La présente contribution met en évidence le rôle fondamental du principe de précaution dans l’élaboration et la mise en œuvre de l’Union bancaire. Trois piliers la composent, le Mécanisme de supervision unique, le Mécanisme de résolution unique et le Système unifié de protection des dépôts, reflètant en forme pyramidale une approche graduée du risque systémique. La montée en puissance de l’usage des technologies de gouvernance algorithmique pour traiter les opérations financières sur les marchés engendre de nouveaux types de risques, liés (...) à la vitesse et au volume inédits des ordres traités à l’intervention de robots. Pour tenter d’en désamorcer les dangers, les régulateurs ont recours au même type d’instruments automatisés, de manière à ajuster leur vitesse de réaction à celle des transactions à contrôler. Enfin, le phénomène de génération de monnaies privées par des mécanismes de cryptographie autocertifiés, telle la blockchain, en ce qu’ils cherchent à se passer de l’appareil d’État, représentent un défi pour la souveraineté des autorités en charge de politiques publiques, fondées sur un socle de légitimité constitutionnelle. Là encore, le principe de précaution invite à mettre en place une monnaie de même nature mais non affranchie de tout système juridique l’encadrant. Epistemological differences fuel continuous and frequently divisive debates in the social sciences and the humanities. Sociologists have yet to consider how such differences affect peer evaluation. The empirical literature has studied distributive fairness, but neglected how epistemological differences affect perception of fairness in decision making. The normative literature suggests that evaluators should overcome their epistemological differences by ‘‘translating’’ their preferred standards into general criteria of evaluation. However, little is known about how procedural fairness actually operates. Drawing on eighty-one interviews with (...) panelists serving on five multidisciplinary fellowship competitions in the social sciences and the humanities, we show that Evaluators generally draw on four epistemological styles to make arguments in favor of and against proposals. These are the constructivist, comprehensive, positivist, and utilitarian styles; and Peer reviewers define a fair decision-making process as one in which panelists engage in ‘‘cognitive contextualization,’’ that is, use epistemological styles most appropriate to the field or discipline of the proposal under review. Au xviie siècle, la question de la durée de la vie fait l’objet d’un nouveau traitement en termes d’arithmétique politique. Cette mathématisation, avec la construction de la notion de « vie moyenne », permet une intégration de l’art de prolonger la vie aux techniques de gouvernement. Élaborée dans le cadre des pratiques financières de rentes viagères, la notion émigre vers l’économie politique, où la vie n’est plus conçue comme support d’intérêts mais comme force productive. Michel Senellart Cet article propose une réponse à la critique adressée par G. Agamben, dans Le Règne et la Gloire (2008), à la généalogie foucaldienne de la gouvernementalité. En cherchant dans la pensée chrétienne des premiers siècles la matrice d’une conception nouvelle du pouvoir comme gouvernement des hommes — « économie » ou conduite des âmes —, Foucault aurait méconnu la signification proprement théologique, au sein du dispositif trinitaire, du mot oikonomia. Nous voudrions montrer, à partir d’une relecture du 2e (...) Discours (362) de Grégoire de Nazianze (329-390), dont Foucault tire le concept d’une « économie des âmes », que cette idée ne présuppose nullement la référence au schéma trinitaire et renvoie bien davantage au modèle du « patronage » romain, couplé à la figure sacerdotale du bon berger. Cette analyse conduira, en outre, à rappeler le lien de la « direction des âmes » avec le paradigme médical. (shrink)

Este artículo pretende mostrar las aportaciones del pensador francés Michel de Certeau, sobre el proceso de surgimiento de las instituciones sociales. Para ello he analizado, en el marco de la antropología certeauniana del creer, su texto Une politique de la langue, en el que Certeau aborda el proyecto del Abbé Gregoire para imponer el francés sobre los patois a finales del siglo XVIII. Puede concluirse, tras este análisis, que las instituciones se fundan siguiendo un proceso en tres fases: la definición (...) clara de las creencias básicas o principios rectores de la institución ; el desplazamiento de los principios alternativos con los que compite ; y la lucha contra la resistencias que ofrecen las antiguas creencias. The subject of this paper is Rudolf Hermann Lotze’s concept of Geltung as him outlines it in the second Logik. This paper, through the notions of gnoseological immanentism and anti-psychologism, aims to shed light on the notion of validity. The Geltung’s concept is very interesting not only for the role that it plays in Lotze’s philosophy, but also for the importance that Lotze’s validityhas in the philosophical debate until the 1930s.

For the past two decades, Einstein's Hole Argument (which deals with the apparent indeterminateness of general relativity due to the general covariance of the field equations) and its resolution in terms of "Leibniz equivalence" (the statement that pseudo-Riemannian geometries related by active diffeomorphisms represent the same physical solution) have been the starting point for a lively philosophical debate on the objectivity of the point-events of space-time. It seems that Leibniz equivalence makes it impossible to consider the points of the space-time (...) manifold as physically individuated without recourse to dynamical individuating fields. Various authors have posited that the metric field itself can be used in this way , but nobody so far has considered the problem of explicitly distilling the "metrical fingerprint" of point-events from the gauge-dependent elements of the metric field. Working in the Hamiltonian formulation of general relativity, and building on the results of Lusanna and Pauri (2002), we show how Bergmann and Komar's "intrinsic pseudo-coordinates" (based on the value of curvature invariants) can be used to provide a physical individuation of point-events in terms of the true degrees of freedom (the "Dirac observables") of the gravitational field, and we suggest how this conceptual individuation could in principle be implemented with a well-defined empirical procedure. We argue from these results that point-events retain a significant kind of physical objectivity. (shrink)

This article argues that beneath the veneer of legitimacy in the organ, tissue, and body part transplantation systems exists a horrifying history of human commodification whose vestiges surprisingly linger in contemporary supply and allocation systems. This history, as the Article demonstrates, dates back to the colonial period in the United States, where “grave robbing” became an important feature in the advancement of medicine. This legacy lives on.

Synchronic and diachronic philology is a necessary but insufficient condition for studying rhetoricians and philosophers of the Ancient world. Knowledge of formal logic in order to understand their works is also required. As a rhetorician-turned-philosopher Augustine not only utilized Stoic and Aristotelian logic but also exceeded the boundary of such formal languages using both original inference patterns unknown to such formal systems and disclosing new horizons to Western philosophy.

It is often claimed that democratic voters have epistemic responsibilities. However, it is not often specified why voters have such epistemic responsibilities. In this paper, I contend that voters have epistemic responsibilities because voting is best understood as an act that bears assertoric force. More precisely, voters perform what I call an act of political advocacy whereby, like an asserter who states or affirms that something is the case, they state or affirm that a certain course of political action is (...) the one that should be followed or enacted. Consequently, the performance of acts of political advocacy such as voting should be understood as bounded by epistemic norms mirroring those binding the act of assertion and yield epistemic responsibilities mirroring the ones required to satisfy these norms. In English, deictic verbs of motion, such ascomecan encode the perspective of the speaker, or another individual, such as the addressee or a narrative protagonist, at a salient reference time and location, in the form of an indexical presupposition. By contrast, Spanish has been claimed to have stricter requirements on licensing conditions forvenir(“to come”), only allowing speaker perspective. An open question is how a bilingual learner acquiring both English and Spanish reconciles these diverging language-specific restrictions. We face this question head (...) on by investigating narrative productions of young Spanish-English bilingual heritage speakers of Spanish, in comparison to English monolingual and Spanish dominant adults and children. We find that the young heritage speakers producevenirin linguistic contexts where most Spanish adult speakersdo not, but where English monolingual speakersdo, and also resemble those of young monolingual Spanish speakers of at least one other Spanish dialect, leading us to generate two mutually-exclusive hypotheses: (a) the encoding of speaker perspective in the young heritage children is cross-linguistically influenced by the more flexible and dominant language (English), resulting in a wider range of productions by these malleable young speakers than the Spanish grammar actually allows, or (b) the young Spanish speakers are exhibiting productions that are in fact licensed in the grammar, but which are pruned away in the adult productions, being supplanted by other forms as the lexicon is enriched. Given independent evidence of the heritage speakers' robust Spanish linguistic competence, we turn to systematically-collected acceptability judgments of three dialectal varieties of monolingual adult Spanish speakers of the distribution of perspective-taking verbs, to assess their competence and adjudicate between (a) and (b). We find that adultsaccept venirin contexts in which they do notproduceit, leading us to argue that (a)venirisnotobligatorily speaker-oriented in Spanish, as has been claimed, (b) adults may not producevenirin these contexts because they instead select more specific motion verbs, and (c) for heritage bilingual children, the more dominant language (English) may support the grammatically licensed but lexically-constrained productions in Spanish. El presente ensayo examina la relación entre los conceptos de vida y de poder, teniendo presentes posiciones fundamentales en la historia de la filosofía, con particular atención a algunos escritos de Kelsen y Schmitt La finalidad es de evidenciar cómo la fuerza de la vida y el poder sobre la vida exigen ser integrados y complementados en estructuras conceptuales y teóricas más amplias y más orgánicas, para evitar unilateralidades y aporías. Resulta que una posición meramente vitalista corre el riesgo de (...) negarse a sí misma e invoca una norma, que, a su vez, sea capaz de reclamar un orden constitutivo, no fruto exclusivo del arbitrio, sino dotado de una intrínseca inteligibilidad, en modo de actuar un enlace y una conexión entre la dimensión natural y el horizonte personal, en el cual la vida se eleva a la consciencia y a la libertad responsable. El reclamo al ethos quiere, entonces, organizar los niveles de la vida, del poder sobre ella y de las normas para regularlo en una perspectiva completa, en la cual el momento subjetivo y aquel objetivo se impliquen recíprocamente, en modo de evitar tanto formas de imposición extraña, percibidas como heterónomas, como la exaltación de la opción arbitraria, asumida como única regla. El último paso lleva a ensanchar el discurso del ámbito humano a aquel de la realidad completa, para subrayar cómo naturaleza y persona puedan ser conexas, si como fundamento último está un Logos creador y ordenador, una Inteligencia creadora, capaz de hacer posible una verdad de las cosas a un nivel primariamente ontológico. El camino conceptual desarrollado busca delinear, en tal modo, un proceso, al mismo tiempo teórico y real, en el cual las posibilidades de la técnica en relación a la vida y a la vida humana no sean confiadas a la mera casualidad de elecciones arbitrarias y de opciones prometeicas, sino sean colocadas en un más amplio horizonte ontológico, dotado de intrinseca inteligibilidad y finalidad, y por tanto capaz de unir, a un nivel más alto y más profundo, naturaleza y cultura, orden objetivo y proyectualidad personal, libertad y responsabilidad. In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. Finally, we propose a research design that takes into account endogeneity issues arising when examining compensation variables. (shrink)

This paper addresses a largely neglected question in ongoing debates over disagreement: what is the relation, if any, between disagreements involving credences and disagreements involving outright beliefs? The first part of the paper offers some desiderata for an adequate account of credal and full disagreement. The second part of the paper argues that both phenomena can be subsumed under a schematic definition which goes as follows: A and B disagree if and only if the accuracy conditions of A's doxastic attitude (...) are such that, if they were fulfilled, this would ipso facto make B's doxastic attitude inaccurate, or vice-versa. We analyse the implications of classical liberal and libertarian approaches for distributive justice in the context of social welfare orderings. We study an axiom capturing a liberal non-interfering view of society, the Weak Harm Principle, whose roots can be traced back to John Stuart Mill. We show that liberal views of individual autonomy and freedom can provide consistent foundations for welfare judgements. In particular, a liberal non-interfering approach can help to adjudicate some fundamental distributive issues relative to intergenerational justice. Essays on a wide range of areas and topics in Asian studies for scholars looking to incorporate Asia into their worldview and teaching. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

This article explores the methodological obstacles to research on wartime sexual violence and the extent to which they can be overcome with archival research. It discusses issues of concept formation, counting victims of human rights abuse, and coding violations. It compares figures from the Peruvian Truth and Reconciliation Commission's final report, an analysis of the Commission's published materials, and an analysis of the primary documents and finds that the number of reported cases of sexual violence is significantly higher than the (...) 538 cited by the Commission, men were more often the targets of sexual violence than previously thought, and sexual humiliation and sexual torture were common practices during the war. In the present contribution I would like to examine some theories of the ontology of abstract entities that take inspiration from the deep insights of Gottlob Frege. These theories develop in full details some ideas explicitly or implicitly articulated in Frege’s works and try to defend a sophisticated version of Platonism about abstract entities. The review of such theories should allow us to cast light on their merits and their possible flaws and, moreover, to determine which of them is the (...) more promising justification of such Platonism.
