This article addresses the data protection and product safety regulatory models currently applied to consumer-facing health technologies. It explains how the design and structures of existing data protection and safety regulation in the U.S. have resulted in exceptionally thin protection for the users of consumer-facing devices and products that rely on or that facilitate consumer collection or aggregation of health and wellness data. It also examines some appealing legislative alternatives to the current thin model used in the U.S. and suggests (...) a framework for prioritizing ameliorative regulation. To better understand existing regulatory models, their deficiencies, and how they should be reformed, the article employs an analytical model describing these regulatory systems across two axes. The vertical axis describes the quantity or depth of regulation, such as, for example, the strictness of the rules imposed by the regulatory model. The horizontal axis describes the reach of the regulation, the behaviors, products, or industries to which the regulation applies. (shrink)

Our discussion of the commentaries begins, at the evolutionary level, with issues raised by our account of the evolution of morality in terms of partner-choice mutualism. We then turn to the cognitive level and the characterization and workings of fairness. In a final section, we discuss the degree to which our fairness-based approach to morality extends to norms that are commonly considered moral even though they are distinct from fairness.

Research seeking a scientific foundation for the theory of art appreciation has raised controversies at the intersection of the social and cognitive sciences. Though equally relevant to a scientific inquiry into art appreciation, psychological and historical approaches to art developed independently and lack a common core of theoretical principles. Historicists argue that psychological and brain sciences ignore the fact that artworks are artifacts produced and appreciated in the context of unique historical situations and artistic intentions. After revealing flaws in the (...) psychological approach, we introduce a psycho-historical framework for the science of art appreciation. This framework demonstrates that a science of art appreciation must investigate how appreciators process causal and historical information to classify and explain their psychological responses to art. Expanding on research about the cognition of artifacts, we identify three modes of appreciation: basic exposure to an artwork, the artistic design stance, and artistic understanding. The artistic design stance, a requisite for artistic understanding, is an attitude whereby appreciators develop their sensitivity to art-historical contexts by means of inquiries into the making, authorship, and functions of artworks. We defend and illustrate the psycho-historical framework with an analysis of existing studies on art appreciation in empirical aesthetics. Finally, we argue that the fluency theory of aesthetic pleasure can be amended to meet the requirements of the framework. We conclude that scientists can tackle fundamental questions about the nature and appreciation of art within the psycho-historical framework. (shrink)

In a 1993 paper, I argued that empirical treatments of the epistemologyused by scientists in experimental work are too abstract in practice tocounter relativist efforts to explain the outcome of scientificcontroversies by reference to sociological forces. This was because, atthe rarefied level at which the methodology of scientists is treated byphilosophers, multiple mutually inconsistent instantiations of theprinciples described by philosophers are employed by contestingscientists. These multiple construals change within a scientificcommunity over short time frames, and these different versions ofscientific methodology (...) can determine the outcome of a controversy. Iillustrated with a comparatively detailed analysis of the methodologyused by biologists debating the existence of an entity called thebacterial mesosome between the mid-1950s and the mid-1970s. This 1993piece has drawn several critiques in the philosophical literature. Inthis present piece I respond to these critiques and argue that they failto address the core argument of the original paper, and I reflectfurther on the methodologies of philosophers of science pursuingempirical or `naturalistic' epistemology. What has become generally known as the Berlin School of Logical Empiricism constitutes a philosophical movement that was erected on foundations laid by Albert Einstein. His revolutionary work in physics had a profound impact on philosophers interested in scientific issues, prominent among them Paul Oppenheim and Hans Reichenbach, the founding fathers of the school, who joined in viewing him as their hero among philosopher-scientists. Overall the membership of this school falls into three groups. The founding generation was linked by the (...) circumstance that both Grelling and Reichenbach were collaborators of Oppenheim; the middle generation by the fact that both Hempel and Helmer were students of Reichenbach's in Berlin; and the younger generation by the fact that all of its members were students and disciples either of Reichenbach's or of Hempel's in the USA. Three stages are at issue: an initial phase in Berlin, a transatlantic migration, and a continuation in the U.S.A.--principally in Pittsburgh. (shrink)

This article argues for a novel approach to the measurement of freedom of choice, on which the availability of an option is a matter of degree, rather than a bivalent matter of being either available or not. This approach is motivated by case studies involving weakness of will, where deficiencies in willpower seem to impair individual freedom by making certain alternatives much harder to pursue. This approach is perfectly general, however: its graded analysis of option availability can be extended to (...) cases where weakness of will is not involved and can be used to generalize numerous existing measures of freedom. Para calificar la estética posmodernista, que responde a la entrada en la era posmoderna, marcada por la ausencia de una visión unitaria y global del mundo, los teóricos de los años 70 privilegiaron el concepto de “heterogeneidad”, que en la década siguiente y parte de los años 90, dejó paso al de “sincretismo”, “mestizaje” o “creolidad”. A partir de los años 90 y, sobre todo, desde la primera década del tercer milenio, el concepto de “hibridez” ocupa un lugar destacado debido, (...) en parte, a la influencia de los estudios poscoloniales. Based on anthropological fieldwork on the revival of hallucinogen research as well as on the epistemic culture of neurophilosophy, this Common Knowledge guest column examines two very different philosophical engagements with psychedelic drugs. In Thomas Metzinger's evidence-based philosophy of mind, hallucinogens help to operationalize questions about the nature of consciousness. While this project contributes to the great divide between empirically enlightened moderns and tradition-oriented premoderns, Metzinger's neurophilosophical reanimation of the ancient conception of philosophy as cultura animi can build a bridge (...) to Aldous Huxley's perennial philosophy, which has informed the psychedelic intelligentsia like no other body of thought. In the sixteenth century, the philosophia perennis grew out of a decidedly nonmodern philosophy of religion that sought to suture the historical and cultural cracks that would come to define modernity. This essay argues that neurophilosophy and ethnographic studies of consciousness cultures could function as critical correctives in a contemporary rearticulation of perennial philosophy. (shrink)

To become more broadly applicable, positions on AI ethics require perspectives from non-Western regions and cultures such as China and Japan. In this paper, we propose that the addition of the concept of harmony to the discussion on ethical AI would be highly beneficial due to its centrality in East Asian cultures and its applicability to the challenge of designing AI for social good. We first present a synopsis of different definitions of harmony in multiple contexts, such as music and (...) society, which reveals that the concept is, at its core, about well-balanced relationships and appropriate actions which give rise to order, balance, and aesthetically pleasing phenomena. The mediator for these well-balanced relationships isTaktwhich is an ability to act thoughtfully and sensibly according to the specific situation and to put things into proportion and order. We propose that the central challenge of building harmonizing AI is to make intelligent systems tactful and also to design and use them tactfully. For an AI system to become tactful, it needs to be able to have an advanced sensitivity to the specific contexts which it is in and their social and ethical implications and have the capability of approximately inferring the emotional and cognitive states of people with whom it is interacting. This article discusses conceptions of modesty and humility and their key features. It gives a brief historical overview of debates about whether or not they’re really virtues at all. It also discusses theories of modesty and humility that root them in the presence or absence of particular beliefs, emotions, desires, and attention. it also discusses related phenomena in epistemology: rational limits on self-ascription of error, attitudes to disagreement, and openness to alternative views.

A dilemma put forward by Schein (1993) and Rayo (2002) suggests that, in order to characterize the semantics of plurals, we should not use predicate logic, but plural logic, a formal language whose terms may refer to several things at once. We show that a similar dilemma applies to mass nouns. If we use predicate logic and sets when characterizing their semantics, we arrive at a Russellian paradox. And if we use predicate logic and mereoogical ums, the semantics turns out (...) to be too weak. We then develop an account where mass nouns are treated as non-singular terms. This semantics is faithful to the intuition that, if there are eight pieces of silverware on a table, the speaker refers to eight things at once when he says: "The silverware that is on the table comes from Italy." We show that this account provides a satisfactory semantics for a wide range of sentences. (shrink)

Henrich et al.’s article fleshes out in a very useful and timely manner comments often heard but rarely published about the extraordinary cultural imbalance in the recruitment of participants in psychology experiments and the doubt this casts on generalization of findings from these “weird” samples to humans in general. The authors mention that one of the concerns they have met in defending their views has been of a methodological nature: “the observed variation across populations may be due to various methodological (...) artifacts that arise from translating experiments across contexts” (sect. 7.2, para. 1). Synaesthesia is a heterogeneous phenomenon, even when considering one particular sub-type. The purpose of this study was to design a reliable and valid questionnaire for grapheme-colour synaesthesia that captures this heterogeneity. By the means of a large sample of 628 synaesthetes and a factor analysis, we created the Coloured Letters and Numbers questionnaire with 16 items loading on 4 different factors . These factors were externally validated with tests which are widely used in the field of synaesthesia research. The questionnaire (...) showed good test–retest reliability and construct validity . Our findings are discussed in the light of current theories and new ideas in synaesthesia research. More generally, the questionnaire is a useful tool which can be widely used in synaesthesia research to reveal the influence of individual differences on various performance measures and will be useful in generating new hypotheses. Même si l’on connaît surtout Ecce homo, l’une de ses dernières œuvres, dans laquelle Nietzsche nous livre une véritable autobiographie intellectuelle, le philosophe allemand s’est en réalité très tôt plu à la pratique de l’autobiographie. L’autoréflexion qu’il présente de son devenir fut ensuite une constante, notamment dans les Préfaces qu’il ajouta par la suite à ses plus fameux ouvrages. Mais cette constante est d’autant plus étonnante chez un auteur qui dit d’une part ne s’être jamais que médiocrement réfléchi, et d’autre (...) part qu’il ne faut pas soupçonner le moins du monde qui l’on est pour être en mesure de devenir soi. Nous tâchons ici de dépasser cette contradiction apparente en proposant une interprétation de ce geste nietzschéen de l’autobiographie et nous nous demandons en même temps si cette pratique ne constitue et ne construit pas davantage le soi à un moment donné, peut-être même à titre d’illusion, plutôt qu’elle ne le saisit véritablement. This article questions the current vogue of Carl Schmitt among political theorists who read him as an antidote to the depoliticizing force of economics and technology in the age of neoliberalism and its algorithmic rationalities. It takes Schmitt’s sparse reflections about cybernetics and game theory as paradigmatic of the theoretical and political problems raised by any theory positing the autonomy of the political. It suggests that this ultimately misunderstands the role of cybernetic representations of political decision-making in shoring up in (...) the 1960s and 1970s the autonomy of the political that Schmitt so vehemently defended. Recent models of the conceptual system hold that concepts are grounded in simulations of actual experiences with instances of those concepts in sensory-motor systems (e.g., Barsalou, 1999, 2003; Solomon & Barsalou, 2001). Studies supportive of such a viewhave shown that verifying a property of a concept in one modality, and then switching to verify a property of a different concept in a different modality generates temporal processing costs similar to the cost of switching modalities in perception. In addition to non-emotional (...) concepts, the present experiment investigated switching costs in verifying properties of positive and negative (emotional) concepts. Properties of emotional concepts were taken from vision, audition, and the affective system. Parallel to switching costs in neutral concepts, the study showed that for positive and negative concepts, verifying properties from different modalities produced processing costs such that reaction times were longer and error rates were higher. Importantly, this effect was observed when switching from the affective system to sensory modalities, and vice-versa. These results support the embodied cognition view of emotion in humans. (shrink)

Punitive behaviours are often assumed to be the result of an instinct for punishment. This instinct would have evolved to punish wrongdoers and it would be the evidence that cooperation has evolved by group selection. Here, I propose an alternative theory according to which punishment is a not an adaptation and that there was no specific selective pressure to inflict costs on wrongdoers in the ancestral environment. In this theory, cooperation evolved through partner choice for mutual advantage. In the ancestral (...) environment, individuals were in competition to be recruited in cooperative ventures and it was vital to share the benefits of cooperation in a mutually advantageous manner. If individuals took a bigger share of the benefits, their partners would leave them for more interesting partners. If they took a smaller share, they would be exploited by their partners who would receive more than what they had contributed to produce. This competition led to the selection of a sense of fairness, a cognitive adaptation aiming to share equally the benefits of cooperation in order to attract partners. In this theory, punishment is not necessary for the evolution of cooperation. Punitive behaviours are only a way to restore fairness by compensating the victim or penalizing the culprit. Drawing on behavioural economics, legal anthropology, and cognitive psychology, I show that empirical data fit better with this framework than with the theory of group selection. When people punish, they do so to restore fairness rather than to help the group. (shrink)

We construct a fibered dimension function in some topological differential fields.

This paper develops a new argument against free will, understood as the principle of alternative possibilities (PAP). This principle has been central in debates around free will and moral responsibility; however, it is almost always stated in terms of bodily rather than mental action, and it is therefore mainly understood as the possibility to physically act differently, rather than to think differently. The argument presented here is aimed at the latter, which is termed the possibility of alternative thought (PAT). It (...) argues on psychological grounds that it is impossible for a subject to think differently than it does in a given situation. First, I make the possibility of alternative thought explicit, explain what it means for a self to entertain a thought (or conscious content), and I define a notion of conscious control that is required for the argument. I then offer a taxonomy of content types, based on how they are being controlled. In the third section, I analyse the scenarios of content generation for each type of content, to determine whether they can satisfy the PAT. It will be shown that this cannot be the case. (shrink)

This article examines HIV-positive patients’ experiences of treatments within a context characterized by the multiplicity of opinions expressed both by specialists and the public domain. It is based upon a survey of 63 patients encountered in a Paris hospital. The authors demonstrate the contrasts between these patients in terms of two main dimensions: the degree of the patients’ proximity to specialist knowledge, and the level of homogeneousness that the patients attribute to medical know-how. At the point where these two dimensions (...) meet, the article distinguishes between three forms of patient attitude towards treatment; in other words, three ways of simultaneously positioning oneself with regard to the media, associations, doctors and family circles/entourage: resorting to exteriority; self-integration into biomedical institutions; arranging heterogeneous actors. Computer vision aims to produce an understanding of digital image’s content and the generation or transformation of images through software. Today, a significant amount of computer vision algorithms rely on techniques of machine learning which require large amounts of data assembled in collections, or named data sets. To build these data sets a large population of precarious workers label and classify photographs around the clock at high speed. For computers to learn how to see, a scale articulates macro and micro (...) dimensions: the millions of images culled from the internet with the few milliseconds given to the workers to perform a task for which they are paid a few cents. This paper engages in details with the production of this scale and the labour it relies on: its elaboration. This elaboration does not only require hands and retinas, it also crucially zes mobilises the photographic apparatus. To understand the specific character of the scale created by computer vision scientists, the paper compares it with a previous enterprise of scaling, Malraux’sLe Musée Imaginaire, where photography was used as a device to undo the boundaries of the museum’s collection and open it to an unlimited access to the world’s visual production. Drawing on Douglas Crimp’s argument that the “musée imaginaire”, a hyperbole of the museum, relied simultaneously on the active role of the photographic apparatus for its existence and on its negation, the paper identifies a similar problem in computer vision’s understanding of photography. The double dismissal of the role played by the workers and the agency of the photographic apparatus in the elaboration of computer vision foreground the inherent fragility of the edifice of machine vision and a necessary rethinking of its scale. To introduce the issue of the tracking and identification of human agents, I examine the ability of an agent to track a human person and distinguish this target from other individuals: The ability to perform person identification. First, I discuss influential mechanistic models of the perceptual recognition of human faces and people. Such models propose detailed hypotheses about the parts and activities of the mental mechanisms that control the perceptual recognition of persons. However, models based on perceptual recognition are incomplete (...) theories of person identification because they do not explain several identification behaviors that are fundamental to human social interactions. Furthermore, recognition-based models tend to appeal to the controversial concept of the “identity” of a person without explaining what determines personal identity and persistence. To overcome these limitations, I propose to integrate the face-recognition program into a broader causal-historical theory of identification. The causal-historical theory of identification complements models focused on perceptual recognition because it can account for the types of non-perceptual identification overlooked by the face-recognition program. Moreover, it can decompose the identification behaviors into tracking processes that succeed or fail to be sensitive to causal characteristics of a target. I illustrate these advantages with a discussion of the difference between the tracking of a person understood as either a causally continuous biological organism or a psychologically continuous mind. Finally, I argue that the causal-historical theory provides a theoretical framework for investigating the tracking of relations between a target and its contextual and historical attributes, such as a target's possessions. We give a characterization of majority voting rules with quorums in the framework of May (Econometrica 20:680–684, 1952)’s seminal article. According to these voting rules, an alternative is socially chosen if and only if it obtains the relative majority of votes and the total number of voters not abstaining reaches the quorum.
