After outlining a common critique in selected texts by Paulo Freire and Benedict XVI, we turn beyond the individual thinkers and into the mystagogy of their common religious traditions, beginning with an extended description of the Jewish ritual of Passover, foundational to a description of the Catholic celebration of the Eucharist to follow, but also definitive in its own right. In describing these two rituals we find a fuller consideration of the constructive responses by Freire and Benedict to the (...) institutional objectification of the human person in the eros of the common meal. This is the mysterious freedom of eros that is a necessary condition for the possibility of true and lasting communion, essential for any liberating education and often missing in Marxist and other accounts of critical pedagogy that ignore its theological roots. Rather than reacting to these limits to the present, well-known literature, we carve out an alternate path. (shrink)

The aim is to contribute to a better understanding of Samuel Pufendorf’s road from his early Elementa jurisprudentiae universalis, published in late 1660 to the eight ‘books’ of De jure naturae et gentium from 1672. In the latter, Pufendorf completed a methodical shift from the more geometrico method to a universal jurisprudence based upon a wide range of humanistic arts, including history. In this connection, Pufendorf gave more credit to Hugo Grotius and his De jure belli ac pacis than (...) in the earlier work. The paper redefines the role that Pufendorf’s contacts with the Chief Minister from Mainz, Johann Christian von Boineburg and his closest collaborators, Hermann Conring and Johann Heinrich Boecler played in Pufendorf’s shift of approach to ‘universal jurisprudence’. Hitherto underexplored correspondence of Boineburg with Boecler permits a reconstruction of the polemic that Boineburg incited and fuelled between Pufendorf and Boecler. Pufendorf’s reflections of the events in the Preface of the first edition of De jure naturae et gentium and later Christian Thomasius’s account in Paulo plenior, historia juris naturalis made the intermezzo into an essential part of the foundation myth of modern natural law. The role or function of experimental and observational replication within empirical science has implications for how replication should be measured. Broadly, there seems to be consensus that replication’s central goal is to confirm or vouchsafe the reliability of scientific findings. I argue that if this consensus is correct, then most of the measures of replication used in the scientific literature are actually poor indicators of this reliability or confirmation. Only meta-analytic measures of replication align functionally with the goals of replication. (...) I conclude by addressing some objections to meta-analysis. (shrink)

Marxism has often been associated with two different legacies. The first rests on a strong exposition and critique of the logic of capitalism, grounded in a systematic analysis of the laws of motion of capitalism as a system. The second legacy refers to a strong historicist perspective grounded in a conception of social relations that emphasises the centrality of power and social conflict to the analysis of history. This article challenges the prominence of structural accounts of capitalism by showing how (...) the tension between these legacies has played out within Political Marxism, both orientations already having co-existed, somewhat uneasily, within Robert Brenner’s original contributions to the Transition Debate. Through this internal critique and re-formulation of Political Marxism, we wish to open a broader debate within Marxism on the need for a more agency-based account of capitalism, which builds more explicitly on the concept of social relations, to recover the historicist legacy of Marxism. As concern over the use of questionable research practices in academic science has increased over the last couple of decades, some reforms have been implemented and many others have been debated and recommended. While many of these proposals have merit, efforts to improve scientific practices are more likely to succeed when they are responsive to the prevailing views and concerns of scientists themselves. To date, there have been few efforts to solicit wide-ranging input from researchers on the topic of needed (...) reforms. This article is a qualitative report of responses from federally funded scientists to the question of what should be done to address the problem of QRPs in their disciplines. Overall, participants were concerned about how institutional and career-oriented incentives encourage the use of QRPs. Compared to previous recommendations, participants had surprisingly little confidence in the ability of ethics training to improve research integrity. (shrink)

Understanding inductive reasoning is a problem that has engaged mankind for thousands of years. This problem is relevant to a wide range of fields and is integral to the philosophy of science. It has been tackled by many great minds ranging from philosophers to scientists to mathematicians, and more recently computer scientists. In this article we argue the case for Solomonoff Induction, a formal inductive framework which combines algorithmic information theory with the Bayesian framework. Although it achieves excellent theoretical results (...) and is based on solid philosophical foundations, the requisite technical knowledge necessary for understanding this framework has caused it to remain largely unknown and unappreciated in the wider scientific community. The main contribution of this article is to convey Solomonoff induction and its related concepts in a generally accessible form with the aim of bridging this current technical gap. In the process we examine the major historical contributions that have led to the formulation of Solomonoff Induction as well as criticisms of Solomonoff and induction in general. In particular we examine how Solomonoff induction addresses many issues that have plagued other inductive systems, such as the black ravens paradox and the confirmation problem, and compare this approach with other recent approaches. The controversy over the equivalence of continuous sedation until death (CSD) and physician-assisted suicide/euthanasia (PAS/E) provides an opportunity to focus on a significant extended use of CSD. This extension, suggested by the equivalence of PAS/E and CSD, is designed to promote additional patient autonomy at the end-of-life. Samuel LiPuma, in his article, “Continuous Sedation Until Death as Physician-Assisted Suicide/Euthanasia: A Conceptual Analysis” claims equivalence between CSD and death; his paper is seminal in the equivalency debate. Critics contend that sedation (...) follows proportionality protocols for which LiPuma’s thesis does not adequately account. Furthermore, sedation may not eliminate consciousness, and as such LiPuma’s contention that CSD is equivalent to neocortical death is suspect. We not only defend the equivalence thesis, but also expand it to include additional moral considerations. First, we explain the equivalence thesis. This is followed by a defense of the thesis against five criticisms. The third section critiques the current use of CSD. Finally, we offer two proposals that, if adopted, would broaden the use of PAS/E and CSD and thereby expand options at the end-of-life. (shrink)

In this paper, I defend the view that only practical reasons are normative reasons for belief. This requires viewing beliefs as the predictable results of our actions. I will show how this fits with our intuitions about mental autonomy. The remainder of the paper consists in a defense against a series of objections that may be expected against this position. The paper concludes with a metaphilosophical explanation about our conflicting intuitions regarding the normativity of rationality.

For the last fifty years, the United States healthcare system has done an extremely poor job of delivering healthcare in a just and fair manner. The United States holds the dubious distinction of being the only industrialized nation in the world lacking provisions to ensure universal coverage. We attempt to provide some of the reasons this dysfunctional system has persisted and show that healthcare should not be a commodity. We begin with a brief historical overview of healthcare delivery in the (...) United States since WWII. This is followed by a critical analysis of the for-profit model including reasons to support the view that healthcare should not be a free market commodity. We also demonstrate how special interest groups have been able to win support for their practices based on propaganda rather than fact. A brief analysis of the Affordable Care Act is offered along with critical comments regarding its ineffectiveness. We conclude with a brief overview of international approaches that have resulted in universal coverage and suggest the United States ought to adopt an approach similar to those outlined so that it no longer stands as the only industrialized nation to ignore the glaring problems that exist. Taking a thematic approach to Butler as a political thinker, this text develops Butler's theory of the political through an exploration of her politics of troubling.

The concept of emergence is commonly invoked in modern physics but rarely defined. Building on recent influential work by Jeremy Butterfield, I provide precise definitions of emergence concepts as they pertain to properties represented in models, applying them to some basic examples from space-time and thermostatistical physics. The chief formal innovation I employ, similarity structure, consists in a structured set of similarity relations among those models under analysis—and their properties—and is a generalization of topological structure. Although motivated from physics, this (...) similarity-structure-based account of emergence applies to any science that represents its possibilia with models. (shrink)

In recent scholarship, the science and religion debate has been historicized, revealing the novelty of the concepts of science and religion and their complex connections to secularization and the birth of modernity. This article situates this historicist turn in the history of philosophy and its connections to theology and Scripture, showing that the science and religion concept derives from philosophy's earlier tension with theology as it became an academic discipline centered in the medieval, then research university, with the centrality of (...) Scripture changing under the influence of historical criticism. Looking at Thomas Aquinas and Friedrich Schleiermacher on theology and Scripture's connection to science, it offers a new framework for theorizing science and religion as part of the history of philosophy. The Voluntary Simplicity Movement can be understood broadly as a diverse social movement made up of people who are resisting high consumption lifestyles and who are seeking, in various ways, a lower consumption but higher quality of life alternative. The central argument of this paper is that the Voluntary Simplicity Movement or something like it will almost certainly need to expand, organise, radicalise and politicise, if anything resembling a degrowth society is to emerge in law through democratic processes. In a (...) sentence, that is the ‘grass-roots’ or ‘bottom up’ theory of legal and political transformation that will be expounded and defended in this paper. The essential reasoning here is that legal, political and economic structures will never reflect a post-growth ethics of macro-economic sufficiency until a post-consumerist ethics of micro-economic sufficiency is embraced and mainstreamed at the cultural level. Of all Plato’s dialogues, the Parmenides is notoriously the most difficult to interpret. Scholars of all periods have disagreed about its aims and subject matter. The interpretations have ranged from reading the dialogue as an introduction to the whole of Platonic metaphysics to seeing it as a collection of sophisticated tricks, or even as an elaborate joke. This work presents an illuminating new translation of the dialogue together with an extensive introduction and running commentary, giving a unified explanation of the (...) Parmenides and integrating it firmly within the context of Plato's metaphysics and methodology. Scolnicov shows that in the Parmenides Plato addresses the most serious challenge to his own philosophy: the monism of Parmenides and the Eleatics. In addition to providing a serious rebuttal to Parmenides, Plato here re-formulates his own theory of forms and participation, arguments that are central to the whole of Platonic thought, and provides these concepts with a rigorous logical and philosophical foundation. In Scolnicov's analysis, the Parmenides emerges as an extension of ideas from Plato's middle dialogues and as an opening to the later dialogues. Scolnicov’s analysis is crisp and lucid, offering a persuasive approach to a complicated dialogue. This translation follows the Greek closely, and the commentary affords the Greekless reader a clear understanding of how Scolnicov’s interpretation emerges from the text. This volume will provide a valuable introduction and framework for understanding a dialogue that continues to generate lively discussion today. (shrink)

This article presents an analysis of James Benning's film, BNSF (2013). It argues that the film comprises a landscape rendered in such a way that the temporal aspects of the processes, both cultural and natural, of which it is composed are brought forth. The article also asserts that, by relating a world that unfolds with a measure of contingency, the film not only manifests the inherent inadequacy of representation, but also it draws attention to the efficacy of the world in (...) the making of its moving image. Finally, the article demonstrates that the qualities of the world delimited by the film impel the viewer to attempt to envision facts of nature that greatly outsize the horizon of her human point of view. Using the taking of the knee by the England men's football team at Euro 2020, this paper looks at political reactions to anti-racist protest. The taking of a knee in other sporting contexts has been met by considerable opprobrium from right-wing politicians and been weaponised as part of a reactionary ‘culture war’ against calls for action to address systemic racial discrimination. This paper offers an analysis of Conservative politicians’ responses to the England players’ actions and to the subsequent negative reactions (...) of fans. After defining soft hate speech and conceptualising booing as a strategy of denial of racism, the analysis reveals three main discursive strategies: delegitimising the players’ protests by linking it to Black Lives Matter; agreeing with the goals of the protests but not the means; and calculated ambivalence towards those who booed. I then show how this allowing of soft hate speech was juxtaposed to a condemnation of hard hate speech. I conclude, firstly, that this relies on a thin understanding of racism as a discursive repertoire rather than as a system of power, and secondly, that the ambivalence towards the booing acted as a gateway for racism. This paper argues that God, despite his Perfection, can have faith in us. The paper includes exegesis of various Midrasihc texts, so as to understand the Rabbinic claim that God manifested faith in creating the world. After the exegesis, the paper goes on to provide philosophical motivation for thinking that the Rabbinic claim is consistent with Perfect Being Theology, and consistent with a proper analysis of the nature of faith. Finally, the paper attempts to tie the virtue that faith can (...) exhibit to the virtues associated with art, as it is understood by R. G. Collingwood. This association is particularly apt, given the Midrashic description of God as an artist. All of this is offered in response to Rabbi Moses Nachmanides who argued that Abraham’s faith, in Genesis 15:6, wasn’t worthy of particular praise. (shrink)

Much of the understanding of the nature of science in contemporary psychology is founded on a positivistic philosophy of science that cannot adequately account for meaning as experienced. The phenomenological tradition provides an alternative approach to science that is attentive to the inherent meaningfulness of human action in the world. Emmanuel Levinas argues, however, that phenomenology, at least as traditionally conceived, does not provide sufficient grounds for meaning. Levinas argues that meaning is grounded in the ethical encounter with the Other (...) such that meaning arises in rupture. For Levinas, the physical world and the I provide constraints on the meaning given by the Other, even as the Other is logically prior to all other experience. This Levinasian perspective advocates an epistemology that is open to the rupture of the Other as a way to knowledge. This emphasis on openness to rupture entails a methodology in which psychologists must allow the objects of study to guide their methods of research. Finally, the Levinasian perspective implies a scientific community that is sensitive to the rupture occasioned by the encounter with the Other. 2012 APA, all rights reserved). (shrink)

We routinely observe others’ choices and use them to guide our own. Whose choices influence us more, and why? Prior work has focused on the effect of perceived similarity between two individuals, such as the degree of overlap in past choices or explicitly recognizable group affiliations. In the real world, however, any dyadic relationship is part of a more complex social structure involving multiple social groups that are not directly observable. Here we suggest that human learners go beyond dyadic similarities (...) in choice behaviors or explicit group memberships; they infer the structure of social influence by grouping individuals based on choices, and they use these groups to decide whose choices to follow. We propose a computational model that formalizes this idea, and we test the model predictions in a series of behavioral experiments. In Experiment 1, we reproduce a well-established finding that people's choices are more likely to be influenced by someone whose past choices are more similar to their own past choices, as predicted by our model as well as dyadic similarity models. In Experiments 2–5, we test a set of unique predictions of our model by looking at cases where the degree of choice overlap between individuals is equated, but their choices indicate a latent group structure. We then apply our model to prior empirical results on infants’ understanding of others’ preferences, presenting an alternative account of developmental changes. Finally, we discuss how our model relates to classical findings in the social influence literature and the theoretical implications of our model. Taken together, our findings demonstrate that structure learning is a powerful framework for explaining the influence of social information on decision making in a variety of contexts. (shrink)

An investigation of public support for coastal adaptation options and public finance options in Florida evaluated stakeholder judgments and how they changed through a participatory engagement process. The study found that public finance mechanisms that imposed fiscal burdens on those who directly benefit from hazard reduction were rated as more acceptable than others. Significantly, visualisations and data on local economic damage and return on investment of potential adaptation options further increased acceptability ratings. The question of whether a development fee for (...) adaptation or any other public purpose supported by private funds is a legal issue that depends on a test called the rational nexus. One concern of this article is to explore options for such fees to cover adaptation to climate change. This raises issues about the potential conflict with the community-wide and intergenerational nature of long-term adaptation. We also explore the relevance of environmental attitudes using the ‘new environmental paradigm’ (NEP) scale and political party affiliation. Results have implications for infrastructure improvements that require public approval for financing. (shrink)

Hume recourt régulièrement à la métaphore selon laquelle nous projetons des valeurs sur le monde du fait des émotions que nous éprouvons. Cette métaphore projectiviste semble impliquer la non-existence des valeurs, et l’impossibilité d’une connaissance morale. Dans cet article, j’essaie de montrer que ces implications sont loin d’être évidentes, et qu’une lecture réaliste de Hume est également possible, qui permet notamment de rendre compte du rapport complexe que Hume entretient avec le rationalisme moral en particulier, et avec la connaissance des (...) valeurs de façon plus générale. Covid‐19 confronts us with tragic choices, in which every option is unacceptable. On the New York State Task Force on Life and the Law, I worked on guidelines for such situations. We did not envision the scale or character of Covid‐19. To minimize fear that the decisions made in these situations might be unfair, we all must know what guidelines or mandates inform them. Only with transparency about how decisions will be made, by whom, and according to what requirements can (...) we have confidence that fairness prevails. We now face many related questions about process, goals, leadership, and trust. For example, how might ethical guidelines evolve as scientific understanding advances? Should guidelines vary with different venues? And if, as I have argued, judgment is necessary even with the best of guidelines, how can we prepare clinicians to make good judgments? Are there implications for better training of personnel in nonemergency times for what they might face in the worst of times? (shrink)

What is cruelty? How and why does it matter? What do the legal rejection of cruelty and the requirements of mercy entail? This essay asks these questions of Lucius Seneca, who first articulated an agent-based conception of cruelty in the context of punishment. The hypothesis is submitted that the answers to these questions offered in Seneca's De clementia constitute one of the turning points in the evolution of practical reason in law. I conclude, however, by arguing that even the mainstream (...) punitive practices of contemporary western societies fail to meet the modest imperatives of the rejection of cruelty and the unconditionality of mercy propounded by Seneca. Much has been written as of late on the status of the physical Church- Turing thesis and the relation between physics and computer science in general. The following discussion will focus on one such article [5]. The purpose of these notes is not so much to argue for a particular thesis as it is to solicit a dialog that will help clarify our own thoughts.
