A persistent boast of the historical approach to functions is that functional properties are normative. The claim is that a token trait retains its functional status even when it is defective, diseased, or damaged and consequently unable to perform the relevant task. This is because historical functional categories are defined in terms of some sort of historical success -- success in natural selection, typically -- which imposes a norm upon the performance of descendent tokens. Descendents thus are supposed to perform (...) the associated task even when they cannot. The conceit, then, is that malfunctions are explicable in terms of historical success. The aim of this paper is to challenge this conceit. My thesis is that the historical approach to functions lacks the resources with which to account for the possibility of malfunctions. If functional types are defined in terms of historical success, then tokens that lack the defining property due to defect, and tokens that have lost the defining property due to disease or damage, are excluded from the functional category. Historically based malfunctions, in consequence, are impossible. The historical approach is no better than its non-historical competitors in accounting for the presumed normativity of functional properties. (shrink)

Duhem is often described as an anti-realist or instrumentalist. A contrary view has recently been expressed by Martin (1991) (Pierre Duhem: Philosophy and History in the Work of a Believing Physicist (La Salle, IL: Open Court)), who suggests that this interpretation makes it difficult to understand the vantage point from which Duhem argues in La science allemande (1915) that deduction, however impeccable, cannot establish truths unless it begins with truths. In the same spirit, the present paper seeks to establish that (...) Duhem is at any rate not the kind of anti-realist he is often presented as being, and that his views are like those Quine sees fit to call realist. An interpretation of Duhem's views on explanation and precision in science, and their bearing on the epistemological status of theory, is advanced which leads naturally into his critique of conventionalism. His attitude towards atomism, which should not be judged from a post-1925 perspective, is considered part of the unified view he strove after and appropriately called Duhem's physicalism, standing in contrast to the kind of reductionist conception usually associated with atomism. This article interprets emotional change as a transition in a complex dynamical sys- tem. We argue that the appropriate kind of dynamical system is one that extends recent work on how neural networks can perform parallel constraint satisfaction. Parallel processes that integrate both cognitive and affective constraints can give rise to states that we call emotional gestalts, and transitions can be understood as emotional ges- talt shifts. We describe computational models that simulate such phenomena in ways that show how dynamical (...) and gestalt metaphors can be given a concrete realization. (shrink)

Should we act only for the sake of what we might bring about (causal decision theory); or is it enough for a decent motive that our action is highly correlated with something desirable (evidential decision theory)? The conflict between these points of view is embodied in Newcomb's problem. It is argued here that intuitive evidence from familiar decision contexts does not enable us to settle the issue, since the two theories dictate the same results in normal circumstances. Nevertheless, there are (...) several reasons to reject the causal approach: (1) its relative complexity; (2) its commitment to the existence of situations in which every possible act would be irrational; (3) its incorporation of an arbitrary time bias; and (4) its implicit distinction between what ought to be done and what ought to be hoped for. This paper offers a critique of mainstream formal semantics. It begins with a statement of widely assumed adequacy conditions: namely, that a good theory must (1) explain relations of entailment, (ii) show how the meanings of complex expressions derive from the meanings of their parts, and (iii) characterize facts of meaning in truth-theoretic terms. It then proceeds to criticize the orthodox conception of semantics that is articulated in these three desiderata. This critique is followed by a sketch of an alternative (...) conception—one that is argued to be more in tune with the empirical objectives of linguistics and the clarificatory aims of philosophy. Finally, the paper proposes and defends a specific theoretical approach—use based rather than truth based—that is suggested by that alternative conception. (shrink)

The article uses the 2010 political success of the Tea Party phenomenon as a jumping-off point to examine a number of ideological tropes and rhetorical devices in American politics. It argues that the political language of the Tea Party is not – as is often assumed – empty moralizing at the expense of intellectual depth, but rather draws on a wide variety of American political and intellectual themes and traditions. The article uses the campaign literature and polemic of key Tea (...) Party affiliates – Sarah Palin, Christine O’Donnell, Glenn Beck, Ron Paul – as entry points to discuss the movement’s political strategies and interpretation of the role of government, individual liberty, American exceptionalism, constitutionalism, the free market, and the common people. In placing these discussions in their historical and intellectual context, the article argues for taking the Tea Party’s political message seriously, not least as a reflection of prevalent democratic concerns and frustrations with the American political system in its current incarnation. When political theorists teach the history of political philosophy, they typically skip from the ancient Greeks and Cicero to Augustine in the fifth century and Thomas Aquinas in the thirteenth, and then on to the origins of modernity with Machiavelli and beyond. Paul Stern aims to change this settled narrative and makes a powerful case for treating Dante Alighieri, arguably the greatest poet of medieval Christendom, as a political philosopher of the first rank. In Dante's Philosophical Life, Stern argues (...) that Purgatorio's depiction of the ascent to Earthly Paradise, that is, the summit of Mount Purgatory, was intended to give instruction on how to live the philosophic life, understood in its classical form as "love of wisdom." As an object of love, however, wisdom must be sought by the human soul, rather than possessed. But before the search can be undertaken, the soul needs to consider from where it begins: its nature and its good. In Stern's interpretation of Purgatorio, Dante's intense concern for political life follows from this need, for it is law that supplies the notions of good that shape the soul's understanding and it is law, especially its limits, that provides the most evident display of the soul's enduring hopes. According to Stern, Dante places inquiry regarding human nature and its good at the heart of philosophic investigation, thereby rehabilitating the highest form of reasoned judgment or prudence. Philosophy thus understood is neither a body of doctrines easily situated in a Christian framework nor a set of intellectual tools best used for predetermined theological ends, but a way of life. Stern's claim that Dante was arguing for prudence against dogmatisms of every kind addresses a question of contemporary concern: whether reason can guide a life. (shrink)

Proactive law enforcement techniques such as sting operations sometimes go too far, resulting in innocent people being "entrapped" into committing crime. Fortunately, the criminal law recognizes entrapment as a defense to a criminal charge. There is, however, much confusion about entrapment. In this paper I argue that this confusion is a result of misunderstanding the _moral status of entrapment. Since all proactive law enforcement violates the autonomy of those subject to it, it undermines moral agency and criminal liability. Although this (...) is sometimes justifiable, proactive law enforcement that does so in a way that constitutes entrapment is not. (shrink)

Constructive empiricism - as formulated by Bas van Fraassen - makes no epistemological claims about the nature of science. Rather, it is a view about the aim of science, to be situated within van Fraassen's broader voluntarist epistemology. Yet while this epistemically minimalist framework may have various advantages in defending the epistemic relevance of constructive empiricism, I show how it also has various disadvantages in maintaining its internal coherence.

Hegel makes claims about the relation of philosophy to religion that might raise concerns for those who want to locate his philosophy generally within the modern enlightenment tradition. For example, at the outset of his Lectures on Aesthetics he claims that philosophy “has no other object but God and so is essentially rational theology”.1 What might seem to placate worries here is that Hegel of course differentiates between the forms of religious and philosophical cognition in which such a content is (...) presented: while religion grasps this content in the form of imagistic or figurative representations [Vorstellungen], philosophy grasps it within conceptual thought, an attitude which might seem to align him with that found within the German enlightenment, for example, that found in Lessing and Kant. However, it seems undeniable that, in comparison to Kant, for example, Hegel employs forms of expression for the presentation of his own philosophical thought that are redolent with the type of imagistic and figurative locutions supposedly at home in religion. Moreover, the actual imagery employed seems to refer to the type of trinitarian version of Christianity that can seem antithetical to those forms of Christian thought that lent themselves to the sort of “demythologization” characteristic of the enlightenment attitude to religious doctrine. Such factors as these make it easy to portray Hegel’s philosophy as a type of irrationalist mysticism,2 or at least as a disguised theology with a content from revealed religion, and thus aligning him more to the spirit of the Counter-Enlightenment than the Enlightenment. Federal efforts beginning in the 1990's have successfully increased pediatric research to improve medical care for all children. Since 1997, the FDA has requested 800 pediatric studies involving 45,000 children. Much of this research is "non-beneficial"; that is, it exposes pediatric subjects to risk even though these children will not benefit from participating in the research. Non-beneficial pediatric research (NBPR) seems, by definition, contrary to the best interests of pediatric subjects, which is why one state supreme court has essentially prohibited (...) it. It also appears that the only plausible rationale for this research is utilitarian, as it risks some children for the good of all. But that rationale is troubling. This Article answers two related questions: (1) What is the appropriate legal relationship between NBPR and the "best interests of the child" standard? (2) What is the ethical justification for this research? I argue that courts should hold that the "best interests" standard governs pediatric research. But, contrary to existing case law, courts must consider the benefits to each child, including pediatric subjects, from a policy that permits NBPR, and not simply consider that a non-beneficial protocol presents more risk than potential benefit to a child. Moreover, I argue that the justification for the practice need not be utilitarian. There is no need to appeal to the greater good to justify the research because each child has reason to endorse a policy permitting NBPR where there is a very low ceiling on acceptable risk, and each child has reason to participate in a practice from which she benefits. More controversially, I argue that each child, like other persons, has reason to help others when she can do so at little to no cost to herself. However, young children also assert the existence of entities that they cannot ordinarily observe. For example, they assert the existence of germs and souls. The belief in the existence of such unobservable entities is likely to be based on children's broader trust in other people's testimony about objects and situations that they cannot directly observe (...) for themselves. Hobbes’s account of sovereign power can be seen as an impetus to Arendt’s passion for authentic political life. From the Human Condition, we will see how the distinction between labor, work, and action can be read as a response to Hobbes’s accounts of both human nature and the necessity for harsh restrictions on citizens in society. In particular, the need for compelled silence, for Hobbes, appears as a dialectical counterpoint to the role of speech in the space of appearances for (...) Arendt. Hobbes also has a hand in drawing Arendt to her final interest in Kant’s Critique of Judgment. Here, Arendt addresses the problem of imperialism in Hobbes’s account of global power. She sees a way beyond imperialism through the cosmopolitan bond we share around the aesthetic domain. Aesthetic cosmopolitanism is a unique way into Arendt’s fight against tyranny. (shrink)
