The treatment-enhancement distinction draws a line between services or interventions meant to prevent or cure conditions that we view as diseases or disabilities and interventions that improve a condition that we view as a normal function or feature of members of our species. The line drawn here is widely appealed to in medical practice and medical insurance contexts, as well as in our everyday thinking about the medical services we do and should assist people in obtaining.

In this article I use Kantian moral philosophy to develop a concept of meaningful work. Specifically, a Kantian would argue that work is meaningful if (1) it is freely entered into, (2) it allows the worker to exercise her autonomy and independence, (3) it enables the worker to develop her rational capacities, (4) it provides a wage sufficient for physical welfare, (5) it supports the moral development of employees and (6) it is not paternalistic. Professor Swartz clearly identifies and analyzes the arguments and intuitions of the opposing Necessitarian theory, and argues that the standard objection to the Regularity theory turns on a mistaken view of what Regularists mean by 'physical impossibility'; that it is impossible to construct (...) an empirical test that can distinguish between events Necessitarians call 'mere accidents' and those they call 'nornologically necessary', and that the Necessitarian theory cannot account fot human beings' free wills. A Bayesian network (BN) is a graphical model of uncertainty that is especially well suited to legal arguments. It enables us to visualize and model dependencies between different hypotheses and pieces of evidence and to calculate the revised probability beliefs about all uncertain factors when any piece of new evidence is presented. Although BNs have been widely discussed and recently used in the context of legal arguments, there is no systematic, repeatable method for modeling legal arguments as BNs. Hence, where (...) BNs have been used in the legal context, they are presented as completed pieces of work, with no insights into the reasoning and working that must have gone into their construction. This means the process of building BNs for legal arguments is ad hoc, with little possibility for learning and process improvement. This article directly addresses this problem by describing a method for building useful legal arguments in a consistent and repeatable way. The method complements and extends recent work by Hepler, Dawid, and Leucari (2007) on object-oriented BNs for complex legal arguments and is based on the recognition that such arguments can be built up from a small number of basic causal structures (referred to as idioms). We present a number of examples that demonstrate the practicality and usefulness of the method. (shrink)

In A Theory of Justice, John Rawls defines a hypothetical contract situation and argues rational people will agree on reflection it is fair to contractors. He solves the rational choice problem it poses by deriving two lexically-ordered principles of justice and suggests the derivation justifies the principles. Its soundness aside, just what justificatory force does such a derivation have?On one view, there is no justificatory force because the contract is rigged specifically to yield principles which match our pre-contract moral judgments. Rawls provides ammunition for this claim: “By going back and forth, sometimes altering the conditions of the contractual circumstances, at others withdrawing our judgments [about what is just] and conforming them to principle, I assume that eventually we shall find a description of the initial situation that both expresses reasonable conditions and yields principles which match our considered judgments duly pruned and adjusted.”. Some people will confront Alzheimer's with a measure of resignation, a determination to struggle against the progressive debilitation and to extract whatever comforts and benefits they can from their remaining existence. They are entitled to pursue that resolute path. For other people, like myself, protracted maintenance during progressive cognitive dysfunction and helplessness is an intolerably degrading prospect. The critical question for those of us seeking to avoid protracted dementia is how best to accomplish that objective.One strategy is to engineer one's (...) own death while still mentally competent to do so (even in the stage of mild dementia). If I were to use a preemptive strategy in the face of a dementia diagnosis, I would probably choose to stop eating and drinking, a process known as voluntarily stopping eating and drinking. An alternative tactic for avoiding prolonged dementia would be to allow oneself to decline into moderate dementia—thus losing capacity to perform self‐deliverance or even to make serious medical decisions—but before getting to that point to provide advance instructions rejecting prospective life‐sustaining medical interventions. These advance instructions would authorize palliative but not curative measures. My current personal instructions define the point of intolerable cognitive decline triggering medical nonintervention as “mental deterioration to a point when I can no longer read and understand written material such as a newspaper or financial records such as a checkbook.” These instructions dictate allowing my demise at a point of moderate dementia when I may not be perceptibly suffering, when I may still be getting some rudimentary satisfaction from my debilitated life, and when I no longer recall the preoccupation with personally intolerable indignity that motivated my instructions. Can I expect that my advance instructions will be implemented in those circumstances? Is it lawful, and is it moral for a surrogate decision‐maker and associated caregivers to allow an uncomprehending, ostensibly content but demented individual to die? My analysis herein contends that it is not only lawful and moral but also legally required to implement clear, considered advance instructions even at a stage of moderate dementia. (shrink)

This paper explores the mutual implication of critical realism and semiosis (or the intersubjective production of meaning). It argues that critical realism must integrate semiosis into its account of social relations and social structuration. This goes well beyond the question of whether reasons can be causes to include more basic issues of the performativity of semiosis and the relationship between interpretation (verstehen) and causal explanation (erklären). The paper then demonstrates how critical realism can integrate semiosis into its accounts of dialectic (...) of structure and agency through an evolutionary approach to structuration. It also demonstrates how critical semiotic analysis (including critical discourse analysis) can benefit from critical realism. In the latter respect we consider the emergence of semiotic effects and extra-semiotic effects from textual practices and give two brief illustrations of how this works from specific texts. The paper concludes with more general recommendations about the articulation of the discursive and extra-discursive aspects of social relations and its implications for critical realism. (shrink)

Agency theory involves what is known as the principal-agent problem, a topic widely discussed in economics, management, and business ethics today. It is a characteristic of nearly all modern business firms that the principals (the owners and shareholders) are not the same people as the agents (the managers who run the firms for the principals). This creates situations in which the goals of the principals may not be the same as the agents--the principals will want growth in profits and stock (...) price, while agents may want growth in salaries and positions in the hierarchy. How nature of scientific knowledge or nature of science and scientific inquiry are contextualized, or related to each other, significantly impacts both curriculum and classroom practice, specifically with respect to the teaching and learning of NOSK. NOS and NOSK are considered synonymous here, with NOSK more accurately conveying the meaning of the construct. Three US-based science education reform documents are used to illustrate the aforementioned impact. The USA has had three major reform documents released over a period of 20 years. (...) The Benchmarks for Science Literacy was the first in 1993, followed by the National Science Education Standards in 1996, and the newest, the Next Generation Science Standards, was released in 2013. NOS or NOSK was strongly emphasized and given a prominent position in the first two, while the NGSS has marginalized the construct. It is categorized as a set of connections that can be made to some of the Science Practices or Crosscutting Ideas. However, a careful conceptual analysis of how the NGSS positions NOSK/nos relative to the previous reform documents reveals a complex situation related to how NOSK/nos is contextualized and apparent assumptions about how NOSK/nos is best taught and learned. A historical review of how NOSK/nos is contextualized reveals a longstanding confusion concerning the relationship between NOSK/nos and SI as well as about how the reform documents seem to assume how it can be best taught to students. The assumptions often run contrary to the empirical research on the teaching and learning of NOSK as well as call into question the ability of the NGSS to promote the perennial science education goal of scientific literacy. We first describe how the concept of “fringe consciousness” can characterise gradations of consciousness between the extremes of implicit and explicit learning. We then show that the NEO-PI-R personality measure of openness to feelings, chosen to reflect the ability to introspect on fringe feelings, influences both learning and awareness in the serial reaction time task under conditions that have previously been associated with implicit learning . This provides empirical evidence for the proposed phenomenology and functional role of fringe consciousness in (...) so-called implicit learning paradigms . Introducing an individual difference variable also helped to identify possible limitations of the exclusion task as a measure of conscious sequence knowledge. Further exploration of individual differences in fringe awareness may help to avoid polarity in the implicit learning debate, and to resolve apparent inconsistencies between previous SRT studies. How can health plans make fair determinations about when “experimental” (and costly) treatments such as high dose chemotherapy with autologous bone marrow transplantation should be covered despite lack of clear clinical consensus about their benefits? Different models for managing “last chance” therapies evolving in some health plans offer promising examples of how issues of fairness and legitimacy in decisionmaking can be addressed.

There is a hoary tradition in moral philosophy that assumes we cannot determine which moral theory is acceptable or correct unless we have available a correct theory of human nature, or, in its more modern form, of the person. With such a theory of the person, however, we could at least narrow down the choice among competing ethical theories. A more recent tradition, at least in one of its standard interpretations, agrees it would be necessary to have a correct theory (...) of the person before we could determine an acceptable moral theory, but it denies there is a determinate nature of the person to be captured in such a theory. The plasticity of the person, according to this strand of Marxist theory, rules out the possibility of there being universal moral theory at all. In this paper, I would like to explore a view that treads an intermediate path. It agrees with the Marxist denial that there is a determinate nature of the person, a deep fact of the matter, that can be abstracted from the social matrix and made the subject of a theory of the person. And, it agrees with both traditions that moral theory depends on and embodies a theory of the person. But, by making the problem of arriving at an acceptable view of the person itself something that depends on overall theoretical considerations, including moral ones, the intermediary, view may be able to avoid the type of moral relativism associated with the Marxist view. I was seven or eight years old. In Hebrew school we had just learned the Aleph-Bet and were, haltingly, beginning to sound out words. As we spoke the ancient text, our teacher translated: "... And God said: 'Let there be light.' And there was light. ..."[note 2] Here was magic; here was the supernatural; here was the creation of the universe. I resonated to the story. I analyze the hierarchy of large cardinals between a supercompact cardinal and an almost-huge cardinal. Many of these cardinals are defined by modifying the definition of a high-jump cardinal. I organize these cardinals in terms of consistency strength and implicational strength. I also analyze the superstrong cardinals, which are weaker than supercompact cardinals but are related to high-jump cardinals. Among the results, I highlight the following. Vopěnka cardinals are the same as Woodin-for-supercompactness cardinals.There are no excessively hypercompact cardinals.Furthermore, I prove some results relating high-jump cardinals to forcing, as well as analyzing Laver functions for super-high-jump cardinals. Arnauld's criticisms as "a model of confusion confounded.” In a review of Wilson's book, R. McRae refers to "the difficult and not too coherent subject of material falsity. '' J. Cottingham describes the Descartes-Arnauld debate on the material falsity of adventitious ideas as "an involved and rather inconclusive exchange " and claims that the example of the material falsity of such ideas espoused by Descartes in Meditation III is "needlessly complicated. " A. Kenny, in turn, notes that several things are (...) "confusing in Descartes' account of false ideas. " Later reference is made to the fact that "Descartes appears confused. [...] and that "Descartes, it seems, cannot give a consistent answer. '' As will become clear, I take issue with each of these assessments. When Descartes' position on material falsity is understood in the light of late Scholastic sources, especially Suarez, whence it draws its strength and inspiration, the alleged confusion and incoherency vanishes. .. The studies that make up this book were written and brought together to honor the memory of Jan Pinborg. His unexpected death in 1982 at the age of forty-five shocked and saddened students of medieval philosophy everywhere and left them with a keen sense of disappoint ment. In his fifteen-year career Jan Pinborg had done so much for our field with his more than ninety books, editions, articles, and reviews and had done it all so well that we recognized him (...) as a leader and counted on many more years of his scholarship, his help, and his friendship. To be missed so sorely by his international colleagues in an academic field is a mark of Jan's achievement, but only of one aspect of it, for historians of philosophy are not the only scholars who have reacted in this way to Jan's death. In his decade and a half of intense productivity he also acquired the same sort of special status among historians of linguistics, whose volume of essays in his memory is being G. L. Bursill-Hall almost simultane published under the editorship of ously with this one. Sten Ebbesen, Jan's student, colleague, and successor as Director of the Institute of Medieval Greek and Latin Philology at the University of Copenhagen, has earned the gratitude of all of us by memorializing Jan 1 in various biographical sketches, one of which is accompanied by a 2 complete bibliography of his publications. Although there may be many questions about the meaning of life that will ultimately prove intractable, I think that there are some questions that can be answered. Furthermore, I think that progress towards answering them can be made through work that has and will be done in moral philosophy. In support of this I shall articulate a set of questions that I think are often at issue when people ask about the meaningfulness of life. These questions give rise to a (...) set of conditions that a fully adequate answer must satisfy. Among other things, these conditions explain why a familiar theological answer to the meaningfulness of life seems so attractive. However, they also create problems for this answer, as well as for an answer that has appeared attractive to a number of contemporary philosophers, that the meaning of life is created by the choices that people make and the desires that they have. I shall suggest that work in moral philosophy may provide an answer that falls between these two camps – that a moral life is a meaningful life. I shall sketch a theory of morality that satisfies the conditions that have been set out. H this sketch can be filled out, then a moral life will be at least part of what can make a life meaningful. Whether this account of the moral life leaves out anything important for the meaningfulness of life will be the subject of some concluding remarks. (shrink)
