The essence of Baars’ paper is to propose nine functions for consciousness. By way of introducing these functions we are presented with a metaphor of a theatre, in which players act, operators set contexts behind the scenes, an unconscious audience provides specialised capabilities, and, of course, a bright spotlight of attention illuminates whatever is available to consciousness. The value of this metaphor is not entirely clear, with the separate ‘roles’ of the audience and of the operators behind the scenes being (...) particularly difficult to identify. Additionally, there may be a problem with idea that there is some kind of competition between actors who are seeking the spotlight of attention, for this suggests that the components of thought have volitions of their own. These would, indeed, be dangerous thoughts. Rather than attempting an analysis of the metaphor and its potential usefulness, this commentary will consider the nine functions of consciousness that have been proposed. (shrink)

Described as one of the two fathers of medical law, Professor Peter Skegg has been a leading figure in the study of law and medicine. Over a 46 year academic career at the University of Auckland, University of Oxford, and the University of Otago, Professor Skegg has helped develop the field of medical law into a burgeoning academic discipline and has provided intellectual guardianship for the practice of law and medicine. This collection brings together contemporaries, colleagues, and former students of (...) Professor Skegg to celebrate his enduring contribution to the study of medical law. This edited collection contains twelve essays written by a range of internationally recognised medical lawyers. The topics cover the regulation of medical practitioners, consent, rights in bodily material, euthanasia, compensation and ethical approval for medical research, treatment orders for mental health conditions, and surrogacy laws. Whilst some of the essays return to territory that has been initially surveyed by Peter s research and analysis, others touch upon some wider medical law topics, illustrating Peter s lasting contribution to medical law as well as mapping out some of the new frontiers for the discipline of medical law. Academics, students and practitioners, from a range of jurisdictions, who are interested in how the law governs the provision of healthcare will benefit reading the various essays contained here. In response to the discussion between William W. Morgan and Annette Kolodny in the Summer 1976 issue of Critical Inquiry I would like to address the issue of separating judgments based on feminism as an ideology from purely aesthetic judgments. Peripherally this included the issue of "prescriptive criticism," so labeled by Cheri Register in Feminist Literary Criticism: Explorations in Theory.1 In the same book, as Kolodny points out,2 I called for criticism that exists in the "prophetic mode." Kolodny indicates reservations (...) about both concepts without fully exploring the issue. I would like to explain my statement here and to explore further the issue of feminism and aesthetics. When I called for criticism in the prophetic mode, I did not intend to promote an idea of the critic as ideological prophet. Rather, as I explain in the context from which the term is taken,3 I am speaking of the engaged scholar who is concerned to influence the future by her/his work today. S/he chooses her/his work with an eye to encourage political and social changes. Obviously, for a feminist this translates into a concern for a future in which women will be free from many of the restrictions that have held them down in the past. Much feminist criticism is thus corrective criticism designed to redress the imbalance in current literary curricula, and more generally to reintroduce "the feminine" into the public culture. · 1. Movement and, more particularly, kinesthesia as a modality and as a metaphor has become of interest at the intersection of phenomenology and cognitive science. In this paper I wish to combine three historically related strands, aisthêsis, kinesthesis and aesthetics, to advance an argument concerning the aesthetic value of certain somatic sensations. Firstly, by capitalizing on a recent regard for somatic or inner bodily senses, including kinesthesia, proprioception and the vestibular system by drawing lines of historical continuity from earlier philosophical investigations (...) on bodily background experience, initially from aisthêsis, Aristotle’s concept of the sensory faculty. Secondly, concepts of the sensate body are advanced through discoveries in the nervous system and related discussions of the ‘inner’ senses such as Charles Bell’s ‘muscle sense’ (1826), and what Charles Sherrington later termed ‘proprio-ception’ (1906). Thirdly, we consider the possibility of aesthetic status for those inner senses, where recently aesthetic arguments by Montero (2006) and Cole and Montero (2007) seek to determine aesthetic criteria for proprioception, and similarly in dance theory the aesthetic status of kinesthesia has been questioned (e.g. Foster 2011). Finally we consider whether previous exposure to a ‘grammar’ of movement is a factor in determining the relative aesthetic value. (shrink)

In this chapter I seek to examine the credibility of Finnis’s basic stance on Aquinas that while many neo-Thomists are meta-ethically naturalistic in their understanding of natural law theory (for example, Heinrich Rommen, Henry Veatch, Ralph McInerny, Russell Hittinger, Benedict Ashley and Anthony Lisska), Aquinas’s own meta-ethical framework avoids the “pitfall” of naturalism. On examination, the short of it is that I find Finnis’s account (while adroit) wanting in the interpretation stakes vis-à-vis other accounts of Aquinas’s meta-ethical foundationalism. I think (...) that the neo-Thomists are basically right to argue that for Aquinas we cannot really understand objective truths about moral standards unless we derive them from our intellective knowledge of natural facts as given to us by the essential human nature that we have. While I find Finnis’s interpretative position on Aquinas wanting, I go on to argue that his own attachment to non-naturalism is justified and should not be jettisoned. Because I think non-naturalism important to the future tenability of a viable natural law ethics (an ethics that is both cognitive and objectivist), I argue that Finnis should, so to speak, “beef up” his “fundamental option” for non-naturalism and more fully avail himself of certain argumentative strategies available in its defense, argumentative strategies that are inspired by the analytical philosophy of G.E. Background: The way the death of a dear person is communicated can have a profound impact on the entire bereavement process. The words and expressions that are used to give the tragic news, the characteristics of who communicates it, the physical setting in which the notification is given, the means used (e.g., in person, via phone call, etc.) are just some of the factors that can influence the way survivors face one of the most difficult moments in their lives. Aim: (...) To review the literature on the topic of death notification to verify the state of the art related to this important procedure. Methods: A systematic review was conducted with PRISMA criteria on English-written materials produced from 1966 to 2019. Results: Out of the initial 3,166 titles considered, 65 articles were extracted for this review. Four main themes emerged: 1) protocols and guidelines; 2) emotional reactions of recipients and notifiers; 3) professional figures involved in the notification process; and, 4) types of death. Discussion: The communication of death represents a complex and stressful experience not only for those who receive it but also for those who give it. Alongside the acquisition of a necessary technique and execution methods, the process should involve the selection of notifiers based on personality characteristics and communication styles. Conclusion: Indications for the need of better training and protocols sensitive to different circumstances emerge. Adequate preparation can deeply affect the quality of communication and the effects it produces, both on recipients and on notifiers. In vocational training, more space should be devoted to this demanding task. (shrink)

Serial music was one of the most important aesthetic movements to emerge in post-war Europe, but its uncompromising music and modernist aesthetic has often been misunderstood. This book focuses on the controversial journal die Reihe, whose major contributors included Stockhausen, Eimert, Pousseur, Dieter Schnebel and G. M. Koenig, and discusses it in connection with many lesser-known sources in German musicology. It traces serialism's debt to the theories of Klee and Mondrian, and its relationship to developments in concrete art, modern poetry (...) and the information aesthetics and semiotics of Max Bense and Umberto Eco. M. J. Grant sketches an aesthetic theory of serialism as experimental music, arguing that serial theory's embrace of both rigorous intellectualism and aleatoric processes is not, as many have suggested, a paradox, but the key to serial thought and to its relevance for contemporary theory. In European industrialized countries, a large number of companies in the healthcare, hotel, and catering sectors, as well as in the technology sector, are affected by demographic, political, and technological developments resulting in a greater need of skilled workers with a simultaneous shortage of skilled workers (CEDEFOP, 2015, 2016). Consequently, employers have to address workers who have not been taken into account such as low-skilled workers, workers returning from a career break, people with a migrant background, older people, and jobseekers (...) and train them, in order to guarantee the professionalization of this workforce (Festing and Harsch, 2018). Continuing vocational education and training (CVET) is seen as an indispensable tool; because CVET has advantages for both employers and employees, it helps to increase the productivity of companies (Barrett and O’Connell, 2001), to prevent the widening of socioeconomic disparities (Dieckhoff, 2007), and to open up career opportunities for the workforce (Rubenson and Desjardins, 2009). However, participation rate on CVET seems to differ, depending on institutional factors (such as sector and size of the company) and individual characteristics (such as qualification level, migration background, age and time of absence from work) (e.g., Rubenson and Desjardins, 2009; Wiseman and Parry, 2017). In contrast to previous research, our study aims to provide a holistic view of reasons for and against CVET, combining the different perspectives of employers and (potential) employees. The analysis of reasons and barriers was carried out based on semi-structured interviews. Fifty-seven employers, 73 employees, and 42 jobseekers (potential employees) from the sectors retail, healthcare and social services, hotels and catering, and technology were interviewed. Results point to considerable differences in the reasons and barriers mentioned by the disadvantaged groups. These differences are particularly significant between employees on the one side and employers, as well as jobseekers, on the other side, while the reasons to attend CVET of jobseekers are more similar to those of employers. The results can be used to tailor CVET more closely to the needs of (potential) employees and thus strengthen both the qualification and career opportunities of (potential) employees and the competitiveness and productivity of companies. Research on language production has focused on the process of utterance planning and involved studying the synchronization between visual gaze and the production of sentences that refer to objects in the immediate visual environment. However, it remains unclear how the visual grouping of these objects might influence this process. To shed light on this issue, the present research examined the effects of the visual grouping of objects in a visual display on utterance planning in two experiments. Participants produced utterances of (...) the form “The snail and the necklace are above/below/on the left/right side of the toothbrush” for objects containing these referents (e.g., a snail, a necklace and a toothbrush). These objects were grouped using classic Gestalt principles of color similarity (Experiment 1) and common region (Experiment 2) so that the induced perceptual grouping was congruent or incongruent with the required phrasal organization. The results showed that speech onset latencies were shorter in congruent than incongruent conditions. The findings therefore reveal that the congruency between the visual grouping of referents and the required phrasal organization can influence speech production. Such findings suggest that, when language is produced in a visual context, speakers make use of both visual and linguistic cues to plan utterances. (shrink)

Paterson sees Bruno as a philosopher of rational thought and the open society, martyred by the forces of social constraint. She outlines his cosmology and shows how his theory of knowledge and his ethics derive from it. For Bruno, the fabric of the universe is a dynamic, spirited, divine power which continually generates the infinite multiplicity of things and draws them back into itself. Man's intellect mirrors the universal motion of creation and corruption, drawing ideas from sensibility as the divine (...) intellect draws the natural species from matter. Since the good and the true coincide in the divine unity, man's good consists in harmonizing them and so mirroring the divine. He whose efforts are directed to this harmony and to expanding constantly his knowledge and achievements is universal man. Paterson argues that a rational ethic is implicit in Bruno's thought. Also implicit is the method of modern science, i.e., a speculative leap, followed by empirical testing. Each essay concentrates on the forensic speeches (...) and the various strategies that Cicero employs "to ensure that the person he represents is acquitted or that the person he is prosecuting is found guilty" (from the dust jacket, the only place advocacy is defined). Well-organized and unusually coherent (given the genre), all of Cicero the Advocate can be read with profit.The book has three parts: an "editorial introduction," "themes," and "case studies." The concise and accurate introduction (1–57) provides a context for understanding Roman forensic oratory. Topics include a helpful comparison between Greek, Roman, and modern expectations; the mechanics of the Roman courts; the role of rhetorical theory in the construction of Cicero's orations; and, [End Page 144] finally, a review of the possible relationship between Cicero's published and original speeches. Indeed, the coverage is so comprehensive that it occasionally overlaps unnecessarily with the treatment of individual contributors (e.g., Lintott, Burnand, Laws).Needless polemics, however, tend to mar the introduction's tone. In advocating advocacy, the editors adopt a Ciceronian rhetoric of deniability, attacking a position that a subsequent statement grudgingly acknowledges. For example, the editors note early on: "Reading the work of some recent scholars [one relevant eighteen-page essay is cited], one might think that a Roman law court was a place in which all kinds of considerations, personal, social, or political, mattered more than the legal and factual points that the court was supposed to be deciding" (3). Before one can ponder this assessment of recent scholarship on Cicero (characteristic of "the individualistic 1980s" [3, n. 11]), the next paragraph begins, "Nobody, of course [my emphasis], denies that the outcome of a trial—in any legal system—can sometimes be affected by extraneous (especially political) issues." So perhaps these "recent scholars" are worth reading after all; indeed, the study of the cultural background that contributes to persuasion certainly warrants consideration in a book on advocacy. Fortunately, the individual contributions that follow adopt a more conciliatory tone.The range and number of essays preclude active engagement, so in what follows I will summarize key issues. After a survey of "Legal Procedure in Cicero's Time" (61–78) by Andrew Lintott, Jeremy Paterson's "Self-Reference in Cicero's Forensic Speeches" (79–95) assesses the oratorical function of self-praise. Attributing this practice to the original role of the patronus (80), Paterson identifies the advertisement of wealth and status as an important element of Roman advocacy, necessarily changing in tone for Cicero as his own status increases. Paterson's fine analysis, however, would need to change if applied to non-forensic speeches, in which Ciceronian self-praise is particularly pronounced. This surely would affect his conclusion that "Cicero never forgot what he was about, which was to win the case for his client" (95). In the dramatically titled "A Volscian Mafia? Cicero and his Italian Clients in the Forensic Speeches" (97–116; "mafia" refers simply to "local networks of obligations and contacts," 114), Kathryn Lomas surveys the role of Italian communities in five of Cicero's works (Pro Roscio Amerino, Pro Cluentio, Pro Caecina, Pro Caelio, Pro Plancio) to try to discover why there is a "relatively low level of visibility" of Italians even in those cases in which such connections are vital (98). The Italians defended by Cicero fall into two categories: municipals who, like Cicero, seek prominence in Rome (Caelius, Plancius), and the wealthy who have key connections within the capital but do not seek political office in Rome (Roscius, Cluentius, Oppianicus). Lomas convincingly demonstrates that Cicero defends clients from regions where he could hope for political support (especially in southern Latium). In "Reading Cicero's Narratives" (117–46), D. S. The conference was held under the auspices of the Union, The Social Sciences and Humanities Research Council of Canada, and the Canadian Society for History and Philosophy of Science. The meetings took place in Montreal, Canada, 25-29 August 1980, with Concordia University as host institution. The program of the conference (...) was arranged by a Joint Commission of the International Union of History and Philosophy of Science consisting of Robert E. Butts (Canada), John Murdoch (U. S. A. ), Vladimir Kirsanov (U. S. S. R. ), and Paul Weingartner (Austria). The Local Arrangements Committee consisted of Stanley G. French, Chair (Concordia), Michel Paradis, treasurer (McGill), Fran~ois Duchesneau (Universite de Montreal), Robert Nadeau (Universite du Quebec it Montreal), and William Shea (McGill University). Both committees are indebted to Dr. G. R. Paterson, then President of the Canadian Society for History and Philosophy of Science, who shared his expertise in many ways. This article discusses the concept of God with a focus on the translation of God in the Chinese and Yoruba religious contexts. Translating the word God is of the essence when comparing concepts of god. The translation of the Christian God as Olodumare misrepresents the latter. As suggested by Africanists, there should be appropriate translations for God, Olodumare, and other African gods. As a preliminary comparative attempt, this article presents a case on the introduction of God to the Chinese people. (...)
