This paper offers a theoretical framework that can be used to derive viable engineering strategies for the design and development of robots that can nudge people towards moral improvement. The framework relies on research in developmental psychology and insights from Stoic ethics. Stoicism recommends contemplative practices that over time help one develop dispositions to behave in ways that improve the functioning of mechanisms that are constitutive of moral cognition. Robots can nudge individuals towards these practices and can therefore help develop (...) the dispositions to, for example, extend concern to others, avoid parochialism, etc. (shrink)

This paper follows on from a brief debate about the role of conscientious objection in healthcare, where the issue arose as to whether conscientious objection is (or can) be a tool of resistance against systemic injustice. The paper contributes to this debate by highlighting that some authors generally opposed to conscientious objection in healthcare have shown some support to this idea. Perhaps if there is one area in which all can agree, it is that in healthcare conscientious objection should be (...) allowed so as to prevent cases of systemic injustice. (shrink)

While there is a prolific debate surrounding the issue of conscientious objection of individuals towards performing certain clinical acts, this debate ignores the fact that there are other reasons why clinicians might wish to object providing specific services. This paper briefly discusses the idea that healthcare workers might object to providing specific services because they are against their professional judgement, they want to maintain a specific reputation, or they have pragmatic reasons. Reputation here is not simply understood as being in (...) good standing with a professional body. Rather, reputation is treated in the sense that a craftsman might wish to be known for providing a specific type, quality, and style of service. Professionalism is understood as acting according to the philosophical and scientific principles that are the basis of healthcare (such as acting for the benefit of the patient’s health and following well- evidenced treatment pathways). In this paper, I discuss the formation of habits with the help of self-tracking technologies. Although devices like Fitbit smart bands come with promises of empowerment through the means of increased control over users’ habits, existing literature does not provide conclusive findings about the validity of such claims. I contribute to the ongoing debate by relying on John Dewey’s pragmatist philosophy and its notion of intelligent habit. I demonstrate that from a pragmatist standpoint, habits that are the most likely to (...) accomplish users’ goals contribute to their flourishing need to be reflective (accompanied by adequate deliberation) and flexible (adaptable to the changing circumstances). On this basis I highlight some ethical-epistemic issues surrounding self-tracking technologies that inhibit the formation of habits desirable from a Deweyan standpoint. These include a lack of reflection on the part of the developers, difficulties for users to deliberate and consciously shape the habits developed by their devices, and dependence upon self-tracking tools that makes it difficult to adapt habits to individual needs and circumstances. I conclude the paper by discussing self-tracking’s general impact on flourishing, as well as placing my arguments in the context of the diversity of self-tracking practices and identifying how users attempt to alleviate the shortcomings of the technology and make it more suitable to their goals and needs. Current developments in reproductive technology forecast that in the foreseeable future artificially generated gametes might be presented as a possible fertility treatment for infertile couples and for homosexual couples desiring to have children genetically originating from both partners. It is important to evaluate the ethical issues connected to this technology before its emergence. This article first reviews the meaning that gametes (sperm and eggs) might have to those who procreate, as well as their ontology. From this, suggestions are made as (...) to what qualities artificially generated gametes need to be truly called gametes. Finally, different proposed routes for artificial gamete generation are examined on the basis of these qualities, with their prospective problems and advantages highlighted. Autotransplanted gametes (or their progenitors) generated solely from patient-derived tissue are deemed to be the most ethically suitable route for the development of this technology. (shrink)

A novel normal form for propositional theories underlies the logic pdl, which captures some essential features of natural discourse, independent from any particular subject matter and related only to its referential structure. In particular, pdlallows to distinguish vicious circularity from the innocent one, and to reason in the presence of inconsistency using a minimal number of extraneous assumptions, beyond the classical ones. Several, formally equivalent decision problems are identified as potential applications: non-paradoxical character of discourses, admissibility of arguments in argumentation (...) networks, propositional satisfiability, and the existence of kernels of directed graphs. Directed graphs provide the basis for the semantics of pdl and the paper concludes by an overview of relevant graph-theoretical results and their applications in diagnosing paradoxical character of natural discourses. Fazekas and Overgaard () present a novel, multidimensional model that explains different ways in which conscious representations can be degraded. Moreover, the authors discuss possible mechanisms that underlie different kinds of degradation, primarily those related to attentional processing. In this letter, we argue that the proposed mechanisms are not sufficient. We propose that attentional mechanisms work differently at various processing stages; and factors that are independent of attentional ones, such as expectation, previous experience, and context, should be accounted for if (...) we are aiming to construct a comprehensive model of conscious visual perception. The purpose of this article is to discuss Kant’s concept of juridical state as the foundation of the contemporary rule of law. Therefore, the article tries to answer two questions: (1) what character can be attributed to Kant’s concept of juridical state taking into account the obligations arising from it; (2) can the analysis of the Kantian juridical state have any impact on the contemporary understanding of the rule of law and if so, what can this impact be. In order (...) to accomplish this task, moral presuppositions of Kant’s juridical state are discussed, according to the commonly accepted view that Kant’s political philosophy is closely linked with his moral and ethical reflection. Then, two interpretations of Kant’s juridical state – the liberal one and the authoritarian one – are analysed. The crucial difference between these interpretations lies in establishing the circumstances in which the duty of obedience to state power should be carried out. Then, Kantian juridical state is compared with two ways of understanding the rule of law – the material one and the formal one – in order to evaluate whether the rule of law should be considered as continuity of or rupture with the Kantian concept. Despite the fact that Husserl did not write a book on aesthetics, it is widely accepted that a Husserlian aesthetics can be developed from his writings. In this article, I describe and analyze a feature of Husserlian aesthetics which I call the “radical individuality of the aesthetic object.” This radical individuality stems from Husserl’s interpretation of aesthetic consciousness in terms of the neutrality modification. I make the case for a radical reading of the neutrality modification by contrasting it with the (...) inactuality modification and the notion of foundation and I argue that the neutrality modification must be kept distinct from these concepts. I further describe the concept of the radical individuality of the aesthetic object by reference to Ingarden’s notion of the aesthetic object as monosubjective. The thesis of the radical individuality of the aesthetic object prima facie leads Husserlian aesthetics close to axiological relativism expressed in the adage that de gustibus non est disputandum. I explain that despite such proximity, Husserlian aesthetics does not entail an axiological relativism and does not preclude discussions concerning aesthetic values. On the contrary, Husserlian aesthetics ultimately shows that such discussions are necessary for keeping the possibility of aesthetic perception itself alive, and thereby encourages such discussions. I conclude with a practical demonstration of the results of my Husserlian analyses by critically engaging some aspects of Proust’s theory of art in À la recherche du temps perdu. (shrink)

It causes many difficulties for jurisprudence to define the notion of judicial activism. At the very beginning it had rather a journalistic character, but but over time it has become a serious charge against these judges who act on the basis of their vision of what the law ought to be like rather than what it actually is like. On the ground of the polish legal theory the echoes of the dispute about judicial activism are reflected in the discussions about (...) the nature of legal interpretation. Transposing the problem of activism into the problem of interpretation allows the use of analysis tools that were previously unavailable. One of these tools are concepts emerged on the neopragmatist philosophy of Stanley Fish. Fish tries to describe the nature of the interpretation in the context of reader-response criticism and the concept of interpretive communities. Application of Fish's philosophy in the field of legal theory provides constructive conclusions about the concepts of judicial activism and judicial law-making. (shrink)

In the posthumously published ‘Future People, the Non-Identity Problem, and Person-Affecting Principles’, Derek Parfit presents a novel axiological principle which he calls the Wide Dual Person-Affecting Principle and claims that it does not imply the Repugnant Conclusion. This paper shows that even the best version of Parfit's principle cannot avoid this conclusion. That said, accepting such a principle makes embracing the Repugnant Conclusion more justifiable. This paper further addresses important questions which Parfit left unanswered concerning: the relative importance of individual (...) and collective goodness, comparisons involving unequal outcomes, how to understand individual goodness, and whether incomparability at the level of individual goodness implies incomparability at the level of overall goodness. This text is a kind of sketch and presents some simple ideas. The aim of this article is to carry out a critical and reflexive analysis of Roman Ingarden's philosophy of responsibility. Being a member of the phenomenological current, Ingarden mainly studied the ontological bases or conditions of responsibility by identifying different situations of responsibility. In this paper situations of responsibility have been analysed in the semantic contexts in which the word "responsibility" appears. Legally, the prescriptive contexts of using the (...) word "responsibility" are particularly important since they are usually either ignored or inadequately separated from descriptive contexts. Roman Ingarden's views were supplemented by Alf Ross's aspects of responsibility. As a result, the elementary ways of understanding responsibility have been reconstructed; they are the basis for reflections on moral responsibility as well as legal responsibility. (shrink)

Neuroscience is a fascinating discipline – its dynamic progress has led to the emergence of new interdisciplinary research programmes with great potential. One of these research areas is neuroeconomics. As will be shown in this article, this discipline, which is difficult to clearly characterize and define, is faced with many problems. This paper argues that social scientists should be interested in the problems and tendencies in social neuroscience for several reasons. Neuroeconomics, and other disciplines inspired by neuroscience, will compete with (...) their parent disciplines in many fields of interest. On one hand it will be necessary for scientists to define and defend the irreplaceable roles of their disciplines, but also critically evaluate the potential of new approaches on the other. In the context of this discussion, which reopens questions about the scientific status of economics and its roles, this paper introduces the main problems related to neuroeconomics. This paper concludes that these problems represent a wide domain for social scientists and methodologists of science. (shrink)

The purpose of the paper is to analyze the thesis that an agreement between representatives of two different cultures can and should be reached at a theoretical level. The author tries to verify the Theory of Communicative Action proposed by Jürgen Habermas in the light of philosophical reflections of American neopragmatist Stanley Fish. Habermas is one of the most important and widely read social theorists in the post-Second World War era. He is also one of the authors of the concept (...) of deliberative democracy, which holds that, for a democratic decision to be legitimate, it must be preceded by authentic deliberation – disinterested exchange of reasons – not merely the aggregation of preferences that occurs in voting. The foundation of deliberative democracy is, according to the German thinker, a communicative action based on communicative rationality. Stanley Fish, in turn, is one of the most eminent American philosophers of the twentieth and twenty-first centuries. The main area of his scientific activity is the theory of literature, law, and history. In the course of his reflections, Fish constructed the concept of an interpretive communities, which implies an original view on the nature of the process of cognition, status of human convictions or beliefs, nature of communication situation and capabilities of theory. The final conclusion stemming from the reflection on Fish’s philosophy explains why Habermas’ theory is not an adequate tool to reach an intercultural agreement. (shrink)

Stať se snaží analyzovat myšlenky málo známého rukopisu Sigmunda Freuda z roku 1895, v němž usiloval o nalezení biologických základů lidské psychiky. Tato práce je pozoruhodná ze dvou důvodů. Jednak představuje úvahy, které se výrazně od- lišují od toho, co je pro Freuda v oblasti psychologie tak typické. Freud se zde, až na výjimky, nezabývá psychoanalýzou či studiemi o hysterii, nýbrž popisuje, co by mohlo být základem těchto psychologických jevů na neurofyziologické úrovni. Druhým pozoruhodným faktem je, že tento manuskript byl (...) pozapome- nut až do poloviny 20. století, kdy byl vytištěn pod názvem Projekt vědecké psychologie. A jak je známo, neurofyziologická studia lidské mysli spojená s analýzou kognitivních funkcí se v ri- gorózní podobě objevují až na počátku 60. let. Stať se proto pokouší ukázat základní principy Projektu a naznačit, v čem byl Freud inspirativním průkopníkem moderních neurofyziologických přístupů k lidské mysli. (shrink)

There is an ethical dilemma present when considering updating predictive clinical artificial intelligence (AI) models, which should be part of the departmental quality improvement process. One needs to consider whether withdrawing the AI model is necessary to obtain the relevant information from a naive patient population or whether to use causal inference techniques to obtain this information. Withdrawing an AI model from patient care might pose challenges if the AI model is considered standard of care, while use of causal inference (...) will not be reliable if the relevant statistical assumptions do not hold true. Hence, each of these two updating strategies is associated with patient risks, but lack of reliable data might endanger future patients. Similarly, not withdrawing an outdated AI might also expose patients to risk. Here I propose a high level ethical framework – epistemic risk management - that provides guidance for which route of model updating should be taken based on the likelihood of the assumptions used during the creation of the original AI model and the assumptions required for causal inference holding true. This approach balances our uncertainty about the status of the AI as standard of care with the risk of not obtaining the necessary data, so as to increase the probability of benefiting current and future patients for whose care the AI is being used. The characteristic asymmetry in the attribution of intentionality in causing side effects, known as the Knobe effect, is considered to be a stable model of human cognition. This article looks at whether the way of thinking and analysing one scenario may affect the other and whether the mutual relationship between the ways in which both scenarios are analysed may affect the stability of the Knobe effect. The theoretical analyses and empirical studies performed are based on a distinction between moral and (...) non-moral normativity possibly affecting the judgments passed in both scenarios. Therefore, an essential role in judgments about the intentionality of causing a side effect could be played by normative competences responsible for distinguishing between normative orders. (shrink)

De Dreu and Gross (D&G) seem to have disregarded some relevant experimental literature on games of conflict, most notably variations on “matching pennies” games. While in such games, “attacker” and “defender” are typically not explicitly labelled, players’ differentiated roles yield naturally to such notions. These studies partly validate some of D&G's findings and interpretations.

Post-truth is described as a phenomenon existing at the public sphere, which consists in special emphasis on the ideologic aspect of expression, while at the same time marginalizing aspect of facts. it seems that in looking for the reasons for this behavior, statement that this practice is simply more effective is insufficient. It's not possible to describe well the phenomenon of post-truth without analyzing transformations of the epistemological plane from which the phenomenon of post-judgment emerged. One of the most important (...) moments in history that could serve as a point of reference for these considerations may be the modern project, which was especially developed in philosophy of Immanuel Kant. His epistemology, based on Enlightend Reason, says that objective truths may be obtained through empirical cognition. The rejection of this approach can be linked to the fragmentation of the Logos, which consisted in the recognition that there is no point of reference capable of guaranteeing and justifying the only true, objective cognition. Thus it seems that the fact, that in public debates rhetoric wins over dialectic, is closely related to the transformations that have taken place on the philosophical plane. (shrink)

Digraphs provide an alternative syntax for propositional logic, with digraph kernels corresponding to classical models. Semikernels generalize kernels and we identify a subset of well-behaved semikernels that provides nontrivial models for inconsistent theories, specializing to the classical semantics for the consistent ones. Direct (instead of refutational) reasoning with classical resolution is sound and complete for this semantics, when augmented with a specific weakening which, in particular, excludes Ex Falso. Dropping all forms of weakening yields reasoning which also avoids typical fallacies (...) of relevance. (shrink)

This paper investigates the phenomenon of judicial law-making in the practice of the highest courts dealing with criminal matters in Germany and Poland on the basis of 200 of their decisions. While German jurisprudence principally acknowledges the right of the judiciary to create new law, the Polish legal theory generally rejects this notion. Still, research indicates that, in practice, the differences in the frequency and intensity with which these courts pass creative rulings are not as substantial as the discrepancy in (...) the theoretical stance would suggest. Owing to circumstances, both the German Federal Court of Justice and the Polish Supreme Court are willing to create new legal norms, but the dimensions of judicial law-making presented by these bodies deviate from each other. In the research sample, the German Federal Court of Justice was more inclined to introduce legal institutions that were foreign to the statutes and rule against the will of the lawmaker explicitly stated in the preparatory works. On the other hand, the Polish Supreme Court used logical conclusions more often, but did not also refrain from passing rulings against the clear wording of the statutory law, and was just as willing to go beyond the wording of the law as was the German Federal Court of Justice. Notably, only the German apex court is willing to openly admit that it creates new legal norms, whereas the Polish Supreme Court does not concede in the reasons that its decisions are of a law-making nature, especially when it applies so-called “interpretation in the wider sense”—which is, in essence, a “concealed” way of creating new legal norms. The paper deals with Martin Buber’s claim that responsibility “is the basic theme of my work in general.” As I show in the opening section of the article, his statement applies to the dialogical period of his work, but not the pre-dialogical. In the mystical phase of Buber’s thought there is no place for responsibility because the very nature of mysticism excludes that possibility. The incompatibility of mysticism and interpersonal responsibility is confirmed in the autobiographical fragment “conversion,” one of the (...) two biographical moments I discuss in relation to the shift in his thinking on responsibility. The second is his relationship with his wife Paula Winkler, which profoundly influenced his thinking about the importance of love and marriage for an understanding of responsibility. I then explore his view of responsibility as a doctrine, which developed along with his dialogical philosophy. Finally, I examine his critical views on four basic ways of avoiding responsibility, which highlight the close connection between freedom and responsibility: belief in fate, individualism, collectivism, and religious acosmism. This is the editorial of the monothematic issue of the journal Filozofia dedicated to Martin Buber (1878 – 1965) on the occasion of the centenary of the first publication of his most famous and popular book, I and Thou, on his philosophy of dialogue.

Research on intergroup emotions has largely focused on the experience of emotions and surprisingly little attention has been given to the expression of emotions. Drawing on the social-functional approach to emotions, we argue that in the context of intergroup conflicts, outgroup members’ expression of disappointment with one’s ingroup induces the complementary emotion of collective guilt and correspondingly a collective action protesting ingroup actions against the outgroup. In Study 1 conducted immediately after the 2014 Gaza war, Jewish-Israeli participants received information about (...) outgroup’s expression of emotions. As predicted, outgroup’s expression of disappointment increased collective guilt and willingness to participate in collective action, but only among those who saw the intergroup situation as illegitimate. Moreover, collective guilt mediated the relationship between disappointment expression and collective action, moderated, again, by legitimacy perception. In Study 2, we replicated these results in the context of racial tension between Black and White Americans in the US. We discuss the theoretical and applied implications of the findings. (shrink)

This article utilises feminist technoscience studies’ notions of bodily ‘materialisation’ and ‘ontological choreographies’, offering a cyborg feminist account of ‘bioavailability’ as embodied becomings, rather than a fixed ontological state of being. Drawn from 2 years’ ethnographic study in in vitro fertilisation clinics in Spain with migrant women who provided eggs to the cross-border in vitro fertilisation industry, this work explores how global understandings of race and inequalities, clinical practices and women’s own emotional and physical labours collectively produce bioavailability. Through examples (...) from observations and interviews in in vitro fertilisation clinics, we examined women’s embodied stories to understand the ways in which bioavailability becomes. The article demonstrates a novel way in which to think about ‘bioavailability’, a concept which has already been of enormous use to the social sciences since its introduction by Lawrence Cohen. We examine recent configurations of bodily extraction in the reproduction–migration nexus that help us rethink the concept of bioavailability. (shrink)

Jan Franciszek Drewnowski był filozofem zaliczanym do środowiska szkoły lwowsko-warszawskiej, współtwórcą koła krakowskiego, oficerem wojska polskiego, pracownikiem wydawnictw technicznych. Drewnowski doktoryzował się u T. Kotarbińskiego, jego niedoścignionym mistrzem był Stanisław Leśniewski. Był jednym z pierwszych słuchaczy akademickich wykładów Leśniewskiego. Studiował na Wydziale Filozoficznym Uniwersytetu Warszawskiego: matematykę, logikę matematyczną i – jak to wtedy nazywano – filozofię naukową. Tam właśnie spotkał ks. Jana Salamuchę, który zaimponował Drewnowskiemu naukową erudycją, a intelektualną uczciwością skierował go od ateizmu ku katolickiej mistyce. W ten sposób (...) Drewnowski wpisał się w grono intelektualnych konwertytów XX wieku, co ma znaczenie także dla jego dorobku. (shrink)

Here, the history of philosophy is used to conceptualize the problems of the present and, in fact, those that are enduring. W państwach, które określają się demokratycznymi, są takie cykliczne momenty, które mobilizują sporą część społeczeństwa. Mobilizacja ta widoczna jest w różnych obszarach, które dotyczą przestrzeni publicznej: w jednostkach samorządu terytorialnego, w organach władzy samorządowej i centralnej, w środkach społecznego przekazu, we wspólnotach religijnych itd. Ta pewnego rodzaju „nadaktywność” wynika z tego, iż w porządku demokratycznym władze są wybierane przez lud poprzez akt wyborczy. Doświadczenie życiowe oraz przykład polskiej demokracji po 1989 r. pokazuje, iż powyższe założenia w przeważającej części nie zawsze (...) są realizowane. Można jednak mówić o przynajmniej dwóch niepożądanych działaniach kandydatów w ramach kampanii wyborczej: obietnicach wyborczych i korupcji wyborczej. Celem artykułu jest przedstawienie problematyki dotyczącej korupcji wyborczej w świetle etyki personalistycznej. Wybór, pomimo że subiektywny, wydaje się uzasadniony z tego powodu, iż personalizm dotyka kwestii problemów społeczno-politycznych z perspektywy koncepcji dobra wspólnego. (shrink)
