The subject of this paper is Rudolf Hermann Lotze’s concept of Geltung as him outlines it in the second Logik. This paper, through the notions of gnoseological immanentism and anti-psychologism, aims to shed light on the notion of validity. The Geltung’s concept is very interesting not only for the role that it plays in Lotze’s philosophy, but also for the importance that Lotze’s validityhas in the philosophical debate until the 1930s.

Synchronic and diachronic philology is a necessary but insufficient condition for studying rhetoricians and philosophers of the Ancient world. Knowledge of formal logic in order to understand their works is also required. As a rhetorician-turned-philosopher Augustine not only utilized Stoic and Aristotelian logic but also exceeded the boundary of such formal languages using both original inference patterns unknown to such formal systems and disclosing new horizons to Western philosophy.

For the past two decades, Einstein's Hole Argument (which deals with the apparent indeterminateness of general relativity due to the general covariance of the field equations) and its resolution in terms of "Leibniz equivalence" (the statement that pseudo-Riemannian geometries related by active diffeomorphisms represent the same physical solution) have been the starting point for a lively philosophical debate on the objectivity of the point-events of space-time. It seems that Leibniz equivalence makes it impossible to consider the points of the space-time (...) manifold as physically individuated without recourse to dynamical individuating fields. Various authors have posited that the metric field itself can be used in this way , but nobody so far has considered the problem of explicitly distilling the "metrical fingerprint" of point-events from the gauge-dependent elements of the metric field. Working in the Hamiltonian formulation of general relativity, and building on the results of Lusanna and Pauri (2002), we show how Bergmann and Komar's "intrinsic pseudo-coordinates" (based on the value of curvature invariants) can be used to provide a physical individuation of point-events in terms of the true degrees of freedom (the "Dirac observables") of the gravitational field, and we suggest how this conceptual individuation could in principle be implemented with a well-defined empirical procedure. We argue from these results that point-events retain a significant kind of physical objectivity. (shrink)

The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. In English, deictic verbs of motion, such ascomecan encode the perspective of the speaker, or another individual, such as the addressee or a narrative protagonist, at a salient reference time and location, in the form of an indexical presupposition. By contrast, Spanish has been claimed to have stricter requirements on licensing conditions forvenir(“to come”), only allowing speaker perspective. An open question is how a bilingual learner acquiring both English and Spanish reconciles these diverging language-specific restrictions. We face this question head (...) on by investigating narrative productions of young Spanish-English bilingual heritage speakers of Spanish, in comparison to English monolingual and Spanish dominant adults and children. We find that the young heritage speakers producevenirin linguistic contexts where most Spanish adult speakersdo not, but where English monolingual speakersdo, and also resemble those of young monolingual Spanish speakers of at least one other Spanish dialect, leading us to generate two mutually-exclusive hypotheses: (a) the encoding of speaker perspective in the young heritage children is cross-linguistically influenced by the more flexible and dominant language (English), resulting in a wider range of productions by these malleable young speakers than the Spanish grammar actually allows, or (b) the young Spanish speakers are exhibiting productions that are in fact licensed in the grammar, but which are pruned away in the adult productions, being supplanted by other forms as the lexicon is enriched. Given independent evidence of the heritage speakers' robust Spanish linguistic competence, we turn to systematically-collected acceptability judgments of three dialectal varieties of monolingual adult Spanish speakers of the distribution of perspective-taking verbs, to assess their competence and adjudicate between (a) and (b). We find that adultsaccept venirin contexts in which they do notproduceit, leading us to argue that (a)venirisnotobligatorily speaker-oriented in Spanish, as has been claimed, (b) adults may not producevenirin these contexts because they instead select more specific motion verbs, and (c) for heritage bilingual children, the more dominant language (English) may support the grammatically licensed but lexically-constrained productions in Spanish. This article argues that beneath the veneer of legitimacy in the organ, tissue, and body part transplantation systems exists a horrifying history of human commodification whose vestiges surprisingly linger in contemporary supply and allocation systems. This history, as the Article demonstrates, dates back to the colonial period in the United States, where “grave robbing” became an important feature in the advancement of medicine. This legacy lives on.

El presente ensayo examina la relación entre los conceptos de vida y de poder, teniendo presentes posiciones fundamentales en la historia de la filosofía, con particular atención a algunos escritos de Kelsen y Schmitt La finalidad es de evidenciar cómo la fuerza de la vida y el poder sobre la vida exigen ser integrados y complementados en estructuras conceptuales y teóricas más amplias y más orgánicas, para evitar unilateralidades y aporías. Resulta que una posición meramente vitalista corre el riesgo de (...) negarse a sí misma e invoca una norma, que, a su vez, sea capaz de reclamar un orden constitutivo, no fruto exclusivo del arbitrio, sino dotado de una intrínseca inteligibilidad, en modo de actuar un enlace y una conexión entre la dimensión natural y el horizonte personal, en el cual la vida se eleva a la consciencia y a la libertad responsable. El reclamo al ethos quiere, entonces, organizar los niveles de la vida, del poder sobre ella y de las normas para regularlo en una perspectiva completa, en la cual el momento subjetivo y aquel objetivo se impliquen recíprocamente, en modo de evitar tanto formas de imposición extraña, percibidas como heterónomas, como la exaltación de la opción arbitraria, asumida como única regla. El último paso lleva a ensanchar el discurso del ámbito humano a aquel de la realidad completa, para subrayar cómo naturaleza y persona puedan ser conexas, si como fundamento último está un Logos creador y ordenador, una Inteligencia creadora, capaz de hacer posible una verdad de las cosas a un nivel primariamente ontológico. El camino conceptual desarrollado busca delinear, en tal modo, un proceso, al mismo tiempo teórico y real, en el cual las posibilidades de la técnica en relación a la vida y a la vida humana no sean confiadas a la mera casualidad de elecciones arbitrarias y de opciones prometeicas, sino sean colocadas en un más amplio horizonte ontológico, dotado de intrinseca inteligibilidad y finalidad, y por tanto capaz de unir, a un nivel más alto y más profundo, naturaleza y cultura, orden objetivo y proyectualidad personal, libertad y responsabilidad. In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. Finally, we propose a research design that takes into account endogeneity issues arising when examining compensation variables. (shrink)

This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. It is often claimed that democratic voters have epistemic responsibilities. However, it is not often specified why voters have such epistemic responsibilities. In this paper, I contend that voters have epistemic responsibilities because voting is best understood as an act that bears assertoric force. More precisely, voters perform what I call an act of political advocacy whereby, like an asserter who states or affirms that something is the case, they state or affirm that a certain course of political action is (...) the one that should be followed or enacted. Consequently, the performance of acts of political advocacy such as voting should be understood as bounded by epistemic norms mirroring those binding the act of assertion and yield epistemic responsibilities mirroring the ones required to satisfy these norms. This paper addresses a largely neglected question in ongoing debates over disagreement: what is the relation, if any, between disagreements involving credences and disagreements involving outright beliefs? The first part of the paper offers some desiderata for an adequate account of credal and full disagreement. The second part of the paper argues that both phenomena can be subsumed under a schematic definition which goes as follows: A and B disagree if and only if the accuracy conditions of A's doxastic attitude (...) are such that, if they were fulfilled, this would ipso facto make B's doxastic attitude inaccurate, or vice-versa. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

The paper proposes an account of the rational response to higher‐order evidence whose key claim is that whenever we acquire such evidence we ought to engage in the inquiring activity of double‐checking. Combined with a principle that establishes a connection between rational inquiry and rational belief retention, the account offers a novel explanation of the alleged impermissibility of retaining one's belief in the face of higher‐order evidence. This article explores the methodological obstacles to research on wartime sexual violence and the extent to which they can be overcome with archival research. It discusses issues of concept formation, counting victims of human rights abuse, and coding violations. It compares figures from the Peruvian Truth and Reconciliation Commission's final report, an analysis of the Commission's published materials, and an analysis of the primary documents and finds that the number of reported cases of sexual violence is significantly higher than the (...) 538 cited by the Commission, men were more often the targets of sexual violence than previously thought, and sexual humiliation and sexual torture were common practices during the war. In the present contribution I would like to examine some theories of the ontology of abstract entities that take inspiration from the deep insights of Gottlob Frege. These theories develop in full details some ideas explicitly or implicitly articulated in Frege’s works and try to defend a sophisticated version of Platonism about abstract entities. The review of such theories should allow us to cast light on their merits and their possible flaws and, moreover, to determine which of them is the (...) more promising justification of such Platonism. Even before Nietzsche, Stirner opened a crak inside the metaphysical western tradition, that always considered life as something that must be judged, understood and evaluated, and that used knowledge as the instrument to go deep in the truth of being. In The Ego and His Own we attend the attempt to reverse this tradition: thinking does not have the function to conceive and found what is «real», but it does make tough and assure the loss of concerns. The unbelief and (...) the loss of concerns are the elements of Stirner’s spectrology that, instead of imposing the laws of real life, it begins to fight «new battles» against the huge and horrible shadow of God. Un large public apprécie en Gaston Bachelard le philosophe de la rêverie poétique et l'épistémologue. Ses oeuvres consacrées à la question du temps sont moins connues. Cet ouvrage se propose de montrer en quoi les données actuelles des neurosciences apportent un éclairage nouveau à cette réflexion. Nombre d'hypothèses formulées en neurobiologie et en neuroesthétique renforce la thèse bachelardienne de la discontinuité du temps vécu et la conception qu'avait le philosophe de "l'instant poétique".

The presence of easily accessible yet unpossessed evidence seems to matter epistemically. In this chapter I offer an inquiry-theoretic explanation of this datum. I argue that agents in the target cases fail to be competent inquirers and gather the relevant easily accessible evidence. This offers a deflationary explanation of the initial datum. I then show how to inflate this explanation to vindicate the thought that unpossessed evidence has defeating power over the justificatory status of one’s beliefs. The inflationary explanation rests (...) on two main planks. First, the subject who believes that p in the target cases ought to have gathered the target piece of evidence that bears on p. Secondly, such a duty is incompatible with justifiedly believing p. Along the way, the chapter offers a framework for thinking about zetetic competence, comments on the existence of epistemic duties of inquiry, and discusses the relationship between such duties and traditional epistemic norms of belief. Prenatal screening can significantly benefit parents and the community. However, it has created a dilemma for women as it requires them to quickly decide whether to continue a pregnancy or terminate it should the test indicate a foetal abnormality. This can be psychologically traumatic for women torn between their connection to an unborn child with all its possible imperfections, and a desire to prevent its suffering as a disabled child in later life. A woman must also consider her own and (...) her family's future welfare. Extensive research into the physical aspects of prenatal screening has not explored the meaning of the experience for women or whether termination is the most appropriate option. This article examines recent qualitative studies, concluding that women who terminate a pregnancy following prenatal screening may experience an acute grief reaction or be plagued by guilt and fear that can precipitate marital breakdown. Additionally, there is a risk that through striving to eradicate congenital disability, a community risks promoting a cult of perfectionism that may have discriminatory effects on disabled people.
