Definition of the problem This interview study investigated ethical issues in long-term care facilities from the perspective of caregivers during the coronavirus disease pandemic. Due to the explorative as well as descriptive methodological approach, interview data are available and can be assigned to four central topics, which reveal a complex and sometimes conflictual reality of work and life in long-term care during the pandemic. On the one hand, the protective measures taken by the state and the institutions, as well as (...) the resulting restrictions on the personal freedom of the residents are critically reflected and the degree of self-determination of the residents of nursing homes in the pandemic is questioned. On the other hand – given the pandemic-related measures – nursing activities in long-term care facilities as a place of work and life are described as challenging, especially regarding the changed nursing processes and quality of care, as well as due to the changed quality of relationships with the residents. Arguments These four topics can basically be assigned to the ethical principles of autonomy and care and present a relevant concretization of the principle-oriented ethical challenges in long-term care during the COVID-19 pandemic. In the synopsis and interpretation of the results, it becomes apparent that the interviewed caregivers closely link the observance and implementation of the autonomy principle in everyday nursing care with the principle of care and the resulting well-being of the residents. Conclusions Our results clearly show that the paradigm shift in long-term care, which has been developed over the last few decades, was weakened by the COVID-19 pandemic. In addition, the reported moral uncertainties and conflicts make it clear that caregivers need support regarding the ethical reflection of their nursing actions and that a sustainable integration of ethics counselling in long-term care facilities may be a possible approach to a solution. This paper contributes to the debate about how the overdemandingness objection applies to Kant's ethics. I first look at the versions of the overdemandingness objections Kant himself levels against other ethicists and ethical principles and I discuss in what sense he acknowledges overdemandingness as a problem. Then I argue that, according to Kant's own standards, introspection about the moral worthiness of one's actions can constitute forms of moral overdemandingness. Self-scrutiny and Kant's well-known claim that we can never be certain that (...) we acted for the right reason jeopardize agents’ deserved happiness. Furthermore, self-scrutiny can constitute an activity Kant himself criticizes under the labels of “micrology” and “fantastic virtue”. The demandingness of critical self-scrutiny has not yet received due attention in the overdemandingness debate since this debate is focused on duties we have towards others. (shrink)

There is a consensus that Kant's aim in the Groundwork is to clarify, systematize and vindicate the common conception of morality. Philosophical theory hence serves a restorative function. It can strengthen agents' motivation, protect against self-deception and correct misunderstandings produced by uncritical moral theory. In this paper, I argue that Kant also corrects the common perspective and that Kant's Groundwork shows in which senses the common perspective, even considered apart from its propensity to self-deception and without being influenced by misleading (...) theory, is deficient. Critical practical philosophy needs to set right agents about the stringency of some of their duties, and agents need to be made aware that they have certain other duties. I discuss how Kant corrects the common agent's notion of the stringency of the duty to not make false promises and how Kant corrects the common agent's notion of duties to self. I finally discuss how his critical practical philosophy can become popular and achieve the correction of the common perspective. I stress the role of education informed by philosophical theory for this and contrast it with so called ‘popular philosophy’. (shrink)

We investigate the behavior of cardinal characteristics of the reals under extensions that do not add new [Formula: see text]-sequences (for some regular [Formula: see text]). As an application, we show that consistently the following cardinal characteristics can be different: The (“independent”) characteristics in Cichoń’s diagram, plus [Formula: see text]. I define ecosabotage and relate this definition to several well-known analyses of civil disobedience. I show that ecosabotage cannot be reduced to a form of civil disobedience unless the definition of civil disobedience is expanded. I suggest that ecosabotage and civil disobedience are special cases of the more general concept of conscientious wrongdoing. Although ecosabotage cannot be considered a form of civil disobedience on the basis of the standard analysis of this concept, the civil disobedience literature can provide important insights (...) into the justification of ecosabotage. First, traditional appeals to a higher law in justifying ecosabotage are no more successful than they are in justifying civil disobedience. Second, utilitarian justifications of ecosabotage are promising. At present there is no apriori reason tosuppose that some acts of ecosabotage could not be justified on utilitarian grounds, although such ecosaboteurs as Dave Foreman have not provided a full justification of its use in concrete cases. En diversos textos relacionados con la filosofía de la historia, Immanuel Kant presenta los conceptos de “naturaleza”, “destino” o “providencia” que dan sentido y finalidad a la historia de la humanidad en su conjunto. Estos textos fueron publicados durante las décadas de 1780 y 1790. El objetivo de este artículo es examinar las diferentes formas que adopta la teleología de la naturaleza en estos textos kantianos. Intentaremos mostrar las coincidencias y las diferencias entre las formas mencionadas.

Five studies examined how interacting with the physical environment can support the development of fraction concepts. Nine‐ and 10‐year‐old children worked on fraction problems they could not complete mentally. Experiments 1 and 2 showed that manipulating physical pieces facilitated children's ability to develop an interpretation of fractions. Experiment 3 demonstrated that when children understood a content area well, they used their interpretations to repurpose many environments to support problem solving, whereas when they needed to learn, they were prone to the (...) structure of the environment. Experiments 4 and 5 examined transfer after children had learned by manipulating physical pieces. Children who learned by adapting relatively unstructured environments transferred to new materials better than children who learned with “well‐structured” environments that did not require equivalent adaptation. Together, the findings reveal that during physically distributed learning, the opportunity to adapt an environment permits the development of new interpretations that can advance learning. (shrink)

Social attitudes toward usury (here defined using the archaic meaning as the taking of interest on loans) have changed dramatically over the centuries. From antiquity until the Protestant Reformation, usury was regarded as an inherently evil activity. Today, with few exceptions, usury is met with moral indifference. Modern objections to usury are limited to protest against "excessive" interest rates rather than interest per se. With this change in focus, the very meaning of the term "usury" has also changed. Many early (...) pronouncements against the taking of interest emphasized the plight of the poor, but ironically, the poor actually pay the highest rates of interest in the modern American economy. Despite the universality of usury, some socio-economic subcultures still manage to avoid the taking or giving of interest. Orthodox branches of both Judaism and Islam have maintained bans on usury throughout the centuries and up to the present time. This is especially interesting in the case of Judaism, given the popular cultural image of the Jew as usurer. Jewish free loan systems may actually offer a model for modern loan programs that can be designed to aid poor borrowers, who are frequently shut out of mainstream financial services. (shrink)

The first case of COVID-19 infection in Africa was recorded in Egypt on 14 February 2020. Following this, several projections of the possible devastating effect that the virus can have on the population of African countries were made in the Western media. This paper presents evidence for Africa’s successful responses to the COVID-19 pandemic and under-reporting or misrepresentation of these successes in Western media. It proceeds to argue for accounting for these successes in terms of Africa’s communitarian way of life (...) and conceptions of self, duty, and rights; and that a particular orientation in theorizing on global justice can highlight the injustices inherent in the misrepresentation of these successes and contribute shared perspectives to formulating a framework of values and concepts that would facilitate the implementation of global policy goals for justice. The paper is thus grounded in a rejection of the insular tenets of theorizing prevalent in the global justice debate and to persistent inclinations in Western scholarship to the thinking that theorizing in the African context that draws inspiration from the cultural past has little to contribute to the quest for justice globally. On the contrary, it argues that reflexive critique of cultural history is a necessary source of normative ideals that can foster tolerant coexistence and a cooperative endeavour toward shared conceptions of justice in the contemporary world. The notions of “concepts of the political” and that of “political concepts” refer to different but intertwined phenomena. As I will argue in this article, the concepts of the political refer to the self-institution of societies, while political concepts are those that emerge in the realm of politics, a field some societies institute as precisely the site in which the reversibility of the political takes place. This article will argue that the concepts of the political and the political concepts coming (...) out of South America in its contemporary history spring from the main events and processes—the political and social history—that dominated the period. The events and concepts first discussed will be those related to the conquest and its legacy, only to later move fully to the past fifty years of dictatorships, transitions to democracy, and the emergence of the neopopulist political form. Daniel Taylor and Dawn Goodwin present a case study of the Morecambe Bay Inquiry (MBI), which examined the high rate of maternal and neonatal deaths over a period of 9 years (2004–2013), within the small maternity unit of Furness General Hospital (FGH), one of the three hospitals comprising Morecambe Bay Hospitals Trust.1 They examine this through a conceptual lens, and provide a solution involving changes in medical education. This commentary explores both these elements. First, they use the lens of ‘Normalisation (...) of Deviance’ (NoD) to explain organisational failure. However, other available lenses such as ‘Sociology of Disasters’, ‘Organisational Silence’ and ‘Comfort-seeking Behaviour’ may point to different problems and solutions. More justification for their choice of the lens of NoD would have been useful. Similarly, more justification for their focus on a cluster of five ‘serious untoward incidents’ (SUIs) occurring in 2008 would also have been useful. They suggest that before 2008, the perinatal mortality rate was low, patient satisfaction was high and recent level 2 accreditation of maternity services by the Clinical Negligence Scheme for Trusts all suggested standards of care within the obstetric department were adequate. This stream of positive signals is likely to have contributed towards a genuine belief of safe operation within the maternity unit by staff and board members. I discuss two puzzling and neglected passages in the Critique of Practical Reason, namely, V:92 and V:163. In these passages Kant claims that practical philosophers should follow the paradigm of the chemist and conduct experiments on common human reason. I explain Kant’s conception of the chemical experiment, provide a detailed interpretation of the two passages in question, and conclude by applying the structure of the chemical experiment to the Analytic of the Critique of Practical Reason. Chemical experiments as a model (...) of ethics should be understood as a method of confirming that a philosophical theory systematizes and defends ideas that ordinary rational agents are already committed to. In recent years, increasing pressures have been brought to bear upon nurses and others more closely to inform, involve and support the rights of parents or guardians when crucial ‘life and death’ ethical decisions are made on behalf of their seriously ill child. Such decisions can be very painful for all involved, and may easily become deadlocked when there is an apparent clash of moral ideals or values between the medical team and the parents or guardians. This article examines a (...) growing number of such cases in New Zealand and analyses the moral parameters, processes, outcomes and ethical responses that must be considered when life and death ethical decisions involving children are made. The article concludes with a recommendation that nurses should be recognized as perhaps the most suitable of all health care personnel when careful mediation is needed to produce an acceptable moral outcome in difficult ethical situations. This article develops the concept of proximity as socio-spatial distance by looking at the temporally and spatially condensed events of contemporary art exhibition openings. The article begins by examining some developments in proximity research, the limitations of theorizing the importance of proximity as mere physical nearness, arguing that potentiality renders proximity meaningful. After introducing the art event, we offer a three-pronged approach to proximity by showing the imperatives for being-there, the conditional indeterminacy of potentiality and the politics of proximity. In (...) contrast to much recent research, it is argued that the significance of events is not reducible to evaluated outcomes. Two ethnographic vignettes show the imperatives, indeterminacies and politics in action. We conclude by showing how this conceptualization of proximity has analytic purchase beyond the empirical realm of contemporary art. (shrink)

Der umfassende Prozess der weltweiten Digitalisierung prägt alle gesellschaftlichen Systeme in unterschiedlicher Weise. Wie sehr verändert die Digitalisierung die uns bekannte Welt und die Vulnerabilität des Lebens? Sind die damit verbundenen Transformationen gar wünschenswert und/oder notwendig? In Hinblick auf eine Vergewisserung dessen, was als (unsere) Welt anzusehen ist, bietet sich der Begriff der Lebenswelt im Ausgang von Edmund Husserl an. Demnach ist es eine wirklich anschauliche, wirklich erfahrene und erfahrbare Welt, in der sich unser ganzes Leben praktisch abspielt. Technisierung bedeutet (...) eine Veränderung dieses menschlichen Weltverhältnisses. Husserl attestierte seinerzeit eine Lebensweltvergessenheit, die zu einer Krise Europas und des europäischen Menschentums beitragen würde. Daher setzte er sich für eine Rehabilitierung der Lebenswelt als Sinnesfundament ein. Diese berühmte Diagnose und jene Massnahme sind seit Husserls Tagen immer wieder aufgegriffen worden. Wird die Digitalisierung die Welt in eine komplett künstliche Welt transformieren, die den Zusammenhang von persönlicher Erfahrung, Leiblichkeit, gesellschaftlichen Institutionen und Erscheinungen der Natur aufgekündigt hat? Bevor eine solche Befürchtung geglaubt werden kann, gilt es, grundlegende Muster der Digitalisierung im Hinblick auf ihre lebensweltliche Konkretion zu befragen. Avantgarde in Halle: The Invention of Aesthetics and the Aestheticization of Christianity. The foundation of scholarly aesthetics by the Halle philosopher Alexander Gottlieb Baumgarten and Georg Friedrich Meier in the middle of the 18th century took place within a milieu that was shaped by both pietism and the Enlightenment. Martin Fritz demonstrates that aesthetics in Halle itself can be considered a synthesis of pietism and Enlightenment ideas. The sensualization of basic Christian concepts is of eminent relevance for these aesthetics, (...) in order to reinvent the pietistic striving for intensive religious experiences through such „aestheticization.“ The romantic idea of „Kunstreligion“, which continues to be significant in cultural life today, is also based on this programmatic notion of aestheticization. Building on this historical background, this article’s concluding systematic considerations argue for a theological revaluation of pertinent contemporary cultural phenomena. (shrink)

Theorien der Natur- und Tierethik verfolgen häufig das Ziel, die moralische Sonderstellung des Menschen zu kritisieren, doch zeigt ein Rekurs auf implizite Menschenbilder, dass diesem Anliegen oft nicht vollends entsprochen wird. Erstens gibt es explizit anthropozentrische Ansätze, die moralische Verpflichtung angesichts von Tieren und Natur mit der Verantwortung gegenüber Menschen grundlegen. Zweitens erzeugen viele Theorien Menschenbilder, die wiederum in einer Sonderstellung münden. Drittens werden durch die Annäherung von Menschen und Tieren marginal humans erzeugt. Viertens zeichnet die Rede vom Menschen im (...) Kollektivsingular ein undifferenziertes Bild von Verantwortung. (shrink)

Cet article examine la concurrence entre des structures de gouvernance des entreprises. Il y est souligné qu’une panoplie de structures “constitutionnelles” peut être observée dans le cadre marchand et que cette variété a servi des objectifs transactionnels importants sur un plan historique. L’article met en contraste les approches coasienne et autrichienne de l’explication des structures de gouvernance. Nous examinons la tendance récente du déplacement de la propriété des entreprises vers les investisseurs par opposition aux arrangements coopératifs et “mutuels”. L ’ (...) a r gument a t ion sout i ent que l’intervention étatique peut être une explication importante des tendances récentes au Royaume Uni, notamment dans le domaine des institutions financières. Les suggestions selon lesquelles des modèles de gouvernance des entreprises par les “partenaires” devraient être introduits à travers l’intervention de l’Etat ignorent à la fois les coûts de transaction et l’importance d’assurer l’affectation du talent entrepreneurial en direction des ressources économiques.This paper considers competition between governance arrangements for firms. It is argued that a variety of ‘constitutional’ structures can be observed in the market and that historically this variety has served important transactional purposes. The Coasian and Austrian approaches to the explanation of governance arrangements are contrasted. Recent trends towards investor ownership of firms and away from co-operative and ‘mutual’ arrangements are considered. It is argued that government regulatory intervention may be an important explanation for recent trends in the UK, especially in the area of financial institutions. Suggestions that ‘stakeholder’ models of firm governance should be introduced through state intervention ignore considerations both of transactions costs and the importance of ensuring the allocation of entrepreneurial talent to the direction of economic resources.
