This article examines how domestic violence impacts the lives and education of young children, children, and young people and how they can be supported within the education system. Schools are often the service in closest and longest contact with a child living with domestic violence; teachers can play a vital role in helping families access welfare services. In the wake of high profile cases of child abuse and neglect, concerns have been raised about the effectiveness of multi-agency responses to children (...) living with abuse. In the UK, the case of four-year-old Daniel Pelka who died in 2012 following abuse and starvation by his mother, who experienced domestic violence, and her partner, led to a serious case review. It found recording systems in Daniel’s school were not used consistently, and details held by different agencies were not collated to enable the formation of a coherent assessment. The lack of integrated working cited in the report echoes findings from previous serious case reviews. A strong correlation exists between domestic abuse and child abuse, with approximately half of all domestic violence situations involving direct child abuse. Children can also be affected indirectly by violence occurring in their home by seeing or hearing it taking place. This article examines the impact of domestic violence on the mental health of children, and the impact on their education. Violence in children’s lives often causes disruption to their schooling and harms the quality of their educational experiences and outcomes. The abuse children experience can result in emotional trauma, physical and psychological barriers to learning, and disruptive behavior in school, while the underlying causes of these problems remain hidden. Knowing when and how to seek advice from multi-agency professionals is an essential part of effective practice among school staff. Despite their vital role in identifying signs of abuse and signposting referral pathways, research indicates teachers often lack confidence and knowledge for such work. The article examines how the professional learning and professional confidence of teachers can be developed, and how recent policy and practice developments in the UK have the potential to influence work in this area. Leibniz wished that his Theodicy (1710) would have as great and as wide an impact as possible, and to further this end we find him in his correspondence with Caroline often expressing his desire that the book be translated into English. Despite his wishes, and Caroline’s efforts, this was not to happen in his lifetime (indeed, it did not happen until 1951, almost 250 years after Leibniz’s death). But even though the Theodicy did not make quite the impact in England (...) that Leibniz had hoped it would, it did draw some attention from the English intelligentsia. In this paper I shall focus on two responses to the Theodicy that were made in England in the years immediately following its publication. First, I shall consider the response of Michel de la Roche and his efforts to promote the book to an English audience in 1711 (efforts which only came to Leibniz’s attention much later, in 1713). De la Roche’s response was broadly positive, though his admiration for the Theodicy was tempered by his belief that Leibniz had struggled – unsuccessfully – to reconcile free will with divine foreknowledge. Second, I shall consider the largely negative response of George Smalridge, the Bishop of Bristol, who delivered his verdict on the book in a letter to Sophie written in 1714. Leibniz subsequently wrote a point-by-point rebuttal of (most of) Smalridge’s criticisms in a letter to Caroline, conceding only one very minor point to the Bishop. As we shall see, some of the points of substance raised by de la Roche and Smalridge have loomed over the Theodicy ever since. (shrink)

What does “life” mean in the protest slogan “Black Lives Matter”? This article draws on a close reading of Aimé Césaire’s Cahier d’un retour au pays natal to offer an answer to this question. In his poem, Césaire carefully examines the ways racial and colonial domination distort life. He identi????ies various false accounts of life complicit in domination, and he points toward an alternative. The article com-pares Césaire’s alternative to accounts of life put forward by Gilles Deleuze and Michel Henry, (...) suggesting that Césaire pushes his cri-tique in a similar direction, but goes further. Crow: Mass Incarceration in the Age of Colorblindness. Alexander showed how policies grounded in the war on drugs have disproportionately distressed racial and ethnic minorities—African Americans and Latinos—and the poor, destroying lives and communities. Incarceration in the United States is today a system that perpetuates what Alexander called a “caste” system from which escape is, especially among black males, virtually impossible. In this informed and well-presented study, Levad takes up Alexander’s social justice analysis, extending it in new directions, offering a creative theological contribution to the mass incarceration crisis in the world’s first “genuine prison society.”Levad observes that a limitation in the Christian response to mass incarceration is the “lack of Catholic voices” (47), which her book makes an effort to correct. She draws on core insights of Catholic tradition to address conditions that foster crime while also responding “to the ways in which the criminal justice crisis both reflects and sustains social injustices” (48). Her book offers a wonderfully clear analysis of mass incarceration and related issues such as recidivism strategies and policing policies. Levad addresses theories of punishment, proposes ideas for prison reform, and, while acknowledging a limited need for prisons, sets forth constructive suggestions for how best to decarcerate society through restorative justice and rehabilitation practices that reintegrate offenders into society.The study is a provocative interdisciplinary conversation between criminology and theology. Levad’s focus is on liturgy and sacrament, the central resources of Roman Catholic theology, finding in the Eucharist the theological [End Page 204] model for inviting the marginalized and dispossessed into the common fellowship of human dignity. She then argues that penance and reconciliation yield attitudes and behaviors that parallel secular restorative justice efforts. Maimonides’ Latin translation of Moreh Nevukhim | Guide for the Perplexed, was the most influential Jewish work in the last millennia (Di Segni, 2019; Rubio, 2006; Wohlman, 1988, 1995; Kohler, 2017). It marked the beginning of scholasticism, a daughter of Judaism raised by Jewish thinkers, according to historian Heinrich Graetz (Geschichte der Juden, L. 6, Leipzig 1861, p. xii). Printed by Gutenberg's first mechanical press, its influence in the West went as far as the Fifth Lateran Council (1512 — 1517) (...) This volume presents an exploration of the intersection between the work of Michel Foucault and feminist theory, focusing on Foucault's theories of sex/body, identity/subject, and power/politics. Like the other books in this series, this volume seeks to bring a feminist perspective to bear on the interpretation of a major figure in the philosophical canon. In the case of Michel Foucault, however, this aim is somewhat ironic because Foucault sees his work as disrupting that very canon. Since feminists see their work (...) as similarly disruptive, Foucault and feminism would seem to find much common ground, but, as the contributors to this collection reveal, the matter is not so simple. Foucault, like many feminists, is centrally concerned with questions related to sexuality and the body. This concern has led both Foucault and feminists to challenge the founding concept of the modernist philosophical canon: the disembodied transcendental subject. For both Foucault and feminists, this subject must be deconstructed and a new concept of identity articulated. The exciting possibilities of a Foucaultian approach to issues of the subject and identity, especially as they relate to sex and the body, are detailed in several of the essays collected here. Despite these possibilities, however, Foucault's approach has raised serious questions about an equally crucial area of feminist thought-politics. Some feminist critics of Foucault have argued that his deconstruction of the concept "woman" also deconstructs the possibility of a feminist politics. Several essays explore the implications of this deconstruction for feminist politics and suggest that a Foucaultian feminist politics is not viable. Overall, this collection illustrates the range of interest Foucault's thought has generated among feminist thinkers and both the advantages and liabilities of his approach for the development of feminist theory and politics. Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. This article explores how we use social media to construe identities and align with others into communities of shared values. The focus is on how ‘users of language perform their identities within uses of language’: How do personae using the microblogging service Twitter perform relational identities as they enact discourse fellowships? Addressing this question means understanding how personae enter into ambient affiliation. Such affiliation is ambient in the sense that social media users may not be interacting directly, but instead participating (...) in mass performances of hashtagging or contributing to iterations of Internet memes. This article will consider three key bonds using both a 100 million-word corpus of posts and a smaller specialized corpus collected by capturing the entire Twitter stream of a particular user. This paper is a reflection on the potential of teaching methodologies that focus on the phenomenon of dissonance or cognitive conflict. In a multicultural and increasingly polarized society, the capacity to question one’s own beliefs and behaviors is certainly one of the skills that the educational system should promote, and the development of this competence is closely related to the effective control of the experience of dissonance originated by new information. Starting from a brief reconstruction of the pedagogical and psychological (...) literature on the subject, I will try to analyze the complexity of the phenomenon of cognitive dissonance by proposing an explanation of the contradictory results of empirical research, identifying as the main problematic nodes the emotional regulation of conflict and the role of the teacher as a facilitator of the process of conceptual change. Tertiary qualities have been studied primarily by Gestalt psychologists. My aim in this article is to revisit the theoretical assumptions regarding tertiary qualities. I start from the Galilean distinction of the qualities of experience, the Lockean subdivision of qualities, the subjectivist definition in aesthetics and the theoretical contribution of Gestalt theory, to show the theoretical value of ‘tertiary qualities’ in the current context of experimental psychological research. I conclude that tertiary qualities are a crucial keyword for an experimental psychology based (...) on the primacy of perception. We also characterize the positional spcs satisfying the minimal majority property. We next evaluate the probability that the Borda, the plurality and the antiplurality spcs fulfil the two aforementioned properties under the Impartial and Anonymous Culture assumption in the presence of three and four alternatives for various sizes of the society. Summary By introducing the concept of “invariants”, Koffka endowed perceptual psychology with a flexible theoretical tool, which is suitable for representing vision situations in which a definite part of the stimulus pattern is relevant but not sufficient to determine a corresponding part of the perceived scene. He characterised his “invariance principle” as a principle conclusively breaking free from the “old constancy hypothesis”, which rigidly surmised point-to-point relations between stimulus and perceptual properties. In this paper, we explain the basic terms and (...) assumptions implicit in Koffka’s concept, by representing them in a set-theoretic framework. Then, we highlight various aspects and implications of the concept in terms of answers to six separate questions: forms of invariants, heuristic paths to them, what is invariant in an invariant, roots of conditional indeterminacy, variability vs. indeterminacy, and overcoming of the indeterminacy. Lastly, we illustrate the lasting value and theoretical power of the concept, by showing that Koffka’s insights relating to it do occur in modern perceptual psychology and by highlighting its role in a model of perceptual transparency. At the heart of Youth Justice Conferencing, a form of restorative justice aimed at addressing youth crime, is the notion that young persons who have committed an offence should be ‘reintegrated’ into their communities (Braithwaite in Crime, shame and reintegration. Cambridge University Press, Cambridge, 1989). This paper focuses on the role of parents as support persons, in particular the ‘crying mum’, an identity often leveraged by the Convenor when prompting the young person to express remorse to the circle. We explore (...) an Avouchment genre that we have observed whereby support persons vouch for the character of the young person. Our analysis considers the ways in which values are composed (as ideational categories are coupled with evaluative interpersonal ones) and unfold in discourse as invitations for participants to align. __Neurotechnology and Direct Brain Communication__ focuses on recent neuroscientific investigations of infant brains and of patients with disorders of consciousness, both of which are at the forefront of contemporary neuroscience. The prospective use of neurotechnology to access mental states in these subjects, including neuroimaging, brain simulation and brain computer interfaces, offers new opportunities for clinicians and researchers, but has also received specific attention from philosophical, scientific, ethical and legal points of view. BackgroundCommentators believe that the ethical decision-making climate is instrumental in enhancing interprofessional collaboration in intensive care units. Our aim was twofold: to determine the perception of the ethical climate, levels of moral distress, and intention to leave one's job among nurses and physicians, and between the different ICU types and determine the association between the ethical climate, moral distress, and intention to leave.MethodsWe performed a cross-sectional questionnaire study between May 2021 and August 2021 involving 206 nurses and physicians in a (...) large urban academic hospital. We used the validated Ethical Decision-Making Climate Questionnaire and the Measure of Moral Distress for Healthcare Professionals tools and asked respondents their intention to leave their jobs. We also made comparisons between the different ICU types. We used Pearson's correlation coefficient to identify statistically significant associations between the Ethical Climate, Moral Distress, and Intention to Leave.ResultsNurses perceived the ethical climate for decision-making as less favorable than physicians. They also had significantly greater levels of moral distress and higher intention to leave their job rates than physicians. Regarding the ICU types, the Neonatal/pediatric unit had a significantly higher overall ethical climate score than the Medical and Surgical units and also demonstrated lower moral distress scores and lower “intention to leave” scores compared with both the Medical and Surgical units. The ethical climate and moral distress scores were negatively correlated ; moral distress and "intention to leave" was positively correlated ; and ethical climate and “intention to leave” were negatively correlated.ConclusionsSignificant differences exist in the perception of the ethical climate, levels of moral distress, and intention to leave between nurses and physicians and between the different ICU types. Inspecting the individual factors of the ethical climate and moral distress tools can help hospital leadership target organizational factors that improve interprofessional collaboration, lessening moral distress, decreasing turnover, and improved patient care. The ‘reasonable person standard’ is often called on in difficult legal cases as the last resource to be appealed to when other solutions run out. Its complexity derives from the controversial tasks that people place on it. Two dialectics require some clarification: the objective/subjective interpretation of the standard and the ideal/ordinary person controversy. I shall move through these dialectics from the standpoint of an EV approach, assuming that on this interpretation the RPS can perform most persuasively its tasks. The all-round (...) model of phronetic agent that I present not only works better than competing models—such as the utilitarian–economic and the Rawlsian—in the law of tort but shows its best potentialities in other kinds of cases. In criminal law and matrimonial law cases the recourse to the EV approach offers through the virtues rich and substantial resources to evaluate conflictual cases. This approach makes the threshold of evaluation much closer to real life than competitors. (shrink)

Purpose Cybersecurity in healthcare has become an urgent matter in recent years due to various malicious attacks on hospitals and other parts of the healthcare infrastructure. The purpose of this paper is to provide an outline of how core values of the health systems, such as the principles of biomedical ethics, are in a supportive or conflicting relation to cybersecurity. Design/methodology/approach This paper claims that it is possible to map the desiderata relevant to cybersecurity onto the four principles of medical (...) ethics, i.e. beneficence, non-maleficence, autonomy and justice, and explore value conflicts in that way. Findings With respect to the question of how these principles should be balanced, there are reasons to think that the priority of autonomy relative to beneficence and non-maleficence in contemporary medical ethics could be extended to value conflicts in health-related cybersecurity. Research limitations/implications However, the tension between autonomy and justice, which relates to the desideratum of usability of information and communication technology systems, cannot be ignored even if one assumes that respect for autonomy should take priority over other moral concerns. Originality/value In terms of value conflicts, most discussions in healthcare deal with the conflict of balancing efficiency and privacy given the sensible nature of health information. In this paper, I argue that Husserl offers an important, although almost completely neglected so far, contribution to the reductionist/antireductionist debate about testimony. Through a phenomenological analysis, Husserl shows that testimony works through the constitution of an intentional intersubjective bond between the speaker and the hearer. In this paper I focus on the Logical Investigations, a 1914 manuscript now published as text 2 in Husserliana 20.2, and a 1931 manuscript now published as Appendix 12 in Husserliana 15. I argue that, (...) in those texts, Husserl highlights three essential phenomenological features of testimony: a) testimony is personal, meaning that it only takes place among persons, b) testimony is social, meaning that it requires the joint effort of multiple cognitive agents, c) testimony is community-building, meaning that it generates a long-lasting social bond among the parts involved. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

Leandra Medine indicates that she wants the Man Repeller multi-author blog to ‘serve as an open forum for women to draw their own conclusions’ instead of making ‘any sort of feministic statement’. Medine renders feminism as amorphous and an individual choice but she has been widely lauded for offering a feminist engagement in fashion. Her practices and position, as I argue throughout this article, allow her to fashion feminism, including associating feminism with the man repeller style and replacing aspects of (...) second wave and rights-based feminisms with the purportedly more equitable and liberating website ethos of choice and equality feminism. Yet in replacing ‘feministic’ critiques with promises of stylish cultural change and clothing that reportedly repels men, Medine and other Man Repeller authors elide how systemic oppression functions. This ambivalent relationship to feminism, and dearth of intersectional advocacy, prompted a backlash in 2020. Critics interrogated Medine's facile statement about #BlackLivesMatter, the company's lack of diversity and the unsuccessful restructuring of the blog. As a means of analysing Man Repeller, I employ textual analysis, feminist and queer literature and media theory. I define fashioning feminism as a collaborative and ongoing process of producing feminist positions and thinking, including the negation of certain forms of feminism. I assert that attending to the fashioning of feminism can foreground central and developing feminist theories; the appeal, unstylishness and effacement of feminism; and the connection between style and politics. This includes readers’ interrogations of Man Repeller's politics, which are occurring along with contemporary examinations of racism. Since fashioning feminism is a collaborative and ongoing process of producing feminist positions and thought, engaging with its concepts and debates can further the critical study of feminism, nurture feminist conversations and advocate for social change.
