There seem to be topics on which people can disagree without fault. For example, you and I might disagree on whether Picasso was a better artist than Matisse, without either of us being at fault. Is this a genuine possibility or just apparent? In this paper I pursue two aims: I want to provide a systematic map of available responses to this question. Simultaneously, I want to assess these responses. I start by introducing and defining the notion of a faultless (...) disagreement. Then I present a simple argument to the conclusion that faultless disagreement is not possible. Those who accept the argument have to explain away apparent cases of faultless disagreement. Those who want to maintain the possibility of faultless disagreement must deny one of the argument's premisses. The position I want to promote belongs to the latter category and is a form of genuine relativism. (shrink)

What, in essence, characterizes the mind? According to Searle, the potential to be conscious provides the only definitive criterion. Thus, conscious states are unquestionably "mental"; "shallow unconscious" states are also "mental" by virtue of their capacity to be conscious (at least in principle); but there are no "deep unconscious mental states" - i.e. those rules and procedures without access to consciousness, inferred by cognitive science to characterize the operations of the unconscious mind are not mental at all. Indeed, according to (...) Searle, they have no ontological status - they are simply ways of describing some interesting facets of purely physiological phenomena. (shrink)

In everyday life we take it for granted that we have conscious control of some of our actions and that the part of us that exercises control is the conscious mind. Psychosomatic medicine also assumes that the conscious mind can affect body states, and this is supported by evidence that the use of imagery, hypnosis, biofeedback and other ‘mental interventions’ can be therapeutic in a variety of medical conditions. However, there is no accepted theory of mind/body interaction and this has (...) had a detrimental effect on the acceptance of mental causation in science, philosophy and in many areas of clinical practice. Biomedical accounts typically translate the effects of mind into the effects of brain functioning, for example, explaining mind/body interactions in terms of the interconnections and reciprocal control of cortical, neuroendocrine, autonomic and immune systems. While such accounts are instructive, they are implicitly reductionist, and beg the question of how conscious experiences could have bodily effects. On the other hand, non-reductionist accounts have to cope with three problems: 1) The physical world appears causally closed, which would seem to leave no room for conscious intervention. 2) One is not conscious of one’s own brain/body processing, so how could there be conscious control of such processing? 3) Conscious experiences appear to come too late to causally affect the processes to which they most obviously relate. This paper suggests a way of understanding mental causation that resolves these problems. It also suggests that “conscious mental control” needs to be partly understood in terms of the voluntary operations of the preconscious mind, and that this allows an account of biological determinism that is compatible with experienced free will. The key idea of the interventionist account of causation is that a variable A causes a variable B if and only if B would change if A were manipulated in the appropriate way. This paper raises two problems for Woodward's (2003) version of interventionism. The first is that the conditions it imposes are not sufficient for causation, because these conditions are also satisfied by non-causal relations of nomological dependence expressed in association laws. Such laws ground a relation of mutual manipulability (...) that is incompatible with the asymmetry of causation. Several ways of defending the interventionist account are examined and found unsatisfying. The second problem is that it often seems to be impossible, in a model that contains variables linked by an association law, to satisfy the conditions imposed on interventions on such variables. Various ways to solve this second problem, most importantly the analysis of manipulability in terms of difference making, are examined. Given that none solves the problem, I conclude that the interventionist conditions are neither sufficient nor necessary for causation. It is suggested that they provide an analysis of nomological dependence, which may be supplemented with the notion of a causal process to yield an analysis of causation. (shrink)

In their contribution ‘Ethics of the algorithmic prediction of goal of care preferences’1 Ferrario et al elaborate a from theory to practice contribution concerning the realisation of artificial intelligence (AI)-based patient preference prediction (PPP) systems. Such systems are intended to help find the treatment that the patient would have chosen in clinical situations—especially in the intensive care or emergency units—where the patient is no longer capable of making that decision herself. The authors identify several challenges that complicate their effective development, (...) application and evaluation—and offer solutions to them. One of these issues is the question of who should ultimately use said systems. While it is undisputed that clinicians should use these AI systems for their decision-making process, there is an ongoing debate about whether next of kin should use them as well. The authors advocate that ‘’access should be provided to both clinicians and loved ones with due explanations and as desired’. We will disagree with this assessment and explain in our commentary why it is important that surrogates provide their own assessments with as little external (AI) influence as possible. INTRODUCTION: In accounts of the two-factor theory of delusional belief, the second factor in this theory has been referred to only in the most general terms, as a failure in the processes of hypothesis evaluation, with no attempt to characterise those processes in any detail. Coltheart and Davies attempted such a characterisation, proposing a detailed eight-step model of how unexpected observations lead to new beliefs based on the concept of abductive inference as introduced by Charles Sanders Peirce. METHODS: In this (...) paper, we apply that model to the explanation of various forms of delusional belief. RESULTS: We provide evidence that in cases of delusion there is a specific failure of the seventh step in our model: the step at which predictions from hypotheses are considered in the light of relevant evidence. CONCLUSIONS: In the two-factor theory of delusional belief, the second factor consists of a failure to reject hypotheses in the face of disconfirmatory evidence. (shrink)

It was the explicit aim of my paper ‘Indexical Relativism versus Genuine Relativism’ to ‘characterize and compare’ (p. 297) two different forms of relativism. One form, exemplified by Harman’s and Dreier’s moral relativism (Harman, 1975 and Dreier, 1990), involves the claim that certain sentences express different propositions in different contexts of utterance, much like indexical sentences – hence the name ‘indexical relativism’. The other form involves the claim that the truth-value of certain contents or propositions depends on certain non-standard parameters, (...) i.e. depends not just on a possible world. The explicit conclusion of the paper was that the two forms differ significantly. Dan López de Sa (2007) seems quite happy to grant my main conclusion, namely that there is a significant difference between these two forms of relativism. However, López de Sa raises two worthwhile issues. First, he proposes a taxonomy of relativist views, one on which my ‘genuine relativism’ turns out to be the disjunction of two distinct views. Secondly, he offers an answer to a difficulty I raised for some forms of indexical relativism. I shall comment on each point. (shrink)

Many theorists have defended the claim that collective entities can attain genuine agential status. If collectives can be agents, this opens up a further question: can they be conscious? That is, is there something that it is like to be them? Eric Schwitzgebel argues that yes, collective entities, may well be significantly conscious. Others, including Kammerer, Tononi and Koch, and List reject the claim. List does so on the basis of Tononi’s Integrated Information Theory of consciousness. I argue here that (...) List’s rejection is too quick, and that groups can, at least in principle, display the kind of informational integration we might think is necessary for consciousness. However, group consciousness will likely differ substantially from the individual experiences that give rise to it. This requires the defender of group consciousness to face up to a similar combination problem as the panpsychist. (shrink)

I propose an argument for the thesis that laws of nature are necessary in the sense of holding in all worlds sharing the properties of the actual world, on the basis of a principle I propose to call the Causal Criterion of Reality . The CCR says: for an entity to be real it is necessary and sufficient that it is capable to make a difference to causal interactions. The crucial idea here is that the capacity to interact causally - (...) or to contribute to determining causal interactions - is not only the ultimate metaphysical ground for the existence of an entity, but it also provides a criterion for determining the nature of that entity, i.e. its properties. The alternative is to conceive of laws of nature as contingent: they could be different from what they are like in the actual world, where that possibility is understood to be metaphysical, not only epistemic. For the sake of this paper, I shall accept Armstrong's thesis that laws of nature are relations between universals. I also follow Armstrong in the view that both the existence and the properties of particulars are metaphysically independent of the existence and identity of other particular. However, what is controversial and what I shall challenge is his thesis that universals are like particulars in the following respect: according to Armstrong, each universal is a logically distinct entity whose existence and identity is independent of the existence and identity of other universals. My aim in this paper is to show that the identity of a universal is entirely determined by its lawful relations to other universals. The crucial premise I use is the thesis that the CCR is a universal criterion, which applies both to particulars and universals. From the thesis that the identity of a universal is exclusively determined by laws, it follows that laws are necessary in the sense that they cannot differ without the universals they link also being different. This creates a difficulty for those authors who, as Armstrong, accept the CCR but nevertheless defend the view that laws are contingent. (shrink)

An emerging consensus regards domestic amnesties for international crimes as generally inconsistent with international law. This legal consensus rests on a norm against impunity: the chief role of international criminal law, and of the fledgling International Criminal Court , is to end impunity for violators of the worst of criminal acts. But the anti-impunity norm, and the anti-amnesty consensus that has arisen from it, now face serious difficulties. The ICC's role in the ongoing conflict in Northern Uganda illustrates the deadlock (...) that has now emerged between countries wishing to retain the power to use domestic politics and criminal law as tools for negotiation with current or outgoing perpetrators, on the one side, and the ICC's determination to apply a consistent international anti-impunity norm, on the other. The paper argues that the anti-impunity norm itself is based on a narrowly retributivist conception of criminal justice. A broader norm for democratic accountability, by contrast, would continue to prefer prosecutions over amnesties in international law, less for the opportunity for deserved retribution for perpetrators than for the public enactment of the deliberative procedures associated with the rule of law.Keywords: amnesty; impunity; international law; international criminal court. Perhaps no term in the geological lexicon excites more passions than uniformitarianism, whose motto is “the present is the key to the past.” The term is controversial in part because it contains several meanings, which have been implicated in creating a situation of “semantic chaos” in the geological literature. Yet I argue that debates about uniformitarianism do not arise from a simple chaos of meanings. Instead, they arise from legitimate disagreements about substantive questions. While emotions inform judgment across many domains, they can also lead to ethical failures that could be avoided by using a more deliberative, analytical decision-making process. In this article, we describe joint evaluation as an effective tool to help decision makers manage their emotional assessments of morality.

Few of Stephen Jay Gould’s accomplishments in evolutionary biology have received more attention than his hierarchical theory of evolution, which postulates a causal discontinuity between micro- and macroevolutionary events. But Gould’s hierarchical theory was his second attempt to supply a theoretical framework for macroevolutionary studies—and one he did not inaugurate until the mid-1970s. In this paper, I examine Gould’s first attempt: a proposed fusion of theoretical morphology, multivariate biometry and the experimental study of adaptation in fossils. This early “macroevolutionary synthesis” (...) was predicated on the notion that parallelism and convergence dominate the history of higher taxa, and moreover, that they can be explained in terms of adaptation leading to mechanical improvement. In this paper, I explore the origins and contents of Gould’s first macroevolutionary synthesis, as well as the reasons for its downfall. In addition, I consider how various developments during the mid-1970s led Gould to identify hierarchy and constraint as the leading themes of macroevolutionary studies—and adaptation as a macroevolutionary red herring. Viewed from a first-person perspective consciousness appears to be necessary for complex, novel human activity - but viewed from a third-person perspective consciousness appears to play no role in the activity of brains, producing a "causal paradox". To resolve this paradox one needs to distinguish consciousness of processing from consciousness accompanying processing or causing processing. Accounts of consciousness/brain causal interactions switch between first- and third-person perspectives.
