Healthcare professionals working in intensive care units are often involved in end-of-life decision-making. No research has been done so far about these processes taking place in Croatian ICUs. The aim of this study was to investigate the perceptions, experiences, and challenges healthcare professionals face when dealing with end-of-life decisions in ICUs in Croatia. A qualitative study was performed using professionally homogenous focus groups of ICU nurses and physicians of diverse professional and clinical backgrounds at three research sites. In total, six (...) institutions at the tertiary level of healthcare were included. The constant comparative analysis method was used in the analysis of the data. Differences were found between the perceptions and experiences of nurses and physicians in relation to end-of-life decisions. Nurses’ perceptions were more focused on the context and features of immediate care, while physicians’ perceptions also included the wider sociocultural context. However, the critical issues these specific professional groups face when dealing with end-of-life decisions seem to overlap. A high variability of practices, both between individual practitioners and between different organizational units, was omnipresent. The lack of adequate legal, professional, and clinical guidelines was commonly expressed as one of the most critical source of difficulties. (shrink)

BackgroundDecisions about limitations of life sustaining treatments are made for end-of-life patients in intensive care units. The aim of this research was to explore the professional and ethical attitudes and experiences of medical professionals on treatment of end-of-life patients in ICUs in the Republic of Croatia.MethodsA cross-sectional study was conducted among physicians and nurses working in surgical, medical, neurological, and multidisciplinary ICUs in the total of 9 hospitals throughout Croatia using a questionnaire with closed and open type questions. Exploratory factor (...) analysis was conducted to reduce data to a smaller set of summary variables. Mann–Whitney U test was used to analyse the differences between two groups and Kruskal–Wallis tests were used to analyse the differences between more than two groups.ResultsLess than third of participants stated they were included in the decision-making process, and physicians are much more included than nurses. Sixty two percent of participants stated that the decision-making process took place between physicians. Eighteen percent of participants stated that ‘do-not-attempt cardiopulmonary resuscitations’ orders were frequently made in their ICUs. A decision to withdraw inotropes and antibiotics was frequently made as stated by 22.4% and 19.9% of participants, respectively. Withholding/withdrawing of LST were ethically acceptable to 64.2% of participants. Thirty seven percent of participants thought there was a significant difference between withholding and withdrawing LST from an ethical standpoint. Seventy-nine percent of participants stated that a verbal or written decision made by a capable patient should be respected. Physicians were more inclined to respect patient’s wishes then nurses with high school education. Nurses were more included in the decision-making process in neurological than in surgical, medical, or multidisciplinary ICUs. Male participants in comparison to female, and physicians in comparison to nurses with high school and college education displayed more liberal attitudes about LST limitation.ConclusionsDNACPR orders are not commonly made in Croatian ICUs, even though limitations of LST were found ethically acceptable by most of the participants. Attitudes of paternalistic and conservative nature were expected considering Croatia’s geographical location in Southern Europe. (shrink)

Leaders and managers of today's multinational corporations face a plethora of problems and issues directly attributable to the fact that they are operating in an international context. With work-sites, plants and/or customers based in another country, or even several countries, representing a vast spectrum of cultural differences, international trade and offshore operations, coupled with increased globalisation in respect to political, social and economic realities, contribute to new dilemmas that these leaders must deal with. Not the least of these being a (...) Code of Ethics and ethical decision making.This paper examines the differences in culture between a group of managers from the United States and similar group from Croatia using Hofstede's theory of International Cultures. The study explores how these cultural dimensions may help in our understanding of the differences in reported whistleblowing. The authors then postulate four hypotheses regarding various aspects of whistleblowing. These Hypotheses were than tested using a survey administered to a sample of U.S.A. and Croatian managers. Finally, the paper discusses the findings and practical implications for contemporary managers in the international arena. (shrink)

This book offers a readable introduction to the main aspects of thought experimenting in philosophy and science. It presents the main options in understanding thought experiments, from empiricism to Platonism, and discusses their strengths and weaknesses. However, it also provides some original perspectives on the topic. Firstly, it provides a new definition and analysis of thought experimenting that brings it closer to laboratory experimenting. Secondly, it develops the author’s earlier theory of “mental modelling”, proposed some decades ago by him, and (...) some other researchers in the field as the crucial procedure in thought experimenting. The mental modelling approach links work with thought experimenting to cognitive science and to research on mental simulation which is a hot topic in present-day research. Thirdly, it proposes a principled way to respond to criticism of thought experimenting by “experimental philosophers” as they have been dominating the present-day debates. The response suggests a possible ameliorative, self-help project for thought experimenting. Finally, the book provides a way to systematize the history of important thought experiments in science and philosophy and thus connects, in an original way, the systematic investigation of experimenting to the historical work of famous thought experiments. The first, critical part of the paper summarizes J. R. Brown’s Platonic view of thought experiments (TEs) and raises several questions. One of them concerns the initial, particular judgments in a TE. Since they seem to precede the general insight, Brown’s Platonic intuition, and not to derive from it, the question arises as to the nature of the initial particular judgment. The other question concerns the explanatory status of Brown’s epistemic Platonism. The second, constructive descriptive-explanatory part argues for an alternative, (...) i.e. the view of TE as reasoning in, or with help of, mental models which can accommodate all the relevant data within a non-aprioristic framework (or, at worst, within a minimally “aprioristic”, nativist one). The last part turns to issues of justification and argues that the mental model proposal can account for justification of intuitional judgments and can also support the view of properly functioning intuition as an epistemic virtue, all within a more naturalist framework than the one endorsed by Brown. The paper joins Horwich’s criticism of stipulationist accounts of a priori knowledge, and raises some problems for his own account of the a priori. It first questions the assumed separability of scientific investigation and non-scieentific assertoric practices in regard to norms of adequacy. It also questioned Horwich’s Restriction Assumption according to which only the former are answerable to the standards of empirical adequacy and overall simplicity (which threaten apriority in the case of science). Finally, it criticises his argument that inability (...) to think otherwise might guarantee apriority, pointing to science-driven reflective revisability of possibly innate beliefs. (shrink)

In Devitt’s view, linguistic intuitions are opinions about linguistic production of products, most often one’s own. They result frorn ordinary empirical investigation, so “they are immediate and fairly unreflectiveernpirical central-processor responses to linguistic phenomena”, which reactions are, moreover, theory-laden, where the ‘theory’ encompasses all sorts of speaker’s beliefs. The paper reconstructs his arguments, places his view on a map of alternative approaches to intuitions, and offers a defense of a minimalistic “voice-of-competence” view. First, intuitions are to be identified with the (...) data, the minimal “products” of tentative linguistic production of naïve speaker-listeners, and not with their opinions about the data. Second, the data involve no theory and very little prototheory. Third, although there might be admixtures of guesswork in the conscious production of data, these are routinely weaned out by linguists. Finally, mere acceptance of the “voice of competence” does not land us in any objectionable Cartesianism: it is cornpatible with naturalism and with distrust of a priori philosophy. (shrink)

Mark Richard in his book offers a new and challenging expressivist theory of the use and semantics of slurs (pejoratives). The paper argues that in contrast, the central and standard uses of slurs are cognitive. It does so from the role of stereotypes in slurring, from fi gurative slurs and from the need for cognitive effort (or simple of knowledge of relevant presumed properties of the target). Since cognition has to do with truth and falsity, and since the cognitive task (...) is a good indicator of semantic structure, it seems that the ascription of negative properties etc. indicates that they belong to the meaning of the slur, and that this meaning therefore confers truth-aptness. The (nasty) richness of meaning might vary with pejoratives: all of them involve “contemptible because G” at the very least. The most typical once carry more information. Some of it is given in the form of conceptual links roughly delineating the core stereotype associated with the pejorative, some in the form of fi gurative transfer of properties from some vehicle to the target member of G. So, slurs are not purely performative and expressive, but semantic in thetraditional, truth-directed sense. The truth-gap that might characterize the resulting sentences does not point to pejoratives not having ambition to say true and nasty things, but only to their failure in the attempt. The ambition defi nes the true-directed meanings of the assumptions, the failure just records that these assumptions are false about their targets. The paper leaves it open how central the truth-directed meanings are. The argument suggests that they are pretty central, either part of the core meaning, or of conventional implicature. (shrink)

Explaining intuitions in terms of "facts of our natural history" is compatible with rationally trusting them. This compatibilist view is defended in the present paper, focusing upon nomic and essentialist modal intuitions. The opposite, incompatibilist view alleges the following: If basic modal intuitions are due to our cognitive make-up or "imaginative habits" then the epistemologists are left with a mere non-rational feeling of compulsion on the side of the thinker. Intuitions then cannot inform us about modal reality. In contrast, the (...) paper argues that there are several independent sources of justification which make the feeling of compulsion rational: the prima-facie and a priori ones come from the obviousness of our basic modal intuitions and our not being able to imagine things otherwise, others, a posteriori, from the epistemic success of these intuitions. Further, the general scheme of evolutionary learning is reliable, reliability is preserved in the resulting individual's cognitive make-up, and we can come to know this a posteriori. The a posteriori appeal to evolution thus plays a subsidiary role in justification, filling the remaining gap and removing the residual doubt. Explaining modal intuitions is compatible with moderate realism about modality itself. (shrink)

A strong, strictly virtue- based , and at the same time truth-centered framework for virtue epistemology (VE) is proposed that bases VE upon a clearly motivating epistemic virtue, inquisitiveness or curiosity in a very wide sense, characterizes the purely executive capacities-virtues as a means for the truth-goal set by the former, and, finally, situates the remaining, partly motivating and partly executive virtues in relation to this central stock of virtues. Character-trait epistemic virtues are presented as hybrids, partly moral, partly purely (...) epistemic. In order to make the approach virtue- based , it is argued that the central virtue (inquisitiveness or curiosity) is responsible for the value of truth: truth is valuable to cognizers because they are inquisitive, and most other virtues are a means for satisfying inquisitiveness. On can usefully combine this virtue-based account of the motivation for acquiring knowledge with a Sosa-style analysis of the concept “knowledge”, which brings to the forefront virtues-capacities, in order to obtain a full-blooded, “strong” VE. Virtually all epistemologists agree that truth is a necessary condition for knowledge. Assuming that our three-dimensional world is nested within a higher-dimensional space, I use multidimensional geometry to present a type of case which undermines this fundamental principle of epistemology. I further argue that we would be unlikely to revise our epistemic practices in light of new discoveries even if our world turned out to be substantially different and many of our beliefs turned out to be false.

The recent revival of interest in the notion of a secondary quality and its generalization to the notion of response-dependence has brought forward a number of interesting theories encompassing a wide variety of domains. I shall assume that the general line of approach embodied in many such theories is plausible and perhaps basically right, and address one particular epistemological issue. Most theories of response-dependence are heavily involved with notions of aprioricity, as we shall document presently. The paper investigates some mechanisms of thought-experimenting, and explores the role of perspective taking, in particular of mental simulation, in political thought-experiments, focusing for the most part on contractualist ones. It thus brings together two blossoming traditions: the study of perspective taking and methodology of thought-experiments. How do contractualist thought-experiments work? Our moderately inflationist mental modelling proposal is that they mobilize our imaginative capacity for perspective taking, most probably perspective taking through simulation. The framework suggests the answers to questions that (...) are often raised for other kinds of thought-experiments as well, concerning their source of data, heuristic superiority to deduction, experiential, qualitative character and ease in eliminating alternatives. In the case of contractualist political thought-experiments, the data come from perspective taking and the capacity to simulate. Mental simulation is way more accessible to subjects than abstract political reasoning from principles and facts. There is a new experience for the subject, the one of simulating. Simulation normally is quick and effortless; the simulator does not go through alternatives, but is constrained in an unconscious way. We distinguish two kinds of political thought-experiments and two manners of imagining political arrangements, building third-person mental models, and fi rst-person perspective taking. The two mechanisms, the fi rst of inductive model building, the second for simulation, and their combination(s), exhaust the range of cognitive mechanism underlying political thought-experimenting. The paper defends causal explanationism concerning our modal intuitions and judgments, and, in particular, the following claims. If a causally explainable mirroring or “pre-established harmony” between our mind and modal reality obtains, we are justified in believing it does. We do not hold our modal beliefs compulsively and blindly but with full subjective and objective justification. Therefore, causal explanation of our modal beliefs does not undermine rational trust in them. Explanation and trust support each other. In contrast, anti-explanationists, claim that (...) causal explanation of intuitions and judgments undermines rational trust in them. They especially target causal explanation in terms of pre-established harmony between our mind, shaped by causal processes, and the underlying modal structure of reality. The paper argues against them. The argument builds upon the claim that the appeal to modal facts is indispensable for systematization and explanation of non-modal ones. Therefore, we should assume that modal facts exist and are not disjoint and isolated from actual facts. The modal structure of the universe intervenes in the non-modal reality. Causal processes indirectly carry information about deep modal structure. Any causal explanation of our intuitional modal beliefs should start from this indirect contact with and information about modal facts. Therefore, if our intuitional modal beliefs are true and causally explainable, they are true in virtue of the deep underlying modal structure. They are sensitive to modal reality and track it. We can come to know this fact, and thus strengthen our spontaneous trust in our modal intuitions. (shrink)

What were the causes of the tragic disintegration of the former Yugoslavia and what is likely to happen next? Nenad Kecmanovi?, who witnessed and actively participated in many of the key events in Serbia and Bosnia-Herzegovina, offers a perceptive, seasoned analysis of the many challenges that threaten political stability in this powder keg region (...) of Eastern Europe. Both a professor of political science and a former politician who served in many high-ranking posts, Kecmanovi? brings rich, first-hand knowledge—theoretical and practical—to his discussion of the many explanations proposed for the troubles in the former Yugoslavia. Among the issues he considers are the renewal of ancient tribal hatreds, the emergence of nationalism as the last stage of communism, how the interests of outside powers have complicated the situation, whether the conflict represents a clash of civilizations, the difficulties of building democracy on the basis of an authoritarian political culture, and the possibility that democracy in this region acts as a great solvent that dissolves former political unions. Looking to the future, he discusses the rapid and potentially explosive developments in Serbia, Macedonia, and Bosnia-Herzegovina, where there is continuing unrest among ethnic minorities. In conclusion, he assesses the chances that the European Union will someday incorporate the individual states of the former Yugoslavia vs. the potential for another outbreak of war. This sobering, in-depth overview of the current tense situation in the Balkans is must reading for anyone with an interest in the future of Europe. (shrink)

Merely conceptual knowledge, not based on specific sensitivity to the referential domain, is not seriously a priori. It is argued here that it is either weakly and superficially a priori, or downright a posteriori. This is done starting from the fact that many of our definitions (or concepts) are recognizably empirically established, and pointing out that recognizably empirical grounding yields superficial apriority. Further, some (first-order) concept analyzing propositions are empirically false about their referents and thus empirically refutable. Therefore, our empirical (...) definitions (or concepts) are fallible and empirically revisable: they can turn out to be incorrect about the intended satisfiers of the concept defined, and their concept analyzing propositions to be false. Now, empirical revisability is incompatible with strong apriority (and entails at best a weak apriority or aposteriority). The result is quite shocking: analyticity does not entail apriority. Kant?s legal and political philosophy is essential for understanding and advancing international order. The article aims to posit arguments that confront the claims that Kant was just war theorist. Since that is the most opposed part of Kant?s political philosophy, mostly due to the misleading interpretation of his argumentation, the author presents Kant?s standpoint on the matters of just war and international order and discusses potential ambiguities between Kant?s and his critics? theories. Furthermore, the consequences of opponents? arguments considering states (...) of states, world republic and cosmopolitan democracy in contemporary political philosophy are debated. Finally, the possibility of consent between the three model solutions which are arising from the contemporary international order theory and Kant?s position are compared and analysed. (shrink)

The paper places the work of G. Gaus into the tradition of political thought experimenting. In particular, his strategy of modeling moral decision by the heuristic device of idealized Members of the Public is presented as an iterated thought experiment, which stands in marked contrast with more traditional devices like the veil of ignorance. The consequences are drawn, and issues of utopianism and realism briefly discussed.

The paper addresses two fundamental issues in epistemic axiology. It argues primarily that curiosity, in particular its intrinsic variety, is the foundational epistemic virtue since it is the value-bestowing epistemic virtue. A response-dependentist framework is proposed, according to which a cognitive state is epistemically valuable if a normally or ideally curious or inquisitive cognizer would be motivated to reach it. Curiosity is the foundational epistemic virtue, since it bestows epistemic value. It also motivates and organizes other epistemic virtues, so it (...) is foundational and central for epistemology. The second issue is the one of the fundamental bearer of epistemic value. I shall argue that truth is the primary goal, but that mere true belief is not the fundamental bearer. Rather, the bearer is a relatively minimalist kind of knowledge. Mere true belief cannot be rationally accepted in isolation from a supporting structure. However, any efficient supporting structure introduces further epistemic goods (justification, reliability, anti-luck guarantees), thus upgrading the original true belief. Mere true belief can be neither defended, nor rationally sustained through time, due to isolation. Mere true belief cannot be rationally sustained in the face of a slightest bit of contrary evidence (the Meno insight). Therefore, mere true belief is not rationally stable. Minimal knowledge is, and this accounts for the primary and secondary value problem, and for a relatively undemanding kind of tertiary value. (shrink)

Psychological egoism is the doctrine that all of our actions are ultimately motivated by self-interest, even including seemingly altruistic actions. Although this view is commonly referred to as \vacuous" or \trivially true" because of its immunity to counterexamples, I argue that there are possible observations that can refute this thesis. I describe the experiments, identify the results that could in principle falsify the strongest possible version of psychological egoism and formulate a probabilistic argument against this view. Ultimately, I conclude that (...) a \trivially true" formulation of psychological egoism is an empirical theory that is in all likelihood false. (shrink)

The paper challenges the entrenched equation of conceptual with apriori. It develops the idea of at least dual justification of a single piece of belief, at a deep, ultimate level and at the surface, immediately accessible to the thinker. Apriori justification then also admits of different degrees of depth. A proposition is deeply apriori for a cognizer if its ultimate ground is apriori, otherwise it is only superficially apriori . In the case of empirically applicable concepts, some of their concept-analyzing (...) propositions are justified apriori only at the surface. Deeply, they are aposteriori, being originally straightforward empirical propositions. It is argued that there is no reason to suppose that they change their epistemic status once build into a concept. (shrink)

The skeptical puzzle consists of three allegedly incompatible claims: S knows that O, S doesn’t know that ~U, and the claim that knowledge is closed under the known entailment. I consider several famous instances of the puzzle and conclude that in all of those cases the presupposition that O entails ~U is false. I also consider two possible ways for trying to make it true and argue that both strategies ultimate fail. I conclude that this result at least completely discredits (...) any solution that denies the principle of epistemic closure. At most, denying that O entails ~U can itself be seen as a novel solution to the puzzle, preferred to any other solution: it accommodates both non-skeptical and skeptical intuitions but does not require us to give up the principle of closure, embrace contextualism or subject-sensitive invariantism, or deny any commonly accepted principle of epistemology or logic. In order to address this problem and provide a new direction for solving the skeptical puzzle, I consider a modified version of the puzzle that is based on knowledge claims about appearances and does not result in a paradox. Xenophobia is one of the key drivers of marginalisation, discrimination, and conflict, yet many prominent machine learning fairness frameworks fail to comprehensively measure or mitigate the resulting xenophobic harms. Here we aim to bridge this conceptual gap and help facilitate safe and ethical design of artificial intelligence (AI) solutions. We ground our analysis of the impact of xenophobia by first identifying distinct types of xenophobic harms, and then applying this framework across a number of prominent AI application domains, reviewing the (...) potential interplay between AI and xenophobia on social media and recommendation systems, healthcare, immigration, employment, as well as biases in large pre-trained models. These help inform our recommendations towards an inclusive, xenophilic design of future AI systems. (shrink)

The paper honors Heda Festini; it’s first part contains author’s personal memories of Heda. The central part of the paper addresses a favorite author of Heda Festini, Franjo Petrić, and his Utopia The Happy City-State. It then places the utopian construction on the map of contemporary understanding of political theorizing. Utopias, like the one due to Petrić, result from thought-experimenting; in contrast to purely epistemic thought-experiments they are geared to “guidance”, as Petrić puts it, namely advice giving and persuading. Political (...) thought-experimenting can be understood to a large extent as work in ideal theorizing; a matter little noticed in the literature. Classical cases cover “ideal theory” in the sense of given, non-temporal arrangement; “ideal” either in a very limited sense of strict compliance (Rawls), or in a wider sense of normatively marked properties, not instantiated in actual political reality. Platonic tradition belongs to a third genus, “ideal” in the sense of recommended end-state; Utopias add to this theoretical quality the dimension of “guidance”, so that they are motivational, time-related ideal theories. The paper depicts these relations between thought-experimenting as a wider genus, and ideal theorizing as its prominent political-philosophical sub-species. The paper is thus a tribute to Heda Festini who helped me find my way to analytic theorizing, and help analytic philosophy to start serious institutional life in our native Croatia. (shrink)

This article is a brief presentation and defense of response-dispositionalist intentionalism against a family of objections. The view claims that for a surface to have an objective stable color is to have a disposition to cause in normal observers a response, namely, intentional phenomenal-color experience. The objections, raised recently by M. Johnston, B. Stroud, and by Byrne and Hilbert, claim that any dispositionalist view is unfair to the naive perceiver-thinker, saddles her with massive error and represents her as maladaptated to (...) her environment. The paper reconstructs the main line of thought in favor of response-intentionalism and argues that it is in fact rather charitable and fair to naïve cognizers, and also avoids a cluster of related objections. The paper discusses Lehrer's pioneering approach to the topic of wisdom. His pithy proposal, that wisdom is preference of merit justified by an evaluation system and undefeated by error, fits well within the grand philosophical tradition of thinking about wisdom, offering a very clear and original formulation of its target. The first part of the paper puts it on a map of philosophical options concerning wisdom (anthropo-, theo- and cosmo-centric ones) and then raises questions about it: does preference have to (...) motivate, what is the relation between factual and evaluative knowledge in the evaluation system, and how is the objectivity of merit secured? The second part briefly develops an alternative proposal inspired by Lehrer's work. It is a two-level picture. Wisdom combines the virtues of the first-order production of decision and action (reliability and practical validity) with second-order reflective endorsement of the first-order picture. The first-order production yields phronesis-generated action-guiding desires which constitute practical wisdom in the narrow sense, and the second level the more refined and sophisticated wisdom of philosophers and their kin. Plato’s Republic is a political thought experiment, claims the present paper. Thought-experimenting is announced in the story of the Ring of Gyges, and done in a thorough and systematic way through a series of political scenarios: community of goods, of women and children, educational system and the philosopher rule? The paper considers the longstanding issue of plausibility, putting it in the context of current debates about thought-experiments, and the issue of replaceability: can a given political thought experiment be replaced by (...) an argument which features only norms and empirical information? The paper also puts the Republic thought experiment into a broad historical context, presenting it as the point of origin of utopian literature on the one hand, and the thought-experimental tradition in political philosophy on the other hand, contrasting it with the social-contract thought-experiment, also adumbrated in the Republic but fully developed in modern thought. The ecological approach to rationality, exemplified in theories such as Gerd Gigerenzer’s Fast and Frugal Heuristics, posits that different decision-making procedures are rational in various decision environments. In this regard, the ecological approach sharply contrasts with standard normative theories like Expected Utility Theory, which is often viewed merely as an analysis of bounded rationality. In this article, I aim to provide philosophical foundations for the ecological approach as a framework for normative rationality. I draw on John Norton’s Material Theory of (...) Induction to argue that the appropriate method for addressing uncertain evidence is domain-dependent and sensitive to the environment, as the ecological approach suggests. Furthermore, I argue that, motivated by insights from material theory, we should re-examine the claim that consistency requirements are universal standards of rationality in three ways: first, the plausibility of consistency axioms depends on the decision environment; second, the application of standard theories is contingent upon the structural conditions of that environment; and third, arguments for axioms, such as money-pump arguments, are plausible only in specific domains. Finally, I argue that the ecological approach can provide a substantive account of rationality norms and that its performance-related criteria for these norms should facilitate the evaluation and modification of agents’ decision-making. These arguments underscore the advantages of the ecological approach over standard theories while situating it within the broader philosophical framework of induction. (shrink)

The paper addresses issues of predicates of taste, both gustatory and aesthetic in dialogue with Michael Glanzberg. The first part briefly discusses his view of anaphora in the determination of the semantics of such predicates, and attempts a friendly generalization of his strategy. The second part discusses his contextualism about statements of taste, of the form A is Φ, and then proposes a pluralist alternative. The literature normally confronts contextualism and relativism here, but the pluralist proposal introduces further options. First, (...) it distinguishes first-level and second-level, more theoretical, approaches. At the first level it introduces the naïve view option, the naive non-dogmatist experiencer who simply claims that A is Φ and that’s it. On meta-level such an experiencer is simply agnostic about further matters. Then, there is the first-level dogmatist stance, characteristic for people who do sincerely debate the issues, who naively believe they are objectively right. The third option is the tolerant, liberal one: “A is Φ; for me, I mean. How do you find it?” On the meta-level, dogmatic disagreement goes well with value-absolutism, entailing that one of the parties is simply wrong, and with relativism. If one is not dogmatist about taste predicates, one should accept that dogmatist is simply wrong; no faultlessness is present. The liberal stance goes well with contextualism. If one is liberal there is no deep disagreement. So, the idea of faultless disagreement is a myth. But the proposal notes that language is open to all possibilities, there is no single option that is obligatory for all speakers. (shrink)

International law has recently recognized that sexual atrocities can be acts of genocide. This precedent was pioneered through a landmark lawsuit in New York against Radovan Karadžić, head of the Bosnian Serbs (Kadic v. Karadzic, 1993–2000), a case in which I played a central role. I argue that we may situate this development philosophically in relation to Hannah Arendt’s Eichmann in Jerusalem: A Report on the Banality of Evil. She aims to secure a better understanding of genocide than was achieved (...) at the Nuremberg Trials (1945) and at the Eichmann trial (1961). Arendt claims that these trials were limited by formalism because they applied familiar paradigms onto these new experiences in a manner that obscured what was distinctive about them and that demanded original thinking and a new paradigm. Nuremberg obscured genocide by miscasting it as a traditional “war crime,” a problem that the Jerusalem court exposed butcould have better clarified. Through a first-hand account, I show how we too had to secure a new paradigm by treating the facts on their own terms and coining the crime as “genocidal rape.” We had to wrest this paradigm from a prevailing approach that also formally applied the category of “war crimes” onto these experiences in a way that obscured them and interfered with justice. Dealing with deductive reasoning, performed by ‘real-life’ reasoners and expressed in natural language, the paper confronts Harman’s denying of normative relevance of logic to reasoning with a logicist thesis, a principle that is supposed to contribute for solving the problem of incongruence between descriptive nature of logic and normativity of reasoning. The paper discusses in detail John MacFarlane’s (2004) and Hartry Field’s (2009) variants of “bridge principle”. Taking both variants of bridge principles as its starting point, the paper proceeds arguing (...) that there is more than one logical formalism that can be normatively suitable for deductive reasoning, due to the fact that reasoning can assume different forms that are guided by different goals. A particular reasoning processing can be modelled by specific formalism that can be shown to be actually used by a real human agent in a real reasoning context. (shrink)

Many authors have argued that we should make a clear conceptual distinction between mononational and multinational states. Yet the number of empirical examples they refer to is rather limited. France or Germany are usually seen as mononational, whereas Belgium, Canada, Spain and the UK are considered multinational. How should we classify other cases? Here we can distinguish between (at least) two approaches in the literature: statistical (i.e., whether significant national minorities live within a larger state and, especially, whether they claim (...) self-government) and subjective (i.e., when citizens feel allegiance to sub-state national identities). Neither of them, however, helps us to resolve the problem. Is Italy multinational (because it contains a German-speaking minority)? Is Germany really mononational (in spite of the official recognition of the Danes and the Sorbs in some Länder)? On the other hand, is Switzerland the “most multinational country” (Kymlicka)? Let us assume that there is no definite answer to this dilemma and that it is all a matter of degree. There are probably few (if any) clearly mononational states and few (if any) clearly multinational states. Should we abandon this distinction in favour of other concepts like “plurinationalism” (Keating), “nations-within-nations” (Miller), “postnational state” (Abizadeh, Habermas), or “post-sovereign state” (MacCormick)? The article discusses these issues and, in conclusion, addresses the problem of stability and shared identity “plural” societies. (shrink)

In this article, I examine the consequences of Mamou’s recent solution to the so-called problem of reindividuation. The problem is first proposed by John Broome as an argument against the Humean view of rationality and subjective decision theory. Essentially, Broome argues that the reindividuation of outcomes must be constrained in some way if the axioms of rationality are not to be vacuous, but the constraints on individuation cannot be consistent with the Humean view of rationality. Mamou offers an elegant Humean (...) solution to this problem. We do not need such rules for reindividuation since the subjective decision theory operates under the assumption of maximal relevance of description, and only under that assumption do the axioms tell anything. Thus the problem of reindividuation dissolves in a quite natural and simple way. However, I argue that if we connect this solution to the topic of justification for the requirements of rationality, problems arise. I examine the influence of the solution on the common argument for the axioms of decision theory, the so-called money-pump arguments. These arguments are a staple in the justification of the axioms of subjective decision theory. I argue that they are in collision with Mamou’s solution. This collision brings us to the dilemma: either accept Broome’s conclusions or lose the money-pump arguments as an effective tool for justification of the axioms. I conclude that neither of the options is really good for the defenders of the Humean view of rationality. (shrink)

In my paper, I document a “travel” journey of concept formation and its concrete expression in law, which also constituted a literal travel journey across continents. Through poetic-hermeneutical approaches to language, guided by previously existing concepts stemming from experiences of the Holocaust, communism, and African-American feminist analyses of rape as an attack on a racial/ethnic group, a previously invisible domain of the human condition was charted. Throughout history, sexual atrocities have been committed within the context of wars, but their weaponisation (...) as acts of genocide remained unarticulated. This changed in the 1990s with Serbia-Yugoslavia’s genocidal wars against its neighbours (Editorial comment: The author uses the term Serbia-Yugoslavia to refer to the entity that succeeded the breakup of the Socialist Federal Republic of Yugoslavia after Croatia and Slovenia declared independence on June 25th, 1991. The SFRY up to that point consisted of the six republics Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Serbia (including the so-called autonomous regions of Kosovo and Vojvodina), and Slovenia. Further declarations of independence by Macedonia and Bosnia and Herzegovina on April 27, 1992, left only Serbia and Montenegro who the same day declared themselves to be the Federal Republic of Yugoslavia (FRY). In 2003, the Federal Republic of Yugoslavia was reconstituted as the State Union of Serbia and Montenegro, which existed until Montenegro and Serbia declared their independence (on June 3rd and June 5th, 2006, respectively)). I sketch the genesis of the concept of sexual atrocities as genocide in connection with my personal journey and how it guided legal prosecution of this “new” crime. My own travel-experience began with my association with Asja Armanda, and her discovery of coordinated mass rapes, when she came to the aid of survivors fleeing the Serbian attacks on Croatia, crimes she attempted to bring to international attention to prevent their expansion into Bosnia-Herzegovina and Kosovo. Testimonials reached me in the U.S. as well. I went to Croatia to join Armanda, where we named the crime “sexual atrocities as genocide.” On the basis of this new concept, we filed a lawsuit in New York against Bosnian Serb leader Radovan Karadžić, pioneering this crime’s recognition under international law. I conclude with philosophical questions that Putin’s similar genocidal attack on Ukraine raises today. (shrink)

The contemporary global crisis can be explored in different perspectives. This text focuses on constitutionalism. It asks whether constitutionalism still matters. Responding to this question requires revisiting the basic analytical and normative concepts that shape individual autonomy, polity, law and democracy in the context of globalization. Part I of the article introduces the question of the crisis of constitutionalism. It briefly explores the dispute between proponents of state and post-state constitutionalism, and proceeds with an analysis of societal constitutionalism. The critical (...) reading of this theory prepares the ground for a positive normative argument. Part II of the article argues for the return to the moral core of constitutionalism. It defends the claim that justice at the global stage requires establishing a minimum common denominator that would be composed of universalizable substantive principles. The institutional question follows. Its focus should be on the authoritative identification, protection and advancement of the core values of constitutionalism in the social and legal-political realms of the world society. (shrink)

In his important and original book, Knowing and Checking, Guido Melchior provides advice on how to tackle skepticism. I argue that his analysis points to a possible virtue-theoretic answer to skepticism, which I call the restraint solution, i.e., activate your self-trust and restrain your inquisitiveness! It leads one to the ideal of bounded reflective curiosity: when it comes to knowledge, we should restrain our second-order, reflective curiosity and stay content with the somewhat Moorean trust in ordinary everyday beliefs. We can (...) preserve our ordinary, first-order vigilance and investigative interest (curiosity) without falling into skeptical over-caution which is basically a reflective, second-order vicious attitude. The paper discusses Sosa’s view of intuitional knowledge and raises the question of the nature of reflective justification of intuitional beliefs. It is assumed, in agreement with Sosa, that pieces of belief of good researchers are typically reflectively justified, in addition to being immediately, first-level justified. Sosa has convincingly argued that reflective justification typically mobilizes and indeed should mobilize capacities distinct from the original capacity that has produced the belief-candidate for being justified, in order to assess the reliability of the (...) original capacity. It has to go beyond justifiers that are of the same-kind as first-level immediate ones, in order to enlarge the circle of justification, and is, therefore, holistic and coherentist. But if this holds, it seems that reflective justifi cation of armchair beliefs, presumably produced by intuition and some reasoning, should revert to empirical considerations testifying to the reliability of intuition and reasoning. Therefore, it typically combines, in an articulated way, a posteriori elements contributing to the thinker’s reflective trust in her armchair capacities. In short, the paper argues that Sosa’s own view of second-order justification goes better with a more aposteriorist view, if it does not even force such a view. (shrink)
