One of the predominant debates in AI Ethics is the worry and necessity to create fair, transparent and accountable algorithms that do not perpetuate current social inequities. I offer a critical analysis of Reuben Binns’s argument in which he suggests using public reason to address the potential bias of the outcomes of machine learning algorithms. In contrast to him, I argue that ultimately what is needed is not public reason per se, but an audit of the implicit moral assumptions (...) of societies within which algorithms are built and applied. Public justification is appealing since it offers us the possibility to align the decision-making outcomes of the algorithm with the core moral values of stakeholders within a constitutional democratic society. My concern is that the common moral principles that form the foundation of public reason are not necessarily neutral, as they still express specific moral ideals and normative standards even if there is moral agreement by society as a whole, or among different stakeholders within society. Appealing to such normative standards may thus still lead to algorithmic outcomes being biased as common moral values may very well still be discriminatory even though they are formed from a consensus, and even if public reason is applied as a kind of filter for potential algorithmic outcomes. Hence, I argue that these implicit moral norms within society that we take as a given in public reasoning, need to be audited from generation to generation in order to effectively mitigate potential algorithmic bias. ABSTRACT:Whether at the executive or the line-management levels, businesspeople face moral decisions that cannot be easily resolved with reference to a shared ethos, whether because of diversity of ethea in the organization or its environment, or because the organization's ethos is inadequate for the problem at hand. These decisions are made more common by the changing norms of a pluralistic business environment, and require collective moral deliberation to be adequately resolved. Discourse ethics ideally characterizes the form of valid (...) collective moral deliberation. I argue that accommodation for the limitations of actual discourse makes discourse ethics, conceived in terms of the rules of practical discourse, practical for realizing improvements in the openness and validity of moral decision-making over states in which these rules are flagrantly violated. These rules have normative implications at the organizational level for the integrity approach to corporate ethics programs, and at the individual level for ethical leadership. (shrink)

Is morality rational? In this book Gauthier argues that moral principles are principles of rational choice. He proposes a principle whereby choice is made on an agreed basis of cooperation, rather than according to what would give an individual the greatest expectation of value. He shows that such a principle not only ensures mutual benefit and fairness, thus satisfying the standards of morality, but also that each person may actually expect greater utility by adhering to morality, even though the (...) choice did not have that end primarily in view. In resolving what may appear to be a paradox, the author establishes morals on the firm foundation of reason. Gauthier's argument includes an account of value, linking it to preference and utility; a discussion of the curcumstances in which morality is unnecessary; and an application of morals by agreement to relations between peoples at different levels of development and different generations. Finally, he reflects on the assumptions about individuality and community made by his account of rationality and morality. (shrink)

In this paper I analyze the tension between realism and antirealism at the basis of Kantian constructivism. This tension generates a conflictive account of the source of the validity of social norms. On the one hand, the claim to moral objectivity characteristic of Kantian moral theories makes the validity of norms depend on realist assumptions concerning the existence of shared fundamental interests among all rational human beings. I illustrate this claim through a comparison of the approaches of Rawls, (...) Habermas and Scanlon. On the other hand, however, objections to moral realism motivate many Kantian constructivists to endorse the antirealist claim that reasonable agreement is the source of the validity of social norms. After analyzing the difficulties in the latter strategy, I try to show how a balance between the realist and antirealist elements of Kantian constructivism can be reached by drawing a sharper distinction between the justice and the legitimacy of social norms. This essay examines the relationship between Eric Voegelin and Leo Strauss in order to show the central themes necessary to elucidate their philosophical positions. The essay reveals the centrality of the figure of Plato as a point of departure to understand the agreement and the disagreement concerning fundamental questions (such as the way of reading ancient texts, the importance of the historical perspective or the importance of the study of the past in order to orient the modern science) which (...) revolves around the issue of the relation between revelation and philosophy. The work concludes with an identification of the common core of both thinkers that allows us to understand their differences (homogeneity or heterogeneity of reality and the human) and, moreover, identifies both perspectives with a «foundational» (Voegelin) or «negative» (Strauss) interpretation of Plato’s thought. Michael Moehler’s Minimal Morality is a wonderful and important book, from which I have learned a great deal. It reinvigorates rational choice moral theory in the process of confronting what I see as the most important issue in social and moral philosophy today: can those in a deeply morally divided society endorse a common moral framework to structure social cooperation? Is a rational moral order possible under conditions of deep and wide moral diversity? Minimal Morality’s (...) answers are thoughtful and innovative. I am not, however, entirely persuaded that Minimal Morality can fulfil its promise of grounding a cooperative order when ‘traditional’ modes moral justification cannot. (shrink)

In a contractual firm–stakeholder relationship the participants are expected to act according to the agreement and for mutual benefit. By acting against the agreement at the expense of the other participant, however, may result in higher individual profits within a short period of time. Building on the unlocked iterated prisoner’s dilemma (PD) setting, Scanlon’s [Scanlon, T.␣M.: 1998, What We Owe to Each Other (Belknap Press of Harvard University Press, Cambridge, Mass)] version of contractualism, and the social dilemma literature, (...) this article considers what types of behaviors should be followed by both parties in an established firm–stakeholder relationship in order to reach an outcome that is defensible both in terms of morality and viability. It is argued that a normative foundation, which advises firms and stakeholders to ground their behavior on principles that could not reasonably be rejected by others, forms a basis for moral and viable behavior that can be expressed in the form of a strategic rule that excludes defection and utilizes the option to exit in response to the other participant’s defection. Then, a set of testable propositions is developed that describe how a firm and its stakeholders can further promote moral and viable relationships. (shrink)

Esto permitirá reconocer, en la educación de la virtud, el conflicto entre afectos y, en el resultado de este proceso educativo, el acuerdo entre razón y afectividad. ABSTRACT The article presents a moral psychology model on the basis of the analysis of the first book of Plato's Laws, particularly of the image of the puppet. Contemporary interpreters have been debating whether that image entails an understanding of temperance as a "victory" over pleasures, or whether it supports an understanding of that virtue as an "agreement" between pleasures and reason. In order to answer that question, the article resorts to the twofold psychology of the Philebus. This makes it possible to recognize the conflict among affects, in education in virtue, and the agreement between reason and affectivity, in the result of that educational process. (shrink)

This book argues for moral contractarianism, the view that moral justification rests on the idea of agreement. It critically appraises the views of contemporary contractarians such as John Rawls, David Gauthier, and Thomas Scanlon. It argues for a theory of moral justification that is based on a hypothetical agreement of restricted scope between strangers in the circumstances of justice and that is bound by historical place and circumstance.

Our research extends the current understanding of cognitive moral reasoning research by considering the often‐overlooked element of context, specifically the issue presented in the ethical dilemma, and the issue of gender agreement between the subject and the dilemma actor. We rely on gender identity and cognitive moral reasoning theories to provide the theoretical underpinnings of our exploration to deepen our understanding of the contextual forces affecting cognitive moral reasoning. Our results generally confirm earlier research findings and (...) provide valuable information regarding our understanding of the impact of the dilemma context and the gender agreement or disagreement between the subject and the actor in an ethical dilemma, with significance found for four of our five hypotheses, with half of the significant results in the direction predicted. Previous research has shown positive relationships between fitness level and different cognitive abilities and academic performance. The purpose of this study was to explore the relationships between logical–mathematical intelligence and mathematical competence with physical fitness in a group of pre-adolescents. Sixty-three children from Castro del Río, aged between 11 and 12 years, participated in this research. The Superior Logical Intelligence Test and the EVAMAT 1.0–5 battery were used. Physical fitness was evaluated by the horizontal jump test, the 4×10 meter speed–agility (...) test, and the Course Navette test. The analyses showed positive relationships between physical fitness with logical–mathematical intelligence and mathematical competence. Specifically, linear regression analyzes indicated that the 4×10 speed–agility test significantly predicted mathematical competence and the horizontal jump test significantly predicted logical–mathematical intelligence. These results are in agreement with previous research, highlighting the importance of improving physical fitness from an early age due to its benefits for intellectual and academic development. This research aimed to examine the agreement between body mass index -based nutritional status and perceived nutritional status overall and by socio-demographic factors and to state the association between the accuracy of weight perception and weight control practices in the Chilean adult population. A population-based cross-sectional study was carried out with 5,192 Chilean adult participants from the Chilean National Health Survey 2016–2017. Agreement between BMI-based weight status and body weight perception for the total sample and across subgroups was (...) determined using the weighted kappa coefficient. The agreement between BMI-based and perceived nutritional status of the total sample was fair. A higher rate of weight perception accuracy was identified in women, younger respondents, and participants with higher education, a higher income, and from urban areas than their counterparts. Respondents with overweight or obesity tended to underestimate their nutritional status. Actions to lose weight were higher in those who had the right perception of their overweight/obesity condition and those who overestimated their body weight, regardless of their nutritional status. In all groups, weight loss behaviors were more related to the perceived than the BMI-based nutritional status. The consequences of accurate perception of the nutritional status are discussed including its effects on body weight and mental health. (shrink)

The most popular argument against moral realism is the argument from disagreement: if there are mind‐independent moral facts, then we would not expect to find as much moral disagreement as we in fact do; therefore, moral realism is false. In this paper, I develop the flipside of this argument. According to this argument from agreement, we would expect to find lots of moral disagreement if there were mind‐independent moral facts. But we do not, (...) in fact, find much moral disagreement; therefore, moral realism is false. I defend the argument, explain the empirical evidence that supports it, and show what makes this challenge novel and powerful. (shrink)

Background The birth plan is a tool that allows the self-learning and thoughtful analysis of the women during the birthing process, facilitating their making of decisions and participation, in agreement with the bioethical principles of autonomy and no malfeasance. Goal: To understand the perception and satisfaction of women who presented a birth plan. Methodology: Qualitative, descriptive, observational, retrospective and cross-sectional study. The population of the study was composed of 21 women who presented a birth plan regulated in a Hospital (...) ever since the recording of the presentation of the birth plan was started (2011) until 2015. Place: Cartagena (Murcia, Spain). Techniques/methods: Semistructured interview. Results-Discussion: Most women considered the plan as a useful self-learning tool on the meaning of the birthing process, as it favored the communication between the expectant mothers/health professionals. Our informants sought information related to the birthing process from informal sources; most perceived a level of respect of their wishes during the process of giving birth. The use of the birth plan did not imply the perception of loss of the degree of control during the birth, although attention to the written document could be improved. Conclusions The use of the birth plan is a very satisfactory and useful experience for their involvement in their self-care, although in some cases, the births did not proceed according to their plans. Nevertheless, the prevalence of the principle of Non-Malfeasance over Autonomy was evidenced. (shrink)

In this essay I argue that moral judgment is a natural kind by developing an empirically grounded theory of the distinctive conceptual content of moral judgments. Psychological research on the moral/conventional distinction suggests that in moral judgments right and wrong, good and bad, praiseworthiness and blameworthiness, etc. are conceptualized as serious, general, authority-independent, and objective. After laying out the theory and the empirical evidence that supports it, I address recent empirical and conceptual objections. Fairly recently, I came upon the following passage in a review of a book by Colin M. Turnbull, called The Mountain People : A child dumped on the ground is seized and eaten by a leopard. The mother is delighted; for not only does she no longer have to carry the child about and feed it, but it follows that there is likely to be a gorged leopard near by, a sleepy animal which can easily be killed and eaten. An (...) old woman who has been abandoned falls down the mountainside because she is blind, so a crowd gathers to laugh at the spectacle of her distress. A man about to die of gunshot wounds makes a last request for tea. As he feebly raises it to his lips, it is snatched from him by his sister, who runs away delighted. Bargaining and distribution of benefits accruing from social cooperation are central topics in contractarian accounts of morality or distributive justice in general and David Gauthier’s Morals by Agreement in particular. In this paper, I raise some problems for MbA both with regards to bargaining over the benefits of social cooperation and the distribution of such benefits. The worries I raise piggyback on a couple of Jan Narveson’s earlier queries of some of the topics in MbA: those of ‘questionable foundation’ (...) and redundancy. However, I go beyond the substance of these queries by arguing that they raise fundamental worries about the correctness of the description of the elements of the bargaining situation, and the role and significance of agreement in MbA. The topic of this paper is the foundation for individual rights proposed by David Gauthier in his seminal 1986 book Morals by Agreement, and particularly the role of conception of rationality in this foundation. The foundation of rights is a part of Gauthier’s broader enterprise: to ground morals in rationality – more specifically, in the economic conception of rationality. Because of the importance of this conception for the whole of Gauthier’s project, we reconstruct first the conception of rationality which (...) can be found in decision theory and game theory, presenting simultaneously in a relatively non-technical way some basic concepts of the aforementioned disciplines. We proceed then to reconstruction of the foundation of rights itself – it turns on Gauthier’s interpretation of the so-called “Lockean proviso.” Lastly, we turn to the connection between rationality and foundation of rights. It is to be found in the narrow compliance – the disposition to enter only into cooperation which satisfies conditions of fairness set out in part by the Lockean proviso. (shrink)

Here a group of philosophers, economists and political theorists discuss the work of David Gauthier, which seeks to show that rational individuals would accept certain moral constraints on their choices. The possibilities and limitations of a contractarian approach to issues of justice is analyzed.

David Gauthier's Morals by Agreement is the most complete and suggestive contractarian theory of morality since the work of Rawls. In this anthology a number of prominent moral and political philosophers offer a critical assessment of Gauthier's theory and its three main projects: developing a contractarian foundation for morality, defending a theory of rational choice, and supporting the claim that rationality requires one to keep one's agreements. An introduction sets out Gauthier's project, while Gauthier himself has the last (...) word, responding to the critiques. A common worry about moral conciliationism is that it entails at best uncertainty about many of our moral beliefs and at worst epistemological moral scepticism. Against this worry, I argue that moral conciliationism saves us from epistemological moral scepticism and enables us to be confident in many of our moral beliefs. First, I show that only taking disagreements seriously as a threat to our beliefs allows us to utilise agreements in support of our beliefs (...) (call this symmetry). Next, I argue that utilising moral agreements as an epistemic resource allows moral conciliationism to resist the potentially worrisome reduction in confidence of our moral beliefs. Taking the relevance of moral agreement into account, I argue that it is anti-conciliationism that must meet the challenge of epistemological moral scepticism. For this, I suggest that moral inquiry is best understood as a collective endeavour. If so, then agreement on our moral judgments is required to justify the confidence we have in many of our moral beliefs. However, by symmetry, this appeal is possible only if one accepts the conciliatory attitude towards disagreements. Hence, accepting, rather than rejecting moral conciliationism, is the way out of moral scepticism. (shrink)

In this paper, I defend a metaethical position described as ‘actual agreement contractualism’: the view that norms arise from actual attempts to arrive at legitimate terms for social cooperation among all those affected. I distinguish the actual agreement approach from hypothetical approaches to contractualism, and defend the former against objections from Thomas Scanlon, in particular. The attractiveness of a focus on actual agreements, I argue, is seen in the way it resolves problems internal to the hypothetical approach as (...) well as in its implications for the purpose of moral theory and for the obligation to justify our actions to others.Dans cet article, je défends une position métaéthique pouvant être désignée comme «contractualisme de l’accord réel», soit la position voulant que les normes découlent d’efforts réels pour s’entendre sur les termes légitimes de la coopération sociale entre tous ceux qui sont touchés. Je distingue cette approche des approches hypothétiques du contractualisme et je défends la première, notamment contre les objections de Thomas Scanlon. L’attrait d’une approche basée sur les accords réels se voit dans la façon dont elle permet de résoudre certains problèmes internes de l'approche hypothétique, mais aussi dans ce qu’elle implique quant à l'objet de la théorie morale et quant à l'obligation de justifier nos actions auprès des autres. On Moral Certainty, Justification and Practice presents a view of morality that is inspired by the later Wittgenstein. Hermann explores the ethical implications of Wittgenstein's remarks on doubt, justification, rule-following, certainty and training, offering an alternative to interpretations of Wittgenstein's work that view it as being intrinsically ethical. The book scrutinises cases in which doubt and justification do not make sense, and contrasts certain justificatory demands made by philosophers with the role of moral justification in concrete situations. It (...) offers an account of moral certainty, which is linked to a view of moral competence. Contrary to the views propounded by philosophers who emphasise the importance of moral principles, it is argued that moral agency is first and foremost a matter of having certain capacities. The book takes an anti-intellectualist stance and remains close to concrete practices. The practice-based view of morality it endorses has implications for moral education, intercultural moral dialogue and the prospects for moral agreement, change and progress. (shrink)

In his book On What Matters, Derek Parfit defends a version of moral non-naturalism, a view according to which there are objective normative truths, some of which are moral truths, and we have a reliable way of discovering them. These moral truths do not exist, however, as parts of the natural universe nor in Plato’s heaven. While explaining in what way these truths exist and how we discover them, Parfit makes analogies between morality on the one hand, (...) and mathematics and logic on the other. Moral truths “exist” in a way that numbers exist, and we discover these truths in a similar way as we discover truths about numbers. By the end of the second volume, Parfit also responds to a powerful objection against his view, an objection based on the phenomenon of moral disagreement. If people widely and deeply disagree about what is the moral truth, it is doubtful whether we have a reliable way of discovering it. In his reply, he claims that in ideal conditions for thinking about moral questions, we would all have sufficiently similar moral beliefs. However, we often find ourselves in less-than-ideal conditions due to various factors that distort our ability to agree. Therefore, differences in moral opinion can be expected. In this paper, I draw a connection between these parts of Parfit’s theory and comment on them. Firstly, I argue that Parfit’s analogy with mathematics and logic and his answer to the disagreement objection are in tension because there are important epistemic differences between morality and these fields. If one would try to account for the differences, one would have to sacrifice some measure of similarity between morality and them. Secondly, I comment on Parfit’s reply to the disagreement objection itself. I believe that, although his description of ideal conditions has some potential for reaching moral agreement, it may be difficult to tell if ideal conditions prevail. This obscurity spells further trouble for Parfit’s overall theory. (shrink)

This article attempts to find grounds for agreement and tolerance among environmentalists, as well as all persons of good will who are reasonable and scientifically informed. It beguis by taking stock of where we are today in ethics in general, and then hi environmental ethics in particular. What are the major theories, their central ideas, and problems? Is there a way forward? Explained and defended throughout is the thesis that moral pluralism is the best way forward.
