 i ochrony życia w ogóle, stosowalność tej klauzuli będzie uniemożliwiona przy każdej próbie formułowania standardu ustawowego. Autor zwraca uwagę na wadliwość wnioskowania prowadzącego od uznania dopuszczalności pewnych ograniczeń ochrony jakiejś wartości (np. życia) na podstawie wyjątków ex definitione obecnych w standardzie międzynarodowym, do tezy o stosowalności klauzuli limitacyjnej przy kształtowaniu standardu ustawowego w polskim systemie prawnym. In the article, I develop some ideas introduced by Edmund Husserl concerning time-consciousness and embodiment. However, I do not discuss the Husserlian account of consciousness of time in its full scope. I focus on the main ideas of the phenomenology of time and the problem of bodily sensations and their role in the constitution of consciousness of time. I argue that time-consciousness is primarily constituted in the dynamic experience of bodily feelings. In the first part, I outline the main ideas (...) of Husserl’s early phenomenology of consciousness of time. In the second part, I introduce the phenomenological account of bodily feelings and describe how it evolved in Husserl’s philosophy. Next, I discuss the idea of bodily self-affection and the affective-kinaesthetic origin of consciousness’ temporal flow. In order to better understand this “pre-phenomenal temporality”, I analyse the dynamics of non-intentional, prereflective bodily self-affection. In the third part, I try to complement Husserl’s account by describing the specific dynamics of bodily experience. In order to do so, I appeal to Daniel Stern’s psychological account of dynamic bodily experience, which he calls the “vitality affect”. I argue that the best way to understand the pre-phenomenal dynamics of bodily feelings is in terms of the notion of rhythm. (shrink)

In the article I discuss the conceptual problem of other minds and different approaches to mental concepts. Firstly, I introduce the conceptual problem and argue that solutions proposed by theory-theory and direct perception approach are inadequate. I claim that mental concepts are neither theoretical terms nor observational terms. Then, I consider third option which states that mental concepts are dispositional terms, i.e. they concern particular patterns (stereotypes) of behavior. Finally, I argue that dispositional approach is to some extent coherent with (...) phenomenological account and that phenomenological concept of embodiment can improve this position. (shrink)

Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...) may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

The contribution focuses on philosophical issues of justice of positive law in the light of the social teaching of John Paul II. The analyses start with consideration of anthropological foundations of justice as virtue, develop with the reflexion upon justice of actions realizing justice and finally arrive at examination of the criteria of justice of law. -/- It is argued that relations between a human being and goods (ends of actions) form ontological basis of natural law and justice of actions (...) – orders and prohibitions are secondary in respect to these relations. An aim of just law (and natural law) is not preservation or restoration of abstractly understood moral order based on norms – orders and prohibitions) but integral development (good) of a person – a being possessing dignity. John Paul’s II philosophy of law takes advantage primarily of Thomas Aquinas’ approach to law and combines it with constructions which are typical for modern human rights protection. John Paul’s II conception of natural law is anthropocentric and bases on subjective rights thinking. Human dignity and human rights which derive from it provide basic criteria for the justice of law. Human rights as subjective rights disclose natural law which is understood as a set of goods for a human person. These goods are ends of actions and as such they determine actions and their forms. This point of view is compatible with Aquinas’ definition: “law is nothing but a rational plan of operation, and … the rational plan of any kind of work is derived from the end” (Summa contra gentiles, lib. 3, cap. 114, n. 5). -/- Positive (human) law which is not just has no normative power in this sense that it does not in itself provide reasons for concrete actions of a concrete actor. Sometimes there are moral reasons for following unjust law, however if its norm prescribes actions which are wrong in themselves (internally wrong) there is moral obligation to act contrary to such a legal norm. -/- Zasadniczym przedmiotem opracowania jest filozoficzna refleksja Jana Pawła II nad sprawiedliwością prawa stanowionego. Analizy przebiegają od zagadnienia antropologicznych podstaw sprawiedliwości poprzez problematykę działań realizujących sprawiedliwość do zagadnienia sprawiedliwości prawa stanowionego. Opracowanie zamykają uwagi wskazujące na kontekst teologiczny istotny dla problematyki sprawiedliwości, którego analiza wykracza jednak poza podjęte zamierzenie koncentrujące się na problematyce filozoficznoprawnej. Argumentuje się, że u podstaw tej refleksji leży namysł nad relacją człowieka do dobra, która stanowi ontologiczną podstawę prawa naturalnego i sprawiedliwości – nakazy i zakazy są wtórne wobec tej relacji. Celem prawa i sprawiedliwości jest dobro konkretnego, obdarzonego godnością człowieka, a nie np. przywracanie abstrakcyjnie pojętego porządku moralnego. Od strony konstrukcji teoretycznej, filozofia prawa Jana Pawła II jest osadzona przede wszystkim na koncepcji Tomasza z Akwinu łączonej z konstrukcjami typowymi dla współczesnej ochrony praw człowieka. To w godności i wynikających z niej prawach człowieka poszukiwać trzeba zasadniczych treściowych kryteriów sprawiedliwości prawa. Prawa człowieka jako prawa podmiotowe są podstawowym wyrazem prawa naturalnego, stanowiącego ontyczną podstawę sprawiedliwości i które pojmowane jest jako zespół dóbr dla osoby, zatem i celów kształtujących działanie. Perspektywa pojmowania prawa naturalnego jest antropocentryczna. Prawo stanowione, które nie jest sprawiedliwe, nie ma „mocy prawa”, przede wszystkim w takim sensie, że nie stanowi samo w sobie racji działania. Niekiedy, ze względów moralnych, niesprawiedliwe prawo wymaga posłuszeństwa. Jeśli jednak prawo stanowione daje uprawnienia do czynów wewnętrznie złych i nakazuje takie czyny, to nie tylko nie obowiązuje w sumieniu i nie jest racją działania, ale obowiązkiem jest postępowanie wbrew takiemu prawu. Choć samo zjawisko wykluczenia społecznego nie jest nowe, to jego waga, zwłaszcza w perspektywie praw człowieka, została doceniona stosunkowo niedawno. „Wykluczenie społeczne” nie jest kategorią konstytucyjną. Celem opracowania jest ogólne usytuowanie problematyki wykluczenia w kontekście zagadnień konstytucyjnych. Zmierza się do dookreślenia, czym jest wykluczenie społeczne oraz do wskazania zasadniczych konstytucyjnych punktów odniesienia, pozwalających na podjęcie tego problemu. Właściwe wykluczeniu społecznemu jest złożoność przyczyn - sam brak środków finansowych nie musi prowadzić do wykluczenia, choć proces wykluczania może być zainicjowany jednym wydarzeniem. (...) Jednak wykluczenia nie można adekwatnie scharakteryzować jedynie poprzez jego przyczyny. Wielowymiarowość dotyczy także przejawów wykluczenia. O wykluczeniu społecznym w sensie właściwym mówi się wówczas, gdy ograniczenia dotyczą jednocześnie wielu sfer życia społecznego. Chodzi przy tym o sfery fundamentalne, istotne . Charakterystyczne dla wykluczenia jest dłuższe trwanie w czasie. Często ma wymiar przestrzenny – procesy wykluczania prowadzą do wyodrębnienia obszarów, enklaw zamieszkanych przez wykluczanych, co jeszcze bardziej utrwala stan wykluczenia. Procesy wykluczania prowadzą niekiedy do zjawiska zwanego dziedziczeniem biedy czy wykluczenia. Ochrona przed wykluczeniem, wolność od niego, została uznana za prawo człowieka; prawo niesprowadzalne do tradycyjnie formułowanych praw gospodarczych, socjalnych i kulturalnych; mimo że wykluczenie społeczne dotyczy przede wszystkim udziału w życiu gospodarczym, społecznym i kulturalnym. Wykluczenie jest powiązane z naruszeniem zasady równości, jednak nie daje się ująć jedynie w perspektywie tej zasady, przy czym w szeregu istotnych punktów różni się od dyskryminacji w korzystaniu z praw człowieka. Poszukując w Konstytucji RP, w której brak jest kategorii „wykluczenia społecznego” zasadniczych punktów odniesienia należy poszukiwać w zasadzie godności z art. 30 oraz – w stosunku do obywateli – w art. 1. Jako pomocnicze punkty odniesienia można wskazać zasady sprawiedliwości społecznej, solidarności oraz równości, a także konstytucyjny katalog wolności i praw, przede wszystkim wolności i praw ekonomicznych, socjalnych i kulturalnych. The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights is (...) chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

Biological research with legitimate scientific purpose that may be misused to pose a biological threat to public health and/or national security is termed dual use. In Poland there are adequate conditions for conducting experiments that could be qualified as dual use research, and therefore, a risk of attack on Poland or other countries exists. Optimal solutions for limiting such threats are required, and the national system of biosecurity should enable early, reliable, and complete identification of this type of research. Scientists (...) should have a fundamental role in this process, their duty being to immediately, upon identification, report research with dual use potential. An important entity in the identification system of dual use research should also be the Central Register of Biological and Biomedical Research, which gathers information about all biological and biomedical research being conducted in a given country. Publishers, editors, and review committees of journals and other scientific publications should be involved in evaluating results of clinical trials. The National Council of Biosecurity should be the governmental institution responsible for developing a system of dual use research threat prevention. Its role would be to develop codes of conduct, form counsel of expertise, and monitor the problem at national level, while the Dual Use Research Committee would be responsible for individual cases. In Poland, current actions aiming to provide biological safety were based on developing and passing an act about genetically modified organisms (GMO’s) and creating a GMO Committee. Considering experiences of other nations, one should view these actions as fragmentary, and thus insufficient protection against dual use research threats. (shrink)

This article first of all attempts to assess the proposals of 2006–2007 to amend Poland’s Constitution, aimed mostly at strengthening constitutional protection of unborn human life. Parliamentary work on this proposal begins with the submission of the Deputy’s bill on amendment of the Constitution, published in the Sejm Paper No. 993 of September 5, 2006, and ends with a series of votes at the 39th sitting of the Sejm of the fifth term of office, held on April 13, 2007, on (...) which it was decided not to adopt any amendment. In the course of the legislative process, several modifi cation were offered not only to Article 38 concerning protection of life, but also to Article 30 dealing with dignity as a source of rights. Each of these proposals had drawbacks, including inter alia: the lack of a definite period of protection or entitlement to dignity, resulting in the decreased protection in relation to issues concerning euthanasia; the application of new categories granting a specific status to unborn human life; specifying the standards for protection by means of legislative acts ranking lower than a constitution, resulting in the transfer of life protection into the sphere of regulation of ordinary legislation. The most conducive for strengthening of the protection of unborn human life, even if not free of imperfections, was an amendment of Article 30 proposed by the Committee in the following wording: “The inherent and inalienable dignity, conferred on the person from the moment of conception, shall be a source of freedoms and rights of persons and citizens. It shall be inviolable; the respect and protection thereof shall be the obligation of public authorities.” From the rejection of the proposals it is diffi cult to draw conclusions that are vital for interpretation of the existing provisions. However, a conclusion that the intention of the authors of the constitution was not to strengthen the constitutional protection of life is not legitimate, mostly because of their doubts about formal correctness of the proposed amendments (when deciding to reject them), particularly the doubts about legal consequences of their adoption. -/- Streszczenie Zasadniczym celem opracowania jest próba całościowej oceny propozycji nowelizacji Konstytucji RP mającej miejsce w latach 2006-2007, zmierzającej przede wszystkim do wzmocnienia konstytucyjnej ochrony życia człowieka przed narodzeniem. Prace parlamentarne nad analizowaną nowelizacją otwiera poselski projekt ustawy o zmianie Konstytucji zawarty w druku sejmowym 993 z dnia 5 września 2006 (projekt wpłynął do Sejmu 7 września); zamyka seria głosowań na 39 posiedzeniu Sejmu V kadencji, dnia 13 kwietnia 2007 roku; głosowań, które przesądziły o niewprowadzeniu żadnych zmian. W trakcie procesu legislacyjnego proponowano szereg formuł, zmieniających nie tylko art. 38 dotyczący ochrony życia, ale także art. 30, który dotyczy godności jako źródła praw. W zasadzie wszystkie zgłoszone propozycje posiadały wady, wśród których najważniejsze to: brak domknięcia okresu ochrony lub przysługiwania godności, skutkujący obniżeniem ochrony w kwestiach związanych z eutanazją; stosowanie nowych kategorii, prowadzące do nadania specyficznego statusu człowiekowi przed narodzeniem; określanie standardu ochrony za pośrednictwem aktów o randze niższej od konstytucji, prowadzące do przesunięcia ochrony życia przed narodzeniem w sferę ustawodawstwa zwykłego. Z punktu widzenia celu, jakim było wzmocnienie konstytucyjnej ochrony życia człowieka przed narodzeniem i wzmocnienie jego pozycji prawnej, najlepsza, choć nie pozbawiona usterek, była zaproponowana przez Komisję zmiana brzmienia art. 30 prowadząca do formuły: „Źródłem wolności i praw człowieka i obywatela jest przyrodzona i niezbywalna godność człowieka, przynależna mu od chwili poczęcia. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych.”. Na podstawie odrzucenia propozycji zmian trudno wyciągać wnioski istotne dla interpretacji aktualnie obowiązujących przepisów; wniosek, że ustrojodawca nie chciał wzmocnienia konstytucyjnej ochrony życie nie jest prawomocny, przede wszystkim ze względu na – istotne w procesie podejmowania decyzji o odrzuceniu propozycji zmian – wątpliwości, co do formalnej poprawności formułowanych propozycji, w tym wątpliwości co do konsekwencji prawnych ich przyjęcia. Problem of Axiological Legitimization of the Universal System of the Protection of Human Rights Summary In this paper it is argued that legitimization of the universal system of the protection of human rights depends primary not from the content of values recognised as fundamental but rather from metaaxiological solutions related to the way of existence and to the possibility of cognition of these values. Legitimisation is based on the recognition of an objective nature and of cognoscibility of basic values. Realisation (...) of the primary aim of this paper is linked to the problem of different meanings of the notion of universality, used in the context of the universal system of the protection of human rights. First, descriptive and normative meanings have to be distinguished. In the case of normative sense, there are moral and legal meanings of “universality”. An axiological justification of the universality of human rights in the legal sense leads to the legitimisation of the universal system. It is shown that modifications of – broadly accepted in the Polish theory of law – definitions of an axiological justification of legal norms are needed. These definitions base such a justification on the valuations made by particular groups of subjects. It is argued that it is much more convenient to refer to valuations understood as meanings of sentences of certain kind. -/- Streszczenie W artykule zmierza się do uzasadnienia tezy, że legitymizacja uniwersalnego systemu ochrony praw człowieka jest oparta nie tyle na treści wartości uznawanych w tym systemie, ale na uznanych w nich rozstrzygnięciach metaaksjologicznych, dotyczących tego, jak istnieją wartości podstawowe dla tego systemu i czy są one poznawalne. Walor legitymizacyjny posiada przede wszystkim uznanie obiektywnego charakteru tych wartości i ich poznawalności. Realizacja zasadniczego celu zakłada uporządkowanie podstawowych pojęć dotyczących problematyki powszechności praw człowieka – termin „powszechność” stosowany w odniesieniu do praw człowieka w kontekście uniwersalnego systemu ochrony ma wiele znaczeń. Przede wszystkim odróżnić trzeba powszechność w aspekcie opisowym i w aspekcie normatywnym. W przypadku powszechności w aspekcie normatywnym w grę może wchodzić powszechność w sensie ideowym i powszechność w sensie pozytywnoprawnym. Uzasadnienie tej ostatniej jest też uzasadnieniem poszukiwanej tu legitymizacji uniwersalnego systemu ochrony praw człowieka. Prowadzone analizy prowadza także do sformułowania postulatów dotyczących sposobu definiowania uzasadnienia aksjologicznego norm prawnych. Modyfikacji wymagają powszechnie przyjmowane w polskiej teorii prawa definicje relatywizujące takie uzasadnienie do ocen przyjmowanych przez konkretne podmioty oceniające lub ich grupy. (shrink)

The aim of the paper is to determine how metaphors tackle the probable nature of information and uncertainty in the structure of the communication process. Since the cognitive theory of conceptual metaphors holds that metaphoric thinking and doing are unavoidable, they are employed often in explaining the communicating domains. The metaphorical conceptualizing is recognized in Shannon and Weaver’s Mathematical Theory of Communication where such abstract concepts as freedom of choice, choosing probabilities, and uncertainty ware conceived in that way. It is (...) described in accord with Reddy’s conduit metaphor and Ritchie’s toolmakers paradigm. In the paper the issue of both the advantages and disadvantages of metaphors is considered: mainly, how they can explain and predict ways in which people communicate their expectations or uncertainties as well as, more practically, how the probable/informational metaphors enable the management of knowledge in libraries or databases. We provide a brief overview of the shift toward the intrinsic view of brain activity, describing in particular the structural and functional connectivity patterns of the “Default mode network”. We then consider the Default mode network in a specifically cognitive setting and ask what changes the focus on the Default mode network and other sorts of intrinsic activity require from models put forward by cognitive neuroscientists.

I try to analyzethe main features of Hessen''s philosophicalneo-Kantianism, in particular the inevitabilityof a choice between the absolute and therelative both in epistemology and in ethics inthe context of contemporary philosophy.

The topos theory gives tools for unified proofs of theorems for model theory for various semantics and logics. We introduce the notion of power and the notion of generalized quantifier in topos and we formulate sufficient condition for such quantifiers in order that they fulfil downward Skolem-Löwenheim theorem when added to the language. In the next paper, in print, we will show that this sufficient condition is fulfilled in a vast class of Grothendieck toposes for the general and the existential (...) quantifiers. (shrink)

Artykuł jest odpowiedzią na polemikę Stanisława Ruczaja z argumentem z Wcielenia, który został zaprezentowany w książce Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga. Ruczaj zarzuca tzw. obronie inkarnacyjnej, że nie rozważa ona możliwości, zgodnie z którą Bóg jest zarazem wcielony, jak i nieukryty. W niniejszym artykule koncentruję się na uzasadnieniu, dlaczego uważam, że jest możliwe, iż owa opcja jest dla Boga wykluczona. Według mnie istnieją racje przemawiające za tym, że jest ona (a) logicznie sprzeczna, (...) (b) niespójna z doskonałym moralnie charakterem Boga, (c) nie skutkowałaby wyeliminowaniem niewiary bez oporu we Wcielenie. (shrink)

History provides us with instances of various societal and economic changes that with a hindsight are interpreted as either indicating progressive or regressive trends. The present paper attempts to define what represents progress and regress by applying psychological constructs to evaluation of the psychosocial changes. Seven principles of progress are applied as criteria for interpreting various historic events. The primary condition for progress is courage to face adversity or, in the cognitive domain, ambiguity, controversy and “unknown”. An overall model of (...) Schellenberga za nieistnieniem Boga przez Stanisława Judyckiego, Ryszarda Mordarskiego, Marka Peplińskiego i Jana Sochonia. Główny zarzut wobec mojego stanowiska głosi, że jest ono zbyt przychylne wobec argumentu J.L. Schellenberga, który niekoniecznie powinien być wzorem ujęcia problematyki ukrytości. Jednym z przejawów przyjęcia założeń kanadyjskiego autora jest zgoda na tezę o istnieniu niewierzących przy braku oporu.

Classic epistemology is under manifold changes; its categories loose their traditional meanings and gain new ones. Civilization and cultural changes, especially in mass communication and scientific knowledge, make impossible to insist on the concept of knowledge entirely as a true and justified belief. Traditional concepts of individual and subjectivistically conceived agent as well as concept of objects (areas and domains) of human knowledge are to much restrictive and at the same time controversial. Epistemological (pure philosophical) meaning of them is constantly (...) confronted and changed by the scientific discoveries and definitions, coming especially from natural and social sciences (biology, neural sciences, psychology and social sciences). It is long-lasting and manifold process of naturalization that regards not only cognitive phenomena but epistemic categories and epistemological theories as well. The papers presents the concise model of the naturalized theory of human knowledge one can eliminate from different positions and theories. Today types of naturalized epistemology try to go beyond the strict and limited concept of naturalism (Quine’s naturalized epistemology) and go toward anti-scientific, more liberal understanding of it. Naturalizing epistemology opens, as it is argued in the paper, the new perspectives and prospects on human cognition and knowledge that are far from the classic concepts. (shrink)

Prezentowana tu książka jest poświęcona relacjom między filozofią a polityką, politycznemu zaangażowaniu filozofii bądź jej ucieczce przed owym zaangażowaniem. W moim ujęciu pytania o autowizerunek filozofa w XX wieku są pytaniami o jego uwikłania, i uwikłania jego filozofii, w politykę. Nigdy wcześniej filozofowie nie żywili takich nadziei na przemodelowanie społeczeństwa z pomocą polityki (i tym się różnili od licznych wcześniejszych utopistów) zgodnie ze swoją filozoficzną wizją jak właśnie w XX wieku. Jest to zarazem książka o tradycyjnych antynomiach i opozycjach filozoficznych: (...) bios teoretikos i bios praktikos, teoria i praktyka, myśl i działanie, interpretowanie świata i jego zmienianie, człowiek kontemplacji i człowiek czynu, wieża z kości słoniowej i zaangażowanie etc. etc. I dlatego, pisząc tu o autowizerunku filozofa, mam na myśli jego autowizerunek ujmowany z punktu widzenia polityki. Interesują mnie tu odpowiedzi na pytanie o stosunek między filozofią a polityką, bowiem to pytanie uważam dzisiaj z racji historycznych za fundamentalne. Dlaczego pytam tu o autowizerunek filozofa? Uważam, że w filozofii (pytającej o swoje uwikłania w politykę) sposób ujmowania siebie determinuje sposób ujmowania świata. Im bardziej filozofia zostaje odniesiona do „teraz”, tym wymaga większej precyzji, dokładniejszego usytuowania siebie w ramach dostępnych bądź wyobrażonych w kulturze możliwości. Autowizerunek to platforma, z której korzysta filozof, to pewien horyzont konstytuujący jego tożsamość, podający zakres możliwych do przyjęcia ról w kulturze. Zupełnie inny jest autowizerunek filozofa w filozofii odniesionej do „teraz”, a zupełnie inny w filozofii nastawionej na uniwersalność, wieczne i niezmienne prawa, na spoglądanie na świat sub specie aeternitatis. Kluczowe słowa w takiej perspektywie to choćby rewolucja intelektualna, przemoc, nowy świat, nowy człowiek, nowa era, zmiana, postęp, konstruktywny wkład, przyłączenie się i zaangażowanie czy wymogi chwili. Pytam tutaj o chęć wywoływania zmian politycznych mocą filozofii i poprzez filozofię jako narzędzie, pytam o filozofa jako politycznego „zbawcę” (Habermas o Martinie Heideggerze), o filozofa jako egzekutora wyroków historii dysponującego pełną świadomością doniosłości chwili, która nikomu poza filozofami nie może się w pełni odsłonić i ujawnić. Dlaczego jednak filozofia potrzebuje siły? Skąd bierze się jej odwieczne marzenie o wykroczeniu poza uniwersum teorii, myśli, kontemplacji - ku realnemu światu, w którym filozof działa? Książka ta w pewnej mierze stanowi analizę marzeń o filozofii działającej, o filozofii czynu - o filozofie przekonanym o swoim posłannictwie jako posłannictwie człowieka działania. Filozof działający to człowiek oddany wspólnocie - przekonany o politycznie sprawczej roli wypowiadanego, filozoficznego słowa; zwierciadlanym odbiciem tego ideału jest filozof oddany tekstowi, czyli (bezpośrednio) lekceważący społeczne powinności i zobowiązania — przekonany o politycznej i społecznej bezsilności tegoż słowa, skoncentrowany na dostarczaniu interpretacji kolejnych interpretacji tekstów filozoficznych. Jednak oprócz nich w perspektywie autowizerunku politycznego pojawiają się i inni: tekstualiści marzący o drobnych, choć społecznie wpływowych wspólnotach czytelników; wspólnotowcy pragnący działać poprzez filozoficzne słowo, a jednak zarazem pozbawieni złudzeń co do swojej historycznej skuteczności, poniekąd z góry świadomi, że tą drogą świata (przynajmniej w przewidywalnym horyzoncie czasowym) zmienić się nie da; miłośnicy tekstu budujący programy społecznej naprawy świata, a poszukujący wśród tekstualistów (na przykład genealogicznej czy dekonstrukcjonistycznej) „metody”, którą można by wprost zastosować w praktyce, na sposób działających w historii wspólnotowców. Tekst, wspólnota - to jedynie ogólne hasła wywoławcze mające ewokować pewne marzenia o miejscu filozofii i filozofa w kulturze. Z jednej strony stoi autowizerunek, w ramach którego naczelnym hasłem jest „robienie historii” (Emil Cioran) czy „robienie rewolucji”, z drugiej autowizerunek z naczelnym hasłem „robienia tekstów”, czyli bycia uważnym czytelnikiem tekstów filozoficznych i uważnym ich autorem. A oprócz tego, pomiędzy nimi, jest miejsce na autowizerunki pośrednie, mieszane i mniej czy bardziej skłaniające się ku któremuś ze skrajnych wyborów oraz na autowizerunki, których powyższe przeciwstawienie nie uchwytuje. Oba motywy mają do pewnego stopnia organizować prezentowaną książkę, ale nie mają stać się jakimś nowym kluczem pozwalającym na zupełnie nową odsłonę filozoficznego pejzażu. Stoi przecież za nimi długa, filozoficzna tradycja, korzystająca na przestrzeni dziejów z określeń pochodzących z różnych słowników. Kto powiedział, że filozofia ma „robić rewolucję”, tzn. gruntować ją i przygotowywać, promować i usprawiedliwiać, znajdować dla niej wielki intelektualny kontekst, stanowić jej awangardę i magazyn niezbędnych pojęć, legitymizować jej przemoc i uzasadniać jej terror, dawać jej broń w walce i podtrzymywać marzenia o jej nieuchronności, wyjątkowości, celowości i wartości? Kojeve, Heidegger, de Man, Sartre, Bataille (w analizowanych tu przeze mnie tekstach i w ściśle określonych okresach) - byli o tym przekonani. Dlaczego odpowiadał im właśnie taki autowizerunek? Co więcej - albo co innego - daje filozofowi „filozofia wspólnoty” niż „filozofia tekstu”, by sięgnąć do dwóch skrajności w ramach długiego continuum? Czym jest owa nadwyżka? Uczuciem spełnienia, świadomością realizacji marzeń, wcielenia w życie filozoficznych ideałów? Przejściem do świata rzeczywistego - a może wreszcie „pracą”, w mocnym sensie tego terminu? Jednak im filozofia była bliżej świata, tym większe rodziła napięcia. Tym większe miała wyrzuty sumienia. Kluczowy problem analizowanych tu propozycji filozoficznych można by podsumować tak: czy szukać przejść — a jeśli tak, to jakie powinny one przyjmować formy - między uniwersum. zagadnień filozoficznych a światem rzeczywistym? Jaka relacja wiąże filozofa ze światem realnym: z historią, postępem, zmianą? Kim jest filozof zanurzony w historii, kim jest filozof „robiący historię”? W jakiej mierze filozofia jest niezbędnym fundamentem społecznych transformacji i społecznych rewolucji? Jak związać filozofię z czynem i z działaniem? Jak związać spekulację i kontemplację z aktywizmem? Jaki stosunek wobec gwałtownych i radykalnych zmian w świecie społecznym ma zajmować filozof - i w jakim charakterze? Filozofa? Obywatela? Obywatela-filozofa? Czy umieszczać filozofię w głównym nurcie zmian społecznych - w ramach toczących się rewolucji — czy przyjmować w niej postawę wyczekującą, obserwującą, niezaangażowaną, która pozwala spoglądać na akcydentalne zawirowania świata rzeczywistego z perspektywy jego istoty? Leon Pinsker’s pamphlet Autoemancipation! (1882), a seminal text of early Jewish nationalism, arguably established Zionism as a movement functioning in the German language. Soon after its publication, the renowned Yiddish writer Sh. Y. Abramovitch produced a Yiddish language version (1884). Abramovitsh’s rendering is above all an adaptation of German or Western European political and cultural concepts and vocabulary to the Jewish, Eastern European Yiddish-speaking milieu, with changes in vocabulary, rhetorical strategies, and cultural references. Abramovitsh reworked the pamphlet according to his (...) own thinking on the plight of Jews in the Russian Empire and a possible nationalist solution, as exemplified in his contemporary novels. In the article, I compare the language in which several socio-political concepts are expressed in the two texts in order to determine whether Abramovitsh, in his ideological skepticism, also subtly adapts the content of the nationalist thesis.
