Thaler and Sunstein justify nudge policies from welfaristic premises: nudges are acceptable because they benefit the individuals who are nudged. A tacit assumption behind this strategy is that we can identify the true preferences of decision-makers. We argue that this assumption is often unwarranted, and that as a consequence nudge policies must be justified in a different way. A possible strategy is to abandon welfarism and endorse genuine paternalism. Another one is to argue that the biases of decision that choice (...) architects attempt to eliminate create externalities. For example, in the case of intertemporal discounting, the costs of preference reversals are not always paid by the discounters, because they are transferred onto other individuals. But if this is the case, then nudges are best justified from a political rather than welfaristic standpoint. (shrink)

Ontologies represent the standard way to model the knowledge about specific domains. This holds also for the legal domain where several ontologies have been put forward to model specific kinds of legal knowledge. Both for standard users and for law scholars, it is often difficult to have an overall view on the existing alternatives, their main features and their interlinking with the other ontologies. To answer this need, in this paper, we address an analysis of the state-of-the-art in legal ontologies (...) and we characterise them along with some distinctive features. This paper aims to guide generic users and law experts in selecting the legal ontology that better fits their needs and in understanding its specificity so that proper extensions to the selected model could be investigated. Driving behaviours and fitness to drive have been assessed using different tools over time: standardized neuropsychological, on-road and driving simulation testing. Nowadays, the great variability of topics related to driving simulation has elicited a high number of reviews. The present work aims to perform a scientometric analysis on driving simulation reviews and to propose a selective review of reviews focusing on critical issues related to validity and fidelity. A scientometric analysis of driving simulation reviews published from 1988 to 2019 was (...) conducted. Bibliographic data from 298 reviews were extracted from Scopus and WoS. Performance analysis was conducted to investigate most prolific Countries, Journals, Institutes and Authors. A cluster analysis on authors’ keywords was performed to identify relevant associations between different research topics. Based on reviews extracted from cluster analysis, a selective review of reviews was conducted to answer questions regarding validity, fidelity and critical issues. USA and Germany are the first two Countries for number of driving simulation reviews. USA is the leading Country with 5 Institutes in the top-ten. Top Authors wrote from 3 to 7 reviews each and belong to Institutes located in North America and Europe. Cluster analysis identified three clusters and eight keywords. The selective review of reviews showed a substantial agreement for supporting validity of driving simulation with respect to neuropsychological and on-road testing, while for fidelity with respect to real-world driving experience a blurred representation emerged. The most relevant critical issues were the a) lack of a common set of standards, b) phenomenon of simulation sickness, c) need for psychometric properties, lack of studies investigating d) predictive validity with respect to collision rates and e) ecological validity. Driving simulation represent a cross-cutting topic in scientific literature on driving, and there are several evidences for considering it as a valid alternative to neuropsychological and on-road testing. Further research efforts could be aimed at establishing a consensus statement for protocols assessing fitness to drive, in order to a) use standardized systems, b) compare systematically driving simulators with regard to their validity and fidelity, and c) employ shared criteria for conducting studies in a given sub-topic. In this article we explore how multinational corporations (MNCs) adopt assurance practices to develop and sustain organizational accountability for sustainability. Using a panel of Fortune Global 250 firms over a period of 10 years, we document the diffusion patterns of third-party assurance of sustainability reports. We specifically investigate how evolving auditing practices, namely diversity of assurance standards and type of assurance providers, shape the quality of sustainability assurance statements. The results illustrate great variability in the adoption of assurance practices in (...) the formative stages of this novel market. Our descriptive analysis indicates the relevance of external institutional pressure as well as internal resources and capabilities as underlying factors driving the adoption of assurance. Our evidence also suggests that several MNCs project a decoupled or symbolic image of accountability through assurance, thereby undermining the credibility of these verification practices. The paper contributes to the emerging literature on international accountability standards and emphasizes the need to enhance theory-based, cross-disciplinary knowledge related to auditing and accountability processes for sustainability. Foucault and Derrida react in two different ways to the new paradigm imposed by structuralism. Foucault uses structuralism to overcome phenomenology, in fact structuralism shows the naivety of phenomenology, in its claim to rely on conscience to constitute meaning. Instead, Derrida on the contrary immediately nurtures a certain distrust of structuralism, especially in its philosophical ambitions and uses the resources of phenomenology to criticize it, showing the metaphysical implications operating in it. We want to show how this opposing position is (...) generated by the specific way in which the two philosophers have responded to the open problems and bequeathed by Husserlian phenomenology. In particular, the theme of “passive genesis,” which was raised in the French debate by Tran-Duc-Thao and Merleau-Ponty, is central. In the first writings it emerges how Foucault has received Merleau-Ponty’s theses and it is precisely to overcome them that he inaugurates an archaeological analysis to try to distance himself from the normalizing anthropological discourse present in the passive synthesis. Derrida reads passive genesis in a radically different way from Merleau-Ponty (and therefore Foucault): the radical nature of Husserl’s phenomenology has opened a space to question the transcendental genesis of philosophical discourse and its possibility of transcending its historical, social and psychological genesis and therefore the sciences that preside over these dimensions. Consequently, showing the naivety of structuralism, Derrida’s research of the sixties is configured as post-structuralist. (shrink)

The Diagnostic and Statistical Manual of Mental Disorders (DSM) is universally acknowledged as the prominent reference textbook for the diagnosis and assessment of psychiatric diseases. However, since the publication of its first version in 1952, controversies have been raised concerning its reliability and validity and the need for other novel clinical tools has emerged. Neurophysiological studies in monkeys and neuroimaging studies in humans support a model of empathy according to which there exists a shared code between perception and production of emotion. The neural circuitry critical to this mechanism is composed of frontal and parietal areas matching the observation and execution of action, and interacting heavily with the superior temporal cortex. Further, this cortical system is linked to the limbic system by means of an anterior sector of the human insular lobe.

Il concetto di "libertà" descrive uno dei valori fondamentali della società occidentale contemporanea. Tuttavia, sebbene tutti concordino circa la necessità di difendere la libertà, persone che incarnano convinzioni politiche, morali e sociali diverse interpretano la libertà in maniere differenti, se non perfino contrapposte. Nonostante queste evidenti divergenze, è opinione diffusa che questo concetto si caratterizzi alla sua base per una sorta di denominatore comune, a proposito del quale sussiste un’unanimità pervasiva e che delinea l’orizzonte di una comune battaglia. Questo studio (...) investiga questa opinione da un punto di vista cognitivo allo scopo di determinare come sia costituito e di quale informazione si componga il concetto astratto di “libertà”. La ricerca – che si rifà in parte alla teoria di G. Lakoff – identifica un nucleo cognitivo comune concreto del concetto e chiarisce come questo si contamini ideologicamente nel corso del suo sviluppo da concetto concreto a concetto astratto. Le conclusioni di questo studio evidenziano tuttavia come il nucleo universale del concetto sia eccessivamente indeterminato per costituire un denominatore comune politicamente rilevante che fornisca una base di accordo a proposito di un valore condiviso ed evidenzia alcuni limiti dell'impostazione data da Lakoff al problema, avanzando delle ipotesi per futuri sviluppi della ricerca su questi temi. In this paper we investigate ignorance in relation to our capacity to justify our beliefs. To achieve this aim we specifically address scientific misconceptions, i.e. beliefs that are considered to be false in light of accepted scientific knowledge. The hypothesis we put forward is that misconceptions are not isolated false beliefs, but rather form part of a system of inferences—an explanation—which does not match current scientific theory. We further argue that, because misconceptions are embedded in a system, they cannot be (...) rectified simply by replacing false beliefs with true ones. To address our misconceptions, we must rather act on the system of beliefs that supports them. In the first step of our analysis, we distinguish between misconceptions that are easy to dispel because they represent simple errors that occur against the background of a correct explanatory apparatus and misconceptions that are, on the contrary, very difficult to dispel because they are the product of pseudo explanations. We show that, in the latter case, misconceptions constitute an integral part of an incorrect explanation and the reasons that support such misconceptions are deeply misleading. In the second step, we discuss various approaches that have been adopted to address the problem of misconceptions. Challenging the notion that directly addressing and criticizing specific misconceptions is an effective approach, we propose that critical thinking is the most fruitful means to deal with misconceptions. We define the core competences and knowledge relevant for the practice of critical thinking and discuss how they help us avoid misconceptions that arise from accepting beliefs that form part of a mistaken explanation.
