Erstaunlicherweise ist sie noch immer weithin unerforscht. Dieser Band geht auf eine Fruhkantianismus-Ausstellung der Universitat Jena (1993) zuruck. Er hilft, das Quellenmaterial leichter zu erschliessen. Kapitel uber Ch. G. Schutz, C. Ch. E. Schmid, die Allgemeine Literatur-Zeitung, Reinhold, Schiller, Hufeland u.a. geben neue Einblicke in diese fruhe Etappe der Kantrezeption. An die hundert Abbildungen prasentieren teilweise vollig unbekanntes Quellenmaterial (...) von hohem Wert. The first reception of Kant directly after publication of the Critique of Pure Reason is one of the most momentous and fascinating stages in the recent history of philosophy. Surprisingly not much research has been done on this. This volume is the result of an exhibition of early Kantianism at the University of Jena in 1993. It helps to make the source material more easily accessible. Chapters on Ch. G. Schutz, C. Ch. E. Schmid, the Allgemeine Literatur-Zeitung, Reinhold, Schiller, Hufeland among others provide new insight into this early stage of Kant's reception. There are approximately 100 illustrations which present very valuable source material, some of which was previously completely unknown. (shrink)

Sugar relationships can be considered contemporary forms of transactional sex, that is, offering sexual services for material resources or other benefits. Considering the common age differences in these relationships, sugar relationships might be of relevance for older adults as well on the mating market. As a sequel to Birkás et al., in the present study, an attitude scale was developed to assess older women’s and men’s acceptance of sugar relationships. We also explored whether the acceptance of sugar relationships was associated (...) with love styles, sociosexual orientation, sexual motivation, and certain socially aversive personality traits. In two online studies with a total number of 836 participants, the results showed that the Acceptance of Sugar Relationships in Older Men and Women Scale proved to be a reliable and conceptually valid measure of older individuals’ attitude toward sugar relationships. A more accepting attitude toward sugar relationships was found to be associated with more unrestricted sociosexuality, preference to engage in playful love relationships and more self-focused sexual motivation, and with more pronounced Dark Triad and borderline traits. It has often been argued that Humean accounts of natural law cannot account for the role played by laws in scientific explanations. Loewer (Philosophical Studies 2012) has offered a new reply to this argument on behalf of Humean accounts—a reply that distinguishes between grounding (which Loewer portrays as underwriting a kind of metaphysical explanation) and scientific explanation. I will argue that Loewer’s reply fails because it cannot accommodate the relation between metaphysical and scientific explanation. This relation also resolves a puzzle (...) about scientific explanation that Hempel and Oppenheim (Philosophy of Science 15:135–75, 1948) encountered. (shrink)

Humean accounts of natural lawhood have often been criticized as unable to account for the laws’ characteristic explanatory power in science. Loewer has replied that these criticisms fail to distinguish grounding explanations from scientific explanations. Lange has replied by arguing that grounding explanations and scientific explanations are linked by a transitivity principle, which can be used to argue that Humean accounts of natural law violate the prohibition on self-explanation. Lange’s argument has been sharply criticized by Hicks and van (...) Elswyk, Marshall, and Miller. This paper shows how Lange’s argument can withstand these criticisms once the transitivity principle and the prohibition on self-explanation are properly refined. The transitivity principle should be refined to accommodate contrasts in the explanans and explanandum. The prohibition on self-explanation should be refined so that it precludes a given fact p from helping to explain why some other fact q helps to explain why p. In this way, the transitivity principle avoids having counterintuitive consequences in cases involving macrostates having multiple possible microrealizations. The transitivity principle is perfectly compatible with the irreducibility of macroexplanations to microexplanations and with the diversity of the relations that can underwrite scientific explanations. Partiality is the special concern that we display for ourselves and other people with whom we stand in some special personal relationship. It is a central theme in moral philosophy, both ancient and modern. Questions about the justification of partiality arise in the context of enquiry into several moral topics, including the good life and the role in it of our personal commitments; the demands of impartial morality, equality, and other moral ideals; and commonsense ideas about supererogation. This paper provides (...) an overview of the debate on the ethics of partiality through the lens of the domains of permissible and required partiality. After outlining the conceptual space, I first discuss agent-centred moral options that concern permissions not to do what would be impartially optimal. I then focus on required partiality, which concerns associative duties that go beyond our general duties to others and require us to give special priority to people who are close to us. I discuss some notable features of associative duties and the two main objections that have been raised against them: the Voluntarist and the Distributive objections. I then turn to the justification of partiality, focusing on underivative approaches and reasons-based frameworks. I discuss the reductionism and non-reductionism debate: the question whether partiality is derivative or fundamental. I survey arguments for ‘the big three’, according to which partiality is justified by appeal to the special value of either projects, personal relationships, or individuals. I conclude by discussing four newly emerging areas in the debate: normative transitions of various personal relationships, relationships with AI, epistemic partiality, and negative partiality, which concerns the negative analogue of our positive personal relationships. The institution of the family and its importance have recently received considerable attention from political theorists. Leading views maintain that the institution’s justification is grounded, at least in part, in the non-instrumental value of the parent-child relationship itself. Such views face the challenge of identifying a specific good in the parent-child relationship that can account for how adults acquire parental rights over a particular child—as opposed to general parental rights, which need not warrant a claim to parent one’s biological progeny. (...) I develop a view that meets this challenge. This Project View identifies the pursuit of a parental project as a distinctive non-instrumentally valuable good that provides a justification for the family and whose pursuit is necessary and sufficient for the acquisition of parental rights. This view grounds moral parenthood in a normative relation as opposed to a biological one, supports polyadic forms of parenting, and provides plausible guidance in cases of assisted reproduction. Ethical approval must be obtained before medical research can start. We describe the differences in EA for an pseudonymous, non-interventional, observational European study. Sixteen European national coordinators of the international study on very old intensive care patients answered an online questionnaire concerning their experience getting EA. N = 8/16 of the NCs could apply at one single national ethical committee, while the others had to apply to various regional ECs and/or individual hospital institutional research boards. The time between applying for (...) EA and the first decision varied between 7 days and 300 days. In 9/16 informed consent from the patient was not deemed necessary; in 7/16 informed consent was required from the patient or relatives. The upload of coded data to a central database required additional information in 14/16. In 4/16 the NCs had to ask separate approval to keep a subject identification code list to de-pseudonymize the patients if questions would occur. Only 2/16 of the NCs agreed that informed consent was necessary for this observational study. Overall, 6/16 of the NCs were satisfied with the entire process and 8/16 were unsatisfied. 11/16 would welcome a European central EC that would judge observational studies for all European countries. Variations in the process and prolonged time needed to get EA for observational studies hampers inclusion of patients in some European countries. This might have a negative influence on the external validity. Further harmonization of ethical approval process across Europe is welcomed for low-risk observational studies. Getting ethical approval for low-risk, non-interventional, observational studies varies enormously across European countries. (shrink)

This paper explores whether there is any relation between mathematical proofs that specify the grounds of the theorem being proved and mathematical proofs that explain why the theorem obtains. The paper argues that a mathematical fact’s grounds do not, simply by virtue of grounding it, thereby explain why that fact obtains. It argues that oftentimes, a proof specifying a mathematical fact’s grounds fails to explain why that fact obtains whereas any explanation of the fact does not specify its ground. The (...) paper offers several examples from mathematical practice to illustrate these points. These examples suggest several reasons why explaining and grounding tend to come apart, including that explanatory proofs need not exhibit purity, tend not to be brute force, and often unify separate cases by identifying common reasons behind them even when those cases have distinct grounds. The paper sketches an account of what makes a proof explanatory and uses that account to defend the morals drawn from the examples already given. (shrink)

Although all mathematical truths are necessary, mathematicians take certain combinations of mathematical truths to be ‘coincidental’, ‘accidental’, or ‘fortuitous’. The notion of a ‘ mathematical coincidence’ has so far failed to receive sufficient attention from philosophers. I argue that a mathematical coincidence is not merely an unforeseen or surprising mathematical result, and that being a misleading combination of mathematical facts is neither necessary nor sufficient for qualifying as a mathematical coincidence. I argue that although the components of a mathematical coincidence (...) may possess a common explainer, they have no common explanation ; that two mathematical facts have a unified explanation makes their truth non-coincidental. I suggest that any motivation we may have for thinking that there are mathematical coincidences should also motivate us to think that there are mathematical explanations, since the notion of a mathematical coincidence can be understood only in terms of the notion of a mathematical explanation. I also argue that the notion of a mathematical coincidence plays an important role in scientific explanation. When two phenomenological laws of nature are similar, despite concerning physically distinct processes, it may be that any correct scientific explanation of their similarity proceeds by revealing their similarity to be no mathematical coincidence. I argue that you can be permitted to discount the interests of your adversaries even though doing so would be impartially suboptimal. This means that, in addition to the kinds of moral options that the literature traditionally recognises, there exist what I call other-sacrificing options. I explore the idea that you cannot discount the interests of your adversaries as much as you can favour the interests of your intimates; if this is correct, then there is an asymmetry between negative partiality (...) toward your adversaries and positive partiality toward your intimates. Many philosophers endorse the Transparency Thesis, the claim that by introspection one cannot become aware of one's experience. Recently, some authors have suggested that the Transparency Thesis is challenged by introspective states reached under mindfulness. We label this the Mindfulness Opacity Hypothesis. The present paper develops the hypothesis in important new ways. First, we motivate the hypothesis by drawing on recent clinical psychology and cognitive science of mindfulness. Secondly, we develop the hypothesis by describing the implied shift in experiential perspective, (...) the scope of introspectable qualities, and the level of skill. Thirdly, we defend the hypothesis against various philosophical arguments. We conclude that the Mindfulness Opacity Hypothesis is empirically and theoretically well motivated and supported. (shrink)

Philosophers who regard some mathematical proofs as explaining why theorems hold, and others as merely proving that they do hold, disagree sharply about the explanatory value of proofs by mathematical induction. I offer an argument that aims to resolve this conflict of intuitions without making any controversial presuppositions about what mathematical explanations would be.

The objective of this article is to analyse and compare four methods of ethical case deliberation. These include Clinical Pragmatism, The Nijmegen Method of ethical case deliberation, Hermeneutic dialogue, and Socratic dialogue. The origin of each method will be briefly sketched. Furthermore, the methods as well as the related protocols will be presented. Each method will then be evaluated against the background of those situations in which it is being used. The article aims to show that there is not one (...) ideal method of ethical case deliberation, which fits to all possible kinds of moral problems. Rather, as each of the methods highlights a limited number of morally relevant aspects, each method has its strengths and weaknesses as well. These strengths and weaknesses should be evaluated in relation to different types of situations, for instance moral problems in treatment decisions, moral uneasiness and residue, and the like. The suggestion arrived at on the basis of the findings of this paper is a reasonable methodological plurality. This means that a method can be chosen depending on the type of moral problem to be deliberated upon. At the same time it means, that by means of a method, deliberation should be facilitated. Autism Spectrum Disorder (ASD) is a neurodevelopmental condition characterized by social/communicative difficulties and perseverative behaviours. While research on autism has flourished recently, few studies have been conducted on the disorder in non‐Western contexts. In low‐ and middle‐income countries (LMICs), biomedical research on autism is required to better understand the needs of the population and to develop contextually appropriate interventions. However, autistic individuals are a vulnerable study population and LMICs present with various considerations. While the presentation of autism is heterogeneous, stigma (...) is a common social consequence affecting research. Drawing specifically on the South African context, the ethical intersections of these issues are discussed, along with the limitations of the current informed consent process. Community engagement is recommended as an adjunct to informed consent to ensure that biomedical research is conducted in a more inclusive way. Practical pointers are provided for implementing systematic support for conducting community engagement alongside biomedical research. (shrink)

This paper explores the relevance of the debate about ethical expertise for the practice of clinical ethics. We present definitions, explain three theories of ethical expertise, and identify arguments that have been brought up to either support the concept of ethical expertise or call it into question. Finally, we discuss four theses: the debate is relevant for the practice of clinical ethics in that it (1) improves and specifies clinical ethicists' perception of their expertise; (2) contributes to improving the perception (...) of moral competence of non-ethicists; (3) gives insight into complementary styles of argumentation of ethicists and non-ethicists; and (4) contributes to the awareness of the problem of profession-building of (clinical) ethicists. Recently, biologists and computer scientists who advocate the "strong thesis of artificial life" have argued that the distinction between life and nonlife is important and that certain computer software entities could be alive in the same sense as biological entities. These arguments have been challenged by Sober (1991). I address some of the questions about the rational reconstruction of biology that are suggested by these arguments: What is the relation between life and the "signs of life"? What work (if any) (...) might the concept of "life" (over and above the "signs of life") perform in biology? What turns on scientific disputes over the utility of this concept? To defend my answers to these questions, I compare "life" to certain other concepts used in science, and I examine historical episodes in which an entity's vitality was invoked to explain certain phenomena. I try to understand how these explanations could be illuminating even though they are not accompanied by any reductive definition of "life.". (shrink)

has offered a lovely example to motivate the intuition that a successful prediction has a kind of confirmatory significance that an accommodation lacks. This paper scrutinizes Maher's example. It argues that once the example is tweaked, the intuitive difference there between prediction and accommodation disappears. This suggests that the apparent superiority of prediction to accommodation is actually a side effect of an important difference between the hypotheses that tend to arise in each case.

Humean accounts of natural law have long been charged with being unable to account for the laws’ explanatory power in science. One form of this objection is to charge Humean accounts with explanatory circularity: a fact in the Humean mosaic helps to explain why some regularity is a law (first premise), but that law, in turn, helps to explain why that mosaic fact holds (second premise). To this objection, Humeans have replied that the explanation in the first premise is metaphysical (...) whereas the explanation in the second premise is scientific, so (since these two varieties of explanation operate very differently) the two explanations cannot be chained together to yield explanatory circularity. This paper presents a new circularity argument that avoids this objection because both explanations in the premises are metaphysical. The new circularity argument also avoids the objection that the contrasts at the point where the two explanations are chained together fail to line up properly. The upshot is to leave the Humean account of law with two unattractive options: to regard scientific explanation under natural law as not constituting genuine explanation at all or to regard the Humean account as involving a vicious explanatory circularity. The moral psychologist Joshua Greene has proposed a number of arguments for the normative significance of empirical research and for the unreliability of deontological intuitions. For these arguments, much hinges on the combination of various components of Greene's research – namely the dual-process theory of moral judgement, ‘personalness’ as a factor in moral decision-making, and his functional understanding of deontology and consequentialism. Incorporating these components, I reconstruct three distinct arguments and show that the Personalness Argument for the claim that empirical (...) research can advance normative ethics and the Combined Argument against deontology are both sound and interesting in themselves. They do not, however, cast doubt on traditional deontology or reserve a specific role for neuroscience. The Indirect Route argument overcomes some of the other arguments’ limitations. It is, however, invalid. I conclude by pointing out the broader philosophical relevance of Greene's arguments as shedding light on second-order morality. (shrink)

The concept of transliminality (''a hypothesized tendency for psychological material to cross thresholds into or out of consciousness'') was anticipated by William James (1902/1982), but it was only recently given an empirical definition by Thalbourne in terms of a 29-item Transliminality Scale. This article presents the 17-item Revised Transliminality Scale (or RTS) that corrects age and gender biases, is unidimensional by a Rasch criterion, and has a reliability of .82. The scale defines a probabilistic hierarchy of items that address magical (...) ideation, mystical experience, absorption, hyperaesthesia, manic experience, dream interpretation, and fantasy proneness. These findings validate the suggestions by James and Thalbourne that some mental phenomena share a common underlying dimension with selected sensory experiences (such being overwhelmed by smells, bright lights, sights, and sounds). Low scores on transliminality remain correlated with ''tough mindedness'' in on Cattell 16PF test, as well as ''self-control'' and ''rule consciousness,'' whereas high scores are associated with ''abstractedness'' and an ''openness to change'' on that test. An independent validation study confirmed the predictions implied by our definition of transliminality. Implications for test construction are discussed. (shrink)

In this article, the question is discussed if and how Healthcare Ethics Committees (HECs) should be regulated. The paper consists of two parts. First, authors from eight EC member countries describe the status quo in their respective countries, and give reasons as to the form of regulation they consider most adequate. In the second part, the country reports are analysed. It is suggested that regulation of HECs should be central and weak. Central regulation is argued to be apt to improve (...) HECs’ accountability, relevance and comparability. To facilitate biomedical citizenship and ethical reflection, regulation should at the same time be weak rather than strict. Independence of HECs to deliberate about ethical questions, and to give solicited and unsolicited advice, should be supported and only interfered with by way of exception. One exception is when circumstances become temporary adversarial to ethical deliberation in healthcare institutions. In view of European unification, steps should be taken to develop consistent policies for both Eastern and Western European countries. (shrink)

Worldwide there are substantial differences within and between countries in aggression and violence. Although there are various exceptions, a general rule is that aggression and violence increase as one moves closer to the equator, which suggests the important role of climate differences. While this pattern is robust, theoretical explanations for these large differences in aggression and violence within countries and around the world are lacking. Most extant explanations focus on the influence of average temperature as a factor that triggers aggression, (...) or the notion that warm temperature allows for more social interaction situations in which aggression is likely to unfold. We propose a new model, CLimate, Aggression, and Self-control in Humans, that helps us to understand differences within and between countries in aggression and violence in terms of differences in climate. Lower temperatures, and especially larger degrees of seasonal variation in climate, call for individuals and groups to adopt a slower life history strategy, a greater focus on the future, and a stronger focus on self-control. The CLASH model further outlines that slow life strategy, future orientation, and strong self-control are important determinants of inhibiting aggression and violence. We also discuss how CLASH differs from other recently developed models that emphasize climate differences for understanding conflict. We conclude by discussing the theoretical and societal importance of climate in shaping individual and societal differences in aggression and violence. (shrink)

Digital duplicates reduce the scarcity of individuals and thus may impact their instrumental and intrinsic value. I here expand upon this idea by introducing the notion of collective scarcity, which pertains to the limitations faced by social groups in maintaining their size, cohesion, and function.

Why do relationships of friendship and love support partiality, but not relationships of hatred or commitments of racism? Where does partiality end and why? I take the intuitive starting point that important cases of partiality are meaningful. I develop a view whereby meaning is understood in terms of transcending self-limitations in order to connect with things of external value. I then show how this view can be used to distinguish central cases of legitimate partiality from cases of illegitimate partiality and (...) how it puts pressure on the traditional way of thinking about partiality. An increasing number of regulations propose the notion of ‘AI audits’ as an enforcement mechanism for achieving transparency and accountability for artificial intelligence (AI) systems. Despite some converging norms around various forms of AI auditing, auditing for the purpose of compliance and assurance currently have little to no agreed upon practices, procedures, taxonomies, and standards. We propose the ‘criterion audit’ as an operationalizable compliance and assurance external audit framework. We model elements of this approach after financial auditing practices, and argue (...) that AI audits should similarly provide assurance to their stakeholders about AI organizations’ ability to govern their algorithms in ways that mitigate harms and uphold human values. We discuss the necessary conditions for the criterion audit, and provide a procedural blueprint for performing an audit engagement in practice. We illustrate how this framework can be adapted to current regulations by deriving the criteria on which ‘bias audits’ for hiring algorithms can be performed, as required by the recently effective New York City Local Law 144 of 2021. We conclude by offering critical discussion on the benefits, inherent limitations, and implementation challenges of applying practices of the more mature financial auditing industry to AI auditing where robust guardrails against quality assurance issues are only starting to emerge. Our discussion as informed by experiences in performing these audits in practice highlights the critical role that an audit ecosystem plays in ensuring the effectiveness of such methodology. The purpose of the presented paper is to showcase the links between Hans-Hermann Hoppe’s libertarian argumentation ethics and Karl-Otto Apel’s transcendental pragmatics with a special reference to the consensus theory of truth proposed by the latter thinker. More specifically, the author contends that Hoppe’s theory is logically contingent on Apel’s views on truth in that some crucial gaps in Hoppe’s grounding of the so-called “a priori of communication and argumentation” are filled by Apel’s original arguments. Additionally, the paper provides a (...) case for interpreting Hoppe's ethics as a theory of rational conflict-freedom, which seems to cohere best with the transcendental-pragmatist approach. Finally, the author offers a few remarks on how the most common objections against Hoppe's theory can be overcome on the basis of the transcendental pragmatics and the conflict-freedom principle. This article elaborates on the relation between ethical casuistry and common law reasoning. Despite the frequent talk of casuistry as common law morality, remarks on this issue largely remain at the purely metaphorical level. The article outlines and scrutinizes Albert Jonsen and Stephen Toulmin’s version of casuistry and its basic elements. Drawing lessons for casuistry from common law reasoning, it is argued that one generally has to be faithful to ethical paradigms. There are, however, limitations for the binding force of (...) paradigms. The most important limitations—the possibilities of overruling and distinguishing paradigm norms—are similar in common law and in casuistry, or so it is argued. These limitations explain why casuistry is not necessarily overly conservative and conventional, which is one line of criticism to which casuists can now better respond. Another line of criticism has it that the very reasoning from case to case is extremely unclear in casuistry. I suggest a certain model of analogical reasoning to address this critique. All my suggestions to understand and to enhance casuistry make use of common law reasoning whilst remaining faithful to Jonsen and Toulmin’s main ideas and commitments. Further developed along these lines, casuistry can appropriately be called “common law morality.”. (shrink)

Existing discussions of partiality have primarily examined special personal relationships between family, friends, or co-nationals. The negative analogue of such relationships – for example, the relationship of enmity – has, by contrast, been largely neglected. This chapter explores this adverse relation in more detail and considers the special reasons generated by it. We suggest that enmity can involve justified negative partiality, allowing members to give less consideration to each other’s interests. We then consider whether the negative partiality of enmity can (...) be justified through projects or the value inherent in the relationship, following two influential views about the justification of positive partiality. We argue that both accounts of partiality can be conceptually extended to the negative analogue, but doing so brings into focus the problems with such accounts of the grounds of partiality. (shrink)

What should we do if climate change or global injustice require radical policy changes not supported by the majority of citizens? And what if science shows that the lacking support is largely due to shortcomings in citizens’ individual psychology such as cognitive biases that lead to temporal and geographical parochialism? Could then a plausible case for enhancing the morality of the electorate—even against their will –be made? But can a democratic government manipulate the will of the people without losing democratic (...) legitimacy? This paper explores the problems that governmental manipulation of voters pose for democratic legitimacy and the tensions between non-manipulated input and morally acceptable output. These venerable issues of political theory resurface in light of recent suggestions to tackle today’s global mega-problems by Ingmar Persson and Julian Savulescu. They suggest that to avert the looming catastrophe, governments should alter psychological traits of the citizenry through biomedical means, from pharmaceuticals to genetics. However, we argue that a government cannot rule with democratic legitimacy if elected by a will of the people it manipulated before. Normatively, conferring power from the governed onto governors is a one-directional relation that is incompatible with manipulation. But while it is tempting to rebut suggestions to morally enhance the people as antithetical to essential ideas of democracy, swift rebuttals tend to overlook the deeper challenge: Majoritarian decision-making may lead to inacceptable outcomes. The dilemma between input and output runs through major works in political theory. Rather than wishfully ignoring the dangers of democracy, democratic theory has to provide answers. (shrink)

Many scholars characterize um as an involuntary emission that is devoid of meaning. Other scholars classify um as a non-linguistic signal that conveys certain messages or resolves a conversational problem, such as determining next speaker. Um is often assumed to signal `powerless language' because it displays speaker uncertainty. Yet an examination of real-time, written conversation in two online communities shows that participants sometimes use an um to mark an obvious flaw in prior talk. In the examples below, um may be (...) used to mark talk as flawed on the basis of information that is available to both parties. When um becomes associated with marking obvious flaws in prior talk, interlocutors may trade on this meaning and deploy an um to display for themselves a higher position of relative expertise, vis-à-vis their interlocutors, within local micro-social hierarchies of knowledge.
