This essay critically assesses Anna Stilz's argument in Territorial Sovereignty: A Philosophical Exploration that legitimate states have a right to do wrong. I concede that individuals enjoy a claim against external interference when they commit suberogatory acts, but I deny that the right to do wrong extends to acts that would violate the rights of others. If this is correct, then one must do more than merely invoke an individual's right to do wrong if one hopes to vindicate a legitimate (...) state's right to commit injustices. Of course, there may be distinctive features of legitimate states that explain why they enjoy moral protections that individuals lack, but I argue that the value of collective self-determination is not up to this task. And even if these arguments fail, self-determination would at most explain why legitimate states enjoy a right to commit injustices against their own citizens; it would provide them no moral protection when they violate the rights of outsiders. Im Anschluss an experimentalpsychologische Studien zur subliminalen Wahrnehmung, zu Volition und Handlungskontrolle erfahren kompatibilistische Theorien menschlicher Freiheit innerhalb der theoretischen Philosophie neue Popularität. Eine Handlung ist demnach frei, wenn sie das Resultat bestimmter Fähigkeiten einer Person (...) ist („Kompetenztheorie“). Von den unmittelbar Beteiligten ist diese Pathologisierung als eine solche jedoch kaum wahrgenommen worden. Daher stellt sich die Frage, wie es zur sozialen Akzeptanz einer derart drastischen Wahrnehmungsverschiebung kommen konnte. Da Begriffe unsere Wahrnehmung strukturieren, interessiert uns vor allem die konzeptionelle (...) Dimension dieser geburtsmedizinischen Verkehrung des Normalen ins Krankhafte, die in einer Reflexion auf die zwei Quellen legitimen ärztlichen Handelns erkennbar wird. Sowohl der Krankheitsbegriff als auch das moderne Verständnis von Selbstbestimmung weisen eine interne Unschärfe auf, die pathologisierende Tendenzen begünstigt. Der moderne Krankheitsbegriff erschwert eine klare Abgrenzung zwischen krank und gesund. Und Autonomie ist ein mehrdeutiges Konzept, das in einer spezifischen Auslegung die Pathologisierung fördert. Da beide Konzepte ärztliches Handeln rechtfertigen, bleibt ihr delegitimierendes Potential in der Praxis unscheinbar. Erst reflexiv und polylogisch lässt sich dieser blinde Fleck beobachten, so dass eine Korrektur der Pathologisierung möglich wird. (shrink)

Diesem wird aus Sicht einer "Bürgerrechtsperspektive" entgegengehalten, es gelte nicht, die Menschen zu korrigieren, sondern die Umwelt so zu verändern, dass Betroffene ungehindert am gesellschaftlichen Leben teilhaben können. Nach Auffassung der "Normalisierungskritik" sind es Stereotypen und Stigmata, die es Behinderten erschweren, ein selbstbestimmtes Leben zu führen. Beide Ansätze ignorieren oder bagatellisieren jedoch aus systematischen Gründen die (...) Art und Weise, in der Betroffene ihre physische oder psychische Schädigung subjektiv erfahren. Deshalb kann auch nicht auf die erheblichen Unterschiede reflektiert werden, die zwischen verschiedenen Formen der Behinderung bestehen. Es ist jedoch verfehlt, die Feststellung, dass Behinderte häufig in spezifischer Art bedürftig sind, mit paternalistischer Herablassung gleichzusetzen. Gerade für ein zuträgliches Verhältnis von Medizinern und Behinderten ist es wichtig, exakt jene Differenzen zu berücksichtigen, die zwischen akuten Krankheiten und verschiedenen Formen chronischer Beeinträchtigung bestehen. In four new and nine previously published essays, Joseph Heath provides a compelling new framework for thinking about the moral obligations of economic actors. The "market failures" approach to business ethics that he develops provides the basis for a unified theory of business ethics, corporate law, economic regulation, and the welfare state.

This essay disambiguates the relationship between phenomenology and explanation, whereby we uncover a fundamentally new way to understand the function of phenomenology within the sciences. These objectives are accomplished in two stages. First, we propose an original way to interpret Husserl's claim that his phenomenology is non-explanatory. We demonstrate, contra accepted interpretations, that Husserl did not think phenomenology is non-explanatory, because it is descriptive or because it does not deal with causes. Instead, we demonstrate that Husserl concluded that phenomenology is (...) non-explanatory, because it engages in a dialectical process of conceptual clarification. To substantiate this interpretation, we examine how Husserl understood the function of explanation in three different tiers of standard science and how he grasped the role of phenomenology in pure logic. Having properly clarified Husserl's conclusion—that phenomenology is non-explanatory—we then execute our second task, namely to challenge just that idea. We argue that Husserl has—despite his claims to the contrary—de facto and inadvertently described his phenomenology as an explanatory nomological science. Our paper therefore not only clears up a longstanding misinterpretation of Husserl, but opens a new area of debate concerning the status of phenomenology within the scientific nexus. (shrink)

Medical ethics has become an important and recognized component of physician training. There is one area, however, in which medical students receive little guidance. There is practically no discussion of the financial aspects of medical practice. My objective in this paper is to initiate a discussion about the moral dimension of physician billing practices. I argue that physicians should expand their conception of professional responsibility in order to recognize that their moral obligations toward patients include a commitment to honest and (...) forthright billing practices. I argue that physicians should aspire to a standard of clinical accuracy—not legal adequacy—in describing their activities. More generally, physicians should strive to promote an integrity-based professional culture, first and foremost by stigmatizing rather than celebrating creative billing practices, as well as condemning the misguided sense of solidarity that currently makes it taboo for physicians to criticize each other on this score. In this book Joseph Heath brings Jürgen Habermas's theory of communicative action into dialogue with the most sophisticated articulation of the instrumental conception of practical rationality-modern rational choice theory. Heath begins with an overview of Habermas's action theory and his critique of decision and game theory. He then offers an alternative to Habermas's use of speech act theory to explain social order and outlines a multidimensional theory of rational action that includes norm-governed action as a specific type.In the (...) second part of the book Heath discusses the more philosophical dimension of Habermas's conception of practical rationality. He criticizes Habermas's attempt to introduce a universalization principle governing moral discourse, as well as his criteria for distinguishing between moral and ethical problems. Heath offers an alternative account of the level of convergence exhibited by moral argumentation, drawing on game-theoretic models to specify the burden of proof that the theory of communicative action and discourse must assume. This paper shows that Husserl is not guilty of Sellars’ myth of the sensory given. I firstly show that Husserl’s account of ‘sensations’ or ‘sense data’ seems to possess some of the attributes Sellars’ myth critiques. In response I show that, just as Sellars thinks that our ‘conceptual capacities’ afford us an awareness of a logical perceptual space that has a propositional structure, Husserl thinks that ‘acts of apprehension’ structure sensations to afford us perception that is similarly propositionally structured. Not (...) only this, but there is much affinity and shared motivation between Husserl and Sellars accounts of the sensory stratum. Reflection on phenomenological considerations prevents Sellars from denying phenomenal non-conceptual content, whilst Husserlian ‘sense data’ are technical designations; dependant parts of perceptual experience grasped in abstraction, necessary for providing a reflective/philosophical account of empirical knowledge. I show that both Husserl and Sellars assert that the proper description of phenomenal content affords it the function of presenting properties of spatial objects during perception, and reiterate the well-known fact that Husserl thinks that perception is of ‘conceptually’ apprehended spatiotemporal objects. Among anthropologists and sociologists, it is widely believed that moral rules are best understood as a type of social norm. Moral philosophers, however, have largely been hostile to this suggestion. In recent years, the impulse to distinguish moral rules from others types of social norm has received what many take to be empirical support from the work of Elliot Turiel and his collaborators, who have argued that there are two distinct “domains” of social cognition, the “moral” and the “conventional.” Many (...) philosophers have taken this as proof that moral rules are fundamentally different from “conventional” social norms. I argue that moral philosophers should not be relying upon Turiel’s view to defend the moral/conventional distinction. First, I show that Turiel is claiming much less than many have taken him to be claiming, because he puts a lot of what philosophers have traditionally thought of as “morality” on the side of convention, or else in the broad region between the two that he refers to as “multidimensional contexts.” Second, I argue that his concept of the “conventional” is so narrow that the overwhelming majority of social norms – such as the standard rules of etiquette – wind up falling into the “multidimensional” category. This stems from his failure to distinguish between genuine conventions and what I refer to as “norms with conventional elements.”. (shrink)

This book, published in 2000, is a clear account of causation based firmly in contemporary science. Dowe discusses in a systematic way, a positive account of causation: the conserved quantities account of causal processes which he has been developing over the last ten years. The book describes causal processes and interactions in terms of conserved quantities: a causal process is the worldline of an object which possesses a conserved quantity, and a causal interaction involves the exchange of conserved quantities. Further, (...) things that are properly called cause and effect are appropriately connected by a set of causal processes and interactions. The distinction between cause and effect is explained in terms of a version of the fork theory: the direction of a certain kind of ordered pattern of events in the world. This particular version has the virtue that it allows for the possibility of backwards causation, and therefore time travel. (shrink)

This paper examines and analyzes five definitions of ‘existential risk.’ It tentatively adopts a pluralistic approach according to which the definition that scholars employ should depend upon the particular context of use. More specifically, the notion that existential risks are ‘risks of human extinction or civilizational collapse’ is best when communicating with the public, whereas equating existential risks with a ‘significant loss of expected value’ may be the most effective definition for establishing existential risk studies as a legitimate field of (...) scientific and philosophical inquiry. In making these arguments, the present paper hopes to provide a modicum of clarity to foundational issues relating to the central concept of arguably the most important discussion of our times. There is, no doubt, a temptation to treat preventions, such as ‘the father’s grabbing the child prevented the accident’, and cases of ‘causation’ by omission, such as ‘the father’s inattention was the cause of the child’s accident’, as cases of genuine causation. I think they are not, and in this paper I defend a theory of what they are. More specifically, the counterfactual theory defended here is that a claim about prevention or ‘causation’ by omission should be understood not as (...) being directly about actual genuine causation but primarily as a counterfactual claim about genuine causation.1 The relation between actual causation and the mere possibility of causation allows my theory to explain both the difference and the similarity between the two notions (causation and prevention/omission). Further, the difference explains certain intuitions we have and the similarity justifies and explains the fact that for practical purposes we usually treat preventions and omissions as if they were genuine causation. Finally, the fact that this counterfactual theory of prevention and omission takes causation as primitive suggests that it is consistent with any theory of causation. This allows us to construct two arguments against what I will call genuinism, the view that cases of prevention and ‘causation’ by omission really are cases of genuine causation. In section II I show that genuinism does not account for the so-called intuition of difference. In section III I outline a number of problems that various theories of causation have with preventions and ‘causation’ by omission. These problems are ipso facto problems for genuinism, whereas I show in section V how the counterfactual theory solves those problems. Further, I answer a genuinist argument based on another type of intuition—the genuinist intuition—by showing why we have that intuition and how it should be handled (section VI). (shrink)

A notable feature of recent philosophical work on climate ethics is that it makes practically no reference to ‘traditional’ environmental philosophy. There is some irony in this, since environmental ethics arose as part of a broader movement within philosophy, starting in the 1960s, aimed at developing different fields of applied philosophy, in order to show how everyday practice could be enriched through philosophical reflection and analysis. The major goal of this paper is to explain why this branch of practical ethics (...) has, for the most part, failed the test of practicability when it comes to formulating a response to global climate change. The central problem is that debates in environmental philosophy became absorbed by a set of metaphysical questions about the nature of value. The result has been a field dominated by views that provide unsuitable foundations for the development of public policy. (shrink)

Abstract“Scaling-up” is the next hurdle facing the local food movement. In order to effect broader systemic impacts, local food systems (LFS) will have to grow, and engage either more or larger consumers and producers. Encouraging the involvement of mid-sized farms looks to be an elegant solution, by broadening the accessibility of local food while providing alternative revenue streams for troubled family farms. Logistical, structural and regulatory barriers to increased scale in LFS are well known. Less is understood about the way (...) in which scale developments affect the perception and legitimacy of LFS. This value-added opportunity begs the question: Is the value that adheres to local food scalable? Many familiar with local food discourse might suggest that important pieces of added value within LFS are generated by the reconnection of producer and consumer, the direct exchange through which this occurs, and the shared goals and values that provide the basis for reconnection. However, these assertions are based on tenuous assumptions about how interactions within the direct exchange produce value, and how LFS are governed. Examination shows that existing assumptions do not properly acknowledge the hybridity, diversity, and flexibility inherent in LFS. A clear analysis of the potential of scale in LFS will depend on understanding both how value is determined within LFS, and the processes through which these systems are governed. Such an analysis shows that, while scaled-up LFS will be challenged to maintain legitimacy and an identity as “alternative”, the establishment of an open governance process—based on a “negotiation of accommodations”—is likely to enhance their viability. This paper raises a challenge for those who assume that corporate social responsibility and good corporate governance naturally go hand-in-hand. The recent spate of corporate scandals in the United States and elsewhere has dramatized, once again, the severity of the agency problems that may arise between managers and shareholders. These scandals remind us that even if we adopt an extremely narrow concept of managerial responsibility – such that we recognize no social responsibility beyond the obligation to maximize shareholder value – (...) there may still be very serious difficulties associated with the effective institutionalization of this obligation. It also suggests that if we broaden managerial responsibility, in order to include extensive responsibilities to various other stakeholder groups, we may seriously exacerbate these agency problems, making it even more difficult to impose effective discipline upon managers. Hence, our central question: is a strong commitment to corporate social responsibility institutionally feasible? In searching for an answer, we revisit the history of public management, and in particular, the experience of social-democratic governments during the 1960s and 1970s, and their attempts to impose social responsibility upon the managers of nationalized industries. The results of this inquiry are less than encouraging for proponents of corporate social responsibility. In fact, the history of public-sector management presents a number of stark warnings, which we would do well to heed if we wish to reconcile robust social responsibility with effective corporate governance. This paper makes a phenomenological contribution to the distinction between personal and subpersonal types of explanation. I expound the little-known fact that Husserl gives an account of personal level explanation via his exposition of our capacity to express the understanding of another’s motivational nexus when we are in the personalistic attitude. I show that Husserl’s unique exposition of the motivational nexus conveys its concrete, internally coherent, and intentional nature, involving relationships amongst the sense contents of acts of consciousness. Moreover, the (...) motivational nexus is a generative space of possibility and choice. I show that, for these reasons, motivational explanation is not causal, nor deductive nomological, nor does it reduce to subpersonal explanation. I finish with the comment that the uniqueness of personal level explanation points towards the possibility that the human sciences ought also employ types of explanations not found in natural sciences. David Gauthier tries to defend morality by showing that rational agents would choose to adopt a fundamental choice disposition that permits them to cooperate in prisoner's dilemmas. In this paper, I argue that Gauthier, rather than trying to work out a prudential justification for his favored choice disposition, should opt for a transcendental justification. I argue that the disposition in question is the product of socialization, not rational choice. However, only agents who are socialized in such a way that they (...) acquire a disposition of this type could acquire the capacity to use language. Given the internal connection between language and thought, this means that no agent endowed with such a disposition could rationally choose to adopt another. Thus rational reflection by moral agents upon their own fundamental choice disposition will have no tendency to destabilize it. (shrink)

Stasis-theory seeks to classify rhetorical problems acccording to the underlying structure of the dispute that each involves. Such a classification is of interest to the practising rhetor, since it may help him identify an appropriate argumentative strategy; for example, patterns of argument appropriate to a question of fact may be irrelevant in an evaluative dispute.

This article examines the tensions in the identities of men who belong to the Promise Keepers movement by uncovering the social conditions that lead men to rethink gender and racial ideologies. Using participant observation and in-depth interviews, the author draws on gender and social movement scholarship to reveal how contradictory gender and racial ideologies shape PKs' identities. Furthermore, the PKs' impact on gender and race relations is also contradictory. PK fosters men's growth on an interactional level, allowing men to embrace (...) a more expressive and caring masculinity that includes cross-racial bonding. Simultaneously, however, PK ignores, and indirectly reinforces, the structural conditions that underpin gender and racial privilege among white men. (shrink)

Thorstein Veblen is perhaps best thought of as America’s answer to Karl Marx. This is sometimes obscured by the rather unfortunate title of his most important work, The Theory of the Leisure Class (1899), which misleading, insofar as it suggests that the book is just a theory of the “leisure class.” What the book provides is in fact a perfectly general theory of class, not to mention property, economic development, and social evolution. It is, in other words, a system of (...) theory that rivals Marx’s historical materialism with respect to scope, generality and explanatory power. Furthermore, it is a system of theory whose central predictions, with respect to the development of capitalism and the possibilities for emancipatory social change, have proven to be essentially correct. When stacked up against Marx’s prognostications, this success clearly provides the basis for what might best be described as an invidious comparison. (shrink)

It is not clear whether the social contract is supposed to merely supplement the unequal gains that individuals are able to make through the exercise of their natural endowments with a set of equal gains secured through social cooperation, or whether the social contract must also compensate individuals for the effects of these natural inequalities, so that they literally become all equal. The issue concerns, in effect, whether natural inequality falls within the scope of egalitarian justice. I think it is (...) fair to say that the majority of egalitarians assume that the principle of equality imposes an obligation to redress natural inequality. Yet there is no consensus on this issue. David Gauthier has made the rejection of the principle of redress a central component of his project. It has often escaped notice that John Rawls also rejects the principle of redress. Thus it is not just anti-egalitarians who reject the principle of redress. There is a current of egalitarian thought – which we might call, for lack of a better term, narrow-scope.. (shrink)

It argues instead for a distinction between “miswanting” and “competitive consumption” as rival explanations for the failure of economic growth to increase average levels of subjectively reported happiness in developed nations. It ends with a caution against over-reliance upon happiness research as an argument for environmentally-motivated constraints on growth.
