We discuss a recent approach to investigating cognitive control, which has the potential to deal with some of the challenges inherent in this endeavour. In a model-based approach, the researcher defines a formal, computational model that performs the task at hand and whose performance matches that of a research participant. The internal variables in such a model might then be taken as proxies for latent variables computed in the brain. We discuss the potential advantages of such an approach for the (...) study of the neural underpinnings of cognitive control and its pitfalls, and we make explicit the assumptions underlying the interpretation of data obtained using this approach. Zeno's paradoxes of motion and the semantic paradoxes of the Liar have long been thought to have metaphorical affinities. There are, in fact, isomorphisms between variations of Zeno's paradoxes and variations of the Liar paradox in infinite-valued logic. Representing these paradoxes in dynamical systems theory reveals fractal images and provides other geometric ways of visualizing and conceptualizing the paradoxes.

BackgroundThe evaluation of pain remains one of the most difficult challenges that healthcare practitioners face. Chronic pain appears to affect more than 35% of the population in the West, and indeed, pain is the most common reason patients seek medical care. Despite its ubiquity, studies in the last decades reveal that many patients feel their pain is dismissed by healthcare practitioners and that, as a result, they are denied proper medical care. Buchman, Ho, and Goldberg (J Bioethic Inq 14:31-42, 2017) (...) point to this phenomenon as a form of “epistemic injustice”: an unfair and harmful downgrading of credibility affecting some individuals and groups, which prevents them from receiving appropriate and beneficial medical care.MethodsBy exploring the existing literature on this downgrading of patients’ credibility written by healthcare professionals and scholars in medical humanities, I identify and examine the reasons patients are often not believed about their pain and why healthcare is too-often unhelpful or hurtful to people presenting with chronic pain. I also explore to what extent it is possible to forge an alternative epistemological model.ResultsI suggest that most of the causes of this downgrading of patient’s credibility result from either the difficulty in communicating pain or the widespread belief that pathology is always the result of objective tissue damage. I examine whether pain has to be effectively communicated and have an objective cause in order for it to be deemed credible. In the end, I argue that in the case of pain, both communication and objectivity are highly problematic.ConclusionsI conclude by suggesting that, although alternative epistemological models might be impossible to build, believing patients has both moral and clinical benefits, and this warrants further research. Social theory plays an important role in the nursing discipline and nursing inquiry as it helps conceptually embed nursing in the larger picture of the social world. For example, a broad category of critical theory provides a unique lens for uncovering social conditions of inequity and oppression. Among the sociological theories, actor‐network theory (ANT) is an approach to research and analysis that has recently gained interest among nurse philosophers and researchers. Studies guided by ANT seek to understand phenomena of interest (...) as constituted within the relationships between human and nonhuman actors to understand how care practices are co‐created/enacted and how they can be made more humane. In this paper, we describe the benefits of ANT for examining healthcare access for incarcerated individuals with life‐limiting illnesses accessing palliative care and for people using illicit drugs. We argue that attention to the materiality of care practices can contribute to efforts of advancing health equity for these groups. (shrink)

Health is certainly a valuable asset in the life of every human being and of particular relevance for a flourishing childhood. As empirical research concerning the social determinants of health shows, its distribution can, at least to a certain extent, be influenced by the way a society is arranged. Many philosophers now acknowledge that a fair distribution of health has to be a central part of a just society and they discuss to what extent a right to health can be (...) justified. However, they do not typically distinguish between physical and mental health and neglect the special problems arising from these distinct, though related, perspectives. In this paper, we argue in favour of such a distinction and ask whether a minimally just society ought to include mental health among the goods that are to be distributed in a fair way among its children. Furthermore, we investigate the relationship between mental health and happiness and ask whether making mental health a subject of justice implies that children are entitled not only to a healthy but also to a happy childhood. Despite the positive impact of happiness on the lives of children, we conclude that happiness cannot be incorporated into a functional theory of justice, since it does not fully meet the criteria of objectivity, measurability and influenceability. Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

This paper argues that concepts of legality in legal theory can be profitably understood as being underwritten by modes of spatio-temporal objectification. In the first part of the paper, a scheme of such modes is provided, and a map of jurisprudential inquiries is thereby offered. In the second part of the paper, two concepts of legality – underwritten by two different modes of spatio-temporal objectification – are analysed. The analysis shows how both concepts of legality lead to different sets of (...) prescriptive resources as to the evaluation and design of legal systems. Finally, it is argued that the response of legal theory to practical challenges within the public sphere cannot afford to be based on any one concept of legality. Rather, we need to be pluralists about concepts of legality, recognising the limitations of any one such concept – represented, in this paper, by way of spatio-temporal objectification that underwrites those concepts. A crisis in legal theory can- not be claimed on the basis of any alleged lack of correspondence between any one concept of legality and reality. On the contrary, a crisis will ensue to the extent that legal theory becomes dominated by theoretical imperial- ism, namely, by the belief that any one concept of legality is capable of capturing the world as it is, and, therefore, also capable of standing as a foundation for a prescriptive agenda. The vice of theoretical imperialism in- duces anxiety over the identity of a discipline, and leads to a quelling of the very theoretical diversity that is required for an ethical response to the spe- cific complexity of the public sphere.Resumen:En este artículo se sostiene que los conceptos de legalidad, dentro de la teoría del derecho, pueden entenderse con mayor provecho si se piensa que están determinados por modos de objetivación espacio-temporal. En la primera parte se presenta un esquema de tales modos y, de esa manera, se ofrece un mapa de las investigaciones iusfilosóficas. En la segunda parte, se analizan dos conceptos de legalidad —determinados por dos modos diferentes de objetivación espacio-temporal—. El análisis muestra cómo ambos conceptos de legalidad conducen a diferentes conjuntos de fuentes prescriptivas para la evaluación y el diseño de los sistemas jurídicos. Finalmente, se sostiene que la respuesta de la teoría del derecho a los problemas prácticos del ámbito público no puede basarse en un solo concepto de legalidad. Por el contrario, es necesario ser pluralistas sobre los conceptos de legalidad y reconocer las limitaciones de cada uno de ellos —representados, en este ensayo, por la objetivación espacio-temporal que los suscribe—. No se puede asegurar que la teoría del derecho esté en crisis sobre la base de una presunta falta de correspondencia entre algún concepto de legalidad y la realidad. Por el contrario, aquella se generará en la medida en que la teoría del derecho llegue a estar dominada por un imperialismo teórico, a saber, por la creencia de que cualquier concepto de legalidad es capaz de capturar el mundo tal como es, y, por lo tanto, que es capaz de erigirse como fundamento para una agenda prescriptiva. El vicio de un imperialismo teórico induce una inquietud sobre la identidad de una disciplina, y conduce a sofocar la diversidad teórica que se requiere para dar una respuesta ética a la complejidad concreta del ámbito público. Yoga, together with other so-called holistic spiritual practices such as reiki or meditation, is one of the most popular spiritual disciplines in our contemporary society. The success of yoga crosses the boundaries between health, sport, religion, and popular culture. However, from a sociological point of view, this is a largely under-researched field. Aiming to fill this gap, this article analyzes the impact, meaning, and implications of the practice of yoga by taking prisons as the institutional context of the study. The (...) growth of yoga in penitentiary settings is a recent trend in many countries and raises new questions concerning its potential to foster well-being and self-transformation. The research presented here applies Schutz’s concepts of “finite province of meaning” and “stock of knowledge” to understand yoga’s role in inmates’ lives. The main argument of the article is that yoga is a body technique that affords inmates the possibility to enter into a “finite province of meaning” and transcend their everyday prison lives. However, the impact of yoga upon inmates’ lives is not limited just to its physical effects as learning yoga also involves the acquisition of a “spiritual stock of knowledge” made up of Eastern philosophy, holistic concepts, and self-help therapeutic narratives. Indeed, physical movements and spiritual accounts constitute one another in the practice of yoga, thus opening up a pathway into a different reality; movement and spiritual discourse inform one another—and it is precisely in this reflexivity that “transcendent experiences” are created and yoga is made meaningful and important in the improvement-setting of the prison. Considering the recent epigenetic studies on the transgenerational transmission of trauma, this article aims to 1) explore its ethical implications for the concept and nature of moral damage, and 2) offer normative suggestions on collective responsibilities both synchronic and diachronic. To do so, I first address recent epigenetic studies’ showing the crystallization of emotional information through generations, and second, defend that a unified approach to the concept of ghost damage may be useful to categorize this phenomenon, facilitate future research on (...) this type of moral damage, and recognize its importance in the identification of hermeneutical injustice. Finally, I suggest that granting a right to transgenerational information may help avoid the perpetuation of inherited damage that jeopardize mental and physical health in the offspring. (shrink)

Sobre la base de una línea interpretativa propiciada por la misma doctrina de Plotino, este trabajo pretende estudiar el problema que conlleva el fin último del alma humana en vista de su ascenso hacia el Uno-Bien. En varios pasajes de su obra, el filósofo sostiene que, conociendo el propio sí-mismo, se puede tomar contacto con un principio supremo, anterior incluso a la potencia intelectiva, en virtud de cuya visión es dable gozar de un amor sin medida. El remate en la (...) unificación no depende en última instancia del acierto racional, sino de concordar en el mismo centro con aquello de semejante al Uno-Bien que hay en el alma. Estas distinciones abonarían la posibilidad de una unión mística dentro del sistema plotiniano. Sin embargo, desde el punto de vista epistemológico, el estatuto místico es controvertido y plantea una serie dificultades teóricas que es necesario dilucidar. Para el análisis de los tópicos mentados se desarrolla una lectura a la vez hermenéutica y crítica tanto de las fuentes como de la bibliografía erudita. (shrink)

O objetivo deste artigo é analisar a Lógica do Discurso na obra de Éric Weil, bem como relacionar os diversos discursos já feitos na história da filosofia na tentativa de apresentar um a nova maneira de ser, de compreender, de falar e de agir. Estes discursos se manifestam como aceitação do absoluto - optando pela racionalidade, ou como recusa ao diálogo - optando pela violência. Esta lógica pretende superar as demais lógicas articuladas na história.

Judging Virtuously: Developing an Empathic Capacity for Perceptual Sensitivity: A Review of Amalia Amaya and Ho Hock Lai , Law, Virtue and Justice.

This paper considers whether, and if so how, the modelling of joint action in social philosophy – principally in the work of Margaret Gilbert and Michael Bratman – might assist in understanding and applying the concept of concerted practices in European competition law. More specifically, the paper focuses on a well-known difficulty in the application of that concept, namely, distinguishing between concerted practice and rational or intelligent adaptation in oligopolistic markets. The paper argues that although Bratman's model of joint action (...) is more psychologically plausible and phenomenologically resonant, its less demanding character also makes it less useful than Gilbert's in our understanding of the legal concept of concerted practice and in dealing with the above difficulty. The paper proceeds in two parts: first, a discussion of the concept of concerted practices in European competition law; and second, a discussion of Gilbert and' Bratman's models of joint action, including a comparative assessment of their ability to provide an evidentiary target and an evidentiary platform for conceited practices. The happiness of non-identity: Michel Foucault’s search for self-loss beyond modern and Christian confession This article focuses on Michel Foucault’s notion of a ‘happy limbo of non-identity’, formulated in his epilogue to the diary of the ‘hermaphrodite’ Barbin (1838-1868). From the eighteenth century onwards, the incitement to put sex and gender into discourse has limited this freedom to be indeterminate. Using The Will to Knowledge and Confessions of the Flesh, Part I and IV of Foucault’s History of Sexuality, this article (...) describes five main features of modern and early Christian confessional practices. What similarities and differences are there? What is constituted and lost in these practices? Using Foucault’s suggestions in essays to enjoy sexual and other pleasures without confessing, it shows that he decouples ‘self-loss’ from negative Christian self-denial as well as from positive, modern self-constitution. Self-loss thus becomes the moment in which the self can transcend itself and explore new modes of subjectivation. (shrink)

The current study explores the role of individual and environmental determinants on students’ fear of crime. Based on a large-scale survey among students of a Belgian university (n = 1,463), the relationship between perceived social and physical disorder and the three dimensions of fear of crime (perceived risk of victimization, feelings of anxiety, avoidance behaviour) is examined. Support was found for a relationship between perceived social and physical disorder and perceived risk of victimization. Moreover, a relationship was found between students’ (...) perception of social disorder and anxiety and students’ perception of physical disorder and avoidance behaviour. Based on the results, this study suggests that preventing or reducing visible signs of disorder on campus should inevitably be included in the university’s security policy. This research offers universities more insight in the determinants of students’ fear of crime and potential measures to increase their (perception of) safety. (shrink)

Memory errors and, specifically, false memories in the Deese/Roediger–McDermott paradigm have been extensively studied in the past decades. Most studies have investigated false memory in monolinguals’ native or first language (L1), but interest has also grown in examining false memories in participants’ second language (L2) with different proficiency levels. The main purpose of this manuscript is to review the current state of knowledge on the role of language proficiency on false memories when participants encode and retrieve information in the same (...) language. To do so, a systematic literature search was conducted, and the available studies were reviewed. These studies differed in, for example, age, language proficiency, or material characteristics, including both high and low associative strength lists, and they reported different results. In this review, we attempted to make sense of the apparently contradictory results by carefully identifying participants’ language dominance and L2 proficiency. Specifically, the results indicated that, first, people are more prone to produce false memories in their dominant than in their non-dominant language. This result generalizes to lists with high and low associative strength, as well as to participants of different ages. Second, false memories do not differ between two languages when speakers are equally proficient in both languages. Finally, highly proficient L2 speakers produce more false memories in their L2 than speakers with lower L2 proficiency. The results of this review will be considered in the light of the theoretical frameworks of false memories and bilingual language processing. (shrink)

In this paper, we explore the desires that play a role at the palliative stage and relate them to various approaches to patient autonomy. What attitude can physicians and other caregivers take to the desires of patients at the palliative stage? We examine this question by introducing five physicians who are consulted by Jackie, an imaginary patient with metastatic lung carcinoma. By combining the models of the physician-patient relationship developed by Emanuel and Emanuel (1992) and the Hellenistic approaches to desires (...) analyzed by Nussbaum (1994), five different ways of dealing with desires in the context of palliative care are sketched. The story of Jackie shows that desires are to a certain extent responsive to reasoning. In the palliative process, that can be a reason to devote attention to the desires of patients and caregivers and to determine which desires need to be fulfilled, which are less important, and how they are linked to emotions the patient has. This study explores the institutional logics and socialization experiences of STEM doctoral students in the context of the current American economic narrative that is specific to science and technology. Data from qualitative interviews with 36 students at three research universities first reveals a disconnect between a well-established national science and technology policy narrative that is market-oriented and the training, experiences, and perspectives of science and engineering doctoral students. Findings also indicate science and engineering doctoral students mostly understand entrepreneurship and innovation (...) in the contexts of funding research activities and creating social impact, which parallel rather than oppose dominant academic values and norms. Based on the findings, we contend that it is both possible and prudent for universities and graduate programs to pursue strategies that align science and engineering doctoral education with the current national economic agenda and support the personal, professional values and perspectives of students without coming in conflict with the scientific core of the academy. The effective implementation of regulation in organizations is an ongoing concern for both research and practice, in order to avoid deviant behavior and its consequences. However, the way compliance with regulations is actually enacted or “performed” within organizations instead of merely executed, remains largely under-characterized. Evidence from an ethnographic study in the compliance unit of a French investment bank allows us to develop a detailed practice approach to how regulation is actually implemented in firms. We characterize the work accomplished by (...) compliance analysts who are in fact, “curving” the script of regulation within what we conceptualize as a “comfort zone”. Beyond agency, ethics appears as a key element in linking the “letter of the law”, which serves as a referential anchor to guide action, with the complex nature of specific situations. We analyze the way individuals and compliance teams cope with, interpret, struggle and in fine, perform regulation within this comfort zone. A particular interest is thus given to the work of embedded ethics in this process, as an enabler to partly recouple compliance with the regulated activity. We find that blind execution is not only impossible, but also devoid of meaning both from regulatory, risk management, and business perspectives in organizations. We highlight and characterize a hermeneutic dimension to this work, essential to effectively perform regulation in complex environments, and we suggest some directions for further research. (shrink)

This Open Access book offers a synthetic reflection on the authors’ fieldwork experiences in seven countries within the framework of ‘Authoritarianism in a Global Age’, a major comparative research project. It responds to the demand for increased attention to methodological rigor and transparency in qualitative research, and seeks to advance and practically support field research in authoritarian contexts. Without reducing the conundrums of authoritarian field research to a simple how-to guide, the book systematically reflects and reports on the authors’ combined (...) experiences in getting access to the field, assessing risk, navigating ‘red lines’, building relations with local collaborators and respondents, handling the psychological pressures on field researchers, and balancing transparency and prudence in publishing research. It offers unique insights into this particularly challenging area of field research, makes explicit how the authors handled methodological challenges and ethical dilemmas, and offers recommendations where appropriate. In de loop van de evolutie heeft het menselijk lichaam allerlei temporaliteiten ontwikkeld. Deze stellen bepaalde grenzen aan het lichaam. Recente ontwikkelingen in de chronobiologie weerleggen de veronderstelling dat deze grenzen eigen zijn aan het lichaam. Met behulp van het begrip ‘eigentijd’ betoog ik dat deze grenzen bepaald worden door de interactie tussen lichaamseigen en lichaamsvreemde tijden.

Solidarity and COVID-19: A Foucauldian Analysis In response to the COVID-19 pandemic, most governments in Europe have imposed disciplinary and controlling mechanisms on their populations. In the name of solidarity, citizens are pressed to submit to lockdowns, social distancing or corona apps. Building on the historical-philosophical studies of Michel Foucault, this article shows that these mechanisms are spin-offs of health regimes that have evolved since the seventeenth century. In case of COVID-19, these regimes decreased the infection, morbidity and mortality rates. (...) But, as a side-effect, they limited the opportunities to act together and practice solidarity. This negatively affected the social cohesion and public sphere in already highly individualistic societies. To prevent the further disappearing of solidarity – understood as something that is enacted rather than as a moral value or political principle – governments and citizens need to invest in the restoral of the social conditions that enable and facilitate the practicing of solidarity after the epidemic. It discusses four themes by way of response to each commentator: conversing, listening, feeling, and hesitating.

O presente texto é uma exposição do Direito Abstrato da Filosofia do Direito de Hegel. O seu objetivo é ressaltar o sentido do ter, conteúdo do Direito Abstrato, como pressuposto para a moralidade, isto é, para o ser livre. A argumentação consiste em lembrar que a liberdade não se restringe a discursos e interesses individuais, mas em criar as condições necessárias para que uma vida seja livre. Assim, o processo dialético dos momentos da concretização da liberdade será de fato um (...) modo de relação social onde o fundamento do direito será a personalidade em geral, na sua relação com as coisas, esfera da legalidade. Tal esfera será também, na sua concretude, um pressuposto para a moralidade. Um miserável não pode ser livre, pois, segundo Hegel, o direito de ter é um direito universal e não somente de alguns particulares. Desse modo, o Direito para Hegel é a ideia da efetivação da liberdade que compreende o direito de ter, o direito de ser livre e o direito de ter e ser livre, que constitui o direito de cidadania. Entretanto, o que justifica esta análise na atualidade é exatamente o não cumprimento deste direito de ter, numa sociedade moralmente antagônica, cujo tecido continua criando a riqueza e a miséria. Neste artigo comentamos somente o direito de ter nas suas explicitações: a personalidade, a possessão, a propriedade, o contrato, a injustiça e a violência. (shrink)

This paper argues that not only does history matter to legal epistemology, but also that understanding legal epistemology can yield a certain understanding of the past. The paper focuses on the common law practice of precedent and argues that there is no set of rules, principles, reasons or material facts that constitute the fixed or foundational content of past decisions, but rather that what is taken by a judge resolving a particular dispute to be the content of past decisions depends (...) on the active and creative construal of relevance engaged in by that judge. Precedents are better thought of as `thick resources with dynamic content'. Such content is constrained by a variety of stabilising practices, but never so constrained as to determine how it can be construed to be relevant. This image of law's past may offer a general view of the past as something with which we can actively and creatively relate in the course of coping with the present. (shrink)

The importance of relationality in ethical leadership has been the focus of recent attention in business ethics scholarship. However, this relational component has not been sufficiently theorized from different philosophical perspectives, allowing specific Western philosophical conceptions to dominate the leadership development literature. This paper offers a theoretical analysis of the relational ontology that informs various conceptualizations of selfhood from both African and Western philosophical traditions and unpacks its implications for values-driven leadership. We aim to broaden Western conceptions of leadership development (...) by drawing on twentieth century European philosophy’s insights on relationality, but more importantly, to show how African philosophical traditions precede this literature in its insistence on a relational ontology of the self. To illustrate our theoretical argument, we reflect on an executive education course called values-driven leadership into action, which ran in South Africa, Kenya, and Egypt in 2016, 2017, and 2018. We highlight an African-inspired employment of relationality through its use of the ME-WE-WORLD framework, articulating its theoretical assumptions with embodied experiential learning. (shrink)

Experts in the field of organ transplantation had to rank order a set of 32 patients according to their priority in receiving a donated kidney. The patients were described by the five characteristics that are incorporated in the kidney allocation algorithm applied by Eurotransplant. The priority rankings as defined by the experts were analyzed and patterns of dedsion making identified in the rankings investigated in this study. All patterns could be explained by some type of lexicographical ranking. The larger group (...) of experts preordered tissue compatibility or, more technically speaking, the criterion of HLA match, while the complementary group applied the criterion of the length of waiting time first. Analyzing the finer decision structures of expert rankings and com paring the method of pattern exploration with a conjoint measurement analysis led to two follow-up questions: First, how can the value judgments of the experts be described adequately? Second, which type of aggregated ordering derived from the individual rankings represents them ‘best’? (shrink)

This article aims to explore the concept of victimless damage. This refers to paradoxical cases where a perpetrator and a moral wrong can be easily identified, but where somehow the role of the victim as such can be questioned. In order to explore this concept, I will first offer a typology of cases that could be labelled under this umbrella concept—namely, cases of deceased victims, biotechnological or no-identity cases, and the ones related to lack of awareness due to epistemic injustice. Then, after highlighting the common traits and discussing some fuzzy cases, I will flesh out the main arguments for and against of the existence of and need for this concept, on the basis of both moral objectivism and subjectivism. In my view, delving into these arguments could shed some light on the metaethical debate on the sine qua non conditions of moral damage and its relation to moral wrongness. Finally, I will conclude by advocating for the need to introduce a gradational concept of moral damage and the second-person perspective into moral philosophy in order to take into account potential cases of victimless damage, but without having to accept the premises of moral realism.
