Ivancovsky et al. explore the relationship between curiosity and creativity, by suggesting they align through novelty-seeking mechanisms. We argue that a general mechanism linking both capacities together is question-asking: Curiosity drives question-asking that leads to creative problem solving. Yet, current findings from our lab suggest that question complexity relates to creativity, but not necessarily to curiosity, warranting further investigation.

Introducing the sixth and final installment of the Common Knowledge symposium “Apology for Quietism,” Allen looks at the symposium retrospectively and concludes that it has mainly concerned “sage knowledge,” defined as foresight into the development of situations. The sagacious knower sees the disposition of things in an early, incipient form and knows how to intervene with nearly effortless and undetectable (quiet) effectiveness. Whatever the circumstance, the sage handles it with finesse, never doing too much but also never leaving anything undone (...) that must be accomplished. Quiet, when it is knowingly and effectively quiet (not pusillanimous or poor in spirit), is about what not to do, how not to approach a problem, what not to decide, what is not known, what will not work. Allen explains these principles in terms of traditional Chinese thought, Daoist and Confucian: wei we wei, or “doing-not-doing,” means effective inaction. What makes such wisdom possible is not mystical insight, he argues, but discipline in a certain kind of art. The sage has no need of reasons (let alone doctrines), only effectiveness; and he does not need truth or justice, only subtlety. The detachment of a quietist has little, if anything, to do with transcending perspectives. Detachment is good as a means to flexibility, and instead of transcending perspectives, a sage is skilled in the quiet art of never getting stuck in one. To be effectively quiet is not so much to be silent as to be inaudible, invisible; the sage “vanishes into things.”. (shrink)

Many mawlids (mawlid al-nabī) have been written as a reflection of the love for the prophet Muhammad. Süleymān Çelebi’s (d. 825/1422) Wasila al-nacāt, has been seen as the founding work in Turkish literature in this category. The effect of Wasila al-nacāt has continued for centuries, and inspired many other mawlids. One of them is Enverī Erzincānī’s work named Mawlūd al-sharīf (Sumbul al-gulzār al-kalām al-kadīm). In literature tradition, mawlids are written in masnawī in ​​verse form, Mawlūd al-sharīf was written in style. (...) ode. In this respect, the work can be seen as an exception between the other ones. Another remarkable aspect of the work is the similarity between the two stories in Nasibī al-mawlid which is estimated to be written in XV. or XVI. century. Until now, no academic work has been done about Mawlūd al-sharīf. The sources that provide information about Mawlūd al-sharīf report about, two copies, one in Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi) and the other in Kastamonu Manuscript Library (Kastamonu Yazma Eserler Kütüphanesi). Research showed that the copy in Kastamonu was in fact another copy of Wasila al-nacāt another copy of Mawlūd al-sharīf was also found in the Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi). The number of couplets of Mawlūd al-sharīf has increased to 202 with the finding of the second copy. About the author of the work that is approximatly written in the XVII. or XVIII. century no information could be found. This study, introduces the Mawlūd al-sharīf and its authors, compares it with Wasila al-nacāt and presents an critical analysis of the text.Summary: The term mawlid means birth, birth time and place of birth. It was used to describe works such as the birth of the Prophet, miracles and the death of the Prophet. Next to these there also many mawlids about the lifes of Fatīma the daughter of the Prophet and her husband Alī, and few about the lifes of a spiritual guide. The first examples of this type seen in Arabic literature are Ibn Dihya al-Kalbī (d. 633/1235), Muhammad al-Azafī (d. 633/1236) and Cafar b. Hasan al-Barzancī (d. 1177/1764); Muhammad b. Masūd el-Kāzarūnī (d. 758/1356) and Sūzanī (d. 569/1173). The celebrations related to mawlid have turned into ceremonial form in the era of the Fatimies. The Fatimies held, Mawlid-al-Alī, Mawlid al-Hasan, Mawlid al-Husayin and Mawlid al-Fatīma ceremonies next to the Prophet’s. The first mawlid ceremony in the form of today was seen in the time of Muzaffar al-Dīn Gokboru (d. 630/1233).Different ideas have been put forward about the first mawlid text in Turkish literature, but Süleymān Çelebi’s Wasila al-nacat has been accepted as a pioneer work in the recognition and love of this kind. Many mawlids were written with the influence of Wasila al-nacat. The likeness of the content and the motifs of the majority of mawlids to Wasila al-nacat is interpreted as a strong sign indicating its importance in this genre. The translation of Wasila al-nacat into Arabic, Circassian, Greek, Kurdish, Tatar, Sawamish, English, German, Albanian, Bosnian... languages ​​should be considered as a factor that exposes its breadth.It is estimated that around 200 Turkish mawlids have been written, but this number is increasing with new studies. One of these mawlids is the work of Enverî Erzincānī called Mawlūd al-sharīf Ethem Erkoç and Mehmet Fatih Köksal are the researchers who have been aware of the existence of this work for the first time. Both researchers mention that the work has 142 couplets and the only copy is that in the Çorum Hasanpasha Writing Works Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi). In his work called Mawlid-nāma Köksal states that there is a second copy of the work, but the copy of Kastamonu, which is known as the second copy, is actually a copy of Wasila al-nacat. In the present study, another more bulky version of Mawlūd al-sharīf was recorded in Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi). In the catalogs of the National Library (Milli Kütüphane) and Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi), the mawlid is indicated as Persian; the reason fort his mistake might be, the fact that the first twelve of the text is Persian.Although there were many poets who used the pseudonym Enverī there is no poet in Turkish literature, who was from Erzincan and wrote a mawlid with the same pseudonym. It was understood that the poet was a sayyid.In five places the author’s name or pseudonym is mentioned. His work shows that he is from Erzincān and that he has a mawlid. As a mawlid poet Enverī, adopted a quite ambitious style. He praises himself for writing in Persian, being the best Persian speaker in this area, and boasted his pure character and wise poetry.In the headlines of the copies the work is called Mawlūd al-sharīf / Sunbul al-gulzār al-kalām al-kadīm. Therefore, it would be more appropriate to consider the work as a double name sage. The copies do not include a record of the copyright date of the work. According to the second copy, which is shorter and which has the impression that it is incomplete, the work was copied in 1249/1833. It can be said that the Mawlid was written in the XVII. or XVIII. century because of its language and style.In the mawlid tradition of writing mawlid, generally masnawī form was preferred. Rarely some mawlids were conposed in verse styles. One of these works, which are two for now, is the one in which Çizmeci-zāde Vehbī wrote the couplets of Wasila al-nacat in sixth verse form. The other one is the Mawlūd al-sharīf of Enverī Erzincān. Mawlūd al-sharīf was written entirely in the form of an ode, except of two stories with 48 couplets must have been added later. The work with 202 couplet was separated from Wasila al-nacat and other mawlids in terms of starting with a Persian tawhid and using the style of an ode. Because of the small number of citations, the subjects described in Wasila al-nacat have not been contacted or have been summarized. Mawlūd al-sharīf is one of the shortest ones. Because of the small number of couplets of Mawlūd al-sharīf, the subjects described in detail in Wasila al-nacat are either not mentioned or only summarized. The work, consists of two major sections: The birth of the Prophet and the miracle of miraj. The remarkable feature of Mawlūd al-sharīf is that the two stories told are identical to the stories in Nasībī Mawlid (XV. or XVI. century). The first story tells how, a Jewish couple living in Baghdad became Muslims because of their respect for the mawlid ceremony. The second story tells about, a young named Alī who organized a mawlid ceremony with little money left from his mother and therefore died with faith. Surprisingly, this similarity is seen in the content and narrative forms of the stories in both texts. The fact that the comparative stories are almost the same makes on think of the possibilities of imitating, quoting or saving rather than an impression of the author by the previous text. Taking into account the chronological time, it seems more likely to accept the quotations in the Mavlūd al-sharīf as duplicating. Writing the stories in Mawlūd al-sharīf after the main chapters and the line differences in the rulers reinforce the impression that the stories are added later. (shrink)

We consider small-weight Cutting Planes (CP * ) proofs; that is, Cutting Planes (CP) proofs with coefficients up to $\operatorname{Poly}(n)$ . We use the well known lower bounds for monotone complexity to prove an exponential lower bound for the length of CP * proofs, for a family of tautologies based on the clique function. Because Resolution is a special case of small-weight CP, our method also gives a new and simpler exponential lower bound for Resolution. We also prove the following (...) two theorems: (1) Tree-like CP * proofs cannot polynomially simulate non-tree-like CP * proofs. (2) Tree-like (CP * proofs and Bounded-depth-Frege proofs cannot polynomially simulate each other. Our proofs also work for some generalizations of the CP * proof system. In particular, they work for CP * with a deduction rule, and also for any proof system that allows any formula with small communication complexity, and any set of sound rules of inference. (shrink)

Turkish-Islamic literature contains numerous religious literar writings. In the existing literature, it can be seen that many kinds such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, and al-asmā al-ḥusnā were written. Al-Asmā al-ḥusnā, written in the form of poetry and prose, were mostly sharḥ or their khawaṣṣ were explained. Çihil-nām al-Manẓūm, which is mentioned in the study, was written as khawaṣṣ al-asmā al-ḥusnā. The work is a poet entitled as Fażāyī. Manuscript was written in the (...) last quarter of the fifteenth century, and thus, it is presumed that the poet lived in the same century. This work has been identified in a manuscript. In addition, the poet’s Hadiyyat al-aḥbāb, der-Bayān al-maqāmāt al-darwīshān, Kitāb al-sharʿiyyat al-arbāb, and Ghazaliyyāt al-Darwīsh Fażāyī four other works have been identified. In the writings of the asmā al-ḥusnās, the names of ninety-nine were emphasized. In this study, the forty names of God are expressed. The text presented is a continuation of the tradition of writing some prose works written in Arabic and Persian. Çihil-nām al-Manẓūm, written in Arabic prose and known as Asmā al-Idrīsiyya it can be seen as a free stsyle translation of the prophet Idrīs. Forty names in the content of the work, their proper-ties, when, how much and how to read is explained. In this study, firstly the information about the subject of Qurʾān, hadith, Arabic, Persian and Turkish literature in the beautiful names of God is provided. Then, the information about the poet Fażāyī was given. Çihil-nām al-Manẓūm was introduced and the transcriptional form of the text was given.SummaryOne of the reasons that deeply affect a nation is the change of religion. In this literature, which has begun to be formed, religious genres such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, have been revealed. Religious literary writings about God were written in the form of tawhīd and munājāts, which consist of one or more prophets found at the head of the dīwāns, or as the annotations of asmā al-ḥusnā or as khawaṣṣ asmā al-ḥusnā.In time, the need for some Turkish literary and scientific works to be translated into a different language were born. It can be seen that with some changes such as subtraction and addition, texts are rewritten or poetic works are translated into prose. In the Qurʾān, there is no information about the number of asmā al-ḥusnā mentioned as a concept. However, the number of the names of God in the Qurʾān is 155. This number is differ-ent in ḥadīths. It is widely accepted that the number of asmā al-ḥusnā is 99. Some Islamic schol-ars have argued against such restricting statements, arguing that ninety-nine names, such as the hiding of the Night of Qadr, were hidden in all Divine names during the month of ramaḍān, while others suggested that the number of ninety-nine was large number of asmās (names).The first examples of asmā al-ḥusnā were written in Arabic literature. The mysterious secrets were revaled to him in 30 ṣuḥuf. His major miracles are governing spiritual beings, knowing the properties of the beings and possessing the knowledge of various unknown things. Again, he wrote a book about the char-acteristics of letters. Aristotle later wrote a commentary using the majority of the information found in this book. Some of the works are written to narrate the Prophet Idrīs’s praising God with forty names:Muḥammad al-Tunisian, al-Ravḍatu al-Sundusiyya fī asmā al-ḥusnā al-Idrīsiyya al-Suhrawardiyya; Shāb al-Dīn Yaḥya b. Ḥabash al-Suhrawardī, Çihil-nām. Among these, the most famous is the work called Asmā al-Idrīsiyyā, written by Suhrawardī. Comparative study of the theory of knowledge (Islam) with special reference to the philosophy of Ghazzālī, 1058-1111 and Aḥmad Raz̤ā K̲h̲ān̲, 1856-1921.

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

I argue for a new conception of practical authority based on an analysis of the relationship between authority and subject. Commands entail a demand for practical deference, which establishes a relationship of hierarchy and vulnerability that involves a variety of signals and commitments. In order for these signals and commitments to be justified, the subject must be under a preexisting duty, the authority’s commands must take precedence over the subject’s judgment regarding fulfillment of that duty, the authority must accept the (...) position and responsibilities of command, and the authority must be sufficiently trustworthy relative to how vulnerable the subject makes herself by deferring. This results in an instrumentalist conception of practical authority that can be favorably compared to Joseph Raz’s famous service conception. The relational conception’s main advantage is that it focuses on the authority as much as the subject, requiring that the authority accept responsibility for the relationship and be sufficiently trustworthy. The article considers the nature of legalistic, or formal, conceptions of the rule of law, focusing particularly on the work of Joseph Raz and Albert Venn Dicey. It asks how such apparently narrow conceptions are generated, and how far they can resist including broader social claims. It concludes that the rationale behind legalistic conceptions compels them to address issues of poverty and the literacy of the law's subjects. However, legalistic conceptions of the rule of law can still avoid sliding into (...) the wider non‐legalistic models advanced by writers such as T. R. S. Allan. (shrink)

We study the complexity of proving the Pigeon Hole Principle in a monotone variant of the Gentzen Calculus, also known as Geometric Logic. We prove a size-depth trade-off upper bound for monotone proofs of the standard encoding of the PHP as a monotone sequent. At one extreme of the trade-off we get quasipolynomia -size monotone proofs, and at the other extreme we get subexponential-size bounded-depth monotone proofs. This result is a consequence of deriving the basic properties of certain monotone formulas (...) computing the Boolean threshold functions. We also consider the monotone sequent expressing the Clique-Coclique Principle defined by Bonet, Pitassi and Raz [9]. We show that monotone proofs for this sequent can be easily reduced to monotone proofs of the one-to-one and onto PHP, and so CLIQUE also has quasipolynomia -size monotone proofs. As a consequence of our results, Resolution, Cutting Planes with polynomially bounded coefficients, and Bounded-Depth Frege are exponentially separated from the monotone Gentzen Calculus. Finally, a simple simulation argument implies that these results extend to the Intuitionistic Gentzen Calculus. Our results partially answer some questions left open by P. Pudlák. (shrink)

This paper examines the following three questions: (1) In The Rose Garden of Mystery (Golshan-e Rāz), how does the prominent 7-8th-century Iranian Sufi, Maḥmūd Shabistarī, distinguish the mystical “contemplation” and “rational reflection” in pursuing divine knowledge? (2) Was Shabistarī an anti-rationalist (strict fideist)? (3) How does Shabistarī’s position fit into the ancient Greek, Neoplatonist, and medieval Islamic and Christian metaphysics? This paper examines Golshan-e Rāz in the context of Shabistarī’s other works, commentaries, secondary sources, and Islamic thought—Sufism and philosophy. Existing (...) literature on Golshan-e Rāz primarily focuses on its literary aspects, neglecting its philosophical and mystical concepts. However, a thorough understanding requires examining these concepts in a broad context, which will inspire further research. The rationale behind this research is rooted in the religious obligation for believers to know God, with “thinking” as the means to acquire such knowledge. This is why the first question Herawī poses to Shabistarī pertains to the nature of thought—justifying this paper’s focus. Contemporary opposition to religion often stems from its perceived incongruity with the rational frameworks offered by positivism, materialism, or scientific inquiry. By differentiating between mystical and rational modes of thought that Shabistarī presents, this study shows the contemporary person that intellectual inquiry extends beyond rationalism and encompasses mysticism. Consequently, rational and mystical perspectives should be pursued in the quest for the divine. Furthermore, this study contends that Shabistarī should not be regarded as a strict fideist; instead, his criticism is directed toward the constraints inherent in rational thinking. (shrink)

The ‘liberal-communitarian’ debate arose within anglophone political philosophy during the 1980s. This essay opens with an account of the main outlines of the debate, showing how liberals and communitarians tended to confront each other with opposing interpretations of John Rawls’ Theory of Justice (1999; originally published in 1971) and Political Liberalism (2005; originally published in 1993). The essay then proceeds to discuss four forms of ‘liberalism after communitarianism’: Michael Freeden’s account of liberalism as an ideology; Joseph Raz and Will Kymlicka’s (...) perfectionist liberalisms; the liberalism of value pluralists such as Isaiah Berlin and Bernard Williams; and Judith N. Shklar’s liberalism of fear. Fakhr al-Dın al-Razı’s final theological treatise, al-Matalib al-‘Aliya min al-‘Ilm al-Ilahiyya, is sufficient justification for the assertion of his towering significance as interpreter of Ibn Sına and in the development of new theological paradigms. Yet such is its richness and subtlety that al-Razı’s views in the Matalib on key doctrinal issues such as the creation of the world require much further study. Previously, scholars have maintained that al-Razı refrains from affirming any one doctrine of creation. I argue to the contrary, (...) that despite al-Razı’s epistemological caution on matters pertaining to the action of God, he ultimately deems creation ex nihilo most probable on the balance of evidence, and therefore the doctrine that is to be believed. İbâziyye hicrî birinci yüzyılda neş’et eden ilk kelâm fırkalarından birisidir. Birçok makâlât türü eserde İbâziyye’nin, Hariciliğin en mu’tedili ve günümüze ulaşan tek kolu olduğu ifade edilmektedir. Buna rağmen ilk dönem İbâzî âlimlerden günümüz İbâzîlerine kadar birçok kişi, İbâziyye’nin Haricî bir fırka olmadığını savunmaktadır. İbâzîler şirk ve isti’raz gibi bazı konularda Haricilerden farklı görüşlere sahip olmakla birlikte, iman-küfür, tevellâ-teberrî, imâmet, vb. birçok konuda ise Haricîlerin görüşlerine benzer görüşleri savunmaktadırlar. Haydar el-Herevî Horasan’dan Osmanlı topraklarına gelen önemli âlimlerdendir. Teftâzânî’nin şeçkin bir talebesi olan bu âlim I. Mehmed’ten büyük saygı görerek onun tarafından himaye edilmiştir. Herevî, Zemahşerî’nin el-Keşşâf’ı üzerine yazdığı şerhi büyük övgü ifadeleriyle I. Mehmed’e ithaf etmiş, ithafın yer aldığı mukaddimede hayat hikayesiyle ilgili önemli ayrıntılar vermiştir. Osmanlı topraklarında geçirdiği uzun yıllar sonra Timur’un oğlu Şahruh ile irtibat kuran Herevî, el-Keşşâf şerhi mukaddimesini tekrardan kaleme alarak aynı eseri bu sefer Şahruh’a ithaf etmiştir. Herevî’nin bu yeni patronaj ilişkisi mukaddimenin ikinci versiyonundan (...) öğrenilmektedir. İkinci versiyonda sadece ithaf kısmı değiştirilmemiş, yeni haminin kimliğiyle irtibatlı olarak muhteva da yeni- den kurgulanmıştır. İlk versiyonda bulunmayan önemli biyografik ayrıntılar ikinci versiyonda yer almaktadır. Mukaddimenin iki versiyonu Herevî biyografisinin neredeyse yegâne kaynağıdır. Bu makalede mukaddimenin ikinci versiyonu ilk defa gün yüzüne çıkarılmış ve her iki versiyonda verilen bilgiler bir araya getirilerek Herevî’nin biyografisi inşa edilmiştir. İki versiyonda herhangi bir tarih verilmemiş, sadece bazı şehirlerdeki ikamet süreleri belirtilmiştir. Biyografi inşa edilirken anlatıda oluşan boşluklar tarihi olaylardan hareketle doldurulmuş ve tarihlendirme yapılmıştır. Bahsedilen olaylar, yapılan nitelemeler ve verilen ikamet süreleri itibara alınarak Herevî’nin hayatının yaklaşık kırk yıllık bölümü tam olarak tarihlendirilmiş, Serahs’tan başlayarak sırasıyla Şîraz, Tebriz, Şirvan, Bursa, Edirne ve tekrar Horasan’a uzanan yıllara dair bütünlüklü bir tablo ortaya konulmuştur. Bu hayat hikayesi ulema-sultan ilişkileri, siyasî gelişmelerin ilim hayatına yansımaları ve hayatını ilim yolculuklarında geçiren bir âlimin zihin dünyası hakkında eşsiz bilgiler sunmaktadır. Alexy si prefigge di individuare quale argomentazione sia razionale (rationaler), ma soprattutto di quali argomentazioni siano inaccettabili poiché del tutto irrazionali: l'autore intende così fornire un criterio di individuazione che possa soddisfare le esigenze del ragionamento giuridico (principalmente quello giudiziario). La ricerca di Alexy non si propone di affermare un giudizio di valore su cosa possa essere considerato effettivamente morale o giuridico e cosa non possa esserlo, vale a dire una particolare decisione, come esito finale del ragionamento, mentre tutto il (...) suo impegno filosofico è diretto verso la definizione delle condizioni metodologiche per la correttezza del ragionamento stesso, allo scopo di scongiurare o, comunque, individuare eventuali irrazionalità. La teoria dell'argomentazione giuridica di Alexy si presenta come un insieme di regole che possono essere considerate una summa ricavata in parte dalla logica formale: accanto a queste rigorose formulazioni, però, si possono osservare anche i contributi della logica induttiva e gli strumenti della retorica, relativi alla verifica delle premesse, come il principio dell'onere dell'argomentazione o del precedente. Le regole individuate da Alexy si dividono essenzialmente in due principali categorie: la prima concernente il discorso pratico generale, la seconda riguarda invece il discorso giuridico, inteso come caso particolare del primo. Nei capitoli seguenti si procede dunque all'analisi di alcuni aspetti della teoria dell'argomentazione, tenendo conto anche delle osservazioni formulate dallo stesso Alexy in risposta alle critiche ricevute, tentando di distinguere i validi contributi della teoria stessa da quegli aspetti che possono apparire eccessivi e inadeguati rispetto alla metodologia adottata. La posizione metodologica debole di Alexy, che mira solo all'esclusione dell'estrema irrazionalità, non risulta poi davvero così “debole” e provoca le critiche di O. Weinberger, J. Habermas, N. MacCormick e J. Raz. L'obiettivo che la teoria di Alexy sembra prefiggersi e mancare, o quanto meno non essere in grado di giustificare adeguatamente il metodo elaborato per conseguirlo, è soprattutto l'elaborazione di una procedura di giustificazione esterna. I severi limiti che lo stesso Alexy pone preliminarmente al proprio progetto vengono infranti, seppure in senso debole, estendendosi al di fuori dell'orizzonte limitato della razionalità relativa al diritto vigente, qualunque esso sia: Alexy non è del tutto fedele alle proposte avanzate con la sua prospettiva debole, in particolare alla netta separazione tra argomentazione e decisione. La neutralità del criterio di controllo di razionalità contrasta, infatti, con qualsiasi pretesa di giustizia, se, come sostenuto da Alexy, deve essere intesa come relativa ad un ordinamento giuridico positivo. Un contributo importante dell'opera di Alexy è la definizione estensiva del concetto stesso di argomentazione elaborata dall'autore che riafferma la complessità e l'apertura del discorso giuridico ben oltre i limiti posti dalle metodologie che ne costringono l'orizzonte entro un rigido logicismo giuridico. Il metodo adottato da Alexy rappresenta un valido contributo anche per lo statuto epistemologico della scienza giuridica, distinguendo l'elaborazione scientifica delle procedure per garantire il controllo di razionalità dalla certezza dei risultati conseguibili. Una volta accettata la sua funzione solo nei suoi limiti storici e politici di strumento di notevole riduzione dell'ambito dell'irrazionalità del discorso giuridico e dei suoi esiti, si può valutare correttamente tutta la portata della teoria, “non definitiva”, elaborata da Alexy e la sua struttura aperta nei confronti di ogni specie di ragionamento giuridico, come prescritto dall'ultima regola di transizione del discorso pratico generale, che espone tutta la teoria dell'argomentazione ad un perenne confronto dialettico con ogni possibile e diversa tesi. İlk dönem İslâm fırkalarından biri olan İbâziyye, Türkiye’de İslâm mezhepleri tarihi başta olmak üzere kelâm, hadis, tefsir, fıkıh gibi bilim dalları kapsamında incelenmiş ve önemli akademik araştırmalara konu olmuştur. Cumhuriyet döneminde İbâziyye fırkasına dair yapılan akademik araştırmalar bilhassa yirmi birinci yüzyılda hızlı bir artış göstermiştir. Bu çalışmada İslâm mezhepleri tarihi alanı başta olmak üzere İslâmî ilimlerde İbâzîlik üzerine yazılan kitap, lisansüstü tez, makale ve bildirilerin bir bibliyografyası hazırlanmış ve Cumhuriyet döneminde İbâziyye araştırmalarının tarihi seyri incelenmiştir. İslâm mezhepleri tarihi bilim dalında (...) İbâzîlik üzerine yapılan çalışmalarda iki temel yaklaşımın benimsendiği görülmüştür. Birinci yaklaşıma göre, Sünnî bakış açısıyla geleneksel mezhepler tarihi kaynakları esas alınarak, İbâziyye Hâricîlerin devamı olarak kabul edilmiştir. Bununla birlikte İbâzîlerin bu konudaki itirazları göz ardı edilmiştir. İkinci yaklaşıma göre ise, Sünnî kaynakların yanında İbâzî kaynaklar da esas alınarak fırka anlaşılmaya çalışılmıştır. Burada müellifler İbâziyye’yi kendi kaynakları üzerinden tanımlayarak, Hâriciyye’den bağımsız bir mezhep olarak değerlendirmişlerdir. İbâziyye’nin Hâricî düşünce yapısından farklılaşan yaklaşımları nedeniyle onlardan ayrılarak, günümüze kadar ulaşmayı başardığını vurgulamışlardır. Mezheplere ilişkin yapılan araştırmalarda objektif veriler ortaya koymak için kaynakların karşılaştırmalı olarak ele alınması gerekmektedir. Aksi hâlde yapılan çalışmalar, doğru verileri yansıtmak yerine sonuçları bilimsellikten uzak, tek taraflı bakış açısının ürünü olarak kalmaktadır. Bu sebeple fırkalar incelenirken, kendi kaynaklarındaki tanımlamalarına da yer verilmelidir. Ancak İbâziyye fırkasına ilişkin kaynakların birçoğunun günümüze kadar ulaşmamış olması yahut siyasî, itikadî, fıkhî görüşlerinin yeterince tanınmamış olması gibi nedenler; İbâziyye’nin gerçekte olandan farklı bir zeminde, yanlış bilgiler üzerinden tanınmasına sebebiyet vermiştir. Bunun yanı sıra mezheplerin, teşekkül sürecinin ardından sistematik hâle gelmesine kadar ki dönemde dinamik yapıda olmaları da göz ardı edilmemesi gereken bir diğer husustur. Bu bağlamda araştırmacılar İbâziyye mezhebinin ortaya çıkışından sistematikleşmesine değin oluşturduğu kendine has görüşleri açıklığa kavuştururken, birincil kaynaklar üzerinden mukayeseli okumalar yaparak, bütüncül olarak analiz etmeleri gerekmektedir. Çalışmamızda Cumhuriyetin ilk yıllarından günümüze kadar İbâzîlik üzerine yapılan araştırmaların bir bibliyografyasını sunduk ve yukarıda belirtilen yaklaşım biçimlerini analiz ettik. Bu kapsamda İslâmî ilimler literatüründe İbâziyye fırkasına ilişkin veriler sunan araştırmacıların konuya dair yaklaşımlarını literatür taraması sonucunda tespit ederek kronolojik olarak sıraladık. Araştırmamız neticesinde, İbâzîlerin kendi kaynaklarını temel alan özgün akademik çalışmaların uzun süre sınırlı kaldığı ve sayıca az olduğu ancak son yıllarda bu alandaki araştırmaların belirgin bir artış gösterdiği sonucuna ulaştık. Bu araştırmaların ivme kazanmasına yönelik çözüm önerilerinde bulunarak İbâziyye ile ilgili çalışmaların daha ileri bir noktaya taşınmasının gerekliliğini ortaya koyduk. (shrink)

The present paper aims to study the issue of the value of life in Murray N. Rothbard’s work, and to examine his argument for the contention that “life _should_ be an objective ultimate value” and that “the preservation and furtherance of one’s life takes on the stature of an incontestable axiom.” Rothbard’s assumptions and presuppositions are investigated and critically assessed. Using conceptual and logical analysis rooted mostly in the praxeological method of economics (as developed by Mises and Rothbard himself) and (...) the theory of value (Scheffler, Raz, Elzenberg), it is demonstrated that Rothbard’s account is fallacious both on its own as well as on broader theoretical grounds. It is argued that what Rothbard could—under his specific assumptions about valuing—correctly claim is only that an actor values life _to some extent_, rather than that life has an objective ultimate value or preservation and furtherance of one’s life has an axiomatic status. The theoretical argument is supported by empirical illustration from suicide terrorism. The paper submits that Rothbard’s position on the value of life is unsound, and that using his argumentation as it stands cannot succeed. (shrink)

Did Alcidamas invent the story of the contest of Homer and Hesiod? Martin West has argued that he did , 433 ff.). I believe that there are a number of reasons for thinking this improbable. The stories of the deaths of Homer and Hesiod were traditional before Alcidamas. Heraclitus knew the legend of the riddle of the lice and Homer's death , and the story of Hesiod's death was well known by Thucydides’ time . The first attempt to record information (...) about Homer's life is ascribed to Theagenes of Rhegium, in the late sixth century b.c. . By that time it seems likely that there was already a considerable body of legends about the early poets. The pieces of hexameter verse in the Herodotean Life of Homer, some of which show detailed knowledge of the area around Smyrna in the archaic period, probably date from before 500 b.c. In relating the stories of the poets’ deaths Alcidamas is recording the results of στορα, and this is what he implies in Michigan papyrus 2754 . West's theory requires one to assume that he has incorporated with these traditions his own fiction of the contest. This seems to me to go against what we know in general about the activity of sophists such as Alcidamas. Although they were capable of inventing myths , there is no evidence that they created such stories about earlier historical figures, rather than collecting popular legends about them, and using these for their own purposes. It is true that Critias used the evidence of Archilochus’ own poetry to draw conclusions about his life . But this is not the same as inventing a story virtually from scratch. Hesiod's own testimony about his poetic victory , the original starting-point for the legend of the contest with Homer, did not on its own provide a basis from which such inferences could be drawn. It seems more likely that the legend is the product of earlier popular embroidery, at a time when speculation about these early poets’ lives was becoming common. (shrink)

The question to be discussed in this paper can be put in simple terms: at what date were the collections of scholia on classical Greek authors compiled? Scholars have given two conflicting answers. The first was put forward by J. W. White in his edition of the scholia to Aristophanes' Birds. Developing an opinion of Dindorf, he suggested that the archetype of the scholia was a large parchment codex of the fourth or fifth century, which contained in the margins a (...) commentary drawn from several sources. A very similar view has been expressed about the scholia to Apollonius Rhodius and Pindar. (shrink)

The relation of the special and the general principle of relativity to the principle of covariance, the principle of equivalence and Mach's principle, is discussed. In particular, the connection between Lorentz covariance and the special principle of relativity is illustrated by giving Lorentz covariant formulations of laws that violate the special principle of relativity: Ohm's law and what we call “Aristotle's first and second laws.” An “Aristotelian” universe in which all motion is relative to “absolute space” is considered. The first (...) law: a free particle is at rest. The second law: force is proportional to velocity. Ohm's law: the current density is proportional to the electrical field strength. Neither of these laws fulfills the principle of relativity. The examples illustrate, in the context of Lorentz covariance and special relativity, Kretschmann's critique of founding Einstein's general principle of relativity on the principle of general covariance. A modification of the principle of covariance is suggested, which may serve as a restricted criterium for a physical law to satisfy Einstein's general principle of relativity. Other objections that have been raised to the validity of Einstein's general principle of relativity are based upon the preferred state of inertial frames in the general, as well as in the special theory, the existence of tidal effects in “true” gravitational fields, doubts as to the validity of Mach's principle, whether electromagnetic phenomena obey the principle, and, finally, the anisotropy of the cosmic background radiation. RÉSUMÉDes travaux récents par Joseph Raz, Niko Kolodny et Sergio Tenenbaum suggèrent qu'il n'existe aucune contrainte normative propre aux intentions. De telles contraintes seraient un mythe. Selon eux, il est possible d'articuler la rationalité des intentions sans postuler que l'intention est un état mental. Je soutiens que nous pouvons aussi comprendre la nature descriptive des intentions sans postuler que l'intention est un état mental. Tout comme l'idée selon laquelle il y aurait des contraintes normatives propres aux intentions, ce postulat est (...) aussi un mythe.
