In the ongoing pandemic, death statistics influence people’s feelings and government policy. But when does COVID-19 qualify as the cause of death? As philosophers of medicine interested in conceptual clarification, we address the question by analyzing the World Health Organization’s rules for the certification of death. We show that for COVID-19, WHO rules take into account both facts and values.

Despite the economic relevance and distinctiveness of family firms, little attention has been devoted to researching their nature and functioning. Traditionally, family firms have been associated both to positive and negative features in their relationships with the stakeholders. This can be linked to different orientations toward corporate social responsibility. Thus, this research aims to identify the approaches that Spanish family firms maintain about social responsibility, based on the model developed by Quazi and O' Brien Journal of Business Ethics 25, 33-51 (...) (2000). An empirical study carried out for 112 Spanish family firms gives support to our initial assumption about these organizations not being a homogeneous group in terms of their orientation towards corporate social responsibility. The differences in perceptions do not seem to be associated to biographical characteristics. These results lead to some relevant academic and practical implications that suggest interesting lines for future research. (shrink)

Following the September 2001 terrorist attacks on the United States, much support for torture interrogation of terrorists has emerged in the public forum, largely based on the “ticking bomb” scenario. Although deontological and virtue ethics provide incisive arguments against torture, they do not speak directly to scientists and government officials responsible for national security in a utilitarian framework. Drawing from criminology, organizational theory, social psychology, the historical record, and my interviews with military professionals, I assess the potential of an official (...) U.S. program of torture interrogation from a practical perspective. The central element of program design is a sound causal model relating input to output. I explore three principal models of how torture interrogation leads to truth: the animal instinct model, the cognitive failure model, and the data processing model. These models show why torture interrogation fails overall as a counterterrorist tactic. They also expose the processes that lead from a precision torture interrogation program to breakdowns in key institutions—health care, biomedical research, police, judiciary, and military. The breakdowns evolve from institutional dynamics that are independent of the original moral rationale. The counterargument, of course, is that in a society destroyed by terrorism there will be nothing to repair. That is why the actual causal mechanism of torture interrogation in curtailing terrorism must be elucidated by utilitarians rather than presumed. (shrink)

This paper explores Kant’s ambivalent views on music. It aims to show, on the one hand, how these ambivalences are in line with the modern philosophical reflection on this art; on the other hand, to show their place within Kantian aesthetics, a place that justifies Kant’s hesitations as whether to classify music as beautiful or agreeable, art or mere enjoyment, free or dependent beauty, culture or nature.

This article explores the proposal offered by Ian Hacking for the distinction between natural and social sciences—a proposal that he has defined from the outset as complex and different from the traditional ones. Our objective is not only to present the path followed by Hacking’s distinction, but also to determine if it constitutes a novelty or not. For this purpose, we deemed it necessary to briefly introduce the core notions Hacking uses to establish his strategic approach to social sciences, under (...) the assumption that they are less well known that the ones corresponding to his treatment of natural sciences. IN THE LAST PART of the Theory of Moral Sentiments, Adam Smith puts his theory in a class with those of his contemporaries Francis Hutcheson and David Hume, namely, the systems that make sentiments the principle of approbation. Despite recognizing important differences with both of them, he thinks that since he has placed the origin of moral sentiments in sympathy, and in particular the fact that we are able to enter into the motives of the agent and get pleasure from (...) finding them appropriate to their cause, sentiments are the foundation of his theory of morals. Many of Smith’s commentators, in fact almost all of the most important studies over the last few years, reaffirm the author’s self-description. However, my aim in this paper is to challenge this view by showing that Smith’s system can also be plausibly seen as a theory of practical reasoning, and in some important aspects very similar to Aristotelian ethics. Surprisingly few scholars have seen this parallel. Laurence Berns, Samuel Fleischacker, Charles Griswold, and Gloria Vivenza are the latest exceptions, identifying several points of coincidence between Adam Smith and Aristotle’s ethics. None of them, however, has tied all these similarities under a unified interpretation, such as the one I propose here: The basic analogy between these theories, and the source of those particular coincidences, is the operation of practical reason. Moreover, and besides the common elements with Aristotle’s ethics, Smith’s reconstruction of practical reason simultaneously announces some of the main features of modern accounts of ethics, such as impartiality and universality as preconditions of moral judgment. The integration of these ancient and modern elements in a single coherent theory allows Smith’s TMS to overcome the insufficiencies and paradoxes of both these traditions, and it constitutes one of the most interesting and challenging proposals of modern ethics. Implikatura skalarna jest bardzo powszechnym typem wnioskowania pragmatycznego, które polega na uznaniu przez odbiorcę za nieprawdziwe zdań zawierających terminy bardziej informatywne niż termin użyty przez mówcę, kiedy wszystkie te terminy można umieścić na jednej skali. Pierwsza część tekstu stanowi przegląd podstawowych teoretycznych podejść do implikatur skalarnych. Druga część oferuje krótki przegląd badań empirycznych na temat rozwoju implikatur skalarnych u dzieci. Ostatnia część jest bazującą na przykładzie implikatur skalarnych próbą refleksji nad wzajemnymi stosunkami między pragmatyką teoretyczną a eksperymentalną.

Combates pela História é, como se sabe, o título de um livro famoso de Lucien Febvre dos anos cinquenta. Através de uma recomposição, de novo se deu importância a todas as modalidades da História, mantendo, todavia, o sentido do rigor que era algo perseguido nos «combates pela História». Quer-se, pois, analisar o sentido da História, nas suas várias áreas. Contudo, ao propor-se este tema, não se desejou que os autores apresentassem tanto as suas investigações nas suas áreas próprias — embora elas estivessem subentendidas e devessem ser expressas —, mas que refletissem sobre o seu sentido no âmbito da História entendida como Ciência Social e Humana. Para tal, desejou-se que discutissem o objeto e o método da História das diversas áreas, equacionando os seus vários problemas. Foi isso que também sucedeu — estamos disso convencidos. The concept of “critical science literacy” advanced by Susanna Priest is significant to how citizens approach scientific knowledge, but the concept is also relevant to undergraduate students majoring in the sciences, who are not necessarily becoming “critically literate” in their own disciplines. That is, future scientists are not learning how arguments are structured, meaning is made, and facts are agreed upon—specifically through communicative practices—both within and outside of the scientific community. This gap in the curriculum can be addressed through collaborative (...) efforts between rhetoricians and sociologists of science. Drawing from three major disciplinary traditions—writing studies, the rhetoric of science, and science communication—this article posits that a pedagogical intervention is necessary to improve science communication with nonexpert publics. A science writing and communication course that is grounded in the rhetoric of science and that also has sociological, philosophical, and historical components can provide science students with a critical awareness of how their discipline operates in society and teach them how to become more responsible and effective communicators. A fin del siglo XX, en Argentina, los procesos de reforma del Estado con la descentralización de competencias a provincias y municipios en áreas vinculadas a la salud, la educación y la vivienda, trajo consigo el problema de que la descentralización de las competencias no fue correspondida con el traslado de recursos. Hoy, se suman otros reclamos en los espacios locales relacionados con el acceso al suelo urbano y la vivienda digna, la sustentabilidad ambiental, la equidad de género, la disminución (...) de la brecha digital entre otras. La falta de planificación de políticas integrales de hábitat para pobladores de menores ingresos, desposeídos, migrantes, empleados en servicios en las familias consolidadas o en la ciudad, profundiza la desigualdad social y la degradación ambiental en la ciudad. Este trabajo propone el análisis de las nuevas dinámicas de acceso al suelo de manera legal implementadas desde el Estado en Pehuajó, Argentina y, para ello hace foco en el estudio crítico del uso de instrumentos normativos en relación a la incorporación de la tierra privada como políticas de inclusión de la población de bajo recursos de barrios populares. La propuesta se articula como interpretación afiliada con el discurso del Programa para América Latina y el Caribe del Instituto Lincoln de Políticas del Suelo. Desde una óptica autodefinida como progresista aplica nuevos instrumentos a la gestión del suelo urbano con la función de prevenir la informalidad y tener así una ciudad más inclusiva, mejor financiada, distribuir más equitativamente los servicios públicos y las cargas, y elegir las geotecnologías más apropiadas. No primeiro volume de História da Sexualidade, Michel Foucault apresenta o que iria tornar-se um conceito polêmico em sua obra, bem como para seus intérpretes. Desde então, a noção de biopolítica tem polarizado as leituras da teoria de poder de Foucault e talvez haja desempenhado um papel bem mais importante do que ele jamais pretendeu. Para propor um estudo genealógico do termo “biopolítica”, é importante olhar mais de perto a noção de vida que pode haver inspirado a análise foucaultiana. Foucault (...) opera com uma noção de vida que ele não determina: vida é um correlato de técnicas e estratégias de poder e de saber, ela carece de qualquer status ontológico e é ela mesma “produzida” pela constelação de poder-saber. The feminist critical deconstruction of Western culture and theology written by Luce Irigaray could be said to represent a certain branch of ecofeminist perspectives on religion. The article analyses the symbolic structures of suppression of women, body and nature and the exaltation of spirit, culture and the androcentric God, inherent in four hymns included in the new supplement to the book of hymns in the Lutheran Church of Sweden. The analysis shows that these symbolic structures are visible also in these (...) more recent hymns, even though they can be said to also consider and bring out women's experiences. Despite their `feminist' approach, they have not, on any deeper level, affected the subordination of women and the nature-given. (shrink)

W artykule podjęto problematykę znaczenia rytuałów jako praktyk pamięci zbiorowej. Rytuały stanowią istotny wymiar pamięci przeszłości, a zarazem pas transmisyjny w podtrzymywaniu ciągłości pokoleniowej. Na płaszczyźnie empirycznej odwołano się do wybranych rezultatów badań socjologicznych, dotyczących rytuałów upamiętniania oraz obrzędów o charakterze patriotycznym, w których obok sacrum świeckiego niejednokrotnie pojawia się sacrum religijne, wzmacniające ich znaczenie. Podstawą refleksji były rezultaty badań własnych, przeprowadzonych wśród młodzieży maturalnej oraz jej rodziców pod koniec pierwszej dekady XXI wieku, oraz aktualnych badań ogólnopolskich.

The death of Bal Keshav Thackeray, in November 2012, has led several Indian journalists and intellectuals to think over the legacy of the supreme leader of the Shiv Sena to the Indian society. The present article means to identify the reasons which have let the Indian journalists describe the bequest of Thackeray to the Indian society in terms of a legacy of fear. The article deals with Thackeray's use of fear as a tool to arise consent around his social, cultural (...) and political thinking first and, secondly, to legitimize and justify the existence and the modus operandi of the Shiv Sena. The author dwells on the way Thackeray has been able to arise and feed social and cultural fear in order to give a meaning and a sense to his political enterprise. The article argues that the most scaring aspect of Thackeray's political discourse doesn't lie in the aims pursued and in the ways they have been pursued but in the idea of social and cultural identity it is based on. In this article we explore the relationship between semiotic analysis of images and quantitative analysis of vast image corpora, in particular the work produced by Lev Manovich and the Cultural Analytics Lab, called “Media Visualization.” Media Visualization has been chosen as corpus because of its metavisual operation (images are visualized and analyzed by images) and its innovating way of conceiving analysis: by visual instruments. In this paper semiotics is used as an approach to Media Visualization and taken as an object (...) of study as well, especially visual semiotics. In this sense, a comparison between visual semiotics (close reading of small corpora) and quantitative analyses of images (distant reading of vast collections) are conducted from a semiotic point of view. Post-Greimassian semiotics guides this study with respect to the issue of the image-within-an-image and metavisual visualization; Peircean semiotics is employed to explain and develop the notion of diagram. This paper focuses on the contributions to natural history, particularly in methods of plant classification of the Portuguese botanist, man of letters, diplomat, and Freemason Abbé José Correia da Serra (1751-1823), placing them in their national and international political and social contexts. Correia da Serra adopted the natural method of classification championed by the Frenchman Antoine-Laurent de Jussieu, and introduced refinements of his own that owe much to parallel developments in zoology. He endorsed the view that the classification of plants (...) should be based on the establishment of affinities rather than of differences. The emphasis on affinities went hand in hand with the development of the concept of symmetry. This idea was introduced by Correia da Serra in systematics and was adopted and further developed by his friend, Augustin-Pyramus de Candolle. Correia da Serra also argued that Cryptogamia reproduce sexually, advocated extension of methods of comparative anatomy from zoology to botany, and applied them to the study of fruits. Correia da Serra was one among many of the estrangeirados, Portuguese "Europeanized" intellectuals who traveled extensively abroad in most cases to escape political or religious persecution at home. The estrangeirados were important contributors to 18th and 19th century European thinking. Most of the estrangeirados were pivotal in the introduction, dissemination and propagation of the new sciences in Portugal, but unlike most of his fellow estrangeirados, Correia da Serra was also an innovative man of science in his own right. This paper has arisen from my interest in questions ofsubjectivity of primary concern to contemporaryfeminist jurisprudence. Rather than side with anyparticular view represented in the debates surroundingthese questions, I have used Foucault's concept ofepisteme to explore the tradition of feministlegal thought. By focusing upon seventeenth-centurywomen's writings in which the earliest statementslinking law to women's oppression are to be found, thepaper argues that knowledge claims about law'sassociation with women's oppression are predicated notupon the positing of a sovereign feministconsciousness, but upon the (...) specific positivities ofknowledge which existed at the time. Theunderstanding of the birth of the feminist legaldiscourse in terms of the specific conditions of itspossibility, although historically contextualised,raises questions about the hitherto seeminglyunassailable adherence to subjectivist epistemologywhich the current feminist engagement with lawmaintains. Resumen: Si bien en Italia el debate sobre las clínicas jurídicas está en una fase inicial, cada vez hay un mayor número de universidades que están poniendo en marcha iniciativas vinculadas a tal fenómeno emergente. Ello permite plantearse nuevas cuestiones, en especial aquellas relacionadas con las clínicas, pero también es posible reconfigurar algunos de los temas “clásicos” y fundamentales de la filosofía del derecho. Este trabajo tiene como objetivo apuntar algunos de tales aspectos. Así tras una reconstrucción del marco general (...) del debate, me detendré sobre los temas principales de la experiencia clínica, esto es la formación del jurista y la tensión por alcanzar la justicia social. Abstract: Although the Italian debate concerning legal clinics is at the beginning, a growing number of Law Schools is starting to explore this approach to legal education. As a consequence, new topics specifically concerning legal clinics arise, while others – more “traditional” for legal-philosophical experts – need to be reconfigured and re-articulated. This essay aims at addressing some of the latter aspects: once the terms of the debate have been reconstructed, I will consider two of the main topics of the clinical experience, namely the jurist’s formation and the tension towards social justice outcomes. This paper examines the relation between the problem of human nature and political theory; it is claimed that every such theory is founded on some anthropological preconditions. The paper studies the political conceptions of four modern philosophers: Thomas Hobbes, Jean Jacques Rousseau, Karl Marx, Pyotr Kropotkin. It reveals that two opposing tendencies form the imaginary of the modern era: the authoritative one that identifies an egoistic/ unsociable human nature that needs control, and the libertarian one that recognizes a human being (...) capable of more advanced types of social fabric. The problem that is also investigated is how anthropological dualism can be transcended to permit the conception of a new anthropological type as well as the type of society that will help human potentiality of consciousness and coexistence to unfold.
