While “meaning negotiation” has become an ubiquitous term, its use is often confusing. A negotiation problem implies not only a convenience to agree, but also diverging interest on what to agree upon. It implies agreement but also the possibility of disagreement. In this chapter, we look at meaning negotiation as the process through which agents starting from different preferred conceptual representations of an object, an event or a more complex entity, converge to an agreement through some communication medium. We shortly (...) sketch the outline of a geometric view of meaning negotiation, based on conceptual spaces. We show that such view can inherit important structural elements from game theoretic models of bargaining – in particular, in the case when the protagonists have overlapping negotiation regions, we emphasize a parallel to the Nash solution in cooperative game theory. When acceptable solution regions of the protagonists are disjoint, we present several types of processes: changes in the salience of dimensions, dimensional projections and metaphorical space transformations. None of the latter processes are motivated by normative or rationality considerations, but presented as argumentation tools that we believe are used in actual situations of conceptual disagreement. Christiansen & Chater (C&C) have taken the interactionist approach to linguistic universals to an extreme, adopting the metaphor of language as an organism. This metaphor adds no insights to five decades of analyzing language universals as the result of interaction of linguistically unique and general cognitive systems. This metaphor is also based on an outmoded view of classical Darwinian evolution and has no clear basis in biology or cognition.

The paper addresses two issues that have been recently debated in the literature on free will, moral responsibility, and the theory of punishment. The first issue concerns the descriptive project, the second both the substantive and the prescriptive project. On theoretical, historical and empirical grounds, we claim that there is no rationale for fearing that the spread of neurocognitive findings will undermine the ordinary practice of responsibility attributions. We hypothetically advocate two opposite views: that such findings would cause the collapse (...) of all punitive practices; that, on the contrary, such findings would open the way to more humane forms of punishment, which would be justified on purely utilitarian grounds. We argue that these views are both wrong, since whereas a sound punitive system can be justified without any reference to moral responsibility, it will certainly not improve the humaneness of punishment. Si esamina, nell'esperienza giuridica, lo stato di eccezione nel senso più generale, come fenomeno straordinario, eventuale, ma che, una volta verificatosi, non possa rimanere giuridicamente ignorato né inspiegabile, analogamente al concetto del miracolo in teologia. Lo stato di eccezione non può essere neppure limitato alle sole condizioni di necessità; non può essere affrontato e risolto con le sole argomentazioni inerenti lo stato di costrizione, che rappresenta solo un aspetto della sua casistica, comprendente anche fattispecie create dall'esclusivo e libero esercizio della (...) volontà di chi provoca o determina lo stesso stato di eccezione. Per analizzare le caratteristiche del ragionamento giuridico nello stato di eccezione, si esaminano due casi. Il primo caso riguarda la cospirazione, il secondo caso di eccezione è la definizione giuridica dei diritti umani. (shrink)

In questo articolo ci proponiamo di portare alla luce i netti confini che separano i concetti di mindreading, introspezione e metacognizione con l’obiettivo di dissipare alcuni fraintendimenti presenti nella letteratura clinica. A tal fine, iniziamo identificando due posizioni principali nell’odierno dibattito filosofico cognitivo sull’introspezione: da un lato le teorie che sostengono che “introspezione” è la denominazione impropria per un processo interpretativo; da un altro lato le teorie che continuano a ritenere che almeno in alcuni casi l’accesso alla propria mente sia (...) diretto e non interpretativo. Dopodiché prendiamo posizione contro le teorie dell’accesso diretto e in favore di una certa versione dell’approccio interpretativista. Infine, da questo approccio ricaviamo alcune linee guida per l’uso della Theory of Mind in neuropsichiatria cognitiva. (shrink)

Effective methods for evaluating the reliability of statements issued by witnesses and defendants in hearings would be an extremely valuable support to decision-making in court and other legal settings. In recent years, methods relying on stylometric techniques have proven most successful for this task; but few such methods have been tested with language collected in real-life situations of high-stakes deception, and therefore their usefulness outside lab conditions still has to be properly assessed. In this study we report the results obtained (...) by using stylometric techniques to identify deceptive statements in a corpus of hearings collected in Italian courts. The defendants at these hearings were condemned for calumny or false testimony, so the falsity of (some of) their statements is fairly certain. In our experiments we replicated the methods used in previous studies but never before applied to high-stakes data, and tested new methods. We also considered the effect of a number of variables including in particular the homogeneity of the dataset. Our results suggest that accuracy at deception detection clearly above chance level can be obtained with real-life data as well. (shrink)

The article briefly analyzes the concept of a person, arguing that personhood does not coincide with the actual enjoyment of certain intellectual capacities, but is coextensive with the embodiment of a human individual. Since in PVS patients we can observe a human individual functioning as a whole, we must conclude that these patients are still human persons, even if in a condition of extreme impairment. It is then argued that some forms of minimal treatment may not be futile for these (...) patients; they may constitute a form of respect for their human dignity and benefit these patients, even if they are not aware of that. Moreover, it is important to consider the symbolic significance of care: while many believe that PVS is a kind of imprisonment, for others providing food and fluids is the only way to testify our proximity to these persons. The best policy would be to provide, as a general rule, artificial nutrition and hydration to PVS patients: this treatment could be withdrawn, after a period of observation and reflection by the family and proxies, on the basis of the proxies' objection to the continuation or of the patient's advance directives specifically referring to this situation. What Jerry Fodor and Massimo Piattelli-Palmarini got wrong about Darwin and evolution.

There is a great distance between two pairs of concepts that are consistent in their own fields; namely, information/control and knowledge/decision. Although contemporary techno-sciences and common sense tend to neglect this distance, its intrinsic implications sometimes make it difficult to understand what is going on in our cultural events and developments. In particular, the abuse of the concepts of knowledge and decision makes it impossible to discriminate between the various levels of systems, both natural and naturoid, which surround us. In (...) fact, the majority of so-called intelligent systems are mere information and control processors, rather than systems that are capable of generating knowledge and decision. The diffusion of such a misunderstanding may cause, in turn, the reduction of man to a mere information system based on established and discoverable rules, thereby neglecting his ability, albeit rarely exercised, to override information and control in order to discover or to set up something new. The term “coenesthesia” was introduced at the end of the eighteenth century by the German physiologist Johann Christian Reil to designate the general perception of the living body through the nerves. Over the course of the nineteenth century, this notion circulated widely not only in Germany, but also in France, where it was developed in particular by Théodule Ribot. However, a good sixty years before Ribot, Maine de Biran had already employed the notion of “coenesthesia” to indicate the “immediate feeling (...) of existence,” which he distinguished from the apperception of the self in relation to the body. What Biran emphasized, in his philosophical appropriation of “coenesthesia,” is the impersonal and mostly unconscious nature of this feeling, which never leaves us and plays a key role in the shaping of our personal and conscious life, unnoticeably influencing the course of our ideas, our character, and the emotional tone of our perception of the world. The purpose of this article is to study Biran’s philosophical use of the notion of “coenesthesia” in the last phase of his philosophical reflection (1823–1824) in relation to the emergence of the problem of the unconscious.
