This paper explores the truism that people think about what they say. It proposes that, to satisfy their own goals, people often plan their speech acts to affect their listeners' beliefs, goals, and emotional states. Such language use can be modelled by viewing speech acts as operators in a planning system, thus allowing both physical and speech acts to be integrated into plans. Methodological issues of how speech acts should be defined in a planbased theory are illustrated by defining operators (...) for requesting and informing. Plans containing those operators are presented and comparisons are drawn with Searle's formulation. The operators are shown to be inadequate since they cannot be composed to form questions (requests to inform) and multiparty requests (requests to request). By refining the operator definitions and by identifying some of the side effects of requesting, compositional adequacy is achieved.The solution leads to a metatheoretical principle for modelling speech acts as planning operators. Students of perception have long known that perceptual constancy is an important aspect of our perceptual interaction with the world. Here is a simple example of the phenomenon concerning color perception: there is some ordinary sense in which an unpainted ceramic coffee cup made from a uniform material looks a uniform color when it is viewed under uneven illumination, even though the light reflected by the shaded regions to our eyes is quite different from the light reflected by the unshaded (...) regions to our eyes (see figure 1). Or consider this example concerning size perception: there is some ordinary sense in which two telephone poles look the same size when the first is viewed from 100 meters and when the second is viewed from 1 meter, even though the visual angle subtended by the two poles on our retinae is very different (see figure 2). Or consider this example concerning shape perception: there is some ordinary sense in which a penny looks round both when viewed head on and when viewed from an acute angle, even though the area projected by the penny onto our retinae under these two conditions is very different (see figure 3). Or, finally, consider this example concerning auditory volume perception (which I cannot depict graphically): there is some ordinary sense in which a speaker’s voice sounds the same volume when heard from across the room and when heard from a distance of 1 meter, even though the energy striking our ears under these two conditions is very different. The traditional view in epistemology is that we must distinguish between being rational and being right (that is also, by the way, the traditional view about practical rationality). In his paper in this volume, Williamson proposes an alternative view according to which only beliefs that amount to knowledge are rational (and, thus, no false belief is rational). It is healthy to challenge tradition, in philosophy as much as elsewhere. But, in this instance, we think that tradition has it right. Review of Primary Ousia: An Essay on Aristotle's Metaphysics Z and H, by Michael J. Loux (Cornell University Press: 1991).

This paper examines how unethical behavior in the workplace occurs when management places inordinately strong emphasis on goalattainment without a corresponding emphasis on following legitimate procedures. Robert Merton's theory of sodal structure and anomie provides a foundation to discuss this argument. Key factors affecting ethical climates in work organizations are also addressed. Based on this analysis, the paper proposes strategies for developing and changing aspects of organizational culture to reduce anomie, thereby creating work climates which discourage unethical practices and provide (...) employees with mechanisms to resolve ethical conflicts in a constructive way. Based on evidence from press articles covering 39 corporate fraud cases that went public during the period 1992-2005, the objective of this article is to examine the role of managers' behavior in the commitment of the fraud. This study integrates the fraud triangle (FT) and the theory of planned behavior (TPB) to gain a better understanding of fraud cases. The results of the analysis suggest that personality traits appear to be a major fraud-risk factor. The analysis was further validated through (...) a quantitative analysis of keywords which confirmed that keywords associated with the attitudes/rationalizations component of the integrated theory were predominately found in fraud firms as opposed to a sample of control firms. The results of the study suggest that auditors should evaluate the ethics of management through the components of the TPB: the assessment of attitude, subjective norms, perceived behavioral control and moral obligation. Therefore, it is potentially important that the professional standards that are related to fraud detection strengthen the emphasis on managers' behavior that may be associated with unethical behavior. This paper argues that contrary to what is often thought, virtue for Kant is not just a matter of strength of will; it has an essential affective dimension. To support this claim, I show that certain affective dispositions, namely moral feelings and desires, are virtuous in the sense that they are constitutive of virtue at the affective level. There is thus an intrinsic connection between an agent’s practice of virtue and the cultivation of her affective dispositions.

Answering machines and other types of recording devices present prima facie problems for traditional theories of the meaning of indexicals. The present essay explores a range of semantic and pragmatic responses to these issues. Careful attention to the difficulties posed by recordings promises to help enlighten the boundaries between semantics and pragmatics more broadly.

An important motivation for relational theories of color is that they resolve apparent conflicts about color: x can, without contradiction, be red relative to S1 and not red relative to S2. Alas, many philosophers claim that the view is incompatible with naive, phenomenally grounded introspection. However, when we presented normal adults with apparent conflicts about color (among other properties), we found that many were open to the relationalist's claim that apparently competing variants can simultaneously be correct. This suggests that, philosophers' (...) claims to the contrary notwithstanding, introspection does not supply authoritative and unambiguous reason to reject color relationalism. (shrink)

This elevating pull of an ethics that can account for the relation of self and other without reducing either term is the central theme of these essays.

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

In Clark (2000), Austen Clark argues convincingly that a widespread view of perception as a complicated kind of feature-extraction is incomplete. He argues that perception has another crucial representational ingredient: it must also involve the representation of "sensory individuals" that exemplify sensorily extracted features. Moreover, he contends, the best way of understanding sensory individuals takes them to be places in space surrounding the perceiver. Critical discussion of Alan Code's paper "Aristotle's Investigation of a Basic Logical Principle: Which Science Investigates the Principle of Non-Contradiction?".

Cases of inexact observations have been used extensively in the recent literature on higher-order evidence and higher-order knowledge. I argue that the received understanding of inexact observations is mistaken. Although it is convenient to assume that such cases can be modeled statically, they should be analyzed as dynamic cases that involve change of knowledge. Consequently, the underlying logic should be dynamic epistemic logic, not its static counterpart. When reasoning about inexact knowledge, it is easy to confuse the initial situation, the (...) observation process, and the result of the observation; I analyze the three separately. This dynamic approach has far reaching implications: Williamson’s influential argument against the KK principle loses its force, and new insights can be gained regarding synchronic and diachronic introspection principles.
