Artificial agents create significant moral opportunities and challenges. Over the last two decades, discourse has largely focused on the concept of a ‘responsibility gap.’ We argue that this concept is incoherent, misguided, and diverts attention from the core issue of ‘control gaps.’ Control gaps arise when there is a discrepancy between the causal control an agent exercises and the moral control it should possess or emulate. Such gaps present moral risks, often leading to harm or ethical violations. We propose a (...) second-order ‘duty of moral control’ that mandates closing these gaps to reduce risks within acceptable moral limits. Our analysis encompasses both autonomous machines and collective agents, acknowledging their similarities and key differences in constitution and moral status. We suggest four methods to close control gaps: ensuring artificial agents attain moral agency, providing meaningful human control, implementing safety engineering, and employing social control. These methods aim to responsibly integrate artificial agents into society. We conclude that a realistic approach, which addresses the practical problems posed by control gaps, is essential. This approach provides solutions to manage the risks posed by artificial agents while maintaining acceptable moral standards, ensuring we responsibly harness their potential and address the ethical challenges they present. ”Meaningful human control” is a term invented in the political and legal debate on autonomous weapons system, but it is nowadays also used in many other contexts. It is supposed to specify conditions under which an artificial system is under the right kind of control to avoid responsibility gaps: that is, situations in which no moral agent is responsible. Santoni de Sio and Van den Hoven have recently suggested a framework that can be used by system designers to operationalize this (...) kind of control. It is the purpose of this paper to facilitate further operationalization of ”meaningful human control”. -/- This paper consists of two parts. In the first part I resolve an ambiguity that plagues current operationalizations of MHC. One of the design conditions says that the system should track the reasons of the relevant agents. This condition is ambiguous between the kind of reasons involved. On one interpretation it says that a system should track motivating reasons, while it is concerned with normative reasons on the other. Current participants in the debate interpret the framework as being concerned with (something in the vicinity of) motivating reasons. I argue against this interpretation by showing that meaningful human control requires that a system tracks normative reasons. Moreover, I maintain that an operationalization of meaningful human control that fails to track the right kind of reasons is morally problematic.When this is properly understood, it can be shown that the framework of MHC is committed to the agent-relativity of reasons. More precisely, I argue in the second part of this paper that if the tracking condition of MHC plays an important role in responsibility attribution (as the proponents of the view maintain), then the framework is incompatible with first-order normative theories that hold that normative reasons are agent-neutral (such as many versions of consequentialism). In the final section I present three ways forward for the proponent of MHC as reason-responsiveness. (shrink)

The view defended in this paper - I call it the No-Assertion view - rejects the assumption that it is theoretically useful to single out a subset of sayings as assertions: (v) Sayings are governed by variable norms, come with variable commitments and have variable causes and effects. What philosophers have tried to capture by the term 'assertion' is largely a philosophers' invention. It fails to pick out an act-type that we engage in and it is not a category we (...) need in order to explain any significant component of our linguistic practice. Timothy Williamson (2000) defends a theory of type (i). He says that a theory of assertion has as its goal "[…] that of articulating for the first time the rules of a traditional game that we play" (p. 240). Among those who think we play the game of assertion, there's disagreement about what the rules are. Some think it's a single rule and disagree about what that rule is. Others think the rules change across contexts. According to the No-Assertion view we don’t play the assertion game. The game might exist as an abstract object, but it is not a game you need to learn and play to become a speaker of a natural language. (shrink)

This essay critically examines some classic philosophical and legal theories of privacy, organized into four categories: the nonintrusion, seclusion, limitation, and control theories of privacy. Although each theory includes one or more important insights regarding the concept of privacy, I argue that each falls short of providing an adequate account of privacy. I then examine and defend a theory of privacy that incorporates elements of the classic theories into one unified theory: the Restricted Access/Limited Control (RALC) theory of privacy. Using (...) an example involving data-mining technology on the Internet, I show how RALC can help us to frame an online privacy policy that is sufficiently comprehensive in scope to address a wide range of privacy concerns that arise in connection with computers and information technology. By focussing on the logical relations between scientific theories and religious beliefs in his book Where the Conflict Really Lies, Alvin Plantinga overlooks the real conflict between science and religion. This conflict exists whenever religious believers endorse positive factual claims to truth concerning the supernatural. They thereby violate an important rule of scientific method and of common sense, according to which factual claims should be endorsed as true only if they result from validated epistemic methods or sources.

Privacy concerns involving data mining are examined in terms of four questions: What exactly is data mining? How does data mining raise concerns for personal privacy? How do privacy concerns raised by data mining differ from those concerns introduced by traditional information-retrieval techniques in computer databases? How do privacy concerns raised by mining personal data from the Internet differ from those concerns introduced by mining such data from data warehouses? It is argued that the practice of using data-mining techniques, whether (...) on the Internet or in data warehouses, to gain information about persons raises privacy concerns that go beyond concerns introduced in traditional information-retrieval techniques in computer databases and are not covered by present data-protection guidelines and privacy laws. This paper introduces the concept of Operator Contestability in AI systems: the principle that those overseeing AI systems (operators) must have the necessary control to be accountable for the decisions made by these algorithms. We argue that designers have a duty to ensure operator contestability. We demonstrate how this duty can be fulfilled by applying the'Design for Defeaters' framework, which provides strategies to embed tools within AI systems that enable operators to challenge decisions. Defeaters are designed to contest either the (...) justification for the AI’s data inputs (undercutting defeaters) or the validity of the conclusions drawn from that data (rebutting defeaters). To illustrate the necessity and application of this framework, we examine case studies such as AI-driven recruitment processes, where operators need tools and authority to uncover and address potential biases, and autonomous driving systems, where real-time decision-making is crucial. The paper argues that operator contestability requires ensuring that operators have (1) epistemic access to the relevant normative reasons and (2) the authority and cognitive capacity to act on these defeaters. By addressing these challenges, the paper emphasizes the importance of designing AI systems in a way that enables operators to effectively contest AI decisions, thereby ensuring that the appropriate individuals can take responsibility for the outcomes of human-AI interactions. Nietzsche's strengths as a critic are widely acknowledged, but his peculiar style of critique is usually ignored as rhetoric, or dismissed as violent or simply incoherent. In this book, Nietzsche's concept of the agon or Wettkampf, a measured and productive form of conflict inspired by ancient Greek culture, is advanced as the dynamic and organising principle of his philosophical practice, enabling us to make sense of his critical confrontations and the much disputed concept of transvaluation or Umwertung. This paper examines the question whether, and to what extent, John Locke’s classic theory of property can be applied to the current debate involving intellectual property rights (IPRs) and the information commons. Organized into four main sections, Section 1 includes a brief exposition of Locke’s arguments for the just appropriation of physical objects and tangible property. In Section 2, I consider some challenges involved in extending Locke’s labor theory of property to the debate about IPRs and digital information. In Section (...) 3, it is argued that even if the labor analogy breaks down, we should not necessarily infer that Locke’s theory has no relevance for the contemporary debate involving IPRs and the information commons. Alternatively, I argue that much of what Locke has to say about the kinds of considerations that ought to be accorded to the physical commons when appropriating objects from it – especially his proviso requiring that “enough and as good” be left for others – can also be applied to appropriations involving the information commons. Based on my reading of Locke’s proviso, I further argue that Locke would presume in favor of the information commons when competing interests (involving the rights of individual appropriators and the preservation of the commons) are at stake. In this sense, I believe that Locke offers us an adjudicative principle for evaluating the claims advanced by rival interests in the contemporary debate about IPRs and the information commons. In Section 4, I apply Locke’s proviso in my analysis of two recent copyright laws: the Copyright Term Extension Act (CTEA), and the Digital Millennium Copyright Act (DMCA). I then argue that both laws violate the spirit of Locke’s proviso because they unfairly restrict the access that ordinary individuals have previously had to resources that comprise the information commons. Noting that Locke would not altogether reject copyright protection for IPRs, I conclude that Locke’s classic property theory provides a useful mechanism for adjudicating between claims about how best to ensure that individuals will be able to continue to access information in digitized form, while at the same time also allowing for that information to enjoy some form of legal protection. Heidegger denied that his enquiries were concerned with ethics. Heidegger and Ethics questions this self-understanding and reveals a form of ethics in Heidegger’s thinking that is central to his understanding of metaphysics and philosophy. In our technological age, metaphysics has, according to Heidegger, become real- ity; philosophy has come to an end. Joanna Hodge argues that there has been a concomitant transformation of ethics that Heidegger has failed to identify. Today, technological relationships form the ethical relations in which humans find (...) them- selves. As a result, ethics is cut loose from abstract universal moral standards, and the end of philosophy announced by Heidegger turns out to be an interminable interruption of the metaphysical will to completion. In order to realise the produc- tive potential of this interruption, the repressed ethical element in Heidegger’s think- ing must be retrieved. (shrink)

This essay examines issues involving personal privacy and informed consent that arise at the intersection of information and communication technology and population genomics research. I begin by briefly examining the ethical, legal, and social implications program requirements that were established to guide researchers working on the Human Genome Project. Next I consider a case illustration involving deCODE Genetics, a privately owned genetics company in Iceland, which raises some ethical concerns that are not clearly addressed in the current ELSI guidelines. The (...) deCODE case also illustrates some ways in which an ICT technique known as data mining has both aided and posed special challenges for researchers working in the field of population genomics. On the one hand, data-mining tools have greatly assisted researchers in mapping the human genome and in identifying certain “disease genes” common in specific populations. On the other hand, this technology has significantly threatened the privacy of research subjects participating in population genomics studies, who may, unwittingly, contribute to the construction of new groups that put those subjects at risk for discrimination and stigmatization. In the final section of this paper I examine some ways in which the use of data mining in the context of population genomics research poses a critical challenge for the principle of informed consent, which traditionally has played a central role in protecting the privacy interests of research subjects participating in epidemiological studies. The semantic puzzles posed by propositional attitude contexts have, since Frege, been understood primarily in terms of certain substitution puzzles. We will take as paradigmatic of such substitution puzzles cases in which two coreferential proper names cannot be intersubstituted salva veritate in the context of an attitude verb. Thus, for example, the following sentences differ in truth value: (1) Lois Lane believes Superman can fly. (2) Lois Lane believes Clark Kent can fly. despite the fact that "Superman" and "Clark Kent" (...) pick out the same individual.1 Equivalently, the following sentence may be true: (3) Lois Lane believes that Superman can fly, but that Clark Kent cannot fly. despite the coreferentiality of the names. (It will at times be convenient to appeal to this conjunctive attitude report in order to fix a single context of utterance.) Substitution failures such as these create a puzzle when conjoined with the assumptions (a) that attitude reports report a binary relation between an individual and some object of that individual's attitude and (b) that that object of the attitude is determined by the content of the complement sentence in the attitude report. If all of the terms in two complement sentences (e.g., "Superman can fly" and "Clark Kent can fly") have the same semantic content, then, prima facie, they ought to generate the same object of believe and, a fortiori, materially equivalent attitude reports. Frege, famously, attempts to defuse the puzzle by positing a semantic value of sense in addition to that of reference, and thereby distinguishing the semantic contents of the two complement sentences. It is difficult to imagine that a Royal Institute of Physics would organize an annual lecture series on the theme ‘conceptions of physics’. Similarly, it is quite improbable that a Royal Institute of Astronomy would even contemplate inviting speakers for a lecture series called ‘conceptions of astronomy’. What, then, is so special about philosophy that the theme of this lecture series does not appear to be altogether outlandish? Is it, perhaps, that philosophy is the reflective discipline par excellence, so that (...) the very nature of philosophy is a topic that belongs to its domain of investigations? Or is there something more serious at issue? Let me first tell you how the question concerning the nature of philosophy arose for me as a young student, and how I tried to answer it, quite naively, by endorsing Edmund Husserl's programme of turning philosophy into a rigorous science. In a second section, I shall offer three diagnoses of the fact that all such attempts seem to have failed. Finally, I'd like to say a few words on my own research agenda in philosophy and on a public function of philosophers. (shrink)

In this paper an attempt is made to reconstruct the development of Husserl’s conception of intentionality from 1891 up to 1900/01. It is argued that Husserl’s concept of intentionality in the Logical Investigations took shape under the influence of problems originating in two different fields: the philosophy of perception and philosophical semantics. This multiple origin of the concept of intentionality of 1900/01 is then adduced as an explanation of tensions within the text of the Investigations, tensions whieh account for the (...) fact that various contradictory interpretations of Husserl’s concept of intentionality are supported by the texts.The paper starts with a brief and schematic interpretation of Brentano’s Psychology from an Empirical Standpoint. Next, the theory of perception of the ‘Psychological Studies for Elementary Logic’ is compared with that contained in the Investigation’s.On the basis of an analysis of Husserl’s early theory of reference to non-existing referents (‘Intentional Objects’, 1894) and of his criticism of Twardowski, it is concluded that his concept of int.entionality of 1900/01 is not free from ambiguities: Husserl wavers between a non-relational and a relational concept. Finally, it is shown why Husserl’s “official” concept in the Investigations was the non-relational version. (shrink)

In his book Mind and World (1994), John McDowell defends the Kantian position that the content of experience is conceptual. Without this Kantian assumption, he argues, it would be impossible to understand how experience may rationally constrain thought. But McDowell's Kantianism is either false or empty, and his view of the relation between mind and world cannot be stated without transcending the bounds of sense. McDowell's arguments supporting the Kantian thesis, which are very different from Kant's arguments, essentially involve a (...) fallacy of ambiguity. In order to understand how thought may be rationally constrained by experience we should become empiricists. (shrink)

This essay examines Nietzsche’s thought on hatred in the light of the realist and perfectionist impulses of his philosophy. Drawing on remarks scattered across his writings, both unpublished and published, it seeks to reconstruct the “philosophy of hatred‘ that, as he himself observed, “has not yet been written‘. In S1 it is shown that hatred is a necessary ingredient in Nietzsche’s dynamic and pluralist ontology of conflict. Hatred plays an indispensable role in the drive to assimilate or incorporate other life-forms (...) into life’s struggle for expansion and self-overcoming. According to Nietzsche’s philosophical physiology, hatred is greatest where struggle and the resistance to assimilation are greatest; that is, among equal powers. It is also distinguished from revulsion and contempt, since these are attached to the process of excretion, not assimilation. What is more, since genuine hatred serves to assimilate what is more or less equal, it is bound up with love, understood as attraction and the desire to appropriate what we wish to make our own; this is one of several ways in which the opposition between love and hate is overcome. But for Nietzsche, hatred can take a variety of forms, and his distinctive claim is that it need not be a destructive force, but can take creative forms. Two different forms of creative hatred are then examined: an active agonal hatred inter pares that allows for an affirmative pride in one’s enemy ; and the reactive hatred of the “spirit of revenge‘ that gives birth to slave morality. Attending to Nietzsche’s argumentation on the etymological relations between “hatred‘ and “ugliness‘, one can distinguish genuine hatred inter pares, affirmative and creative, from contempt towards what is inferior from a position of strength, and from hatred-as-ressentiment towards what is superior from a position of weakness. Nietzsche’s analysis of the creative hatred that gave birth to slave morality reveals its destructive core in the “imaginary revenge‘ that degrades its noble opponent, raising the problem: How to respond constructively to the necessity of hatred and conflict implied by Nietzsche’s ontology? In the final section, two responses to this problem are considered: on the one hand to seek ways to “improve‘ hatred by drawing on its idealising powers for constructive ends; on the other hand, to use physiological self-knowledge to correct the errors intrinsic to hatred and cultivate an episteme beyond love and hate. These responses can pull in different directions, but they can also be co-ordinated in a way that addresses the realist and perfectionist impulses in Nietzsche’s philosophy. (shrink)

Scepticism and Animal Faith marks a turning point in Santayana’s philosophy leading to the development of his complete naturalism, and, if followed, leads to a decisive change in philosophical inquiry that was a century ahead of his time. Indeed, much of what Santayana explicates in this book is now central to inquiries in the social and biological sciences that attempt to understand human behavior. In short, he turns philosophy on its head. Before Santayana, philosophers often thought humans were distinct from (...) other animals because of their reasoning and their ability to act based on thinking through difficulties and then deciding to proceed in the most beneficial way. This approach was widely endorsed from Plato to American pragmatism. However, Santayana’s orientation is dramatically different focusing on animal faith and not human reason. He is a complete non-reductive naturalist.In this article, I examine the implications of Santayana turning to animal faith as a basis for understanding human action. To the surprise of his contemporaries, he no longer considered humans unique from other animals nor perhaps even more complicated in their interactions with their environment. Mental consciousness or spirit is a reflection, an after effect, of animals acting and responding in a physical environment. He suggests an analogy to the sound of music produced by an orchestra. Consciousness or spirit is not causal. For the most part it is momentary, lasting only so long as it is generated by our physical being, what he calls psyche. Hence, rather than being a philosopher who recognizes reason and mind as unique in causing human action, he notes that our actions, like that of all animals, are caused by our psyche’s physical interaction with its environment. Such a move abandons philosophy as a discipline focusing on reason as the basis for action. One might think this lessens the value of consciousness, but not for Santayana. Spirit is celebrational and to be cherished. Indeed, a principal goal of human life is to cultivate a spiritual life. Santayana’s naturalistic approach also leads to a distinct understanding of human cultures, their value, and the political structures involved in various human organizations. There is no hierarchy of best or better, only the reality of human societies serving their constituents in differing ways, much as we might describe the social structures of other animals. If the goal is to provide the greatest range of opportunities for the greatest number of people, one may find evidence that some societies enable more people to live well, but no one political structure is likely to accomplish that in all human environments. Even so, Santayana explores the natural values of charity and justice as central to human societies enabling individual humans to flourish. (shrink)

Linguist, psychoanalyst, and cultural theorist, Julia Kristeva is one of the most influential and prolific thinkers of our time. Her writings have broken new ground in the study of the self, the mind, and the ways in which we communicate through language. Her work is unique in that it skillfully brings together psychoanalytic theory and clinical practice, literature, linguistics, and philosophy. In her latest book on the powers and limits of psychoanalysis, Kristeva focuses on an intriguing new dilemma. Freud and (...) psychoanalysis taught us that rebellion is what guarantees our independence and our creative abilities. But in our contemporary "entertainment" culture, is rebellion still a viable option? Is it still possible to build and embrace a counterculture? For whom -- and against what -- and under what forms? Kristeva illustrates the advances and impasses of rebel culture through the experiences of three twentieth-century writers: the existentialist John Paul Sartre, the surrealist Louis Aragon, and the theorist Roland Barthes. For Kristeva the rebellions championed by these figures -- especially the political and seemingly dogmatic political commitments of Aragon and Sartre -- strike the post-Cold War reader with a mixture of fascination and rejection. These theorists, according to Kristeva, are involved in a revolution against accepted notions of identity -- of one's relation to others. Kristeva places their accomplishments in the context of other revolutionary movements in art, literature, and politics. The book also offers an illuminating discussion of Freud's groundbreaking work on rebellion, focusing on the symbolic function of patricide in his _Totem and Taboo_ and discussing his often neglected vision of language, and underscoring its complex connection to the revolutionary drive.
