This article provides an account of a collaborative teaching and learning project conducted in the English programme at the University of Tasmania in 2015. The project, Blended English, involved the development, implementation, and evaluation of learning and teaching activities using online and mobile technologies for undergraduate English units. The authors draw on the project’s findings from survey and focus group data, and staff reflective practice and peer review, to make the case for increasing technology-enhanced teaching and learning in English literary (...) studies. The blended approach described in this article has the capacity to enhance disciplinary learning; increase accessibility for students in remote and regional areas; facilitate deeper scholarly enquiry; and encourage staff to develop innovative, collaborative, and flexible teaching and learning practices. Vaccine mandates played a critical role in the success of New York City’s COVID-19 response. By relying on evidence as a substantive basis for the mandates and adhering to procedural requirements and precedent, New York City leveraged its position and expertise as a local governmental authority to devise mandatory vaccine policies that withstood numerous legal challenges. New York City’s experience highlights the role of municipal government in mounting a meaningful public health response, and the strategies adopted by NYC may provide (...) a blueprint for municipalities around the world facing the ongoing COVID-19 pandemic and the threat of future public health emergencies. Kant claims that persons have a perfect duty to respect themselves. I argue, first, that Kant’s argument for the duty of self-respect commits him to an implausible view of the nature of self-respect: he must hold that failures of self-respect are either deliberate or matter of self-deception. I argue, second, that this problem cannot be solved by understanding failures of self-respect as failures of rationality because such a view is incompatible with human psychology. Surely it is not irrational for people, (...) especially members of oppressed groups, to view themselves as having diminished moral worth. (shrink)

Critics have argued that Rawls's account of self-respect is equivocal. I show, first, that Rawls in fact relies upon an unambiguous notion of self-respect, though he sometimes is unclear as to whether this notion has merely instrumental or also intrinsic value. I show second that Rawls’s main objective in arguing that justice as fairness supports citizens’ self-respect is not, as many have thought, to show that his principles support citizens’ self-respect generally, but to show that his principles counter the effects (...) of the market on lower class citizens’ sense of worth. This discussion establishes that Rawls, in the end, sees self-respect primarily as an intrinsic good. (shrink)

There appears to be a tension between two commitments in liberalism. The first is that citizens, as rational agents possessing dignity, are owed a justification for principles of justice. The second is that members of society who do not meet the requirements of rational agency are owed justice. These notions conflict because the first commitment is often expressed through the device of the social contract, which seems to confine the scope of justice to rational agents. So, contractarianism seems to ignore (...) the justice claims of the severely cognitively impaired. To solve this problem, Martha Nussbaum proposes the capabilities approach. The justifiability condition, on this approach, is met by the idea of overlapping consensus. This essay argues that overlapping consensus cannot meet liberalism’s justifiability condition, nor is it more inclusive of the cognitively impaired. Therefore, we have reason to retain the contract device and look for another way to ensure that liberalism respects the justice claims of all. (shrink)

Many distributive egalitarians do not endorse strict equality of goods. Rather, they treat an equal division as having a special status such that departures from equality must be justified. They claim, then, that an equal division is “presumptively” just. Though the idea that equality is presumptively just and that departures from it may be just has intuitive appeal, making a case for this idea proves difficult. I argue, first, that extant “presumption arguments” are unsound. Second, I distill two general philosophical (...) morals: luck egalitarians have not adequately defended the presumption of equality and they face serious obstacles in doing so; Rawls has defended it, but only indirectly via the contract apparatus. This approach narrows the presumption’s appeal. Third, I consider and reject two alternative ways of understanding the presumption of equality that might avoid the problems revealed by my examination of extant views. The first appeals to the idea of value pluralism. The second treats the presumption as a view about the burden of proof. I conclude, ultimately, that it is misleading to think of distributive egalitarianism as typically having the form of a presumption argument. (shrink)

Luck egalitarianism has been criticized for condoning some cases of oppression and condemning others for the wrong reason—namely, that the victims were not responsible for their oppression. Oppression is unjust, however, the criticism says, regardless of whether victims are responsible for it, simply because it is contrary to the equal moral standing of persons. I argue that four luck egalitarian responses to this critique are inadequate. Two address only the first part of the objection and do so in a way (...) that risks making luck egalitarianism inconsistent. A third severely dilutes the luck egalitarian doctrine. A fourth manages to denounce some instances of oppression for the right reason, but at the same time permits other instances of oppression and condemns yet others for the wrong reason. (shrink)

According to Catharine MacKinnon, pornography itself subordinates women by ranking women as inferior to men and legitimating acts of violence and discrimination against us. As such, pornography is directly implicated in women's diminished moral and civil status. It follows that pornography is not a form of speech, but rather an action, and so does not deserve first amendment protection. I argue that MacKinnon does not adequately support her claim that pornography is an action but instead shows that it is harmful (...) speech. While this might be grounds for limiting it, MacKinnon does not adequately support the view that pornography is especially harmful in comparison to other sorts of misogynist and sexist speech. My article discusses the character of Marla, the narrator’s lover, in the film Fight Club. Her only option, within the terms of the film’s logic, I argue, is to define her worth derivatively, by association with the narrator. Fight Club, then, despite its somewhat self-effacing attitude about the rejuvenation of masculinity that it portrays, reinforces a familiar patriarchal story: men’s sense of worth lies in their joint world-making activities. Women’s sense of worth lies in their attachment to individual men who (...) undertake these activities. My main argument builds upon three preliminary discussions. The first is a brief outline of the contours of the concept of self-respect. The second is an analysis of the links between gender, personhood and the grounds of self-respect. The third is an account of my approach to interpreting Fight Club given its many layers of irony. Drawing on these preliminary discussions, I examine two interpretations of the film’s social commentary— what I call the “gender-neutral” and the “gender-specific” interpretations. I show that on both of these readings the film implies that Marla, as a woman, must regain her self-respect through an intimate relationship with the narrator. (shrink)

A certain tension cuts across Althusser’s many theoretical experiments: a tension — perhaps even a “paradox”— between science and struggle. In a conjuncture in which a self-defeating skepticism short-circuits the conjunction between science and struggle, it seems vital to reformulate this problem anew. By turning to Althusser’s formulation of the “revolutionary” materialist dialectic in the so-called “theoreticist” texts this essay elaborates a re-formulation of the supposed aporias of this paradox and finds a possible way out of it. Science and struggle (...) are disarticulated insofar as no other practice produces the effect of their conjunction. That is the task of the revolutionary materialist dialectic. Having defined “Althusserianism” as the philosophical practice which continuously produces combinations, conjunctions, or encounters between science and struggle, this essay then turns to the theoretical and political practice of Mauricio Malamud. The variations in the “Althusserianism” of this communist philosopher and militant further displace the apparent paradoxical character of the relation between science and struggle. In the political and theoretical practice of Malamud, this essay encounters both the necessity of theory as “a guide for action” and affirms neither “a scientism without politics” nor a “politicism without science.” . In Equal Citizenship and Public Reason, Watson and Hartley dispute the claim that Rawls’s doctrine of political liberalism must tolerate gender hierarchy because it counts conservative and orthodox religions as reasonable comprehensive doctrines. I argue that their defense in fact contains two arguments, both of which fail. The first, which I call the “Deliberative Equality Argument”, fails because it does not establish conclusively that political liberalism’s demand for equal citizenship forbids social practices of domination, as the authors contend. In addition to having an institutional site or scope, a theory of distributive justice might also have an institutional ‘reach’ or currency. It has the first when it applies to only social phenomena. It has the second when it distributes only socially produced goods. One objection to luck egalitarianism is that it has absurd implications. In response, Tan has defended a luck egalitarian account that has a strictly institutional reach. I argue, first, that Tan’s view contains two fatal ambiguities and, (...) second, that, to be sound, it requires an institutional currency. This second argument implies that virtually all extant luck egalitarian currencies are incompatible with his approach. I argue, third, that the alleged absurd implications often have little to do with the extent of luck egalitarianism’s reach. (shrink)

Thomas Hobbes’ theory of punishment plays a constitutive role in the Leviathan’s theory of state sovereignty. Despite this, Hobbes’ justification for punishment is widely found to be discrepant, weak, inconsistent, and contradictory. Two dominant tendencies in the scholarship attempt to stabilize the Leviathan’s justification for the state’s right to punish by either identifying it with the sovereign’s right to war or by elaborating a theory of authorization within the state. In contrast, by tracing the deployments of the metaphor that Hobbes (...) utilizes to evoke the state’s right to punish in the Leviathan (i.e. that of the nerves of the Leviathan) this paper finds that these two accounts can be made to be consistent with each other — thereby destabilizing the grounds upon which the theory of punishment can be founded. In his book On the Nature of Marx’s Things Jacques Lezra inherits another Marx and another materialism. It is an aleatory materialism: a materialism of the dynamic contingency of Marx and his “things”. This “subterranean current” of aleatory materialism is excavated by Lezra in his swerve through the letters, notebooks, and “private notes” of a young Marx working on his doctorate thesis. Following Lezra’s necrophilological thread –which encounters Lucretius and his “things”– we find that, in a parallel fashion, Marx is (...) also searching for a concept of science in his dissertation. This is what here is tentatively called a science of contingency. This science – though not in the usual disciplinary sense– opens the possibility of an alliance with Karen Barad’s performative materialism that displaces the humanism of the “new materialisms” by thinking alongside another science of contingency, also of a certain Lucretian inheritance, and which Marx did not get to think: quantum mechanics. -/- -- -/- En su libro On the Nature of Marx’s Things Jacques Lezra hereda otro Marx, y otro materialismo. This paper argues that luck egalitarianism, especially in the guise of equality of opportunity for welfare, is in tension with the ideal of fair equality of opportunity in three ways. First, equal opportunity for welfare is compatible with a caste system in employment that is inconsistent with open competition for positions. Second, luck egalitarianism does not support hiring on the basis of qualifications. Third, amending luck egalitarianism to repair this problem requires abandoning fair access to qualifications. Insofar as luck egalitarianism (...) cannot support fair equality of opportunity, it cannot do justice to the claims of the disabled. Indeed, in the absence of fair equality of opportunity, disabled people are likely to be marginalized. (shrink)

When policy issues involve complex technical questions, demonstrations are more likely to marshal charts, graphs, models, and simulations than to mobilize popular movements in the streets. In this paper we analyze PowerPoint demonstrations, the most ubiquitous form of digital demonstrations. Our first set of demonstrations are the PowerPoint presentations made in December 2002 by the seven finalist architectural teams in the Innovative Design competition for rebuilding the World Trade Center. Our second case occurred some blocks away, several months later: Colin (...) Powell's PowerPoint demonstration at the United Nations. We argue that Edward Tufte's denunciation of PowerPoint does not capture the cognitive style made possible by the affordances of this pervasive new technology. On the basis of our case materials, we demonstrate the distinctive morphology of PowerPoint. Its digital character provides affordances (1) that allow heterogeneous materials to be seamlessly re-presented in a single format that (2) can morph easily from live demonstration to circulating digital documents that (3) can be utilized in counter-demonstrations. A careful examination of this widely used technology is critical for understanding public discourse in a democratic society. (shrink)

Catharine MacKinnon argues that pornography is action, rather than speech. She argues further that the speech/action distinction is what delineates the scope of the First Amendment. It follows, she thinks, that pornography does not fall within the scope of the First Amendment. I argue that the legal distinction between speech and action on which MacKinnon relies is unstable and therefore cannot determine which utterances fall within the scope of the First Amendment. Indeed, attempting to sort utterances by means of the (...) speech/action distinction in order to make this determination can lead to a paradox, which I call the “viewpoint paradox”. That an utterance expresses a particular viewpoint is typically sufficient for its qualifying as speech; yet MacKinnon’s argument that pornography is not speech pivots are her claim that it is an act of subordination because it expresses a particular viewpoint about women. I explore the connection between expertise and rationality. I first make explicit the philosophically dominant view on this connection, i.e., the ‘expert-consultation’ view. This view captures the rather obvious idea that a rational way of proceeding on a matter of importance when one lacks knowledge is to consult experts. Next, I enumerate the difficulties which beset this view, locating them to some extent in the current philosophical literature on expertise and rationality. I then propose that different lessons should be drawn (...) for rationality from the fact of expertise. One is that some empirical and phenomenological studies of the nature of expertise can be fruitfully applied by analogy to theories of the rational agent. (shrink)

Since the establishment of Christianity in the West as a major religious tradition, Augustine has been considered a principal architect of the ways philosophy can be used for reasoning about faith. In particular, Augustine effected the joining of Platonism with Christian belief for the Middle Ages and beyond. The results of his enterprise continue to be felt, especially with regard to the contested topics of human embodiment, sexuality, and the nature and roles of women. As a result, few thinkers have (...) been as problematic for feminists as he has been. He is the thinker that a number of feminists love to hate. What do feminist thinkers make of this problematic legacy? These lively essays address that question and provide thoughtful arguments for the value of engaging Augustine’s ideas and texts anew by using the well-established methodologies that feminists have developed over the last thirty years. Augustine and his legacy have much to answer for, but these essays show that the body of his work also has much to offer as feminists explore, challenge, and reframe his thinking while forging new paradigms for construing gender, power, and notions of divinity. The essay challenges the de facto dichotomy between the discipline of logic and the activity of social criticism, i.e., it provides an illustrated reminder to philosophers that the gulf between these two areas of philosophy is not quite as wide as our curriculum andspecialization designations tend to suggest. Social criticism plays some necessary roles in certain branches of logic, and the second-order accounting of the contents of these branches leads back to social criticism. These points suggest an adjusted conception of (...) logic that would, among other things, render phrases such as “applying logic to social criticism” as misleading since certain branches of logic would not even coherently exist apart from social criticism. The lead illustrations are the identification of basic, pervasive, and thought-impeding logical errors that have been missed by numerous logic texts, and the assessment of contemporary academic logic as properly a quest for communal sanity that lies caught between communal insanity and communal mendacity. One of the principles of health care ethics is the principle of justice. An important expression of justice is equity. The provision of basic primary health care services to all people is the key to eliminating the gross inequities in health status existing in many countries. For many years nurses in developing countries have ‘led the way’ in bringing these essential services to poor rural communities, including the diagnosis and treatment of illnesses, and the prescribing and dispensing of medications. Nurses (...) are the most appropriate health workers for this role, but most have not been prepared adequately for it. This is unsafe for patients and puts nurses at legal risk. Justice requires that patients should obtain access to safe health care and that nurses should receive appropriate education. Nurse practitioner programmes are being established to prepare nurses for this advanced practice role, but here again ethical considerations apply. Justice will be served only if nurse practitioner programmes are accessible to the nurses who are most likely to work in medically underserved communities where the need is greatest. (shrink)

I argue that the love of wisdom can be recovered by reawakening in humans the genuine sense of wonder, i.e., by recovering the transformed condition in which humans experience philosophical asking as a meaning-bestowing and existentially-transforming phenomenon. Wonder in this sense is primarily a metaphysical and not psychological state, and it is evoked by the transforming phenomenon of philosophical asking. Philosophical asking is not reducible to a something, e.g., a sentence in question-form, that provokes the setting up and critique of (...) theories but rather is essentially a way of existing, a dwelling, that is marked by the astonishment of watching the world, and ourselves, open up and transfigure by our very asking, i.e., by our existing as askers. The twentieth century was unprecedented in the scope and enormity of the terrible deeds that human beings perpetrated against their fellows. Oftentimes, the unjust detention, imprisonment, tortures, and executions were set in motion by the event of the arrest. This paper examines the phenomenon of the arrest as it is depicted in two of the century’s literary giants -- Franz Kafka and Alexander Solzhenitsyn. Uncanny correspondences can be detected particularly between Kafka’s novel The Trial and Solzhenitsyn’s memoir The Gulag Archipelago. (...) Moreover, through Kafka’s powerful literary imagination, he created works containing many features that were later to stand at the heart of the terror of totalitarian regimes. This paper analyzes and explores the arrest and, as a result, a philosophical typology of the arrest emerges. Due to the power and scope of Kafka’s genius, his work both prefigures and expresses many of the essential characteristics of totalitarian regimes that come to be enacted in flesh and blood later in the century. In The Trial, the arrest may be seen as an eerie and surreal foreshadowing of the millions of morally outrageous and legally spurious arrests that were to come in the twentieth century. (shrink)

The thermodynamic integral principle, equivalent to the Onsager theory of irreversible thermodynamics, is analyzed in detail for a purely dissipative system. Different reformulations of the principle are also given together with the derivation of the corresponding Euler—Lagrange equations. One of them, the dual field formulation, is of special interest: It is an exact variational principle in terms of the intensive parameters and their dual fields introduced in place of the thermodynamic current densities. We show the adequacy of axioms and proof rules for strict and lazy functional programs. Our basic logic comprises a huge part of what is common to the two styles of functional programming. The logic for call-by-value is obtained by adding the axiom that says that all variables are defined, whereas the logic for call-by-name is obtained by adding the axiom that postulates the existence of an undefined object for each type. To show the correctness of the axiomatization we do (...) not use denotational semantics and the adequacy of the evaluation of programs with respect to the semantics. Instead we use the standard term models based on call-by-value and call-by-name evaluation. We introduce a new method to prove on the syntactical level the monotonicity of the evaluation of functional programs with unbounded recursion. The direct method yields results concerning the proof-theoretic strength of the axiomatization. As a side result we obtain a syntactical proof of the context lemma for simply typed lambda terms with recursion. (shrink)

Half of the 33.2 million people living with HIV today are women. Yet, responses to the epidemic are not adequately meeting the needs of women. This article critically evaluates how prevention of mother-to-child transmission (PMTCT) programs, the principal framework under which women's health is currently addressed in the global response to AIDS, have tended to focus on the prevention of HIV transmission from HIV-positive women to their infants. This paper concludes that more than ten years after their inception, PMTCT programs (...) still do not successfully ensure the adequate treatment, care and support of HIV-infected women. Of particular concern is the continued widespread use of single-dose nevirapine despite World Health Organization recommendations to employ more effective combination therapies that do not potentially jeopardize women's future treatment outcomes. In response, the article calls for a more comprehensive approach that places women's health needs at the centre of AIDS responses. This is critical in settings where the pandemic is generalized and there is a push to greatly expand PMTCT programs, as a more effective and equitable way of meeting the needs of women in the context of HIV. Without such a comprehensive approach, women will continue to be impacted disproportionately by the pandemic, and current strategies for prevention, including PMTCT, and treatment will not be as effective and responsive as they need to be.
