La présente contribution met en évidence le rôle fondamental du principe de précaution dans l’élaboration et la mise en œuvre de l’Union bancaire. Trois piliers la composent, le Mécanisme de supervision unique, le Mécanisme de résolution unique et le Système unifié de protection des dépôts, reflètant en forme pyramidale une approche graduée du risque systémique. La montée en puissance de l’usage des technologies de gouvernance algorithmique pour traiter les opérations financières sur les marchés engendre de nouveaux types de risques, liés (...) à la vitesse et au volume inédits des ordres traités à l’intervention de robots. Pour tenter d’en désamorcer les dangers, les régulateurs ont recours au même type d’instruments automatisés, de manière à ajuster leur vitesse de réaction à celle des transactions à contrôler. Enfin, le phénomène de génération de monnaies privées par des mécanismes de cryptographie autocertifiés, telle la blockchain, en ce qu’ils cherchent à se passer de l’appareil d’État, représentent un défi pour la souveraineté des autorités en charge de politiques publiques, fondées sur un socle de légitimité constitutionnelle. Là encore, le principe de précaution invite à mettre en place une monnaie de même nature mais non affranchie de tout système juridique l’encadrant. Le processus est à l’étude au sein de l’Union européenne et de certains Etats membres, dont la France. (shrink)

Epistemological differences fuel continuous and frequently divisive debates in the social sciences and the humanities. Sociologists have yet to consider how such differences affect peer evaluation. The empirical literature has studied distributive fairness, but neglected how epistemological differences affect perception of fairness in decision making. The normative literature suggests that evaluators should overcome their epistemological differences by ‘‘translating’’ their preferred standards into general criteria of evaluation. However, little is known about how procedural fairness actually operates. Drawing on eighty-one interviews with (...) panelists serving on five multidisciplinary fellowship competitions in the social sciences and the humanities, we show that Evaluators generally draw on four epistemological styles to make arguments in favor of and against proposals. These are the constructivist, comprehensive, positivist, and utilitarian styles; and Peer reviewers define a fair decision-making process as one in which panelists engage in ‘‘cognitive contextualization,’’ that is, use epistemological styles most appropriate to the field or discipline of the proposal under review. Au xviie siècle, la question de la durée de la vie fait l’objet d’un nouveau traitement en termes d’arithmétique politique. Cette mathématisation, avec la construction de la notion de « vie moyenne », permet une intégration de l’art de prolonger la vie aux techniques de gouvernement. Élaborée dans le cadre des pratiques financières de rentes viagères, la notion émigre vers l’économie politique, où la vie n’est plus conçue comme support d’intérêts mais comme force productive. La question fut posée au sujet de l’inoculation de la petite vérole. Michel Senellart Cet article propose une réponse à la critique adressée par G. Agamben, dans Le Règne et la Gloire (2008), à la généalogie foucaldienne de la gouvernementalité. En cherchant dans la pensée chrétienne des premiers siècles la matrice d’une conception nouvelle du pouvoir comme gouvernement des hommes — « économie » ou conduite des âmes —, Foucault aurait méconnu la signification proprement théologique, au sein du dispositif trinitaire, du mot oikonomia. Nous voudrions montrer, à partir d’une relecture du 2e (...) Discours (362) de Grégoire de Nazianze (329-390), dont Foucault tire le concept d’une « économie des âmes », que cette idée ne présuppose nullement la référence au schéma trinitaire et renvoie bien davantage au modèle du « patronage » romain, couplé à la figure sacerdotale du bon berger. Cette analyse conduira, en outre, à rappeler le lien de la « direction des âmes » avec le paradigme médical. (shrink)

Este artículo pretende mostrar las aportaciones del pensador francés Michel de Certeau, sobre el proceso de surgimiento de las instituciones sociales. Para ello he analizado, en el marco de la antropología certeauniana del creer, su texto Une politique de la langue, en el que Certeau aborda el proyecto del Abbé Gregoire para imponer el francés sobre los patois a finales del siglo XVIII. Puede concluirse, tras este análisis, que las instituciones se fundan siguiendo un proceso en tres fases: la (...) definición clara de las creencias básicas o principios rectores de la institución ; el desplazamiento de los principios alternativos con los que compite ; y la lucha contra la resistencias que ofrecen las antiguas creencias. Karl Polanyi is one of the most influential social scientists of our era. This article argues that beneath the veneer of legitimacy in the organ, tissue, and body part transplantation systems exists a horrifying history of human commodification whose vestiges surprisingly linger in contemporary supply and allocation systems. This history, as the Article demonstrates, dates back to the colonial period in the United States, where “grave robbing” became an important feature in the advancement of medicine. This legacy lives on.

In this paper we discuss an often-neglected topic in the literature on the ethics of voting. Our aim is to provide an account of what states are obligated to do, so that voters may fulfil their role as public decision-makers in an epistemically competent manner. We argue that the state ought to provide voters with what we call a substantive opportunity for competence. This entails that the state ought to actively foster the epistemic capabilities that are necessary to achieve competent (...) participation in political decision-making practices. (shrink)

Marginal structural models can be used to estimate the causal effect of a potentially time-varying treatment in the presence of time-dependent confounding via weighted regression. The standard approach of using inverse probability of treatment weighting can be sensitive to model misspecification and lead to high-variance estimates due to extreme weights. Various methods have been proposed to partially address this, including covariate balancing propensity score to mitigate treatment model misspecification, and truncation and stabilized-IPTW to temper extreme weights. In this article, we (...) present kernel optimal weighting, a convex-optimization-based approach that finds weights for fitting the MSMs that flexibly balance time-dependent confounders while simultaneously penalizing extreme weights, directly addressing the above limitations. We further extend KOW to control for informative censoring. We evaluate the performance of KOW in a simulation study, comparing it with IPTW, sIPTW, and CBPS. We demonstrate the use of KOW in studying the effect of treatment initiation on time-to-death among people living with human immunodeficiency virus and the effect of negative advertising on elections in the United States. In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. Ethical reflection on Artificial Intelligence (AI) has become a priority. In this article, we propose a methodological model for a comprehensive ethical analysis of some uses of AI, notably as a replacement of human actors in specific activities. We emphasize the need for conceptual clarification of relevant key terms (e.g., intelligence) in order to undertake such reflection. Against that background, we distinguish two levels of ethical analysis, one practical and one theoretical. Focusing on the state of AI at present, we (...) suggest that regardless of the presence of intelligence, the lack of morally relevant features calls for caution when considering the role of AI in some specific human activities. In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. Finally, we propose a research design that takes into account endogeneity issues arising when examining compensation variables. (shrink)

Hermann's Weyl Das Kontinuum has inspired several studies in logic and foundations of mathematics over the last century. The book provides a remarkable reconstruction of a large portion of classical mathematics on a predicative basis. However, diverging interpretations of the predicative system formulated by Weyl have been proposed in the literature. In the present work, I analyze an early formalization of Weyl's ideas proposed by [Casari, E. 1964. Questioni di Filosofia Della Matematica, Milano: Feltrinelli] and compare it with other, more (...) well-known, accounts, such as those proposed respectively by Feferman and Avron. In this way, I fill a gap in the literature on Weyl's predicative mathematics by shedding light on an interpretation that has never been studied. Moreover, Casari's work is plausibly the first systematic reconstruction of Weyl's system. In particular, I highlight the different insights about predicativity that can be found in Weyl's work. Casari's reconstruction focuses on the logical and mathematical processes described by Weyl in the first part of his book. Through the analysis of this unexplored perspective, I shed light on fundamental aspects of Weyl's work and elucidate the alleged ambiguities it presents. In particular, in line with Avron's most recent reconstruction of Weyl's ideas, this analysis supports a stronger conception of predicativity than what is commonly attributed to Weyl in the literature. As a result, this work not only provides an analysis of a neglected interpretation of Das Kontinuum, but also contributes to elucidating Weyl's classical conception of predicativity. (shrink)

This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

War is being privatized at an accelerating rate. This paper suggests that the benefits from privatizing war accrue to the political and economic elite in thatprivatization reduces the political costs of war, allows for state crimes to be committed by proxy, turns war into a free crime zone, and has created new opportunities for war profiteering. However, the benefits to the political and economic elite are not without their costs to the remainder of the population. The capital accumulation process impels (...) companies to expand their markets in order to survive and grow, focus on efficiency in order to maximize profits, and concentrate on fulfilling the contract terms in order to acquire more business. The paper demonstrates how the introduction of these motives has negatively impacted the war in Iraq and foreign affairs. (shrink)

Like COVID-19, new infectious disease outbreaks emerge almost annually, and studies predict that this trend will continue due to a variety of factors, including an aging population, ease of travel, and globalization of the economy. In response to episodic public health crises, governments and organizations develop, implement, and enforce policies, procedures, protocols, and programs. The epidemiological triad is both a model of disease causation and fundamentally used to design and deploy such control measures. Here we adapt this model to the (...) workplace setting and use the epidemiological triad to characterize the related ethical challenges in implementing the control measures employers face as a guide for a workplace intervention framework. Through this approach, our aim is to show how an integrated ethical framework, grounded in epidemiological principles, has important implications for how we categorize, understand, and resolve the difficult decisions that emerge in the workplace under pandemic conditions. La interpretación monista de la ontología de Parménides aquí propuesta parece confirmada por la lógica ineludible que impregna enteramente su pensamiento. A pesar del carácter fragmentario de su poema, es posible reconstruir la férrea racionalidad de la ontología parmenídea. Esta lógica intrínsecamente coherente pone de manifiesto la absoluta necesidad de la naturaleza monística del ser. En esta perspectiva parece evidente la absoluta incompatibilidad de la perfecta racionalidad y coherencia de la verdad con la dimensión engañosa e inconsistente de la doxa.

Two literal quotations from Chrysippus’ On Possibles, preserved in Plutarch’s On the Contradictions of the Stoics, seem to contradict the Stoic thesis of the isotropy of the void. According to this thesis the void is an infinite undifferentiated expanse whose center is marked by, and coincides with, the position of the world. Since there is nothing else outside the world, the cohesive force that pervades it is sufficient on its own to guarantee the quasi–indestructibility of the trans–cyclical διακόσμησις and the (...) eternity of the οὐσία. Conversely, in these two quotations Chrysippus maintains that there is a central διαφορά equipped with causal force. This seems to imply the anisotropy of the void. Chrysippus’s view here is also at odds with another official Stoic thesis, i.e. that the incorporeal is causally inert. In this paper it will be argued that there is in fact no contradiction, because, in those two quotations, Chrysippus consciously develops a cosmological hypothesis in order to resolve a difficulty concerning the role of fire during the universal conflagration. Chrysippus’ solution to this difficulty belongs to modal logic and consists in distinguishing between the actual universe and the possible ones. (shrink)

The study of legal transplants provides a vital critical supplement to mainstream theories about legal change. Legal transplants are not exceptional or isolated occurrences, despite the economic, social, political and cultural barriers that separate the world’s legal systems. This Article goes beyond traditional approaches to the study of transplants by substituting the figurative language of transplants with explicit theory about how legal change is produced. It first provides a brief account of what the literature on legal transplants has achieved so (...) far in terms of "macro" explanations of legal change currently available. It then argues that legal transplants as social acts performed by individuals call for a study of the "micro" level of engagement with legal change by individuals. The key notion that is advanced to explore this dimension is the notion of mediated action, which denotes action that is performed by individuals making use of features of the environment as tools to interact in a specific setting. The notion of mediated action was first introduced in cultural-historical psychological investigations of the social formation of the mind. As social acts, legal transplants represent instances of mediated action. The last part of this Article highlights how legal transplants raise questions of justice and discusses briefly how the new approach to the study of transplants advocated here relates to them.
