ʻUmar II’s vast correspondence with governors is examined for the discussion of Islamization and acculturation. From the caliph’s point of view, these two processes had to be regulated and the dilemma was how to formulate a policy that was both in line with Islamic ethics and, at the same time, controlling Islamization by setting a high entrance bar for the converts. The struggle against acculturation attempted to preserve Muslim political dominance by controlling the administration.

Much of what we know we know through testimony, and knowing on the basis of testimony requires some degree of trust in speakers. Trust is therefore very valuable. But in trusting, we expose ourselves to risks of harm and betrayal. It is therefore important to trust well. In this paper, I discuss two recent cases of the betrayal of trust in (broadly) academic contexts: one involving hoax submissions to journals, the other faking an identity on social media. I consider whether (...) these betrayals suggest that we ought to be less trusting in contexts like these. I argue that we should not: the acquisition of knowledge is dependent on trust, and we cannot intentionally reduce the extent to which we trust in these kinds of contexts without risking destroying it utterly. Instead, we must trust in our epistemic networks and the way they work to filter out deception. (shrink)

The inflation of Type I error rates is thought to be one of the causes of the replication crisis. Questionable research practices such as p-hacking are thought to inflate Type I error rates above their nominal level, leading to unexpectedly high levels of false positives in the literature and, consequently, unexpectedly low replication rates. In this article, I offer an alternative view. I argue that questionable and other research practices do not usually inflate relevant Type I error rates. I begin (...) by introducing the concept of Type I error rates and distinguishing between statistical errors and theoretical errors. I then illustrate my argument with respect to model misspecification, multiple testing, selective inference, forking paths, exploratory analyses, p-hacking, optional stopping, double dipping, and HARKing. In each case, I demonstrate that relevant Type I error rates are not usually inflated above their nominal level, and in the rare cases that they are, the inflation is easily identified and resolved. I conclude that the replication crisis may be explained, at least in part, by researchers’ misinterpretation of statistical errors and their underestimation of theoretical errors. (shrink)

During multiple testing, researchers often adjust their alpha level to control the familywise error rate for a statistical inference about a joint union alternative hypothesis (e.g., “H1,1 or H1,2”). However, in some cases, they do not make this inference. Instead, they make separate inferences about each of the individual hypotheses that comprise the joint hypothesis (e.g., H1,1 and H1,2). For example, a researcher might use a Bonferroni correction to adjust their alpha level from the conventional level of 0.050 to 0.025 (...) when testing H1,1 and H1,2, find a significant result for H1,1 (p < 0.025) and not for H1,2 (p > .0.025), and so claim support for H1,1 and not for H1,2. However, these separate individual inferences do not require an alpha adjustment. Only a statistical inference about the union alternative hypothesis “H1,1 or H1,2” requires an alpha adjustment because it is based on “at least one” significant result among the two tests, and so it refers to the familywise error rate. Hence, an inconsistent correction occurs when a researcher corrects their alpha level during multiple testing but does not make an inference about a union alternative hypothesis. In the present article, I discuss this inconsistent correction problem, including its reduction in statistical power for tests of individual hypotheses and its potential causes vis-à-vis error rate confusions and the alpha adjustment ritual. I also provide three illustrations of inconsistent corrections from recent psychology studies. I conclude that inconsistent corrections represent a symptom of statisticism, and I call for a more nuanced inference-based approach to multiple testing corrections. (shrink)

Disorders of volition are often accompanied by, and may even be caused by, disruptions in the phenomenology of agency. Yet the phenomenology of agency is at present little explored. In this paper we attempt to describe the experience of normal agency, in order to uncover its representational content.

Although the literature on social innovation has focused primarily on social enterprises, social innovation has long occurred within mainstream corporations. Drawing upon recent scholarship on social movements and institutional complexity, we analyze how movements foster corporate social innovation (CSI). Our context is the adoption of green information systems (“green IS”), which are information systems employed to transform organizations and society into more sustainable entities. We trace the historical emergence of green IS as a corporate response to increasing demands for sustainability (...) reporting, a key social innovation that environmental activists helped to create. Drawing upon extensive survey data from more than 400 U.S. firms, we then examine how managers perceived environmental activism in relation to broader field pressures for change and how their perceptions of both were related to green IS adoption. The results reveal that activists were more effective at influencing adoption indirectly by transforming organizational fields than by directly influencing corporate managers. Combined with the historical analysis, these findings suggest that CSI emerged out of ongoing interactions between activists, corporate managers, and other influential actors within a broader social innovation system. Activists helped to create conditions for social innovation, but corporations took the lead in developing new practices. (shrink)

We use game theoretic models to take an in-depth look at the dynamics of discrimination and academic collaboration. We find that in collaboration networks, small minority groups may be more likely to end up being discriminated against while collaborating. We also find that discrimination can lead members of different social groups to mostly collaborate with in-group members, decreasing the effective diversity of the social network. Drawing on previous work, we discuss how decreases in the diversity of scientific collaborations might negatively (...) affect the progress of epistemic communities. (shrink)

Moral judgments entail or consist in claims that certain ways of behaving are called for. These actions have expectable consequences. I will argue that these consequences are suspiciously benign: on controversial issues, each side assesses these consequences, measured in dispute-independent goods, as significantly better than the consequences of behaving in the ways their opponents recommend. This remains the case even when we have not formed our moral judgment by assessing consequences. I will suggest that the evidence indicates that our perception (...) of the consequences of acting as recommended by our moral judgments is motivated, such that the warrant of such assessments is lower than we might have thought. The suspicion correlation between our moral judgments and our assessments of the implicated facts provides higher-order evidence that should lead us to reduce our confidence in these assessments. This article explores the relationship between pragmatic encroachment and epistemic permissiveness. If the suggestion that all epistemic notions are interest-relative is viable , then it seems that a certain species of epistemic permissivism must be viable as well. For, if all epistemic notions are interest relative then, sometimes, parties in paradigmatic cases of shared evidence can be maximally rational in forming competing basic doxastic attitudes towards the same proposition. However, I argue that this total pragmatic encroachment is not tenable, and, (...) thus, epistemic permissivism cannot be vindicated in this way. (shrink)

Addiction is almost universally held to be characterized by a loss of control over drug-seeking and consuming behavior. But the actions of addicts, even of those who seem to want to abstain from drugs, seem to be guided by reasons. In this paper, I argue that we can explain this fact, consistent with continuing to maintain that addiction involves a loss of control, by understanding addiction as involving an oscillation between conflicting judgments. I argue that the dysfunction of the mesolimbic (...) dopamine system that typifies addictions causes the generation of a mismatch between the top-down model of the world that reflects the judgment that the addict ought to refrain from drugs, and bottom-up input caused by cues predictive of drug availability. This constitutes a powerful pressure toward revising the judgment and thereby attenuating the prediction error. But the new model is not stable, and shifts under the pressure of bottom-up inputs in different contexts; hence the oscillation of all-things-considered judgment. Evidence from social psychology is adduced, to suggest that a similar process may be involved in ordinary cases of weakness of will. (shrink)

Proposals for regulating or nudging healthy choices are controversial. Opponents often argue that individuals should take responsibility for their own health, rather than be paternalistically manipulated for their own good. In this paper, I argue that people can take responsibility for their own health only if they satisfy certain epistemic conditions, but we live in an epistemic environment in which these conditions are not satisfied. Satisfying the epistemic conditions for taking responsibility, I argue, requires regulation of this environment. I describe (...) some proposals for such regulation and show that we cannot reject all regulation in the name of individual responsibility. We must either regulate individuals’ healthy choices or regulate the epistemic environment. (shrink)

Ocorre que a filosofia habermasiana, conforme entendimento do artigo, implica a adoção de uma teoria dualista entre os conceitos de Estado e de direito. O trabalho busca esclarecer dois pontos centrais da Filosofia política de Maquiavel – as figuras da Virtù e da Fortuna. A virtú deve ser vista como uma forma do livre-arbítrio do governante, sendo a principal variável na condução do principado.Destaca-se, também, a utilização da variável nacontestação aos valorestradicionais. Já a Fortuna constitui-se na indeterminabilidade de parte dos resultadosdo governo: ela deve ser dominada, conquistada para o benefício do príncipe.

Pretendeu-se estudar a aquisição da virtude em Aristóteles a partir da interpretação de M. F. Burnyeat. Para esse, a virtude aristotélica exige dimensões cognitivas e emocionais, sendo que ao aprendiz não basta conhecer os princípios e as regras gerais da ação, mas deve ter internalizado, através do hábito, uma vontade de praticar ações nobres e justas. Compete ao sujeito virtuoso, portanto, ter o conhecimento do que é correto (the that), assim como, subsidiariamente, a justificativa do porquê é apropriada determinada ação (...) (the because). Da análise dessas variáveis, o autor procura esclarecer a figura conflituosa do akratic (incontinente) e do akalastos (perverso) e elucidar a hipótese do desenvolvimento moral. Concomitantemente este artigo pretende introduzir o problema criminológico da ideia de ressocialização ou da pena capital, entendendo ser o argumento aristotélico ainda influente para a filosofia da virtude e jurídica hodierna e necessário quando se discutem novos paradigmas éticos e jurídicos. O objetivo do artigofoi especular sobre a epistemologia proposta por David Hume (1711-1776), especificamente a perspectiva empirista e cética. Procurou-se, assim, expor os principais conceitos da sua filosofia, especialmente acrítica à concepção de causalidade, o problema da probabilidade e os conceitos de percepções, imagens e ideias. Finalmente buscou-se expor uma interpretação que entende haver um ceticismo mitigado no autor e a superação de uma teoria do conhecimento exclusivamente psicológica.

The paper motivates a novel research programme in the philosophy of action parallel to the ‘Knowledge First’ programme in epistemology. It is argued that much of the grounds for abandoning the quest for a reductive analysis of knowledge in favour of the Knowledge First alternative is mirrored in the case of intentional action, inviting the hypothesis that intentional action is also, like knowledge, metaphysically basic. The paper goes on to demonstrate the sort of explanatory contribution that intentional action can make (...) once it is no longer taken to be a target for reductive analysis, in explaining other, non-intentional kinds of action and voluntariness. O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o fundamento (...) natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. O presente artigo aborda o problema da soberania para Hans Kelsen. Tem como objetivo analisar a posição do autor sobre o tema (especialmente através do texto Sovereignty), traçando paralelamente algumas considerações. Ocorre que para Kelsen o conceito de soberania mostra-se impreciso a partir da doutrina tradicional. Ainda, mesmo superando essa doutrina e a teoria dualista, também o conteúdo do direito nacional e internacional permanece inalterado. Portanto, prova-se a irrelevância de tal para a teoria jurídica.

O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.

O artigo investigou o método para uma filosofia intercultural a partir da Ibero-América, de Raul Fornet-Betancourt. Partiu-se especificamente do texto do autor para posteriormente fornecer considerações críticas aos seus posicionamentos. Nesse sentido, analisou-se a originalidade do tema, a filosofia da libertação como modelo de diálogo intercultural, seus pressupostos hermenêuticos e epistemológicos e, por fim, o pensamento ibero-americano como base para uma filosofia intercultural. No final do trabalho apresentou-se seis críticas ao texto estudado – o problema da arrogância e dissimulação filosófica, (...) a adoção tácita de um platonismo e a não originalidade filosófica, o problema da falácia naturalista e do falsificacionismo e, finalmente, a não razoabilidade política das propostas. O objetivo do trabalho é auxiliar o jurista desocupado responsável pelo ensino da cadeira de filosofia do direito. A situação mais frequente nas faculdades de direito são as aulas de filosofia e de outras cadeiras do eixo fundamental serem tapeadas por qualquer bacharel sem nada melhor para fazer. Ocorre que tais ociosos juristas muitas vezes se veem receosos quando instituídos nos seus cargos, isso porque não possuem qualquer conhecimento na matéria em que lecionam, ao mesmo tempo em que são lançados (...) em sala de aula expostos às dúvidas e críticas dos alunos. Nesse sentido apresento a esses professores, juristas desocupados, uma técnica pedagógica resumida e de fácil compreensão para ministrarem sem maiores sobressaltos a cadeira de filosofia do direito. Seguindo os passos propostos, o jurista desocupado não terá riscos de ser questionado pelos alunos ou pela instituição, mantendo seu complemento de renda garantido. (shrink)

Pretendeu-se dissertar sobre a segunda conferênciada obra O Liberalismo Político de John Rawls. A exposição trata dométodo de justificação do autor, concentrada nos termos racionalidade(concepção de bem) e razoabilidade (senso de justiça);subsequentemente aborda as variáveis – cooperação, voluntariedade,autonomia, limites do juízo, discordância, pluralismo, reciprocidade,imparcialidade, publicidade, justificação, democracia e tolerância. Nessesentido, parte-se da obra supracitada para a sistematização da teoria eresolução de problemas: uma referência histórica em Kant; uma respostaàs hipóteses comunitaristas; a convergência de modelos de justificação,sobretudo uma deontologia com uma (...) concepção substancial de justiça; eos argumentos epistemológicos fundacionistas e coerentistas. Conclui-se,além da unidade da obra, a tipificação contratualista na história daFilosofia, um compatibilismo ético e o caráter epistemológico coerentista. (shrink)

The Cognitive Reflection Test is a widely used measure of the degree to which individuals override an intuitive response and engage in reflection. For both theoretical and practical reasons, it is widely taken to assess an important component of rational thought. In this paper, I will argue that while doing well on the CRT requires valuable cognitive capacities and dispositions, doing badly does not always indicate a lack of such capacities and dispositions. The CRT, I argue, offers respondents implicit (but (...) misleading) testimony: some of those who do badly do so due to a stronger disposition to defer to testimony. Since deference is not irrational, those who do badly need not be irrational, not even in part. (shrink)

This article analyzes the recent debate surrounding inclusive fitness and argues that certain limitations ascribed to it by critics—such as requiring weak selection or providing dynamically insufficient models—are better thought of as limitations of the methodological framework most often used with inclusive fitness. In support of this, I show how inclusive fitness can be used with the replicator dynamics. I conclude that much of the debate is best understood as being about the orthogonal issue of using abstract versus idealized models.

The Global Reporting Initiative (GRI) has successfully become institutionalized as the preeminent global framework for voluntary corporate environmental and social reporting. Its success can be attributed to the “institutional entrepreneurs” who analyzed the reporting field and deployed discursive, material, and organizational strategies to change it. GRI has, however, fallen short of the aspirations of its founders to use disclosure to empower nongovernmental organizations (NGOs). The authors argue that its trajectory reflects the power relations between members of the field, their strategic (...) choices and compromises, their ability to mobilize alliances and resources, and constraints imposed by the broader institutions of financial and capital markets. The authors draw three notable implications from this study. First, institutional theory needs to pay more attention to economic structures, strategies, and resources. Second, institutional entrepreneurship by relatively weak societal groups such as NGOs is inherently constrained by the structural power of wider institutions and by the compromises required to initiate change. Third, the strategies of NGOs represent a form of power capable of shifting, if not transforming, the field of corporate governance. (shrink)

Hunting and gathering is, evolutionarily, the defining subsistence strategy of our species. Studying how children learn foraging skills can, therefore, provide us with key data to test theories about the evolution of human life history, cognition, and social behavior. Modern foragers, with their vast cultural and environmental diversity, have mostly been studied individually. However, cross-cultural studies allow us to extrapolate forager-wide trends in how, when, and from whom hunter-gatherer children learn their subsistence skills. We perform a meta-ethnography, which allows us (...) to systematically extract, summarize, and compare both quantitative and qualitative literature. We found 58 publications focusing on learning subsistence skills. Learning begins early in infancy, when parents take children on foraging expeditions and give them toy versions of tools. In early and middle childhood, children transition into the multi-age playgroup, where they learn skills through play, observation, and participation. By the end of middle childhood, most children are proficient food collectors. However, it is not until adolescence that adults (not necessarily parents) begin directly teaching children complex skills such as hunting and complex tool manufacture. Adolescents seek to learn innovations from adults, but they themselves do not innovate. These findings support predictive models that find social learning should occur before individual learning. Furthermore, these results show that teaching does indeed exist in hunter-gatherer societies. And, finally, though children are competent foragers by late childhood, learning to extract more complex resources, such as hunting large game, takes a lifetime. (shrink)

Recent findings in neuroscience, evolutionary biology and psychology seem to threaten the existence or the objectivity of morality. Moral theory and practice is founded, ultimately, upon moral intuition, but these empirical findings seem to show that our intuitions are responses to nonmoral features of the world, not to moral properties. They therefore might be taken to show that our moral intuitions are systematically unreliable. I examine three cognitive scientific challenges to morality, and suggest possible lines of reply to them. I (...) divide these replies into two groups: we might confront the threat, showing that it does not have the claimed implications for morality; or we might bite the bullet, accepting that the claims have moral implications, but incorporating these claims into morality. I suggest that unless we are able to bite the bullet, when confronted by cognitive scientific challenges, there is a real possibility that morality will be threatened. This fact gives us a weighty reason to adopt a metaethics that makes it relatively easy to bite cognitive scientific bullets. Moral constructivism, in one of its many forms, makes these bullets more palatable; therefore, the cognitive scientific challenges provide us with an additional reason to adopt a constructivist metaethics. Can our cultural membership excuse us from responsibility for certain actions? Ought the Aztec priest be held responsible for murder, for instance, or does the fact that his ritual sacrifice is mandated by his culture excuse him from blame? Our intuitions here are mixed; the more distant, historically and geographically, we are from those whose actions are in question, the more likely we are to forgive them their acts, yet it is difficult to pinpoint why this distance should excuse. Up (...) close, historically or geographically, we tend to be less forgiving: few of us excuse the Taliban for what they did to women and homosexuals; and if there is less of an outcry concerning treatment not all that dissimilar in Saudi Arabia and elsewhere, this is probably only because these actions are less well publicized. Cet article constitue la réponse à une note critique publiée dans le n° 71 d’ Actuel Marx, dans laquelle Fabien Foureault discutait les travaux de G. Duménil et D. Lévy concernant l’actuelle transition entre le capitalisme et un nouveau mode de production, le managérialisme. Le premier argument est le fait que les hauts managers sont rétribués par la distribution de stock-options, considérés comme des revenus du capital par Foureault bien que ces options n’aient pas de rapport avec la détention antérieure (...) d’actions par les bénéficiaires. La forme de la rémunération l’emporte sur les pratiques qui la motivent. Foureault utilise, par ailleurs, les calculs réalisés au sein des Distributional National Accounts qui montrent que la part des revenus du capital au sein du revenu total du 1 % supérieur de la hiérarchie des revenus n’a pas décru. Ces nouvelles estimations sont, pour GD et DL, inutilisables hors des finalités comparatives pour lesquelles elles ont été conçues. I have learned from all the commentators—now, and in some cases in the past as well—and I am sincerely honored by their having taken my work (...) seriously enough to comment on it, even if only to take issue with it. In what follows, I shall attempt to reply to their main criticisms. As will shortly become clear, I do not here have the space for anything like adequate responses. Instead, I shall have to content myself with programmatic statements of how such responses might go. Let me admit at the outset that until the details of these responses are fully worked out, and the relevant empirical research conduced, I cannot be sure that the responses will succeed. Nevertheless, there are grounds for confidence, given the available data.Because there is some overlap between the criticisms, I shall address some of them—those of Blair, Nichols, and Vargas—by topic rather than by commentator, before turning to Mullen and Matravers.Is the Ability to Understand the Moral/Conventional Distinction a Necessary Condition of Aptness for Moral Responsibility?Blair, as well as Vargas and Nichols, suggests that an agent's knowing that an action is against the rules might be sufficient to ground responsibility for performing that action, even if the agent lacks the ability to draw the moral/conventional distinction. As Blair points out, we do not reserve blame only for those who violate moral rules. Blame, and sometimes punishments, are also meted out to those who violate merely conventional norms. Because psychopaths can understand conventional norms perfectly well, they may therefore seem to be appropriate targets of at least some kind of moral blame.But is it really the case that agents are (ever) blameworthy for violating conventional norms alone? Many philosophers, for instance when considering the morality of civil disobedience, have argued that conventional norms are typically backed by second-order moral norms. Hence, for many or all conventional norms, there is a (defeasible) moral obligation not to violate that norm, an obligation independent of the content of the conventional norm; it is because there are such second-order moral obligations that agents are blameworthy for violating conventional norms. [End Page 163] But if this is the case, then the fact that we sometimes blame agents for violating conventional norms is not evidence against the claim that the ability to grasp moral norms is a necessary condition of blameworthiness. There is no reason to think that psychopaths will find it any easier to grasp second-order moral norms than first-order (of course, they may understand that there are such things as second-order norms—norms concerning norms—but for them such norms will only be conventional). In fact, it might be more difficult to understand the moral force of second-order moral norms than first, inasmuch as the harms caused by violating such norms are emotional and not physical. Normal subjects invest (some) conventional norms with moral significance, and it is for this reason that we regard violations of such norms as apt to give rise to blame; lacking the ability to draw the moral/conventional distinction, psychopaths cannot invest such norms with moral significance. Once again, for them these norms are merely conventional, and they therefore fail to grasp the full significance of violating them.It might be objected that if conventional transgressions are (sometimes) backed up by second-order moral norms, children would not classify them as neatly as they do. They would misclassify some conventional norms as moral, insofar as they are backed up by second-order moral norms. They would therefore deny that violations of conventions are permissible on the say-so of an authority. There are two possible explanations of children's classifications, compatible with the suggestion that some conventions are backed by second-order moral norms. ABSTRACTIn a recent paper published in this journal, Eric Funkhouser argues that some of our beliefs have the primary function of signaling to others, rather than allowing us to navigate the world. Funkhouser’s case is persuasive. However, his account of beliefs as signals is underinclusive, omitting both beliefs that are signals to the self and less than full-fledged beliefs as signals. The latter set of beliefs, moreover, has a better claim to being considered as constituting a psychological kind in its (...) own right than the set of beliefs Funkhouser identifies. (shrink)

I argue, on the contrary, that to the extent to which these controversies require special expertise, we have no such duty. We are far more likely to worsen than to improve our epistemic situation by becoming better informed on these questions. I suggest we (...) do better to embrace the views of experts who are also morally wise. I argue that this is likely to lead to more accurate beliefs about these political and moral controversies; in any case, it will avoid the incoherence and irrationality which are the likely consequence of open-minded evidence gathering. A tese defende o antiplatonismo presente na obra do jusfilósofo Hans Kelsen como núcleo argumentativo da sua teoria do direito. Sustenta que a melhor definição da sua filosofia não é como neokantiana, mas como antiplatônica. Isso porque há significativas inconsistências na sua interpretação de Kant, o que a impossibilita de ser classificada como tal. Além, encontra-se na sua leitura sobre Platão referências mais sólidas e conceitos mais claros. Nesse sentido, advoga a hipótese de que a obra de Kelsen tem como (...) constante e como chave de entendimento a sua objeção e contestação às teses de Platão, sobretudo a questão da separação entre alma e corpo, isto é, forma e matéria. O primeiro e segundo capítulos defendem a hipótese da inconsistência das teses de Kelsen sobre Kant. Entende que a sua pressuposição de contradição entre a razão pura e a razão prática, assim como a ideia de uma contradição entre ser e dever-ser, não se sustenta considerando as próprias obras de Kant e a literatura especializada sobre o autor. No segundo capítulo apresenta a sua leitura sobre Platão, concentrada na obra A Ilusão da justiça (Dei Illusion der Gerechtigkeit). O quarto capítulo expõe, sopesando seu antiplatonismo, as duas principais referências teóricas para Kelsen a par de Kant, isto é, as teorias de David Hume e Sigmund Freud. O quinto capítulo demonstra como o antiplatonismo de Kelsen articula com os principais conceitos de suas teses, isto é, mostra que mesmo refutando a classificação do autor como neokantiano, conceitos como norma fundamental, liberdade, o monismo entre direito e Estado, monismo entre direito internacional e nacional e o problema da decisão judicial possuem justificativa e base filosófica coerente. Finalmente, conclui com a possiblidade da ideia de uma teoria kelseniana do direito desvinculada do neokantismo e fundada sobre os pressupostos céticos humeanos e freudianos, tanto moral, quanto teórico, ou seja, reconhece a unidade das obras do autor, desde que condicionada a sua interpretação como antiplatônica.
