Mit Inkrafttreten des Sozialgesetzbuches V, das in seinem §137 auch Krankenhäuser zu Qualitätssicherung verpflichtet, kann sich seit Ende der 80er Jahre kein Fachgebiet der Medizin mehr gegenüber der Teilnahme an qualitätssichernden Maßnahmen verschließen. Die gesetzlichen Grundlagen zur Einhaltung von Normen und definierten Abläufen zur Reproduzierbarkeit von Ergebnissen, die für den labormedizinischen und apparativen Bereich in der Forschung und Technik schon länger bestehen, haben den Bereich der medizinischen Versorgung erreicht [10, 11, 18]. Ziel der Maßnahmen ist es, die Struktur-, Prozeß- und (...) Ergebnisqualität der medizinischen Versorgung zu beeinflussen und einen immer besseren Stand der Versorgung zu erreichen („continuing quality improvement“/Qualitätsspirale). So sind nicht nur Steigerungen der Lebensqualität behandelter Patienten, Verbesserungen der Versorgungsstruktur und des Arbeitsumfeldes, der Aus- und Weiterbildung der medizinischen Berufsgruppen, sondern auch ökonomisch relevante Kosteneinsparungen durch Prozeßoptimierung möglich. Allerdings sind qualitätssichernde Aspekte in der medizinischen Behandlung und das Bewußtsein für die Berufsethik durchaus nicht neu. Bereits in der Antike war der zufriedene, erfolgreich behandelte Patient ein Aushängeschild für den behandelnden Praktiker und im Interesse der Gesellschaft. In vielen Kulturen gab und gibt es oft religiös begründete, berufsethische, gesetzliche Grundlagen oder auch traditionelle Riten dazu, wie Erfolg und Mißerfolg der Behandlung eines Menschen durch einen Arzt bestraft oder eben belohnt werden sollten. Timothy O’Connor presents a novel and powerful version of the cosmological argument from contingency. What distinguishes his argument is that it does not depend on the Principle of Sufficient Reason. This version thus avoids powerful objections facing the Principle. We present and develop the argument, strengthening it in various ways. We fill in big gaps in the argument and answer criticisms. These include the criticisms that O’Connor considers as well as new criticisms. We explain how his replies to a Kantian (...) criticism and to the demand for contrastive explanation fail, and properly answer the criticism and the demand. We develop two new criticisms, the objection from opaqueness and the objection from constitution, and explain how these objections can be answered. (shrink)

It is useful to envision two fundamentally different ways by which the timing of plant development is regulated: developmental stage‐transition mechanisms and time‐to‐flowering mechanisms. The existence of both mechanisms is indicated by the behavior of various mutants. Shoot stage transitions are defined by dominant mutants representing at least four different genes; each mutant retards transitions from juvenile shoot stages to more adult shoot stages. In addition, dominant leaf stage‐transition mutants in at least seven different genes have similar phenotypes, but the (...) leaf rather than the shoot is the. focus (and at least two of these genes encode domain proteins.) One mutant, Hairy sheath frayed 1‐0 (Hsf1‐O) simultaneously affects shoot and leaf; this mutant's behavior initiated our interest in plant heterochronism(1). The second type of timekeeping involves time‐to‐flowering. As with most plant but not animals species, cultivars of the maize species vary greatly for the time‐to‐flowering quantitative trait: between 6 and 14 weeks is common. It is via the 'slipping time frames' interaction that takes place between stage‐transition mutants and time‐to‐flowering genetic back‐grounds that unexpected and radical phenotypes occur. We see a reservoir of previously unsuspected morphological possibilities among the few heterochronic genotypes we have constructed, possibilities that may mimic the sort of variation needed to fuel macroevolution without having to posit (as done by Goldschmidt(2)) any special macromutational mechanisms. O tempo lógico não seria, ao contrário, uma nova articulação dos "instantes" em que cada sistema verdadeiramente filosófico se põe em ligação com os demais? Se Goldschmidt retira os sistemas do tempo, não é para acusar o encapsulamento dogmático de cada um deles, como interpreta Porchat, mas para recolocá-los numa dimensão em que esses "átomos" podem ser articulados.

Los métodos de resolución consensuada de conflictos, sea a nivel de individuos, grupos o estados, ha existido siempre, pero en las últimas décadas han adquirido un especial interés, ante el peligroso avance de la conflictividad en todos los ámbitos. En la presentación se exploran las posibilidades de la hermenéutica analógica para apoyar los procedimientos de mediación y arbitraje, sean pre-judiciales, judiciales, vecinales (municipales) o escolares. Se parte de las siguientes asunciones: 1) El convenio entre partes, o laudo consensuado, o “reparto (...) autónomo” en la concepción de Werner Goldschmidt es ética y antológicamente superior al recurso decisionista; 2) El reparto autónomo realiza mejor el valor justicia en cuanto dirime definitivamente la controversia y porque reasume el concepto de comportamiento prudente bajo la forma de epiqueia o justicia del caso particular; 3) Puede constituirse en “modélico” con respecto a situaciones posteriores; 4) Evita y torna innecesarias las discusiones teóricas éticas y/o legales sobre las normas generales de posible aplicación, problemas estos muchas veces de difícil o imposible resolución. Se argumentará a favor de las siguientes hipótesis: 1) La hermenéutica analógica puede portar elementos para la comprensión de la lógica de la situación conflictiva; 2) Puede aportar elementos para una hermenéutica de la situación conflictiva como un todo y no solamente de cada posición por separado; 3) Puede aportar elementos heurísticos y prudenciales para ayudar a la tarea del mediador en el propósito de que cada parte “se ponga en el lugar del otro”. Cet ouvrage de Victor Goldschmidt, pour la premiere fois en edition de poche, est le seul consacre a une notion centrale de la philosophie platonicienne, le paradigme, a la fois exemple, comparaison et modele.En prenant comme fil conducteur la definition donnee dans le Politique, l'auteur commence par etudier le role joue par ce procede privilegie dans la methode dialectique des derniers Dialogues. S'exercer sur une realite banale permet de decouvrir la structure d'un grand sujet, plus difficile a definir, comme (...) le sophiste ou l'art politique. Cependant la reussite d'une demarche en saurait en fonder la legitimite. En s'interrogeant sur son fondement, Victor Goldschmidt montre que l'usage d'un paradigme obeit a un mouvement profond de la pensee platonicienne, il nous mene du visible a l'invisible. (shrink)

Several philosophers have proposed Knowledge-Based Decision Theories (KDTs)—theories that require agents to maximize expected utility as yielded by utility and probability functions that depend on the agent’s knowledge. Proponents of KDTs argue that such theories are motivated by Knowledge-Reasons norms that require agents to act only on reasons that they know. However, no formal derivation of KDTs from Knowledge-Reasons norms has been suggested, and it is not clear how such norms justify the particular ways in which KDTs relate knowledge and (...) rational action. In this paper, I suggest a new axiomatic method for justifying KDTs and providing them with stronger normative foundations. I argue that such theories may be derived from constraints on the relation between knowledge and preference, and that these constraints may be evaluated relative to intuitions regarding practical reasoning. To demonstrate this, I offer a representation theorem for a KDT proposed by Hawthorne and Stanley (2008) and briefly evaluate it through its underlying axioms. (shrink)

We study the representation of attitudes to risk in Jeffrey’s decision-theoretic framework suggested by Stefánsson and Bradley :602–625, 2015; Br J Philos Sci 70:77–102, 2017) and Bradley :231–248, 2016; Decisions theory with a human face, Cambridge University Press, Cambridge, 2017). We show that on this representation, the value of any prospect may be expressed as a sum of two components, the prospect’s instrumental value and the prospect’s intrinsic value. Both components have an expectational form. We also make a distinction between (...) a prospect’s overall intrinsic value and a prospect’s conditional intrinsic value given each one of its possible outcomes and argue that this distinction has great explanatory power. We explore the relation between these two types of intrinsic values and show that they are determined at the level of preferences. Finally, we explore the relation between the intrinsic values of different prospects and point to a strong restriction on this relation that is implicit in Jeffrey’s axioms. We suggest a natural interpretation to this restriction. (shrink)

Denoncant l'opposition recue entre la genese et la structure, l'auteur procede a un examen minutieux de la constitution de ces principes, en s'appuyant sur les deux Discours et l'Emile - Rousseau lui-meme disait que son systeme y etait formule -, (...) mais surtout sur le Discours sur l'inegalite, dont le present travail etudie le contenu et les prolongements. Prenant le temps de considerer ce texte comme une oeuvre proprement philosophique et d'etablir la these des interlocuteurs du philosophe pour mieux determiner sa pensee, Victor Goldschmidt montre comment s'elabore et progresse cette pensee et en restitue ainsi le sens, la coherence, en un mot l'unite substantielle. Comment penser une philosophie du droit chez Epicure, sans le trahir? Comment degager des principes politiques dans l'oeuvre de celui dont la maxime etait de vivre cache, loin des affaires administratives concernant la Cite? Le defi peut paraitre ambitieux, c'est pourtant celui que releve Victor Goldschmidt dans cet ouvrage. Et il puise a la source meme, au coeur des dernieres sentences des Maximes Capitales, grace auxquelles il thematie et structure une pensee politique s'inscrivant parfaitement au sein de la logique (...) de la doctrine epicurienne. En effet, pour vivre bien, il est necessaire de penser le vivre ensemble avec des lois pour toile de fonds. La pensee epicurienne se deploie autour des concepts directeurs que sont l'interet, la reciprocite, la securite, le juste se definissant en reference a l'utile. Le droit epicurien veut s'imposer comme une realite et depasser le simple statut de doctrine du droit. C'est dire toute la portee de cette etude, et la place qu'on doit accorder a la pensee epicurienne dans la philosophie politique. (shrink)

In The Human Career, Walter Goldschmidt presents a challenge to conventional views of human social behaviour. He argues that change rather than equilibrium is the natural condition of society, that humans must be seen as motivated actors rather than as passive recipients of cultural roles and that emotions, rather than intellect, are the crucial element in the formulation of culture. These three elements, combined with established theory form a dynamic model of human sociality.

Ces etudes debordent le probleme du temps chez les Stoiciens et se proposent d'etablir que cette question, en apparence modeste, permet d'eclairer, et en meme temps commande l'ensemble du systeme. Au premier abord en effet, la theorie du temps se presente comme une simple section d'un chapitre de la Physique, celui qui traite des Incorporels. Mais deja la simple interpretation des textes transmis fait voir que cette theorie tient etroitement a d'autres theories, comme celle des incorporels en general, des categories, (...) de la substance. Abordant ensuite les theses majeures de la logique et de l'ethique, on s'apercoit qu'a leur tour elles sont solidaires de la conception du temps qui, dans bien des cas, fait evanouir leur apparence de paradoxe. A cela meme, il n'y a rien d'etrange, si l'on se souvient que le stoicisme, plus que tout autre philosophie antique, constitue un systeme coherent. Mais plus particulierement, le probleme du temps a du former comme le noeud de la reflexion stoicienne qui vise, contre les lourdes autorites de Platon et d'Aristote, a retablir dans sa realite et dans sa dignite, le concret, le sensible, disqualifie comme sujet a la generation et a la corruption, c'est-a-dire, en un mot, comme l'etre dans le temps. The doctrine of reincarnation is usually associated with Buddhism, Hinduism and other Eastern religions. But it has also been developed in Druzism and Judaism. The doctrine has been used by these traditions to explain the existence of evil within a moral order. Traversing the boundaries between East and West, we explore how Jewish mysticism has employed the doctrine to help answer the problem of evil. We explore the doctrine particularly as we respond to objections against employing it in a theodicy. (...) Proving the existence of God is a perennial philosophical ambition. An armchair proof would be the jackpot. Ontological arguments promise as much. This Element studies the most famous ontological arguments from Anselm, Descartes, Plantinga, and others besides. While the verdict is that ontological arguments don't work, they get us entangled in fun philosophical puzzles, from philosophy of religion to philosophy of language, from metaphysics to ethics, and beyond.

This paper addresses the most fundamental question in metaphysics, Why is there something rather than nothing? The question is framed as a question about concrete entities, Why does a possible world containing concrete entities obtain rather than one containing no concrete entities? Traditional answers are in terms of there necessarily being some concrete entities, and include the possibility of a necessary being. But such answers are threatened by metaphysical nihilism, the thesis that there being nothing concrete is possible, and the (...) subtraction argument for this thesis, an argument that is the subject of considerable recent debate. I summarize and extend the debate about the argument, and answer the threat it poses, turning the tables on it to show how the subtraction argument supports a cosmological argument for a necessary being. This essay outlines answers to the problem of evil from Jewish perspectives. The essay uses traditional Jewish sources to illustrate theodicies familiar in other religious traditions, and introduces a few less familiar Jewish theodicies besides. Other responses to the problem of evil are also considered. Jewish responses are not usually framed in contemporary philosophical categories, and mine is an attempt at categorization. The traditional Jewish sources might show some promise of contributing to contemporary philosophical debate.

Many religious traditions teach that we should worship God, and philosophers have explored the requirement to worship God, and what might make God worthy of worship. These religious traditions also prohibit worshipping other gods. This essay explores, from a Jewish perspective, what it might mean to worship other gods, what the rationale behind the prohibition might be, and why the prohibition might be so grave.

The papers in this volume are largely about research ethics and cover questions of consent, reproduction, pediatric research, ethical codes, and clinical relationships. Half the papers have this common aspect: they are conservative—in the sense of supporting the standard, prevailing, or popular view—but they shift the focus—supporting the standard views in terms of moral factors generally neglected by the literature. The volume provides a diverse set of papers for the reader: variously addressing abstract and concrete problems from within different philosophical (...) traditions. (shrink)

Jürgen Habermas vertritt die These, dass sich das Konsensprinzip des kommunikativen Handelns in den Meinungs- und Willensbildungsprozess der Politik übertragen lasse. In der vorliegenden grundlegenden Kritik zeigt die Autorin, dass diese These nicht haltbar ist. Anders als Habermas annimmt, findet kommunikatives Handeln keinen Eingang in die Prozeduralität der Politik. Das politische Handeln wird vielmehr durch systemische Vorgaben bestimmt. Diese ergeben sich im Wesentlichen aus der Prozeduralität des ökonomischen Systems sowie aus der über Macht bestimmten Prozeduralität des politischen Systems selbst.
