The central problem of social theory is 'structure and agency'. How do the objective features of society influence human agents? Determinism is not the answer, nor is conditioning as currently conceptualised. It accentuates the way structure and culture shape the social context in which individuals operate, but it neglects our personal capacity to define what we care about most and to establish a modus vivendi expressive of our concerns. Through inner dialogue, 'the internal conversation', individuals reflect upon their social situation (...) in the light of current concerns and projects. On the basis of a series of unique, in-depth interviews, Archer identifies three distinctive forms of internal conversation. These govern agents' responses to social conditioning, their individual patterns of social mobility and whether or not they contribute to social stability or change. Thus the internal conversation is seen as being the missing link between society and the individual, structure and agency. (shrink)

Fifteen original essays open up a novel area of inquiry: the distinctively ethical dimensions of women's experiences of and in aging. Contributors distinguished in the fields of feminist ethics and the ethics of aging explore assumptions, experiences, practices, and public policies that affect women's well-being and dignity in later life. The book brings to the study of women's aging a reflective dimension missing from the empirical work that has predominated to date. Ethical studies of aging have so far failed to (...) emphasize gender. And feminist ethics has neglected older women, even when emphasizing other dimensions of 'difference.' This chapter offers a conceptual analysis of territory, distinguishes it from property accounts, and discusses different versions of property accounts, all derived from Locke’s ‘Second Treatise of Government’. It offers a conceptual analysis of territory and the various rights associated with territory. According to Locke, territorial right is established through the subjection, by free consent, of persons and their land to state authority. This theory is found to rest on a number of flawed assumptions, among them claims to natural rights (...) of property and an obvious link between private property and territorial jurisdiction. Cara Nine draws on Lockean principles to claim that a state is a collective that, like individuals, owns property, namely the territory of the state. After examining the historical antecedents of such ideas, the chapter points away from them and towards accounts of territory based on individual and collective claims of rights. (shrink)

ABSTRACT:Since the dawn of capitalism, corporations have been regarded by the law as separate legal “persons.” Corporate “personhood” has nonetheless remained controversial, and our understanding of corporate personhood often influences our thinking about the social responsibilities of corporations. This essay, written in honor of Prof. Thomas Donaldson, explores the tension in recent decisions by the U.S. Supreme Court and the Delaware Chancery Court about what corporations are, whose interests they serve, and who gets to make decisions about what they do. George Berkeley's arguments have attracted a good deal of attention, but the account of abstraction has been often treated as if it were an entirely independent piece of writing. Berkeley links Locke's use of abstract general ideas to a belief in the possibility of an idea of existence abstracted from perception, that is, to the central issue of the Principles of Human Knowledge. The mistake Berkeley has been pointing to, the reliance on abstract general ideas, is a philosophical mistake, but (...) here it is clear Berkeley takes this mistake to have far‐reaching consequences, diverting the search for knowledge from what would be useful to know into trivial byways. Having identified the consequences of a mistaken belief in abstract ideas, Berkeley returns to his earlier claim, that it is language that leads us into this error. (shrink)

This article reviews the development of feminist studies during the latter quarter of the twentieth century, identifying initial themes in feminist theory and highlighting three major themes framing feminist scholarship today: the relationship between structure and agency; the intersection of race, class, and gender; and emerging studies of the political economy of sexuality. The article emphasizes the significance of understanding structured inequality, including new studies of sexuality and their relationship to race/class/gender stratification.

Governments in New Zealand have legislated a large number of settlements extinguishing many hundreds of claims taken by Māori against the Crown for breaches of the country’s founding document, Te Tiriti o Waitangi. They portray settlements as a great success for Māori and the Crown. Māori disagree. Settlements are government-determined and imposed on Māori using a smoke and mirrors approach that masks successive governments’ true intentions: to claw back Māori legal rights; to extinguish all claims; and to maintain White control (...) over Māori. In short, to uphold the Doctrine of Discovery in further breach of Te Tiriti o Waitangi. Māori claimants and negotiators report being enticed into the process by false promises only to become traumatised and disenchanted. Yet many take a pragmatic stance and sign settlements, making the best they can out of a bad deal that goes nowhere near compensating for their actual loss. They know that despite what legislation may say, the settlements are not full, not fair and not final and that, like all previous settlements, they will be revisited. They also know that unless fundamental changes are made to the constitutional makeup of the country, there is no prospect of justice and reconciliation for Māori. (shrink)

Locke, in his discussion of essences, makes extensive use of a distinction he introduces between nominal and real essences. This distinction has always been found interesting and important, and in fact, R.I. Aaron said of it that ‘there is no more important distinction in the Essay.’ Nevertheless, to say there has not been general agreement about what Locke was getting at is putting it mildly. Interpretations of Locke's point in making such a distinction have varied widely, depending upon whether the (...) importance of the real or the nominal essence is stressed. Locke tells us we should distinguish the nominal essence, which is the abstract idea to which a general name is attached and for which it stands, from the real essence, which is the ‘real internal, but generally in Substances, unknown Constitution of Things, whereon their discoverable Qualities depend.’. The authors surveyed hospitals across the country on their policies regarding overlapping surgery, and found large variation between hospitals in how this practice is regulated. Specifically, institutions chose to define “critical portions” in a variety of ways, ultimately affecting not only surgical efficiency but also the autonomy of surgical trainees and patient experiences at these different hospitals.

Inflammatory responses are essential for the clearance of pathogens and the repair of injured tissues; however, if these responses are not properly controlled chronic inflammation can occur. Chronic inflammation is now recognized as a contributing factor to many age‐associated diseases including metabolic disorders, arthritis, neurodegeneration, and cardiovascular disease. Due to the connection between chronic inflammation and these diseases, it is essential to understand underlying mechanisms behind this process. In this review, factors that contribute to chronic inflammation are discussed. In the first few pages of the Third Dialogue, several interesting things happen that provide a framework for this final dialogue. The first is that Hylas embraces skepticism with noticeable fervor. At the beginning of the Third Dialogue, Hylas is ripe for the kind of skepticism to which philosophers fall prey. Philonous's reply to the annihilation objection does depend, however, on a claim he has made previously, that sensible things that are independent of my mind must depend on God's mind, (...) for the reason that ideas can only depend upon minds. Philonous's argument rests on the allegation that ideas are inert and only spirits like God are agent. Hylas's response to Philonous's claim, that he is merely adopting the standard theistic position that God is the ultimate cause, is to offer his own standard objection to any such theistic claim, a version of the problem of evil.
