In No Place for Ethics, Hill argues the Supreme Court has an overriding obligation to ground its judicial review responsibilities not only in the Constitution but also in ethics, understood as the Constitution's ultimate justification. The text discusses a response to the question basic to all human beings: how should I behave?

Currently, the widely used notion of activity is increasingly present in computer science. However, because this notion is used in specific contexts, it becomes vague. Here, the notion of activity is scrutinized in various contexts and, accordingly, put in perspective. It is discussed through four scientific disciplines: computer science, biology, economics, and epistemology. The definition of activity usually used in simulation is extended to new qualitative and quantitative definitions. In computer science, biology and economics disciplines, the new simulation activity definition (...) is first applied critically. Then, activity is discussed generally. If a utopia is a near perfect, or even a demonstrably superior, society, is there anything that endangers that society as soon as it is achieved? Yes. Prosperity! I have shown in “More's Utopia and the New World Utopias: Is the Good Life an Easy Life?”, that the actually existing, “real” New World Utopian communities were severely challenged by success. For example, the vigor of the Jansonite community in Bishop Hill, Illinois (1846-1860) sharply declined when that community met their (...) survival needs and had to deal with surpluses and comfort. Her art of prospecting affords the reader (...) a linear impression of a journey that begins with “The Shimmering Maya,” a recountal of a family move in August 1944 from Colorado to South Texas. “Desert Silvery Blue” describes life in Alpine, Texas, while “Leaving for Good” narrates her experience of displacement as she departs Alpine in 1951 to attend Rice Institute, known then as “the atheist school” (p. 37). From Alpine to Houston, she experiences the greening of America and the shock of Gulf Coast humidity, “a sensation of being hit in the face and smothered” (p. 42). Chapel Hill: University of North Carolina Press, 1992. viii + 287 pp. Cloth, $39.95.A new book on an imperfectly understood and neglected author is always welcome, and without a doubt this one makes a valuable contribution to our understanding of Valerius within the cultural and social (...) conditions in which he lived. The virtue of Bloomer’s work over earlier studies lies in his impulse to view Valerius’ collection of exempla as conditioned by the needs of its readers. Bloomer correctly emphasizes that Valerius’ stories largely derive from a common stock of episodes and anecdotes that was cultivated throughout the education system and especially by the declaimers. Bloomer scrutinizes the rhetorical structure Valerius gives to his individual exempla and his work as a whole, since it is in this structure that one sees the authentic stamp of Valerius’ own interests and, presumably, those of his readership. Bloomer sets out to use the evidence for Valerius’ method of organization, his handling of politically sensitive subjects, and his overt statements of his purpose to interpret Valerius’ work within its cultural context. But there are signs that Bloomer’s methodology may be at odds with itself—a conflict, moreover, that arises from and reflects the current rift among professional classicists about the relationship of traditional philological methods of analysis to the newer criteria of cultural studies (a subject much too large to address in this review).Bloomer has organized his book into six chapters with titled subdivisions, a bibliography, and an index. The first two introductory chapters are the most successful in reconciling methodologies. In chapter 1 Bloomer sketches what we know of the life of Valerius, describes his work, and characterizes the milieu in and for which Facta et Dicta Memorabilia was composed. Bloomer’s initial description of Valerius’ endeavor as one of “culling 967 stories from various authors and arranging them under categorical headings” (1) catches the ancient author in what is his most significant activity for Bloomer: excerpting, abstracting, shaping, and labeling exemplary anecdotes for the uses of declaimers. Bloomer discusses the scanty autobiographical information Valerius supplies at 2.6.8, but he is more interested in discerning the type of audience which must have been interested in Valerius’ collection of exempla. Bloomer’s view is that Valerius [End Page 151] wrote for “students and practitioners of declamation” (1), for whom he “provided a stock of rhetorical illustrations” and whom he taught by the example of his text how to “introduce, join and conclude such stories” (2). One might well have compared the no less exemplary habits of M. Porcius Latro, the elder Seneca’s paragon of declaimers in his generation. Latro (“Pilferer”?) controlled in his memory a prodigious cache of rhetorical structuring devices, including epiphonemata, enthymemes, commonplaces, and sententiae, and he regularly rehearsed these for deployment in his declamations (Controv. 1 praef. 23). More mention of Valerius’ relation to “flesh and blood” declaimers like Latro would give a fuller picture of his historical context.Bloomer identifies Valerius’ subject as the “classical past,” through which he conveys “the sensation of human nature observed, condensed, and communicated, all in an elevated if at times abstract Latin prose style.” Valerius’ work attests to the success of declamation at Rome, and it serves the practical needs of its readers in its attempt to alleviate the burden of acquiring a compendious knowledge of classical texts by serving as an abbreviated “vehicle of instruction and acculturation into the elite of Tiberian Rome” (4). Now tailoring oneself to the political and cultural climate of Tiberian Rome could involve a certain amount of risk and require a large measure of compromise, to judge by the accounts of the ancient historians. Tacitus documents several declaimers who rose socially through Sejanus’ sponsorship (e.g., Junius Otho and Bruttedius Niger, Ann. 3.66). After the fall of Sejanus, an eques Romanus named M. The individualism and restless mobility of modernity have become disorienting and frightening. Our nostalgia for premodern times when natural bonds to kith and kin were unshakable continues to surface, most recently in the popular phenomenon of support groups. On Community examines this crucial philosophical issue of community for the postmodern mind by presenting 13 readable, original essays by some of the top experts currently working on this problem. The first four essays, by Eliot Deutsch, R. W. Hepburn, Hilary Putnam, and (...) Leroy S. Rouner, examine philosophies of community, emphasizing metaphysical analysis and definition of the nature of community. The second section considers the theme in a cross-cultural context. Merry I. White, Katherine Platt, Benjamin Schwartz, and Huston Smith illustrate in this section the various ways in which community is understood and experienced in Japan, North Africa, China, and India. The final section, which contains contributions by Patrick Hill, Jurgen Moltmann, Catherine Keller, and George Rupp, explores the future of community, focusing on community building in Western societies. While the authors represent diverse interests, they also share common ground. Virtually all agree that a creative community needs some form of individualism in order to make a community effective. And there is a consensus among the essays that community is a good thing and that the quest for community in our time is a significant fact. In response to criticism, we often say – in these or similar words – “Let’s see you do better!” Prima facie, it looks like this response is a challenge of a certain kind – a challenge to prove that one has what has recently been called standing. More generally, the data here seems to point a certain kind of norm of criticism: be better. Slightly more carefully: One must: criticize x with respect to standard s only if one is better (...) than x with respect to standard s. In this paper, I defend precisely this norm of criticism – an underexplored norm that is nevertheless ubiquitous in our lives, once we begin looking for it. The be better norm is, I hope to show, continuously invoked in a wide range of ordinary settings, can undergird and explain the widely endorsed non-hypocrisy condition on the standing to blame, and apparent counterexamples to the norm are no such counterexamples at all. I further contend that, given some plausible principles, my previous “moral commitment” account of the moral standing to blame will be extensionally equivalent to the be better norm. (shrink)

For more than 20 years, research has proven the beneficial effect of natural frequencies when it comes to solving Bayesian reasoning tasks (Gigerenzer & Hoffrage, 1995). In a recent meta-analysis, McDowell & Jacobs (2017) showed that presenting a task in natural frequency format increases performance rates to 24% compared to only 4% when the same task is presented in probability format. Nevertheless, on average three quarters of participants in their meta-analysis failed to obtain the correct solution for such a task (...) in frequency format. In this paper, we present an empirical study on what participants typically do wrong when confronted with natural frequencies. We found that many of them did not actually use natural frequencies for their calculations, but translated them back into complicated probabilities instead. This switch from the intuitive presentation format to a less intuitive calculation format will be discussed within the framework of psychological theories (e.g., the Einstellung effect). (shrink)

Tschacher and Haken have recently applied a systems-based approach to modeling psychotherapy process in terms of potentially beneficial tendencies toward deterministic as well as chaotic forms of change in the client’s behavioral, cognitive and affective experience during the course of therapy. A chaotic change process refers to a greater exploration of the states that a client can be in, and it may have a potential positive role to play in their development. A distinction is made between on the one hand, (...) specific instances of instability which are due to techniques employed by the therapist, and on the other, a more general instability which is due to the therapeutic relationship, and a key, necessary result of a successful therapeutic alliance. Drawing on Friston’s systems-based model of free energy minimization and predictive coding, it is proposed here that the increase in the instability of a client’s functioning due to therapy can be conceptualized as a reduction in the precisions with which the client’s prior beliefs about themselves and their world, are held. It is shown how a good therapeutic alliance results in the emergence of a new hierarchical level in the client’s generative model of themselves and their relationship with the world. The emergence of this new level of functioning permits the reduction of the precisions of the client’s priors, which allows the client to ‘open up’: to experience thoughts, emotions and experiences they did not have before. It is proposed that this process is a necessary precursor to change due to psychotherapy. A good consilience can be found between this approach to understanding the role of the therapeutic alliance, and the role of epistemic trust in psychotherapy as described by Fonagy and Allison. It is suggested that beneficial forms of instability in clients are an underappreciated influence on psychotherapy process, and thoughts about the implications, as well as situations in which instability may not be beneficial for therapy, are considered. Media analyses of the aesthetic presentation of news frequently and persuasively demonstrate the skewed ethics of news production, where those in need who are distant and dissimilar are often presented in ways that do not fully humanize their condition. However, it is argued here, they also locate too fully the locus of moral responsibility in the production and presentation of the media text. This article explores the moral demands inherent in two kinds of media presentation: the explicit focus on shock (...) and awe over intimacy; and minimal presentations that substitute bare information (such as statistics or maps) for affective stories. It is argued that in both cases a moral encounter with the other can be motivated despite the news presentation and it is concluded that an excessive emphasis on the role of the news in generating moral responsibility justifies a spectatorish inertia that should be resisted. Human propensities that are the products of Darwinian evolution may combine to generate a form of social behavior that is not itself a direct result of such pressure. This possibility may provide a satisfying explanation for the origin of socially transmitted rules such as the incest taboo. Similarly, the regulatory processes of development that generated adaptations to the environment in the circumstances in which they evolved can produce surprising and sometimes maladaptive consequences for the individual in modern conditions. These combinatorial (...) aspects of social and developmental dynamics leave a subtle but not wholly uninteresting role for evolutionary biology in explaining the origins of human morality. (shrink)

A new solution to the liar paradox is developed using the insight that it is illegitimate to even suppose (let alone assert) that a liar sentence has a truth-status (true or not) on the grounds that supposing this sentence to be true/not-true essentially defeats the telos of supposition in a readily identifiable way. On that basis, the paradox is blocked by restricting the Rule of Assumptions in Gentzen-style presentations of the sequent-calculus. The lesson of the liar is that not all (...) assumptions are for free. One merit of this proposal is that it is free from the revenge problem. (shrink)

On October 29, 2013, Texas House Bill 2 went into effect, greatly changing women’s access to an abortion in the state. This bill requires that physicians performing clinic-based abortions obtain admitting privileges at a hospital within 30 miles of the clinic. A few months later, on January 1, 2014, the Texas Health and Safety Code was amended to include the requirement that all abortion clinics must meet the standards of an ambulatory surgical centre. These requirements will result in heavy burdens (...) for women seeking an abortion. Many clinics cannot afford the upgrade and are being forced to close down. On August 29, 2014, a Federal District Court for the Western District of Texas ruling to overturned the two proposed requirements. The court deemed them unconstitutional violations of a woman’s right to obtain an abortion recognizing that their purpose was to create obstacles for women. The ruling was appealed and the Federal Appeals Court allowed for the new regulations, forcing all but eight clinics in Texas to close their doors. Before the enactment of HB2, there were approximately 40 abortion clinics serving Texas’ population of about 26 million. The new regulations would force all except eight clinics to close down. The remaining clinics are located in four cities forcing many women to travel hundreds of miles to access them. For some, it is more feasible to leave Texas to go to an abortion clinic outside the state. Even if every woman seeking an abortion was able to travel to one of the remaining clinics, the clinics could not meet the demand. Both of these requirements, the ambulatory surgical requirement and the admitting privileges requirement, constitute an undue burden for women. But what about the physicians? These requirements also place an undue burden on physicians who want to perform abortions. For affected physicians, it is difficult or impossible to obtain admitting privileges at a nearby hospital. Many hospitals are denying these privileges to physicians because the hospitals have no interest in participating in performing abortions and gain nothing by allowing it. If the majority of abortion clinics are forced to close down, physicians who want to perform abortions would have to relocate to one of the four cities mentioned previously, or even leave the state. Women seeking an abortion have to travel to the clinic once or twice. Physicians would have to relocate permanently. Much of the focus of these rulings has been on women’s rights and what constitutes an undue burden for women. In addition to this, physician’s rights should also be considered. There have been several cases of doctors facing harassment and even death threats for performing abortions. Fear of such treatment has led to many doctors to decline to perform abortions. Doctors do not have an obligation to perform abortions but it is within their rights as physicians to do so. However, given this harsh treatment by anti-abortion groups, not a lot of doctors are willing. The new regulations will leave open clinics in four cities in Texas making it more difficult for those few doctors who want to perform abortions to do so. The new regulations impose undue burdens on women and doctors alike. On Tuesday, October 14, the Supreme Court struck down the new requirements allowing thirteen clinics in Texas to reopen. (shrink)

This paper analyzes the metaphysical system developed in Cheyne’s Philosophical Principles of Religion. Cheyne was an early proponent of Newtonianism and tackled several philosophical questions raised by Newton’s work. The most pressing of these concerned the causal origin of gravitational attraction. Cheyne rejected the occasionalist explanations offered by several of his contemporaries in favor of a model on which God delegated special causal powers to bodies. Additionally, he developed an innovative approach to divine conservation. This allowed him to argue that (...)
